Newsletter 2017-19 May 12, 2017 LAST CHANCE FOR A HIGHWAY FUNDING BILL THIS YEAR The West Virginia Legislature will reconvene its special session Monday to continue budget and highway funding deliberations. Gov. Jim Justice called a special session of the Legislature beginning Thursday, May 4. The session adjourned May 5 after the House of Delegates voted down the budget bill passed by the West Virginia Senate. Neither house took up the gas tax/DMV fee highway bill, the bill to extend tolls on the West Virginia Turnpike or the 2% teacher pay raise bill. The CAWV Board of Directors met Wednesday and developed an action plan for one final push for passage of highway legislation. Board members divided up key legislators and have been contacting them at their home and offices to gain their support for the highway initiatives. The message to legislators is: “West Virginia needs highway funding for jobs, better roads, economic development and safety. The time is now. Next year is an election year and legislators will not be voting for a highway bill. They need to vote “YES” next week.” ACTION NEEDED: CAWV members need to call their House of Delegates members to encourage them to vote “YES” on the highway funding bill and the turnpike toll bill. They need to hear that it’s time to improve West Virginia’s highways and create jobs. If the Legislature does not pass a highway funding bill this year, it is almost certain they will not pass a bill next session since it’s an election year. WV Secretary of Transportation Tom Smith was a guest today on WV MetroNews “Talkline.” He said the WVDOH needs revenues today to repair and maintain the state’s roads rather than waiting to vote on a road bond amendment later this year. “We are just falling further and further behind on road projects,” the secretary told Hoppy Kercheval. “Without revenues showing up sooner rather than later, we can’t get the work done that we really need to get done now and putting this work off, deferring it, makes it so it costs more later.” Smith, who is also Highways Commissioner, said the WVDOH has only advertised about 20 resurfacing contracts through May compared to almost 100 in past years. He said they could surge projects forward by taking 2018 programmed projects and advertising them this year. This could create jobs as well, he told “Talkline” listeners. CAWV CONGRESSIONAL FLY-IN CANCELLED The May 18, 2017 CAWV Congressional Fly-In to Washington has been cancelled. Governor Jim Justice called a special session of the WV Legislature May 4 and it was expected the session would be over before the Fly-In on May 18. However, legislators could not reach agreement on the budget or highway funding bills and the special session recessed on May 5. Legislators will reconvene Monday, May 15.

“We discussed this in our Board of Directors meeting Wednesday and determined CAWV’s efforts need to be concentrated at the State Capitol next week,” said CAWV President C.R. Neighborgall. “We have worked long and hard to provide long-term funding for highways and infrastructure and we want our members in Charleston meeting with their legislators. We are close to finally getting highway funding and we need to push it over the finish line.” This year would have been the 29th annual CAWV Congressional Fly-In to meet with West Virginia’s senators and representatives. The CAWV Board is reviewing options to best meet with Senators Capito and Manchin and Reps. McKinley, Jenkins and Mooney. “The CAWV Board appreciates all members who have taken time and effort to travel to Washington to promote issues of importance to our members and West Virginia’s construction industry,” said President Neighborgall. “Next year would have been our 30th anniversary of the CAWV Fly-In. We will plan a special presentation for next year’s event and we ask members to plan now to attend,” he said. INFRASTRUCTURE WEEK IS RIGHT AROUND THE CORNER AGC of America is once again one helping to support and promote Infrastructure Week – a national week of education and advocacy that brings together American businesses, workers, elected leaders, and everyday citizens around the message #TimeToBuild. Next week – May 15-19, 2017 – advocates around the country will highlight the state of our nation’s infrastructure and encourage lawmakers to invest in and modernize our roads, bridges, highways, airports, waterways, ports, and water systems. AGC of America will be engaged in a social media campaign during the week to help educate the broader public and Congress about the many benefits of investing in the nation’s aging infrastructure. OVER 30 MEMBERS ATTEND THE CAWV / BRICKSTREET SAFETY TRAINING The CAWV Safety Committee, in conjunction with BrickStreet Insurance, held a silica safety seminar on Friday, May 5 at the BrickStreet Headquarters in Charleston. The seminar, Overview Training for OSHA’s Updated Silica Standard for Construction, was well attended by CAWV members from the Highway, Building and Utility Divisions. The new standard, which goes into effect on June 23, 2017 and will be enforced beginning September 23, 2017, has many changes related to employee silica exposure and silica control for construction. Allan Williams, Safety and Loss Control Specialist for BrickStreet, gave the attendees a complete list of the changes and how it will impact jobsites. He also noted that contractors must have a silica exposure plan for each project to be in compliance with the new standards. Members also heard from Dan Whiteman, Industrial Hygienist, West Virginia University Safety Health Extension, about the different types of personal protective equipment (PPE) that can be used to make sure you are meeting the new standards. CAWV ANNUAL SCHOLARSHIP GOLF OUTING – MORNING FILLING UP QUICKLY The annual CAWV Scholarship Golf Outing will be held Friday, June 2, at Berry Hills Country Club in Charleston. We are limited to 20 "Sixsomes" for both the 7:30 a.m. and 1:30 p.m.

America’s Resort ~ The Greenbrier

The Meadows Course

As in past years the CAWV will hold its Golf Tournament on the Mead-ows Course.

The Meadows Course was originally built in 1962 as a nine-hole course. It was located in an area that had long been known as the “meadows," alongside a meandering stream on The Greenbrier’s 6,500 acre estate.

The course was dramatically up-dated in 1999. It now offers very challenging play from the blue and gold tees and an enjoyable, forgiv-ing golf experience from the shorter white or red tees.

