1 PURPOSE

This document (the “Architectural Requirements”) details the requirements associated with

any modification, change or addition to property and structures (i.e., homes and grounds,

including townhomes) owned by owners of property (“Homeowner” or Homeowners”) in

Lakes of Parkway (“LOP”). These requirements are authorized pursuant to Article XI of the

Amended and Restated Declaration of Protective Covenants for Lakes of Parkway

(“Protective Covenants”).

The LOP modifications committee of the Association and the new construction committee of

the Association (collectively, the “ARC”) of Lakes of Parkway Homeowners Association, Inc.,

a Texas non-profit corporation (“HOA”) has been appointed by the Board of Directors

(“BOD”) to establish and oversee a review and approval process for such modifications,

changes, or additions.

2 SCOPE

The requirements contained in this document pertain to all Homeowner property and

structures (i.e., homes and grounds, including townhomes) within LOP.

This includes changes to the exterior of your home, yard, or driveway as well as major

changes to the interior structure of your home (refer to Section 3 of this document for more

specific information).

If you have a question regarding what changes may be included or excluded, please contact

the property manager for LOP (“Property Manager”) or a member of the ARC (ARC contact

information is found on the LOP website at www.lakesofparkwayhoa.org under “Home

Modifications Requests” or directly from the ARC homepage at http://loparc.weebly.com.

3 GENERAL REQUIREMENTS

The requirements contained herein pertain to all work (as identified in Section 3.1 below)

conducted in LOP (home or grounds). Additional requirements specific to each type of work

are found in Appendix A.

3.1 When is an ARC Application Required?

Any of the following actions on Homeowner property in LOP requires the submittal and

approval of an ARC Application (herein so called) prior to the commencement of work.

This includes any external appearance or interior structural change, including, but not

limited to:

• The placement, erection, or installation of any structure (e.g., balcony, swimming pool, basketball goal, fence, gazebo, pergola, patio cover, deck, emergency generator, outdoor kitchen, window shade/awning, water softener, backyard playground equipment, etc.)

• Any change, alteration, repair, or other modification to an existing structure (e.g., roof replacement, house addition, house modifications, balcony repair, driveway modification, house painting, patio change or addition, door (exterior) modification or window replacement, etc.)

• A major landscaping modification in the front, rear or side yard (e.g., addition or removal of tree(s) or palm(s), addition of fountains or yard ornaments, etc.)

• Any use of a dumpster (mobile waste container) or portable toilet for a project that does not require an ARC Application (e.g., interior home modifications)

NOTE: examples listed above may not be all inclusive.

Once you have determined that your project requires an ARC Application, refer to Section

4 of this document for information on the ARC Application submittal process

The entire ARC Application process is detailed on flow diagrams located on the ARC

homepage here.

If uncertain as to whether your project requires an ARC Application, please contact the

Property Manager or a member of the ARC (ARC contact information is found here).

One (1) ARC Application per type of work (as identified in this Section and detailed in

Appendix A) is required.

For large projects, multiple ARC Applications may be required depending on the scope of

work. If clarity is needed on whether a project requires multiple ARC Applications, please

contact one of the ARC members.

Should the ARC Application be submitted after the construction, the ARC is not required to

provide approval, and the unapproved change may be deemed to be a violation of the

Protective Covenants and these Architectural Requirements. No construction should begin

prior to the approval of the ARC Application. You may be required to remove the

unapproved improvements.

3.2 Homeowner Responsibility

Any Homeowner who engages in any of the work types noted in Section 3.1 above is

responsible for obtaining ARC Application approval before the commencement of any

such work. Renters or occupants must submit the ARC Application through the

Homeowner.

The ARC Application review and approval process may take up to 45 days (30 days for

new construction); however, the ARC will make every effort to complete their review in a

timely manner.

It is the responsibility of the Homeowner to submit and obtain approval of each ARC

Application. The ARC will not accept ARC Applications from renters, contractors (including,

but not limited to, architects, engineers, general construction contractors and

subcontractors; collectively herein called “Contractor”) or other third parties.

Homeowners must initiate the ARC Application process and remain involved in the process

through Application approval and project completion. Homeowners must ensure that their

Contractors are aware of the ARC requirements contained herein and their responsibility to

adhere to them.

The ARC recommends that the Homeowner avoid purchasing material or signing contracts

until approval of their ARC Application has been obtained. The HOA is NOT responsible for

any Contractor fees or costs that may result when material is purchased prior to ARC

Application approval.

3.3 Fines / Unauthorized Work

Violations of these Architectural Requirements are subject to fine, including but not limited

to the following violations:

• Conducting work subject to the requirements contained herein without an approved ARC Application

• Dumping of chemical or paint waste into LOP storm drains, streets, or common property

• Conducting work outside of construction hours as defined in Section 3.12 of this document

• Failure to address noise complaints as noted in Section 3.13

The BOD has the authority to issue a “cease and desist” order for any of the work noted in

Section 3.1 of this document if commenced without proper authorization, i.e., an approved

ARC Application.

