    BETWEEN

    THE GOVERNMENT OF THE UNITED STATES OF AMERICA

    AND

    THE GOVERNMENT OF GEORGIA

    ON CO-OPERATION IN THE FIELD OF

    LAW ENFORCEMENT

    The Government of the United States of America (USG) and the Government of Georgia (hereinafter referred to as "the Parties):

    Recognizing the importance of technical assistance in the establishment and support of projects designed to strengthen the rule of law by means of training, technology and mutual cooperation, in particular in the areas of anti-corruption, border security, anti-money laundering and the institution of a modern forensic laboratory;

    Recognizing the need to assist the Government of Georgia in developing its capability to deter transnational crime and internal corruption that will improve regional stability and enhance the rule of law;

    Acting on the basis of their national laws, international commitments and principles of international law,

    Taking into account principles and provisions of the "Agreement between the Government of the United States of America and the Government of the Republic of Georgia regarding Cooperation to Facilitate Humanitarian and Technical Economic Assistance", signed in 1992,

    Have agreed as follows:

    PART I. PROJECT DESCRIPTION AND GOALS

    ARTICLE 1. TECHNICAL ASSISTANCE PROJECTS

    Pursuant to the provisions of the present Agreement, Parties agree to facilitate the implementation of the:

    - Anti-Corruption Project - Anti-Money Laundering Project

    Forensic Institute Development Project Border Control Project.

    ARTICLE 2. THE ANTI-CORRUPTION PROJECT

    1. Actions to be taken in the Project include provision of US legal advisors and academics to assist Georgia, in both its public and private sector, to effectively combat corruption and foster civic development.

    2. The Specific goal of this Project is to improve the ability of the Georgian Government to combat corruption and thereby strengthen public confidence in the effectiveness and integrity of the Government.

    3. The planned duration of this specific project is one year, after which assessments will be made to determine if future years are necessary.

    ARTICLE 3. THE ANTI-MONEY LAUNDERING PROJECT

    1. Actions to be taken in this Project include the provision of advisory assistance aimed at researching the nature of financial crime and money laundering in Georgia in order to assist it in developing institutions capable of monitoring and controlling financial transactions.

    2. The Specific goal of this project is to prevent capital flight and to ensure economic stability necessary for a growing democracy.

    3. The Planned duration of this specific project is one year, after which assessments will be made to determine if future years are necessary.

    ARTICLE 4. THE FORENSIC INSTITUTE DEVELOPMENT PROJECT

    1. Actions to be taken in this Project include the provision of technical training and assistance designed to support phase one of a long-term project, which aims to establish on the base of the Expertise and Special Examination Centre of the Ministry of Justice of Georgia a multi-agency forensic laboratory under the auspices of the Ministry of Justice.

    2. Phase one includes assistance in developing management structures, procedures, jurisdictional parameters and regulations.

    3. The specific goal of this project is to improve the country's system of justice by increasing the use of scientifically valid forensic evidence in the judicial fact finding process in part as a supplement to reliance on confessions and admissions, and thereby to strengthen the rule of law in Georgia.

    4. The planned life of this specific module of the project is one year, after which assessments will be made to determine if future years are necessary.

    ARTICLE 5. THE BORDER SECURITY PROJECT

    1. Actions to be taken in this Project include the provision of specialized training that compliments the on-going US-Georgian Border Security Programs.

    2. The specific goal of this project is to safeguard the security of Georgia's borders and to enhance the ability of the Government to collect customs and tax revenue.

    3. The Planned duration of this specific project is one year, after which assessments will be made to determine if future years are necessary.

    ARTICLE 6. PROJECT ACHIEVEMENT VERIFICATION

    1. Progress towards achievement of goals of the Projects foreseen by Articles 2, 3, 4 and 5 of the present Agreement will be measured in terms of demonstrated improvements in the overall law enforcement sector.

    2. Methods of verification of project achievements will include the observation by personnel of the Parties and by an increase in the number of arrests and prosecutions of people engaging in public corruption, an increase in the detection of illegal border crossings, enhanced tax and customs revenue collection, drafting of anti-money laundering legislation aimed at preventing capital flight outside the country, and increasing admission of forensic evidence in trials conducted in the courts of Georgia.

    3. The providing of United States Government grant funding beyond the current fiscal year is conditioned upon satisfactory progress toward project goals and the availability of funds authorised and appropriated on a year-to-year basis by the U.S. Congress and approved by the United States Department of State Bureau for International Narcotics and Law Enforcement Affairs (INL).

