* Note – Statistics cited in the above table are derived from the LASD Quarterly Disciplinary Report for January 1, 2007 through March 31, 2007and reflect all administrative discipline cases in which LASD executives have approved discipline during that quarter. The OIR Report ofOversight of Administrative Discipline Cases (attached) is a tracking chart showing case progress. It includes cases where discipline has not yetbeen imposed, cases where there has been a finding that no discipline is appropriate, and cases where past discipline is being appealed. As aresult, the actual imposition of discipline noted on the OIR chart will, in some cases, have been imposed in an earlier quarter. OIR feels itimportant to retain those cases on the chart however, so that the public can be informed about their eventual outcome. New informationregarding existing cases and cases initiated during this quarter are indicated by bold typeface. The “Subsequent History” column in thetracking chart reports whether OIR concurred with any modification of discipline. Unless expressly noted, OIR did not necessarily concur with amodification of discipline undertaken during the grievance process. OIR strives to provide the greatest degree of transparency possible to theadministrative discipline process yet respecting the right to privacy of LASD employees as expressed by law.
** “Discharge” as referenced in this chart and the OIR Report of Oversight of Administrative Discipline Cases means cases in which LASD hasinformed the employee that it intends to discharge him or her. Subsequent due process appeals and grievance proceedings initiated by theemployee after notification can result in reinstatement. OIR continues to track the status of the cases it reviews, and will provide any relevantupdates in future charts if and when a change in discipline occurs.

Two deputies responded to a callof possible narcotics activity in avan. After locating the van, thedeputies approached it. SubjectDeputy #1 saw the driver orpassenger point a handgun in hisdirection and fired two rounds atthe suspected gunman. Thedriver of the van thenaccelerated away from thedeputies. After a brief vehiclepursuit, the driver pulled the vanto the curb, jumped out of thevan and fled on foot. Whilefleeing on foot, the armedsuspect, the driver turned andpointed a handgun at SubjectDeputy #2, and Subject Deputy#2 fired a single round at thegunman. After a canine search,Department personnel locatedthe gunman hiding under aparked car. Departmentpersonnel recovered no weaponand detained the two passengersin the van.

While driving to the location of asuspect’s vehicle, following a shooting incident, a supervisorspotted the suspect running andgot out of his car in order tointercept him. The suspecttossed a gun and ran into thesupervisor, and pushed himdown. The supervisor threw hisflashlight at the retreatingsuspect, which struck him in theback of the head, causing him todrop to the sidewalk. Thesuspect was handcuffed withoutfurther incident.

Complaining ofpain, subject was transported to alocal hospital were it was determinedshe had sustained a fracture to theleft elbow.
Case was presented to ExecutiveForce Review Committee on2/22/07, and the Committeeconcluded that the force usedwas within Department policyand recommended additionalrelevant training. OIR concurredwith the policy conclusion andthe additional trainingrecommendation.

During the pursuit of a stolenvehicle, the suspects fled aftercolliding with a telephone pole. As suspect (2) exited thepassenger side he turned andpointed a handgun in thedeputies direction. Deputy (1)saw the weapon and fired,missing the suspect, who thenfled the scene. Suspect (1) wastaken into custody following thecontainment of the area. Suspect (2) turned himself indays later.

At the conclusion of a traffic stop onthe suspect for reckless driving,subject deputies encountered aresistive suspect. During a brieffight, Subject Deputy (1) punchedthe suspect one time in the face, andwhen the suspect ran free, he ranthrough an apartment complex andthen back toward his car. Withsubject deputies in pursuit of thesuspect, the suspect’s father grabbedhim, and the suspect then produceda revolver. When subject deputiesdrew their weapons and ordered thesuspect to drop his weapon, thesuspect placed his revolver under hischin and fired a fatal shot to hishead.

At the conclusion of a brief carpursuit of a possible driver under theinfluence, subject deputies engagedin a short foot pursuit of thesuspected driver, who jumped out ofthe stolen truck. After jumping achainlink fence, the suspect turnedtoward the subject deputies andreached for his waistband. SubjectDeputy (1) fired one round from hisservice weapon at the suspect andmissed. Without further incident, thesuspect surrendered. No weaponwas recovered.

When SubjectDeputies turned the suspect over,the suspect was dead. The suspecthad sustained wounds to his eyesduring a fight with the bank’ssecurity guard and self-inflicted stabwounds to the heart. At the scene,Department personnel recovered theknife and one firearm.

Deputies approached a vehicle at agas station for expired registration. The driver admitted to not having avalid license. While Deputy (1) spokewith the driver, Deputy (2) contactedthe passenger, the driver’s teenageson. Deputy (2) attempted to detainthe passenger in the backseat of thepatrol car while Deputy (1)completed his investigation. At thispoint, police officers from a localpolice agency arrived. Deputy (2)and the officers struggled with thepassenger at the rear of the patrolcar. Deputy (2) and the officers tookthe passenger to the ground,struggled with him there, and thenhandcuffed him. Meanwhile, Deputy(1) took the driver to the ground. After the passenger was cuffed, hewas lifted off the ground by officersas captured on videotape. Theofficers of the local police agency arealleged to have slammed thepassenger into the trunk of the carand punched him.