The work may only resume when both of the following requirements have been met:

• An ARC Application has been submitted as noted in Section 4.4 of this document

• The ARC has reviewed and approved the ARC Application

3.4 Emergency Repairs

ARC Applications are not required for emergency repairs (e.g., roof repairs to stop further

damage from a leak, gas piping repair when a gas leak has been discovered, water piping

repair to stop a leak, etc.).

If the emergency repair involves work that meets the requirements in Section 3.1 of these

Architectural Requirements, then an ARC Application must be submitted within seven (7)

days after the completion of the emergency work. When in doubt, it is recommended that

an ARC Application be submitted.

3.5 Applicable Regulations / City of Houston Permit Approvals

Homeowners and their Contractors are responsible for meeting all applicable Federal,

State and Local building codes and regulations and for obtaining any required permits for

the project. This includes, but is not limited to, City of Houston building permits.

NOTE: It is recommended that the Homeowner obtain ARC Application approval before

submitting documents/drawings to the City of Houston Permit Department as approval by

the City of Houston does not guarantee ARC Application approval.

3.6 Access via HOA or MUD 355 Property

Any work taking place on the Homeowner’s property that requires the use of HOA common

area property/easements or Municipal Utility District Number 355 (“MUD 355”) property

easements to access the area for or during construction is subject to the review and

approval by the HOA or MUD 355, as the case may be, prior to ARC Application approval.

3.7 Damage Responsibility

The Homeowner is financially responsible for any damage to their neighbor’s property,

HOA property, or MUD 355 property that results from work conducted on their property.

The Homeowner must make repairs which are approved by and satisfactory to the party

whose property was damaged.

When damage occurs to a neighbor’s property, resolution of the damage repair must be

achieved between the Homeowner and neighbor.

When damage occurs to HOA or MUD 355 property, it is the Homeowner’s responsibility to

restore (to the satisfaction of the HOA or MUD 355), as the case may be, the property to its

original condition.

In this case, the Homeowner has two (2) options:

• Allow the HOA or MUD 355, as the case may be, to perform the remediation work

with the Homeowner reimbursing the HOA or MUD 355, as the case may be, for the

expenses incurred, or

• Perform the remediation work themselves in which case the Homeowner must

present their remediation plan to the HOA or MUD 355, as the case may be, for

approval prior to commencement of the work.

Note: If the HOA or MUD 355, as the case may be, deem the plan insufficient, then

the HOA or MUD 355 reserves the right to reject the plan and make the repairs,

charging all related expenses to the Homeowner.

It is advised that Homeowners ensure that their Contractor has general liability insurance

and that the Homeowner request a certificate of insurance from the Contractor and verify

its validity.

3.8 Safety Responsibility

The Homeowner is responsible for the safety of all visitors and Contractors during the

demolition and or construction of the Homeowner’s project. The ARC recommends that

Homeowners review their Contractor’s safety record during the hiring process to ensure

that the Contractor places a high priority on ensuring job safety performance.

3.9 Material Storage

All construction material (e.g., lumber, roofing material, etc.) must be stored in the

Homeowner’s driveway, garage or backyard prior to the commencement of and during the

work; i.e., storage (temporary or otherwise) of any material in the LOP street in front or side

of the house is expressly prohibited. Long term storage of such material is prohibited.

3.10 Waste Management and Disposal

The Homeowner is responsible for ensuring that the Contractor properly disposes of all

demolition and construction debris. Contractors must not leave construction debris in front

of the house for pickup by the HOA trash disposal service.

Homeowners must ensure that Contractors conduct daily visual sweeps of their yard,

driveway, and street at the end of each day to cleanup any miscellaneous construction

debris (nails, screws, etc.) and other litter (e.g., paper, boxes, etc.).

3.11 Dumpster Use

An ARC Application for dumpster use is only required if a dumpster will be utilized for a

project that does not require an ARC Application (e.g., interior home modifications). Refer

to Appendix A.22 for additional information.

For projects that require an ARC Application, the dumpster will be included within that ARC

Application.

All dumpsters utilized in LOP must be:

• Limited to one (1) dumpster per property

• Located on the Homeowners driveway (i.e., must not be in the street).

• In good condition (i.e., painted and not rusted)

• Free of any leakage of water or other liquid

• Emptied within one (1) week of being filled

• Never overfilled

• Removed from LOP within one (1) week after completion of project

• On Homeowners property for no more than six (6) months in duration (an extension may be requested if project duration exceeds six months)

3.12 Construction Hours

All construction work must be limited to the following hours:

• Monday through Saturday: 8 am to 6 pm.

• Sundays and Holidays: No construction work allowed

Violators of the above restrictions are subject to a fine of $500 per day.

Certain work may continue beyond the above hours if necessary, such as:

• Roofing work when needed to cover the roof before rain

• Emergency repair work

All appropriate safety measures must continue to be taken when working beyond normal

working hours.

