Preface

It is often said that administrative law is notoriously difficult to study and to teach because its doctrines are abstract and nuanced, moving across a wide array of statutes and aspects of legal practice. This book is an attempt to defend administrative law as an exciting and dynamic subject which is central to meeting the future challenges facing Irish public governance.

Law and Public Administration in Ireland inevitably focuses heavily upon judicial review, as the central aspect of the legal regulation of governance, providing a firm backstop against government abuse of power. In our account of the grounds of judicial review, we have sought to track the movement within the case-law, rather than simply overview existing precedents. Administrative law is a deeply contextual subject, one in which formal doctrinal language obscures the competing principles of public policy and the role played by the complicated fact patterns of cases. This underlying connection with purpose and pragmatic sensitivity to context are essential for any student, practitioner or decision-maker dealing with judicial review cases, and we have sought to anchor our text in this emphasis.

Alongside this formal legal analysis, this book also seeks to engage with broader issues concerning the reform of Irish public administration and the availability of non-judicial forms of review. A distinct focus is upon the crucial role of Parliament in administrative law. It will be obvious to the reader that administrative law has direct implications for citizens, the executive and the courts, with each usually constituting the applicant, the respondent and the adjudicator respectively. Yet, outside the narrow confines of individual cases, it is the Oireachtas which is the primary actor in our administrative justice system. This book stresses the fact that in discharging its legislative mandate, the Oireachtas must create consistent frameworks for resolving disputes between citizen and government. In our discussion of the Office of the Ombudsman, public inquiries in Ireland and parliamentary review generally, we argue that a greater commitment to improving the machinery of administrative justice is key to disentangling the Oireachtas from executive dominance, and ensuring that the executive is answerable to the public. Ultimately, the core question which this book poses is, simply put, what do we want from administrative law? This, to us, is the fundamental question of the subject. Rather than a focus upon inherited principles, it is important to locate the ongoing value judgments shaping judicial decisions and the design of our institutions. For the courts and practicing lawyers, we would submit that this question was central to recent refinements to judicial review principles such as occurred in Meadows v Minister for Justice. Such cases, and broader debates regarding the reform of the Irish administrative state, reflect the fact that Irish legal scholarship continues to question which administrative structures and approaches best reflect, and practically secure, the values of Bunreacht na hÈireann. We hope that this book contributes to this vital conversation.
