Sec. 58-51. Intent.

The residential district R-1 is composed of certain quiet, low-density areas plus certain open areas where similar residential

development appears likely to occur. The regulations for this district are designed to stabilize and protect the essential characteristics

of the district, to promote and encourage a suitable environment for family life where there are children, and to prohibit all activities

of a commercial nature. To these ends, development is limited basically to single-unit dwellings providing homes for the residents

plus certain additional uses, such as schools, parks, churches and certain public facilities that serve the residents of the district.

Sec. 58-52. Use regulations.

In residential district R-1, structures to be erected or land to be used shall be for one or more of the following uses:

(1) Single-family dwellings.

(2) Group homes.

(3) Schools, public and private.

(4) Churches.

(5) Parks and playgrounds.

(6) Off-street parking as required by this chapter.

(7) Accessory buildings permitted as defined; however, garages or other accessory structures such as carports, porches and

stoops attached to the main building shall be considered part of the main building. No accessory building may be closer

than five feet to any property line.

(8) Poles, distribution lines, distribution transformers, pipes, meters and other facilities necessary for the provision and

maintenance of public utilities, including water and sewerage facilities. Transmission lines, transmission towers and

electrical substations are not deemed necessary facilities under this section.

(9) Light fixtures shall be no higher than 16 feet. All lighting shall be approved by the architectural review board.

Sec. 58-53. Special uses.

The following uses shall be permitted in the R-1 district with a special use permit:

(1) Estate/liquidation auction sale.

(2) Outdoor craft and/or antique shows/sales.

(3) Parades.

(4) Lodging/bed and breakfast.

(5) Mobile office/classroom shall only be permitted with a special use license with the following restrictions:

a. For use as a classroom for a period of one year and must reapply for a special use permit for each additional

year thereafter;

b. For use as an office for a period of six months and must reapply for an additional six months, with one year

being the maximum for an office.

(6) Home occupations, in the main building of the lot.

(7) Limited professional offices, medical and dental.

(8) Two-family dwellings.

(9) Accessory apartments (not more than one per detached single-family structure, and designed as not to exceed 40

percent of the total living area of the structure). All conversions shall be in conformance with the building codes as adopted

by the town.

(10) When conditions imposed by the town to meet certain public objectives restrict residential development due to road

frontage regulations, pipe stem lots may be allowed if:

a. It becomes necessary to provide an alternate means of access to lots fronting on a major thoroughfare when the

town deems it undesirable to allow direct access to the major thoroughfare.

b. It is found that a lot of record before September 19, 1983, by reason of narrowness and existing public road

frontage only, cannot be subdivided for compatible single-family dwelling use.

(11) When pipe stem lots are permitted, the following design standards shall apply:

a. No two pipe-stem lots shall be contiguous unless access is provided by a common ingress/egress easement. No

more than three pipe-stem lots may be served by a single common driveway.

b. When more than one lot uses a common driveway, adequate ingress/egress easements and safe turnarounds

shall be provided.

c. Adequate provisions for perpetual maintenance by the homeowners shall be approved by the town council and

recorded with the plat of subdivision or a covenant running with the land and be non-amendable without the

express consent of the town council.

d. When two or more pipe stem lots have a common driveway, the minimum travel way width shall be 18 feet;

and the driveway shall be constructed of a surface material accepted by the council.

e. No principal residential structure shall be located closer than 25 feet to the front property line, or, in the case of

two or more lots, the common drive. All other side and rear yard areas of the R-1 district shall apply. In the case

of a single pipe stem easement lot, the rear lot line of the conforming lot (having road frontage) shall be

considered the front lot line of the pipe stem lot.

Sec. 58-54. Area regulations.

(a)For lots in the R-1 district containing or intended to contain a single permitted use served by public sewage disposal, the

minimum lot area shall be 10,000 square feet or more.

(b)For lots containing or intended to contain a single permitted use served by individual water and sewerage system, the

minimum lot area shall be 20,000 square feet or more; the required area for any such use shall be approved by the health

official. The administrator may require a greater area if considered necessary by the health official.

Sec. 58-55. Setback regulations.

Structures in the R-1 district shall be located 35 feet or more from any street right-of-way which is 50 feet or greater in width, or 50

feet or more from the center of any street right-of-way less than 50 feet in width. This shall be known as the setback line.

Sec. 58-56. Frontage regulations.

For permitted uses in the R-1 district, the minimum lot width at the setback line shall be 75 feet or more.

Sec. 58-57. Yard regulations.

(a)Side. The minimum side yard for each main structure in the R-1 district shall be ten feet, and the total width of the two

side yards shall be at least 20 feet.

(b)Rear. Each main structure shall have a rear yard of 25 feet.

Sec. 58-58. Height regulations.

(a)Permitted uses in the R-1 district may be erected up to 35 feet in height from grade: building not more than three stories

above grade.

(b)Accessory buildings more than five feet of any lot line in the R-1 district may be erected to a height no more than 15

feet above grade.

(c)Church spires, belfries, cupolas, monuments, municipal water towers, chimneys, flues, flagpoles, television antennas,

and radio aerials are exempt. Parapet walls may be up to four feet above the height of the building on which the walls rest.

Sec. 58-59. Corner lots.

(a)Of the two sides of a corner lot in the R-1 district, the front shall be deemed to be the shorter of the two sides fronting on

the streets.

(b)The side yard on the side facing the street shall be 20 feet or more for both main and accessory buildings.

Sec. 58-61. Other applicable requirements.

Article IX, Signs and Nameplates, of this chapter shall apply to the residential district R-1.

Sec. 58-62. Underground utilities.

Except for transmission powerlines of 34,500 volts or greater, water towers, or other installations in the R-1 district approved by the

town council, all on-site utilities or utility facilities serving new uses or installed after the effective date of the ordinance except for

good cause shown because of unusual soil or topographical conditions, shall be installed underground including, among others,

electrical, water, sewer, power, gas, telephone and cable utilities.

Sec. 58-63. Maximum lot coverage.

The maximum lot coverage shall be 30 percent.

For single family detached dwellings on lots containing 36,000 square feet or less in the R-1 district, all parking for vehicles or

trailers in a front yard shall be on a surfaced area, provided, however, that this shall not be deemed to preclude temporary parking on

an unsurfaced area in a front yard for a period not to exceed 48 hours for loading, unloading, cleaning or repair of vehicles or trailers.

In addition, no more than 25 percent of any front shall be surfaced area for a driveway or vehicle/trailer parking area; provided,

however, that these limitations may be exceeded for a surfaced area that is:

A. Directly contiguous with, and providing primary access to, two side-by-side parking spaces as long as the

surfaced area is not more than 25 feet long and 18 feet wide;

B. On a lot which has its primary access from a major thoroughfare and consists of two side-by-side parking

spaces and a vehicular turn-around area as long as the surfaced area is not more than 25 feet long and 18 feet wide

and the turn-around area does not exceed 150 square feet; or

C. Provided as an accessibility improvement as approved by the zoning administrator.

Surfaced area shall include asphalt, poured or precast concrete, brick, stone, gravel, or any other impervious surface, or grasscrete or

other similar pervious surface. On a pipestem lot, the surfaced area within the pipestem driveway shall not be included in this

limitation.