In addition, the ARC may issue a “variance” from these work hour restrictions during a

period immediately following a natural disaster (e.g., hurricane, flood, windstorm).

3.13 Noise Complaints

All construction must follow the noise requirements contained herein (i.e., as specified in

the applicable Appendix). Each noise complaint must be addressed immediately by the

Homeowner. The construction activities must cease, and other construction methods

utilized. Failure to comply may result in an HOA warning and/or fine.

3.14 Bathroom Access

The Homeowner must provide access to bathroom facilities for their Contractors, either via

their home or a rented outdoor portable toilet. For projects that will last multiple days, a

rented outdoor portable toilet is recommended.

An ARC Application for use of an outdoor portable toilet is only required when the portable

toilet will be utilized for a project that does not require an ARC Application (e.g., interior

home modifications). Refer to Appendix A.23 for additional information.

For Projects that require an ARC Application, the use of a portable toilet must be noted on

the ARC Application.

Portable toilets should be placed on the Homeowner’s property in a discrete location and

must be appropriately maintained to avoid odor or sanitation issues.

3.15 Contractor Parking and Traffic Laws

Contractor vehicles are prohibited from parking in any LOP street directly opposite a

driveway entrance. Such parking may prevent a resident from entering or exiting their

driveway.

Contractors must obey LOP speed limits (25 mph) and stop signs. The Homeowner is

responsible for their Contractor violations of LOP traffic laws.

The Homeowner is responsible for advising their Contractors of these requirements and for

ensuring their Contractors adhere to these traffic laws and parking requirements during the

construction period.

4 ARC APPLICATION SUBMITTAL PROCESS

The ARC Application form is available for download from the LOP website at

www.lakesofparkwayhoa.org under “Home Modifications Requests” or from the ARC

homepage at http://loparc.weebly.com.

It is the responsibility of the Homeowner (as set forth in Section 3.2) to submit and obtain

approval of each ARC Application. The ARC will not accept ARC Applications from

Contractors or other third parties (as set forth in Section 3.2).

Homeowners must be involved in the ARC Application process and must ensure that their

Contractor is familiar with the requirements, standards and procedures contained herein.

4.1 ARC Application Form

Download the Application form from the ARC homepage here and complete with the

following information:

• Homeowner’s full name, address, and contact email address and phone number(s)

• Brief description of the proposed addition, change or modification

• Material to be used (e.g., roof material, paint type/color, etc.)

• Dimensions (height, width, length) of any structure(s) proposed for addition or modification

• If a dumpster will be utilized

• If a portable toilet will be utilized

4.2 ARC Application Attachments

Refer to your specific project type in Appendix A for the attachments required for your

specific project.

In general, the following items must be included with the completed ARC Application form:

• Plot plan or lot survey indicating location of modification, change or addition (refer to Appendix A and your specific project type for additional information)

• Color or material specifications (e.g., material or color samples, roofing material, etc.) Refer to Appendix A and your specific project type for additional information

• “Before” photos of the house or area in its existing state before any modifications are initiated

• Other items as noted for your specific project in Appendix A

4.3 ARC Application Deposit

Deposits are required and must accompany the ARC Application for the following work:

• Swimming Pool Installation ($2,000)

• House or Room Addition ($2,000)

• Balcony Repair, Modification or Addition ($2,000)

• Outdoor Kitchen ($1,000)

• Roof Replacement ($1,000)

• House Painting ($1,000)

• Outdoor Basketball Goals ($100)

The Homeowner must notify the ARC upon completion of work. ARC will perform an

inspection and if no deficiencies are found, the deposit will be returned. Refer to Section 6.

4.4 ARC Application Submittal

Hand write in legible handwriting the information requested on the form and as noted in

Section 4.1. Submit a pdf of your completed ARC Application and required attachments to

[email protected].

NOTE: It is the responsibility of the Homeowner to submit and obtain approval of each

ARC Application. The ARC will NOT accept ARC Applications from Contractors or other

third parties as set forth in Section 3.2. All correspondence regarding Homeowner ARC

Applications must be conducted between the ARC and the Homeowner.

5 ARC APPLICATION REVIEW AND APPROVAL PROCESS

Refer to the ARC Application Review and Approval flow diagrams on the ARC homepage

here.

5.1 ARC Application Review

The ARC may take up to 45 days (30 days for new construction) from the date of receipt of

the ARC Application to review an ARC Application but will make every effort to review in a

time manner. To ensure timely review of your application, ensure that all required

attachments are included and promptly respond to any questions the ARC may have

regarding your application.

5.2 ARC Application Approval

Upon approval of an ARC Application, the Homeowner will be advised via email and USPS

mail with a “conditional approval / approval with stipulations” letter. At this point, the

Homeowner is approved to proceed with the project provided all conditions and stipulations

as noted in the approval letter are adhered to.

The ARC recommends Homeowners retain an electronic copy of the ARC Application

approval letter for a minimum of five (5) years.

