Advantages: The main advantage of the Golden Rule is that it avoids absurd and unjust results that may be produced by applying the literal rule. If used in[Fisher v Bell]- D would have been guilty as Parliament clearly intended to prevent the purchasing of flick knives. Disadvantages: no clear definition of what amounts to an absurd result. Unpredictable. If used in [LNER v Berriman] a different set of judges may have chosen to avoid the unjust result. The judiciary are not elected and they should not have this power to decide when and how to use it.Michael Zander called it a feeble parachute.