    PART II. STANDARD PROVISIONS

    ARTICLE 7. FINANCING

    1. Distribution of USG funds for procurement of goods and services will be made as charges against sub-obligation documents prepared and issued by the U.S. Embassy or by INL.

    2. Funds obligated by the United States that have not been sub-obligated within twelve months following the close of the U.S. government fiscal year in which the

    agreement is signed ·may be de-obligated by the USG. An extension of the subobligation period may be granted upon request to the U.S. Department of State, INL.

    3. The Government of Georgia, according to the Georgian legislation, will ensure the effective operation of its Courts, Ministries, Departments, Agencies, Commissions and Councils receiving USG assistance, including the multi-agency forensic laboratory under the auspices of the Ministry of Justice of Georgia, by providing adequate funding for normal administrative and related expenses, such as payment of rents and utilities, telephone costs, salaries and benefits - including medical and other insurance protection, and by recruiting and retraining competent personnel.

    4. The Government of Georgia, according to the Georgian legislation, will ensure that the multi-agency forensic laboratory under the auspices of the Ministry of Justice of Georgia, established through the implementation of the project, and }ts equipment is available for the use of privately retained persons who because of their education, background and experience have the same or substantially similar professional competence as analysts employed by Government agencies and have the respective permission to work as experts under the Georgian legislation. The Government of Georgia will also ensure the drafting of respective legislation that will provide the basis for the admission into evidence in the courts of Georgia of such persons' forensic findings and opinions in the same manner and to the same degree that the forensic findings and opinions of similarly qualified government employed analysts are so admitted into evidence.

    5. The Government of Georgia shall make such reasonable efforts as are necessary to ensure that funds or other support provided under the present Agreement are not employed in any way in support of drug trafficking.

    ARTICLE 8. TITLE

    Title to all property shall be to the Government of Georgia, unless otherwise specified in the present Agreement.

    ARTICLE 9. PROPERTY

    1. Property furnished to the Government of Georgia through financing by the USG shall be devoted to the projects for which it was given and thereafter shall be used to further the projects' objectives.

    2. The Government of Georgia agrees to return to the USG, or reimburse the USG for, any property that it obtains through USG financing, which is not used in accordance with this provision.

    3. Funds derived from the sale of any property furnished by the USG to the projects shall be used in the furtherance of the objectives of the projects.

    4. All equipment, supplies and material will be accounted to the U.S. Embassy by the end-user in no less rigorous a manner than would be used if the equipment, supplies and material were acquired by the Government of Georgia with the funding of the Georgian Government. This provision does not exclude the obligation of the endusers to give an account to the competent authorities of the Georgian government according to the national legislation of Georgia.

    ARTICLE 10. PERSONNEL

    1. Before scholarships, fellowships or participant training for personnel proposed by the Government of Georgia can be funded under the present Agreement, personnel proposed for the training must execute a certification, as set forth in the Annex to this Agreement that they have not been convicted of a narcotics offence or been involved in narcotics trafficking within the last ten years.

    2. The Government of Georgia agrees to undertake all legal measures under the Georgian legislation to retain personnel who have received training financed under this Agreement for a minimum of two years after completing such training. This requirement may be waived by written agreement of appropriate representatives of the Parties.

    ARTICLE 11. MONITORING AND EVALUATION

    1. Both Parties shall have the right:

    a. to examine any property procured through or financed by that party under the project to determine that such property is being used in accordance with the terms of the projects; and

    b. to inspect and audit any records and accounts with respect to funds, property and contract services furnished by that party under this agreement to determine that such funds, services or property are being utilized in accordance with the terms of this Agreement.

    2. The Parties agree to monitor the progress of these projects jointly and to monitor the use of the projects' equipment and material at least annually during the life of the projects. Each party will assign qualified personnel to participate in the monitoring and evaluation process.

    3. Each Party will furnish the other with information necessary to evaluate the effectiveness of the projects' operations under the terms of the present Agreement. At the termination of the projects a completion report shall be issued as an integral part of this process. The completion report will include a summary of United States Government and Government of Georgia project contributions, a record of activities performed, objectives achieved and related basic data.

    ARTICLE 12. APPLICABLE LAWS

    1. Both Parties shall expend funds and support project operations in accordance with their respective government's applicable laws and regulations.

    2. All goods and services procured with USG funds will be procured _in and shipped from the United States unless otherwise provided for in this agreement or as otherwise authorized by the USG.