5.3 ARC Application Rejection

An ARC Application may be rejected by the ARC for the following reasons:

• Application is incomplete (i.e., it does not contain the required attachments as noted in the Appendix specific to the project)

• Handwriting on form is unreadable (i.e., illegible)

• Proposed design does not comply with the requirements contained herein.

In the event an ARC Application is rejected, the Homeowner will be notified by email and/or

USPS mail. The reason for the rejection will be noted.

The Homeowner may resolve the rejection by resubmitting the ARC Application to:

• Provide the information that may have been omitted

• Clarify unreadable (i.e., illegible) handwriting

• Make design adjustments to comply with requirements contained herein

The Homeowner may also request a meeting with the ARC to review the reasons for the

rejection. The Homeowner is encouraged to communicate with the ARC to resolve the

rejection. ARC member contact information is located on the ARC homepage here.

5.4 ARC Application Denial

An ARC Application denial occurs when the ARC and the Homeowner are unable to reach

an agreement to resolve a rejected ARC Application as noted in Section 5.3 above. In this

case, the ARC will notify the Homeowner by email and/or USPS mail that the Application

has been denied. Further, in the event the ARC fails to approve or disapprove an ARC

Application submitted, or to request additional information within 45 days (30 days for new

construction) after submission thereof, the ARC Application shall be deemed denied.

Upon receipt of the denial notification, the Homeowner may present the denial to the

Property Manager and request time at the monthly BOD meeting for the BOD to review the

denied ARC Application. The Homeowner may only request time at the HOA meeting if their

ARC Application has been denied by the ARC. A rejected ARC Application does not qualify

for time at the monthly HOA meeting.

After reviewing the Homeowners case, the BOD will notify the ARC of their decision. The

ARC will notify the Homeowner by email and/or USPS mail of this final decision. In the event

of a denial, the Homeowner may NOT proceed with the work. If the BOD approves the ARC

Application, the Homeowner must comply with any stipulations from the BOD before

proceeding with work.

6 PROJECT INSPECTIONS

Inspection by one or more ARC members is required for completed projects before a deposit

will be returned. If the inspection confirms the completed work meets the ARC requirements

contained herein and all stipulations on the ARC Application approval have been met, the

deposit will be returned. If any deficiencies are noted, the Homeowner must correct the

deficient work before the deposit will be returned.

It is the Homeowners responsibility to notify the ARC when the work has been completed

and is ready for inspection or re-inspection.

For projects that do not require a deposit, ARC members are available to perform

inspections at the request of the Homeowner.

The Property Manager has the authority to request the ARC to conduct an inspection.

7 PROFESSIONAL SERVICES

The ARC may employ the services of consultants to render professional advice for ARC

Application reviews and charge the cost back to the Homeowner. The Homeowner will be

notified in advance of any costs involved and may elect to withdraw or amend their ARC

Application to avoid such costs.

8 PROJECT COMPLETION

Homeowners are required to advise the ARC when their project has been completed and to

provide “after” photos of the finished project. The “after” photos may be sent to:

ARC Application Form

Lot Survey or Plot Plan

A lot survey or plot plan showing the proposed location of the pool, the pool deck, and associated equipment (e.g., pump, filter, heater, piping manifolds, etc.) relative to any easement borders or setback lines must be included with the ARC Application.

Deposit A $2,000 deposit payable to the HOA must accompany the ARC Application submittal.

The deposit must be presented in the form of a check with “Pool Installation Deposit” written on the check.

Access via HOA or MUD 355 Property

If use of HOA or MUD 355 property is needed to access the area on the Homeowner’s property for the pool installation, then a request for such access must be included in the ARC Application.

If damage occurs to the HOA or MUD 355 property during the access, then it is the Homeowner’s responsibility to restore (to the satisfaction of the HOA or MUD 355, as the case may be) the property to its original condition.

The remediation plan must be reviewed and approved by the HOA or MUD 355, as the case may be, prior to commencement of any restoration work.

The Homeowner has the option to allow the HOA or MUD 355, as the case may be, to perform the remediation work and reimburse them for any expenses incurred if they so choose.

“Before” Photos

A set of photos of the area where the pool installation is proposed must accompany the ARC Application.

“After” Photos A set of photos of the completed pool installation project must be provided to the ARC upon completion of the project.

Good Neighbor Policy

The Homeowner must:

• advise the affected neighbor(s) of the pool installation

• allow affected neighbor(s) two (2) weeks to review any documents or drawings

• address and resolve any differences

NOTE: The ARC Application may be delayed if affected neighbors object to the pool installation.

Drainage Plan A drainage plan drawing must be submitted in PDF format. This drawing must show how the pool filter discharge line and pool deck drain lines are tied into the drain line going to the street.

Piping Pressure Test

The pool installation Contractor must pressure test all in-ground piping prior to pouring the deck concrete or installing deck tiles.

Variable Speed Pump

The Homeowner is required by the HOA and City of Houston to install a low noise variable speed pump.

Noise Control If neighbors complain of noise coming from the pool filtering and pumping system, the Homeowner is required to soundproof the pool equipment and piping to reduce noise.

