Acting Mayor Christensen than mentioned that the assessment roll f'or the waterworks Improvement program was to be prepare d in the immediate f'uture which entailed much detailed work and the council had decided that the f'irm of' Comstock and Davis would be the logical f'irm to complete this taj3k. . Acting Mayor Melf'ord Christensen opened the meeting by announcing the low bidder on the water works improvement 1960- 2 as Sandstrom and Haf'ner. Inc. Motion by Hodges, seconded by Mal­vin, to award the contract f'or water works improvement 1960-2 (laterals in the Pinewood area and Twelve Oaks area) to Sandstrom and Haf'ner. Inc. 4 ayes, motion carried.

Acting Mayor Christensen than mentioned that the assessment roll f'or the waterworks Improvement program was to be prepared in the immediate f'uture which entailed much detailed work and the council had decided that the f'irm of' Comstock and Davis would be the logical f'irm to complete this taj3k.. Motion then made by l1a1vin, seconded by Smith to authorize Comstock and Davis Village Engineers to prepare the assessment roll f'or iTater Proje ct 1960-1 and 1960-2. Cost of' said prepara,tion to be 1 per-cent of' the construction cost. 4 Ayes, motion carried.

Mr. Glen Dawson. a member o~ the Police Commission reported on the activities of that commission. / He stated that the commission had intervie~ed three men for the job as patrolman and after careful d6hsidar~tion; recdmnlended that Mr. Carter Caldwell be hired tot the job as patrolman. Melford Christensen then asked Chief , Robertus it he concurred with the co~is6ionts recommendation and received an , ~ffirmative answer. The question of salary to be paid to Mr' Caldwell was then dis­cussed and Mr. Robertus stated that he thought Hr. Caldwell should start at the same rate as p~evious patrolmen at $75.00 a month, retroactive to june 1st at which time Mr. Caldwell had begun his training with the Hounds View Village Police Force, Motion by Hoiges, sebonded by Malvin to hire Carter Caldwell as police of­fiber at $75.00 per month retroactive to June 1, 1960. 4 ayes, motion carried.

Mr~ Chris Piewhowski, Building Inspector for the village. appeared before the council and reported that he had received an application from a Mr. Theodore 11 . Holsten for building o~ a double bungalow on land zoned class A residential. Mr. Piehowski was instructed to return the application to Mr, Holsten with in­formation that the applicant i:Jould have to apply for rezoning with the Clerk's Office and the application cleared through the Planning Commission in order to build double bungelows in the location desired.

The subject of Northeast Construction building fourplexes instead of duplexes as required in their building permits was again brought to the attention of the council. The Village Attorney, Mr. Meyers, reported that there are only two ways to correct the situation, One was to take them into Justice Court and the other by issuing an injunction against them. The cotincil then instructed the building inspector to take action against the proper parties concerned in Justice Court and see that the permits for duplexes be produced. Motion by Smith, seconded by Christen­sen to instruct the Building Inspector that when court action is brought~ainst the Northeast Counstruction Company (Mr. Donald Babinski) that, Mr~ Babinski be instr~ lcted to produce his permit and plans for the duplexes and the Building Inspector determine whether Mr. Babanski is conforming to the plans or if not. cease ~rom the non~conformance of said plans and that is such is not done by the builder, the council to take action in ~he form of an injunction against the builder. 4 ayes, motion carried.

The question o~ licensing builders in the village was dis­cussed by the council as to what legal work can be carried on by the builder holding a General Contracting License. The council decided that all General Contracting applications should be ohecked fDr lIy the Village Attorney for legality.

Mr. Carl E. G. Larson appeared before the council regarding the zoning of His property which once held a commercial zoning and was changed under the new rezoning. Mr. Larson presented a copy showing the proper zoning of his land by legal methods in 1948, and he mentioned that a former council had rezoned his land to commercial at that time. Mr. Larson was referred to the Plan­ning Commission for investigation of the change in his zoning by that committee.

The subject of cutting weeds and x~xxx~ spraying of nox­i ous weeds in the village was brought to the attention of the council and Mr. Richard Birdsall. ;feed Inspector for tho village. was instructed to start cutting weeds a nd all necessary spraying as required by law.