    ARTICLE 13. CURRENCY EXCHANGE

    The Government of Georgia shall pursuant to the Georgian legislation make such arrangements as may be necessary to ensure that funds introduced into Georgia by the USG for the purpose of carrying out obligations of the USG under this agreement shall be convertible into the currency of Georgia at the highest rate which at the time of conversion is not unlawful.

    ARTICLE' 14. TAXES

    Pursuant to the 1992 "Agreement between the Government of the United States of America and the Government of the Republic of Georgia regarding Cooperation to Facilitate Humanitarian and Technical Economic Assistance", tax exemptions for the latter shall apply to:

    a. any funds, material and equipment introduced into Georgia by the USG pursuant to the present Agreement;

    b. any foreign contractor, including any consulting firm, and any foreign personnel of such contractor financed with the funds for the Projects provided for in the present Agreement.

    ARTICLE 15. STATUS OF USG PERSONNEL IN GEORGIA

    1. The Government of Georgia agrees to receive persons designated by the USG to discharge responsibil ities of the USG under this Agreement according to the Georgian legislation and international law principles.

    2. • Agreement between the Government of the United States of America and the Government of the Republic of Georgia regarding Cooperation to Facilitate Humanitarian and Technical Economic Assistance":

    a. upon appropriate notification from the USG, the Government of Georgia will grant such persons the privileges and immunities accrued to the Administrative and Technical staff of the USG and assigned to the U.S. Embassy except as otherwise provided in this agreement.

    b. all personnel of the USG assigned to duties in Georgia in connection with cooperative/technical assistance programs and projeds under the present Agreement and accompanying members of their families shall be exempt from all Georgian income taxes and social security taxes with rasped to income earned while in Georgia, and from property taxes on personal property intended for their own personal use. Such personnel and accompanying members of their families shall receive the same treatment with rasped to the payment of customs and import duties on personal effeds, equipment and supplies imported into Georgia for their own use, as is accorded by the Government of Georgia to diplomatic agents of the U.S. Embassy in Georgia.

    ARTICLE 16. HUMAN RIGHTS

    The Parties recognize and agree that the protedion of human, rights is an important element of the present Agreement. To this end, the parties understand and agree that:

    a. USG assistance to the Government of Georgia's crime control efforts is conditioned on the Government of Georgia adively proteding human rights in Georgia, and

    b. In accordance with the United States law and policy, no USG assistance or , funds will be provided under this Agreement to or for use by a unit of the security forces of the Government of Georgia if the U.S. Secretary of State has credible evidence that such a unit has committed gross violations of human rights, unless the U.S. Secretary of State determines that the Government of Georgia is taking effedive measures to bring the responsible members of the

    security forces unit to justice. The Parties understand that "effective measures" means that the Government of Georgia is carrying out a credible investigation and that the individuals involved face appropriate disciplinary action or impartial prosecution in accordance with the national law.

    PART Ill. ADDITIONAL PROVISIONS

    ARTICLE 17. CONTRACTING THE TECHNICAL ASSISTANCE

    The technical assistance projects provided for in the present Agreement will be contracted through United States government agencies.

    ARTICLE 18. FUTURE FUNDING OF THE PROJECTS

    Future funding of the projects provided for in the present Agreement is contingent upon the congressional authorization and appropriation of funds and approval by the Assistant Secretary of State for International Narcotics and Law Enforcement Affairs.

    TICLE 19. MODIFICATIONS

    1. Conditions of the projects provided for in this Agreement can be changed only through the modifications to the present Agreement.

    2. Modifications to this Agreement must be made as jointly made by the signatories and issued as an additional Protocol to the present Agreement.

    PART IV. FINAL PROVISIONS

    ARTICLE 20. ENACTMENT AND TERMINATION

    1. This Agreement shall enter into force when signed by authorized representatives of the Parties.

    2. Either Party may terminate this Agreement by giving the other Party a 90-day prior written notice of intent.

    3. Termination of this Agreement shall cancel any obligations of the Parties to make contributions pursuant to this Agreement, except for payments to commitments entered into with third parties prior to the notice of cancellation of the agreement.

    4. The USG reserves the right to terminate any and all assistance provided under this Agreement upon notice or take appropriate other measures if an agency of the Government of Georgia, to or through which assistance is being provided under this Agreement or a key individual of such agency or any recipient of scholarships, fellowships or training financed under this Agreement is found to have .been convicted of a narcotics offence or to be or have been engaged in drug trafficking as defined in 22 Code of Federal Regulations, Part. 140.

    5. Obligations under Article 9 of this Agreement relating to use of property shall remain in force after termination of this Agreement.