Large radius elbows must be installed on piping near the pool pump(s) to reduce noise due water flow through the piping.

Protective Fencing

During the pool construction, permanent fencing may be taken down to allow for equipment access. However, a protective fence must be in place around the construction area during construction to prevent entry (humans or animals) into the construction area.

The Homeowner must ensure that any access gates to the pool construction area are always securely closed after construction hours (i.e., nights, weekends, and holidays).

Pool Fence Gate(s)

The gate for the pool fence must be installed and maintained in accordance with the City of Houston requirements. The City of Houston and HOA require child proof locks to prevent children from entering the pool area without an adult.

Easements Easements are restrictions placed on real estate to provide a specific use, such as service of utilities, or drainage across a lot.

The ARC will not approve a swimming pool installation when any section of the pool shell is within an easement area.

Pool Equipment

Pool equipment must be screened from view from the street, adjacent lots, and the lakes upon adjacent HOA common area (“Lakes”).

Water Runoff Texas State Law prohibits the alteration of the natural flow of surface water such that it impacts an adjacent property, i.e., swimming pool addition must not result in water overflow onto adjacent property.

Fiberglass Pools

Single piece in-ground fiberglass pools are not allowed in LOP.

Above Ground Pools

Temporary or permanent above ground pools are NOT allowed in LOP. This prohibition does not apply to occasional use of blow up or “kiddie” pools.

The style and color must be evaluated by the ARC to ensure uniformity with LOP architectural style.

Metal roofs and aluminum roofs are allowed on lower level roofs.

Anti-Fungal Requirement

Roof shingles must have anti-fungal capability.

Roof shingles without anti-fungal capability are prohibited.

Rotten Facia Boards

Any rotted material on fascia boards or eves must be replaced at the time of roof replacement.

Drip Edge or Edge Strip

For roofs with shingles, an aluminum drip edge or edge strip is required to support the edge of shingle to allow it to hang over the edge of the fascia board. Refer to Figure A.2.8.

Painting of Roof Vents

All roof vents (e.g., ridge vents, plumbing vents, hood vents, wind turbines, etc.) must be painted to match the color of the roof shingles or tiles. Refer to Figure A.2.2 and A.2.3.

Animal Intrusion Screens

Any screens that are installed to prevent animals from entering the attic must be painted the same color as the new roof material.

Magnetic Sweeps

Magnetic sweeps must be used daily to check and remove nails, screws, and other construction debris from the surrounding area (e.g., driveway, yard, street, etc.). Refer to Figure A.2.6.

Satellite Dishes

Any non-functioning satellite dishes, mounting brackets or cables must be removed from the roof at the time of roof replacement.

Solar Powered Roof Vents

Solar powered roof vents can be used to exhaust hot air from the attic air space; however, the installation must comply with the following:

• The vent hood must be painted with a color that matches the color of the new roofing.

• The solar panel width/length cannot be greater than the maximum diameter of the hood vent.

• The solar panel must be secured to the vent hood such that it will withstand hurricane force winds.

Refer to Figures A.2.4 and A.2.5.

Lightning Arrestors

Lightning arrestors may be installed on chimneys or roof ridges only. Refer to Figure A.2.7

The grounding cable for connecting and grounding the lightning arrestors must be secured along the roof ridges and valleys and may not be routed across an open roof area.

The grounding cable must be routed down the side of the house in an area not visible from the street or Lake walkway.

RECOMMENDATIONS (ROOF REPLACEMENT)

Ridge Vents Ridge vents are recommended as an alternative to wind turbines.

REQUIREMENTS

General Requirements

Refer to Section 3 of this document for applicable general requirements (e.g., safety, material storage, waste management, construction hours, parking, etc.).

Concrete Thickness

The replacement concrete must be a minimum of 4inches thick.

At the transition from curb to driveway, the concrete should be a minimum of 5 inches thick.

At the transition from the driveway to the garage, the minimum thickness should be 6 inches.

Concrete Strength

The concrete must have at least a 3,000-psi compressive strength at 30 days. The concrete must have rebar installed on 2-inch-high plastic rebar chairs.

Driveway Dowelling

The driveway slab must be dowelled into the street slab on 24-inch centers and dowelled into the house grade beam on 24-inch centers. The dowels are to be drilled and glued into the street slab and house grade beam.

Driveway Sand Base

A minimum 2-inch thickness of sand must be installed as a base for the concrete driveway slabs.

Expansion Joints

Expansion joints must be included in the driveway design. For new construction, treated wood can be installed as the expansion joint material.

Sometimes the concrete driveway structure is perfectly sound, but the wooden expansion joints have rotted away leaving a 1 inch to 1-1/2-inch-wide gap.

This gap should be filled in with an elastomeric product that will fill the gap and prevent water from entering the expansion joint.

Concrete Driveway Width Increase

Due to color and texture difference in old vs new concrete, the ARC will NOT approve a driveway width increase by simply adding strips on each side of the driveway.