The subject of t~e purchase of a tractor by the village was discussed which is equipment necessary for cutting weeds on p arks and playgrounds and for the upkeep of village property. ti o tion by Christensen, seconded by Malvin that t h e council a u thorize purchase of the Ford Tractor from Richard Birdsall f' or the sum of ~ 750.00 with the understanding that the equipment Mr. Birdsall has for the tractor be included in the purchase price. 4 ayes, motion carried.

The 'dell Inspector, Mr. Skiba presented a question to the council concerning the construction of new houses on property where the mains and laterals are to be placed. He stated that the council had amended the well ordinance to provide for greater depth of wells but that the builders constructing houses where water will be available, feo1 that where they had to provido deep wells it would be a disadvantage to them when water would be avail­able to these houses in a short time. Mr. Skiba was informed that said builders or persons desiring to build homes on streets to which wat e r would be available shortly, could waive the deep well requirements and construct a shallow XKN well on their pro­perty providing they sign a water hook-up agreement with the vil­lage which includes a provision t h at said builder or owner wi11 hook up with the village water system as soon as it becomes avail­able on that street and to said house. The water hook_up agree­ment will become part of the rocords on file in the county court­house concerning that home.

Clerk Smith read a letter from the Northern States Power Company concerning installation of gas at 5055-5057 and 50-95-5099 Sunnyside Road. Council instructed Clerk to h ve Doputy to call Northern States Power to inform thaem not to install gas at the aforementioned adresses.

Motion by Malvin, seconded by Hodges to a~journ at 10:07 P. M. 4 ayes, motion carried.

On advice of tho Attorney the meeting was againx called to order by the council at 10:17 p. m. to consider the matter of instructing the V~llage Engineer to have the well driller proceed with the construction of the well. The Attorney was instructed to draw up a form for the contractor to sign regarding the well construction to release the village from any damages ".Thich might be incurred by the contractor as a result of this action. 4 ayes, motion carried.

The regular meeting of the Mounds View Village Council and executive staff was called to order by Mayor Allan B. Crane at 8:12 P. M., Monday, June 27, 1960, at the Red Oak School at Sherewood Road and Red Oak Drive.

Mr. Comstock, Villago En$ineer, gave a report concerning the meeting 'lith the Arden Hills Village Engi neer and J .. ttorney regarding thata contract between the Village of Mounds View and l...rden Hills in hooking up t c the J\ rsenal sewer line. He stated that the Arsenal line was now open to allow h rden Hills to hook up and that the Army had allowed Arden Hills to negotiate with other villages to sublet from their contract with the Army. Mr. Comstock stated that the village of Arden Hills did not wish to hook up to the A.rsenal line at the present time but would contr" ct with Mounds View to allow this village to hook up to the line. It was stated that the cost for hooking up and disposal of sewago would cost the villago of Mounds View $1,000.00 per month beginnine at the time of the Km.H~xaK~ contract. It was stated that tho vilage of Mounds View would propably have to sign a contract in tho near future or some other village might take over the contrac t with Arden Hills. He said this was necessary so that the Village of Arden Hills would not jeopnr.dize the terms of tho contract wi~h the Army and lose possession of an outlet on the Arsenl line. Mr. Meyers stated that he was present at the same meeting wi~h Mr. Comstock and concurred with him that this was correct. The Council decided to meet with Mr. Ehlers, the fiscal agent, to see if bonds could be issued for a 5 year period contract which is the period the governL~ent would agree to contract for.

Attorney Meyers then presented the liquor applications to tho council for approval or action. Six for Offsale licenses and four applications for on s ele liquor. Mr. Meyers stated that all ap­plications had been cleared and that none of the applicants had a record of violations during the last five years in accordance with provisions of the liquor law. The following applications were reviewed and action taken t~ereto as follows:

Application of Robert and Rita vlaste. Notion by Crane, se­conded by Hodges to issue an off sale liquor license to said applicants. Crane, Hodges, Malvin, aye; Christensen and Smith, No; motion carried.

The subject of issuance of permits t q the Northeast Construc­tion (Donald Babinski) was again discussed, The Inspectors stated that Mr. Donald Babinski waS to comply with several requirements decided on at the Justice Cour. and that these requirements would be given the Clerk so that a letter could be forwarded to Mr. Babinski for compliance.