The course shares a massive double green on the 18th hole with The Greenbrier Course and is a true test of skill. Many regional and state champion-ships are contested on it annually. The Meadows Course, along with The Greenbrier Course and The Old White Course, the two other championship, 18-hole courses,

begins and ends at the Golf Club.

We will not know status of the courses until Mid June.

The Golf Club The Golf Club is home to three, dis-tinctively different 18-hole champi-onship courses. Each begins and ends at this central facility. The Golf Club also features locker rooms and an award-winning pro shop.

Golf cars and caddies are available, as well as a practice range and put-ting greens.

We will not know status of courses until Mid June.

Daily club cleaning and storage are also available. Private lessons and golf clinics are offered throughout the year. Walking is permitted at all times.

PUTNAM COMMISSION ISSUES BONDS TO FINANCE VALLEY PARK PROJECT The Putnam County Commission issued bonds this week to finance the Valley Park improvement project. The county has issued up to $10 million in bonds for the Greater Teays Valley TIF District. The tax increment-financing district, which was created in 2004, stretches along Interstate 64 between the Teays Valley and Hurricane exits. The $15 million project will primarily be financed through the TIF funds, with the county footing $3 million. TIF bonds allow counties and cities to sell bonds for improvements on the assumption that the improvements will bring in more tax revenue to pay off the bonds. The project will allow construction of a new entrance sign and lane for the park, new ADA-accessible playgrounds, a new community center, baseball and soccer fields and multiple other park improvements. It also includes improvements to the park’s wave pool, including cabanas and a sand bar. PREVENTING BACKOVERS Road construction workers face many hazards on the job. In addition to many of the hazards present on a “traditional” construction site, road workers also need to contend with moving vehicles both in and around the job site. From 1995 through 2002, 844 fatal occupational injuries occurred at road construction sites. The majority of these fatalities, 693 (82%) cases, were reported to be transportation incidents. Fatalities involving a ground worker being struck by a vehicle or equipment accounted for 509 (73%) of the transportation incidents. Victims were as likely to be struck by construction equipment (32%) as by highway vehicles (28%). The leading cause of fatalities for workers in work zones is being run over or backed over by construction equipment. While we often worry about construction workers being killed by motorists, road workers working behind the barriers in the work zone are at equal risk of being killed by construction vehicles due to their large “blind spots.” Each month, at least one worker is killed by being backed over by a construction vehicle, often a dump truck. These deaths are completely preventable. One way to prevent these fatalities is to implement traffic patterns on jobsites to reduce the amount of backing up that is necessary and minimize the exposure of workers on foot to vehicles. This is called developing an Internal Traffic Control Plan or ITCP. Reverse motion on anything in this industry is fraught with peril. Backup alarms on construction machinery are basically cosmetic devices in terms of assuring a clear backside. As such, operators need to positively assure that no one or nothing is behind them. This is achieved by getting out and looking. Always check the machine perimeter before moving. When vision is impaired, have a spotter (in high-visibility apparel) guide you. Use wide angle mirrors. The new generation of machines is fitted with best viewable surface mirrors. Keep them clean and adjusted. Use rear-mounted cameras and/or rear-mounted presence-sensing alarms. Presence-sensing alarms are becoming more reliable as technology improves. The equipment industry recognizes the urgency of the problem and will find technical solutions to address chronic people behavior problems. There is also a lot of new technology to help prevent workers from being struck such as cameras, radar, and wearable back up alarms. WVDOH REPORT - $2.8 BILLION IN ROAD PROJECTS AT STAKE IN SPECIAL SESSION West Virginia Department of Highways has presented legislators a report on the new road projects and maintenance work that could be funded if the Legislature approves a small increase in the gas tax and DMV fees during the special session. Governor Justice put legislation on the special session agenda to support his plan to create 48,000 jobs. The list totals over $2.8 billion worth of projects the WVDOH could advertise if additional funding is approved by lawmakers. The nearly 500 projects are split 60 percent ($1.7 billion) for system preservation projects and 40 percent ($1.2 billion) for expansion projects. The updated project list from DOH is broken down by county. The future of these important road projects hinge on the Legislature’s approval in the upcoming special session. Each legislator will have a copy of the report on their desks when they return to the State Capitol on Monday. Members can click here to view the full project list. HOUSE MEMBERS CONTINUE TO PUSH HIGHWAY TRUST FUND FIX AS PART OF TAX REFORM

As the push continues for Congress to fix the Highway Trust Fund, a bipartisan group of members of the House of Representatives are circulating a letter calling for a permanent Highway Trust Fund fix to be included in any tax reform package. Representatives Graves and Holmes Norton circulated a similar letter last year was signed by 130 bipartisan members of the House, including Rep. David McKinley and Rep. Evan Jenkins. So far, 111 members of the House have signed onto this year’s letter. Rep. McKinley has signed this year and the CAWV will be contacting Rep. Jenkins and Rep. Alex Mooney to gain their support.

Attendees at next week’s Transportation Construction Coalition (TCC) meeting in Washington will be bringing this message to Capitol Hill and urging their House representative to sign onto the Graves/Holmes Norton letter. In addition to signing the Graves/Holmes Norton letter, attendees will also be asking their members of Congress to fully fund the FAST Act’s authorized levels for FY 2018 and increase airport infrastructure investment as part of the FAA authorization.

The FAST ACT provides funding certainty for the Highway Trust Fund through fiscal year 2020. However, following the FAST Act's expiration, the Highway Trust Fund will face cuts of approximately $18 billion per year. A permanent fix for the Highway Trust Fund needs to be found in order to eliminate these cuts.