However, ARC approval to widen in this manner may be achieved if both surfaces are recoated so that the entire surface is consistent in color and texture for both the new and old sections.

The new sections of the driveway must be structurally integrated into the existing concrete driveway by the proper installation of dowels at least every 12 inches and the installation of rebar.

Brick Paver Driveway Width Increase

Due to color differences between old and new pavers, the ARC will NOT approve a simple add-on to increase driveway width.

To gain approval, the old brick pavers must be removed, and a wider base created so that new brick pavers can be installed throughout the new driveway.

Pressure Washing

Upon completion of the project, the Homeowner must pressure wash the driveway and street area in front of the driveway. Debris must not be washed down into the street storm sewer. Instead, the debris must be properly disposed.

RECOMMENDATION

Replacing Concrete Driveway with Brick

Homeowners are encouraged to consider replacing cracked or heaved concrete driveways with brick paver driveways. The settlement and heaving of the concrete driveway are most likely due to the use of “fill soil” used to bring the soil grade to the design elevations.

With time, the soil may have settled between one (1) and four (4) inches due to the settlement of "fill soil", drought conditions, and tree roots removing the water in the soil below the driveway slabs. Although a brick paver driveway is more expensive than a concrete driveway, it allows the Homeowner a cost-effective way to relevel the driveway in the future.

Color Limit LOP has a two (2) color limit, (i.e., no more than two different colors are allowed on any house: (e.g., one color for the house base color and a different trim color). Color of downspouts / gutters must match the approved base or trim color.

A third color is allowed for houses with accent beam ends, corbels, or shutters. Refer to Figure A.4.1.

Paint Quality Paint must be a high-quality paint that will help reduce or eliminate mold growth, mildew and powdering of the paint.

For stucco façade homes, an elastomeric paint that is mold, mildew and fade resistant (e.g., Sherwin Williams “Sherlastic” paint, etc.) may be helpful.

The addition of a mold/mildew prevention additive to the paint may be helpful (e.g., Add-2 Prevent Mildew Mildewcide Additive, etc.).

Dark Colors Dark colors that contrast with the LOP style / neighborhood are prohibited.

Paint Spray Spraying of paint is prohibited on windy days. The Homeowner is responsible for correcting any overspray on a neighbor’s house or property.

Paint must be “rolled” in areas where the houses are close together.

Disposal Disposal of paint / paint wash down into LOP storm drains is strictly prohibited.

Failure of the Homeowner or their Contractor to observe this requirement will result in a $500 fine to the Homeowner.

Roof Vents All roof vents (e.g., ridge vents, plumbing vents, hood vents, wind turbines, etc.) must be painted to match the color of the roof shingles or tiles.

Brick Houses Painting of brick houses in LOP is allowed. Approval of such must comply with the house painting requirements noted in this Appendix.

The deposit must be presented in the form of a check with “House (or Room) Addition Deposit” (or “Foundation Repair Deposit”, if appropriate) written on the check.

House Drawings

For house or room additions, structural drawings of the house which include elevation and plan views showing the new addition must be included with the ARC Application.

If the proposed modification or addition has a roof, include an elevation drawing showing how the structure will look from a side and rear view.

Foundation Plan Drawing

A detailed structural foundation drawing of the existing foundation house foundation and for the addition or repair must be included with the ARC Application. This drawing(s) must include the slab, grade beams, and piers beneath the grade beam.

For additions, the new addition must be structurally dowelled into the existing foundation. The dowel installation plan must be shown in detail on the foundation drawing(s).

Stamped Drawings

All structural drawings must be reviewed and stamped by a licensed structural engineer for the State of Texas.

Drainage Plan

For a house or room addition, a drainage plan showing the new gutters and downspouts and their connection to a buried drain line must be included with the ARC Application. The drain line must flow to the street.

“Before” Photos

A set of “before” photos showing the location of the proposed addition or foundation repair in its current state must be submitted with the ARC Application.

REQUIREMENTS (HOUSE or ROOM ADDITION / FOUNDATION REPAIR)

General Requirements

Good Neighbor Policy (House or Room Addition only)

The Homeowner must:

• advise the affected neighbor(s) of the addition

• allow affected neighbor(s) two (2) weeks to review any documents or drawings

• address and resolve any differences

NOTE: The ARC Application may be delayed if affected neighbors object to the house or room addition.

Foundation for Addition

The slab of the addition must be supported by grade beam(s) and pier(s) beneath the grade beam(s) even if the house utilizes a post tension slab design. The grade beam and piers must match the dimensions of the primary foundation, (i.e., the piers must be installed to the same depth as the existing house piers).

Some houses in LOP were constructed utilizing a post tension slab design. In this case, the grade beam(s) and pier(s) for the addition should utilize the pier depth of adjacent houses if that information is available and documented. Pier depths in may vary from 8 to 12 feet depending on the precise location of the home within LOP.

