E state Agency has made hugestrides in improving itsreputation. Most professionals

in the business are keen to redressthe balance in the public’s eye andwork tirelessly to be seen to bebeyond reproach in their dealings, andexhibit the highest personal andcorporate integrity.

As estate agents usually represent the vendor there isa clear obligation to act in their client’s best interests. Inthe past this sometimes meant that agents would perpetrate “terminological inexactitudes” or bend the truth when it came to describing their clients’ property.

However, agents of integrity are keen to point out to their clients that theyhave a responsibility to ensure that the property is not described in amisleading way both in regard to inclusion or omission. Many people areunaware that these regulations relate not only to estate agents, but also totheir clients.

This means that whilst an estate agent should thoroughly check allrelevant facts supplied, there is also a legal onus on the seller to providereliable information to the agent as well.

Estate agents themselves are bound by The Estate Agents Act 1979.Vendors should note that whilst agents have a degree of freedom to draft theirclient service contracts as they see fit, there are certain rules that must befollowed. For example, agents must provide a full breakdown of all charges;they must reveal any connection they have with the buyer or seller, and theymust convey all offers to the seller promptly and in writing.

Of course, you can’t legislate for integrity, but when selecting an agent,vendors should make quite sure that their chosen agent not only adheres tothe letter of the law, but demonstrates a level of professionalism thatconsiderably exceeds its requirements. www.maslen.co.uk

of areas across the county. As I type, Patcham, along with areas around the Arunand Cuckmere rivers, are on flood alert. In recent months, both Pulborough andthe Balcombe Tunnel have flooded. Gatwick Airport famously flooded onChristmas Day. Looking back further though, our area has suffered horrendouslyfrom both flooding and weather-related erosion over the past millennium.

There was a time when Brighton, as we call it now, consisted principally of alower town beneath the cliffs, approximately where the Palace Pier is now. TheGreat Storm of 1703 devastated this settlement (a storm that also resulted inthe flooding of the Somerset Levels). In 1705, a second huge storm finished offthe lower town for good. Those who survived moved to the cliff top – where thetown has remained ever since.

Pool Valley, as the natural drainage pointfor the Wellesbourne (Brighton’s forgottenriver), has been flooded many times in thepast. In 1850, the entirety of the valleygardens was turned into a lake by onevicious storm. Basements were inevitablyflooded. Water burst out into the seathrough Pool Valley.

Work began on Brighton’s successfulintercepting sewer system in 1871 whichsaw the brick-lined pipes of London Road,Lewes Road and Marine Parade (whichpreviously just emptied onto the beach andinto the sea) joined together and directed towards Telscombe. A stormwateroutlet was installed within a large groyne which may easily be seen from thePalace Pier today. It stops pollution rather than flooding though.

Not long after the 1987 Hurricane (of which the strongest wind was felt inShoreham – 115 mph!), Europe’s largest stormwater drain was built beneaththe promenade. One access point is a small cafe-like structure at the foot ofHove Street. This did not prevent Patcham from flooding in 2000 (nor did ithelp Lewes which famously suffered for weeks on end).

Looking back again, the coastline of Hove has changed dramatically overthe years. The Adur once emptied into the sea in front of Wish Road thoughthat changed by the hand of man, rather than by natural causes. I t is still raining and I can hardly believe how lucky I am to be going to Cubatomorrow. The Big Daughter’s boyfriend is taking me and my friend B to theairport tomorrow morning at 7.30am. Son-in-laws-in-waiting are most useful!

Landlady Towers is still very much a sieve and my bedroom wall is literallycrumbling, in the style of an unloved Havana bordello. Worse still, when Iexamined what I thought was a huge fly on the ceiling, I discovered undercloser investigation that it was actually a mushroom. It looked more like amagic mushroom than a dry rot mushroom – I’ve seen both during variousphases in my life – so I’m not going to get unduly alarmed just yet. The SmallDaughter’s room, which is on the top floor of the house, has sprung a ratherunpleasant leak and I’ve had to move her bed so that she can balance a bowlon the end of it in order to catch the errant droplets. The water had previouslybeen dripping on to the middle of the bed, apparently, but The Small Daughterhad not thought it important enough to mention, even though she’d once puther slipper on and found it full of water...kids!

My builder, who has beenpromising to come round and fixthese issues for the last sixmonths, finally came round todayand is going to do all the work whileI’m away sunning myself on myfavourite Caribbean island, which isjust fine by me, as I shall comeback to a perfectly plastered non-leaking wall and will no longer haveto worry about The Small Daughterdrowning in her own slipper.

I am well in need of a holiday as The Boyfriend and I spent all dayyesterday doing an emergency paint job on one of my Hastings’ properties. A couple of rooms in the flat had already been painted, but the estate agentclaimed that now the rooms had been painted, the woodwork looked scruffyand needed glossing. Furthermore, he said that good tenants in Hastings arenow as rare as hens’ teeth and therefore if it didn’t look its very best, the flatwould be sitting empty for a long time. Given that Hastings Council nowcharge council tax on empty properties, I thought the sooner we got overthere the better, in spite of the fact that it was my first day off in weeks. Mynext potential painting day would have been three weeks hence, by whichtime I would have accumulated another month of council tax payments. TheBoyfriend proved himself to be quite an expert with a paintbrush, which hemight live to regret...

In recent weeks there has been an increase in properties available on therental market across Brighton and Hove. As a snapshot, a quick search onthe UK’s largest property portal shows 579 one- and two-bed apartments

and 510 two- to four-bed terraced houses available to let, so landlords have tomake sure that their property stands out from the crowd.

Even though you may have let your property consistently before, acompetitive tenant market means you and your agent need to work harderand smarter to get your property to be ‘the one’ that appeals. Here are mytop five tips on getting your property let in a buoyant market:

1Get detailed feedback from your letting agent on current viewingsHow many viewings have there been? Of those who have viewed what

have been their concerns or points of interest? If there has not been enough footfall through the door, it may be price or the web listing that is thesticking point. If you have had viewings but people are not applying, perhapsan area of the décor needs updating or there is some other internal aspectthat needs addressing.

2Revisit the web listingIs your property looking its best online? View the listing through the

eyes of an applicant. What does it look like against similar properties? Are there enough photos? Could the main image be refreshed? Does the text adequately describe all the features and benefits of the property?

3Price reductionsNo one likes to take less for a property than it has achieved in the past,

but a one month void will often cost you more across the year than a slightreduction in the asking price. The right price depends on what similarproperties are available that your home is competing with. For the sake of £50 or £25 reduction per month in the asking price you may end up with theability to cherry pick from a number of interested applicants which is betterthan no applicants at all.

4Re-consider your applicantsThe ‘perfect’ on-paper applicant rarely exists but landlords often have very

fixed ideas of who they want living in their properties. However, a good lettingagent will give a detailed profile of who your interested parties are to help youmake an informed decision. If you have a family home to let, then more oftenyou’ll get applicants with children and pets which some landlords don’t like.However, families tend to stay longer (especially when they have children andpets and get ‘settled’ in a property), so the benefit of accepting theseadditions will be more stable income from the property.

5Don’t be greedyIf you have been renting your property out for a while to tenants who pay

the rent on time and keep your property in good condition, our advice wouldbe to think carefully about increases in the rent at renewal stage. Is askingfor an extra 2–5% worth the risk of them giving notice and you having to incurre-let costs or risk a void period?