Piers are required due to the gumbo type soil present within LOP in the top four feet of depth. Many lots had fill dirt from lake construction added to provide slope for drainage control on the lot. The piers for the addition must be deep enough to avoid the fill and gumbo type of soil to have adequate bearing support.

See Figure A.8.1.

Stucco Homes

The new addition stucco must match the texture and details of the existing house stucco.

The stucco trim around the windows and doors of the new addition must match the trim style and design of the existing house.

A note should be placed on the drawings to indicate that the color and texture of new addition must match existing house texture and color.

Roof Tiles or Shingles

Roofs for the new addition must match the existing roof material, style, and pattern of the roof on the existing house. If the roof is tile, it is often difficult to match the new tile color with the existing tile color. For this situation it may be best to pull up and blend the old and new tiles together in an alternating pattern.

For tile roofs, power washing the existing roof before trying to match the color may be necessary to properly match the color.

Roof Slope New addition roof slopes must be designed and constructed at the same slope as the existing roof slope. A flat roof is not allowed in LOP, except for a balcony roof.

Outdoor Light Fixtures

Outdoor light fixtures of the new addition must match existing external light fixtures to be architecturally consistent.

Water Runoff Texas State Law prohibits the alteration of the natural flow of surface water such that it impacts an adjacent property (i.e., addition must not result in water overflow onto adjacent property).

Window Replacement

Windows for the new addition must match the style and tint color of the existing window colors.

NOTE: Windows for the room or house addition must be submitted as a separate ARC Application. Refer to Appendix A.5

The placement of the windows in the new addition must not disrupt the privacy of the neighbor’s private areas in their backyard. Placement of the new windows will not be allowed if it allows viewing into the neighbor’s swimming pool area.

Walkway Plan

For any proposed walkways added because of the room addition, a plan drawing must be submitted to indicate their location.

View of Lake or Green Areas

The house addition or room must not block a neighbor’s view of the lake or green areas.

New Flood Lights

Any newly installed exterior flood lights must be installed such that the light does not shine into the neighbors’ property.

A concrete pier is required under each balcony column pad for new balconies and for balcony repair work.

Prior to any balcony repair work, the Homeowner must determine whether there is an existing pier beneath each balcony column pad. If no such pier exists, the Homeowner must have a pier installed as part of the repair work.

Each newly installed pier must be installed at the same depth or deeper as the existing piers for the house.

Tubular Steel Columns

If the balcony is not supported by steel columns, then the Homeowner must install steel pipe or structural tubing columns within the wood framed stucco columns. See Figure A..9.2.

The columns must be bolted to the concrete pads. See Figure A.9.3.

In addition, the support beams must be bolted or screwed to the steel columns. Refer to Figure A.9.4.

Flood Lights Any newly installed exterior flood lights must be installed such that the light does NOT shine into the neighbors’ property.

Power Conduits

Refer to Appendix A.10. All exterior electrical conduits for power must be buried or hidden from sight, i.e., they are prohibited from being attached externally to the stucco or brick exterior wall.

Conduits for Power

All exterior electrical conduits for power must be buried or hidden from sight, i.e., they are prohibited from being attached externally to the stucco or brick exterior wall.

Although external conduit and electrical lines may be approved by the City of Houston, they are prohibited by the HOA.

Any electrical conduits that are visible from the street or lake walkways must be removed and/or re-routed underground or through the exterior walls of the house.

See Figure A.10.1 below for an example of an unacceptable electrical conduit installation.

Flood Lights Any newly installed exterior flood lights must be installed such that the light does not shine into the neighbors’ property.

Appendix A.11 – SOLAR ENERGY DEVICE INSTALLATION

DEFINITION AND HOA / ARC DISCRETION

Definition "Solar Energy Device(s)" means a system / series of mechanisms designed primarily to provide heating or cooling or to produce electrical or mechanical power by collecting and transforming solar-generated energy which includes a mechanical or chemical device that has the ability to store solar-generated energy for use in heating, cooling or the production of power.

HOA / ARC Discretion

The ARC normally “approves with stipulations” ARC Applications for Solar Energy Device installation; however, the ARC reserves the right to withhold approval of any Solar Energy Device and associated equipment (mast, frame, brackets, support structure, piping and wiring, etc.) even if it complies with the Requirements herein, if the placement of the device constitutes a condition that substantially interferes with the use and enjoyment of Homeowners (see Good Neighbor Policy below) by causing an unreasonable discomfort or annoyance to persons of ordinary sensibilities.

Confirmation from the supplier or installer that the solar energy device will remain secured to the roof or ground during hurricane force winds must be included in the ARC Application.

The Solar Energy Device and any related equipment (e.g., mast, frame, brackets, support structure, piping, wiring, etc.) must:

• be located to the rear one-half (1/2) of the lot

• not be visible from the frontage street or side streets

• serve only improvements on the particular lot on which it is located unless an alternate location (e.g., roof) increases the estimated annual energy production of the device by more than ten (10) percent (%), as determined by the National Renewable Energy Laboratory publicly available modeling tool.

In such instances, the device and mast shall be placed in the least visible location where an acceptable level of annual energy production is still possible.

• not extend above the roofline of the house or other structure upon which the device is located

• conform to the slope of the roof and have a top edge that is parallel to the roofline

Non-Roof mounted Solar Energy Devices

The Solar Energy Device and associated equipment (e.g., mast, frame, brackets, support structure, piping, wiring, etc.) must:

• not extend above the height of the fence line

• be in a fenced yard or patio owned and maintained by the Homeowner

• not be placed on property owned or maintained by the HOA.

Corrosion Control

The Solar Energy Device hardware must be coated such that corrosion is prevented during the life of the installation.

Advertisement Advertising slogans, logos or illustrations on the Solar Energy Device and associated equipment are prohibited. The inclusion of the Manufacturer logo, printing or instructional illustration which may be included by the Manufacturer of the Solar Energy Device and associated equipment is acceptable.

Security during Installation

The Homeowner is responsible for maintaining continuous fencing security of their property during fence replacement. The Homeowner or a neighbor may have a pool, and to prevent accidental drowning, continuous security must be maintained.

Fence Posts Fence posts can be either 4”x4” treated wood or galvanized round fence post pipe.

The posts must be embedded at least 18” in concrete in the ground.

All posts must be installed in concrete to enable the fence to withstand hurricane force winds.

WOOD FENCES – REQUIREMENTS

Maximum Fence Height

The total height of the replacement fence or new fence, including the baseboard (rot board), must not exceed 7ft. This height is measured from the ground (soil) to the most elevated portion of the fence.

Rot (Base) Board

A 6” or 12” horizontal rot board or baseboard is required and must:

• be treated wood

• have a beveled edge

• be installed level horizontally (i.e., not tilted to the grade) at the base of the fence.

Refer to the Figure A.12.1.

Framing All framing members (e.g., 2” x 4” s, etc.) must be treated wood.

Vertical Fence Boards

Vertical fence boards must be

• cedar wood

• continuously applied to the fence when the fence is visible from the street

• placed on the street side of the framing so that the framing is not visible from the street.

The alternating panel design (i.e., “good neighbor” style) is no longer acceptable when visible from the street.

Screws or Nails

Screws and/or nails used in the fence construction must be anti-corrosive to avoid rusting and staining of the wood.

Fence Painting / Staining

Painting of wood fences is prohibited.

The wood fence may be protected with the application of a clear or light color stain. Staining is recommended for those wood fences visible from the street.

Before staining older fences, the existing fence boards must be pressure washed (water blasted) to restore them to their original appearance.

Limited Replacement of Existing Wood Fences

When replacement of a small section of an existing wood fence (<25% of the total fence length) is warranted due to damage or deterioration, it is permissible to replace the damaged or deteriorated vertical fence boards provided they are pressure washed (water blasted) to remove the faded gray appearance and the entire fence (existing and new) is then coated with a clear or light color stain.

Bracing Any free-standing gazebo or pergola must be properly braced with knee braces or secured with brackets in order withstand hurricane force winds.

Piers For gazebos with heavy tile roofs on a slab, the columns must be supported by piers beneath the columns. The concrete slab edges should be supported with an in-ground grade beam which stiffens the slab.

Hurricane Design

Each member of a lightweight pergola must be anchored and secured to the primary structural framing members in such a way that no member of the structure can blow away in hurricane force winds.

Yard Ornaments

Only one (1) yard ornament (e.g., statue, etc.) is allowed in the front yard and/or side yard(s). A photo or sketch of the proposed ornament must be presented for approval.

Artificial Turf Material

The use of artificial turf in front or side yards is prohibited. The ARC will consider the use of artificial turn in the backyard depending on the application.

• located on an easement

Tree Stumps Tree stumps must be ground to four (4) to six (6) inches below grade.

After grinding, the surface must be leveled to the surrounding elevation to avoid having a mound in the yard.

Within one week of tree removal, the area must be seeded or restored with sod with the same type of grass as grown in the yard.

Tree Replacement or Addition

Trees should be selected to complement the design of the house and landscaping.

All trees should be free of disease, of good habitat and representing the best qualities of their species.

Trees should be selected that can withstand the extremes of climate, soil conditions and winds experienced in the area.

Homeowner must install the tress in a manner generally acceptable to the horticultural practices of the area and which maximizes the chances of survival.

Arborist The ARC recommends that Homeowner utilize a qualified arborist with adequate insurance to remove large trees.

Dumpster must be in good condition (i.e., painted, not rusted).

Dumpster must not leak water or other liquid at any time (i.e., during mobilization, use, or demobilization). Leakage at any time is the responsibility of the Homeowner to mitigate through water blasting or other acceptable method.

Dumpster must be emptied within one (1) week of being filled.

Dumpster must not be overfilled.

Dumpster must be removed from LOP within one (1) week after completion of the project.

Dumpster may not remain on a Homeowner’s property for more than six (6) months.