It was stated by Attorney Meyers that in accordance with the actio~ on Mr. Donald Babinski, Mr. Babinski has agreed to be cOjperative with every t h in ; required by the village. and that a covenant is to be drawn up and filed with the deed for each of these buildings stating that the buildings will be used for double bungelows only. A set of plans was required for the double bungalows on Sunnyside Ro a d.

At this ~oint Mr. Halvin interjected the thought that IllS long as liquor had been voted int o Mounds View Village and that applications have been received it is the duty of all of us to vote for these applications favorably and that none of the council should deny a right to any of the applicants. No remarks were forthcoming from Smith or Christensen and the business of process­ing the applications proceeded.

Application by Mr. Anthony Donetelle of the Irondale Inn for both off and on sale liquor licenses. Motion by Malvin, se­conded by Hodges" to issue said licenses to said applicant. Hodges, Malvin and Crane, aye; Smith and Christensen; no; motion carried.

Application by 'valter Lazarz of the Meadowbrook Inn for both off and on sale liquor licenses. Hotion by Crane, seconded by Hodges to issue said licenses to said applicant. Malvin, Hodges, Crane, aye; Christensen and Smith, no; motion carried.

Application by Mr. Simon T. Simon for off sale liquor license. Motion by Malvin, seconded by Hodges for issuance o~ said license to applicant. Hodges, Malvin, Crane, aye; Christensen and Smith no, Motion carried.

Application by Hr. and Mrli. Alvin and Ebba Jansen for for on and off sale liquor licenses. Mayor Crane informed Mr. Jansen that in accordance with the ordinance all of the off± sale licenses had been issued and therefore no action could be taken on that application. Mr. Crane then moved, seconded by Hodges not to take action at this time on the application for on sale license due to the reason that applicant's do not have x specified premiseli 5 ayes, motion carried. '

Mr. Jansen stated that he is in the process of selling much of his property for business construction and that was the reason he applied for a liquor license in order to hold a license open for on sale liquor. The council agreed to meet with Mr. Jan sen on THursday night, June 30th to discuss the plans for his prop erty ii~x of the Skyline Motel.

Attorney Heyers g ave a report on and read the ordinance es­tablishing a certificate of Occupancy. This matter tabeled until next meeting for study by the council.

Clerk Smith read a letter from an Attorney for Mr. Ron Voge, concerning the annexing of his property lying in Mounds View village to the village of Blaine. Mr. Meyers instructed to pre­pare a letter to Mr. Voges Attorney denying the annexing of his land in Mounds View and stating that the village would be glad to accept a proposal from him to annex his property on which the Race Track is located back to the village of Mounds View from which it w~s wnce annexed.

Mr. Christensen stated that a meeting had been arranged with Mr. vTallace Groi:; erg to discuss the two alternative plans given by the Engineer for the village for Mr. Groberg's project on ~ Bronson Drive.

A meeting of the council will be held with the remaining re­creation members on July 5, 1960 at 7:00 P. M. at the village of­fice. Next regular council meeting July 11.

The regular meeting of the Mounds View Village council was called to order by Mayor Allan ~. Crane at 8:03 P. M., Mond~, Ju~ 11, 1960, at the Red Oak School,Red Oak Drive and Sherewood Road.

A petition was presented to the council by James W. Gibson petitioning the council to hold a hearing on the extension of water mains in the West 1/2 of Section 7 of the village. Motion by Malvin Seconded by Hodges to accept the petition for referral to the Village Engineer and for a report at the next meeting. 5 ~es, motion carried.

Motion by Christensen, seconded by Bodges to accept the minutes of M~ 23rd without reading as the council has had time to to study the minutes. An addition was given to the minutes by Clerk Smith that the recreation Committee had suspended their operations on May 23rd due to the fact that there were descrepancies between the Clerk's records and the Recreation Committee's reeords and the fact that the recreation ordinance had not bem given approval by the council. Christensen also aided a change on page 3 concerning the size of the water line which should read an 18 inch line instead of 8 inch line. Upon call of roll the motion, addition and change in the mimtes received 5 8\V'es for approval, motion carried.

Clerk Smith read the minutes of the meeting of May 25th, 1960. Correc­tion made changing the dq of the meeting from Monday to Wednesd~. Motton by Christensen seconded by Hodges to approve the minutes of May 25th as corrected. 5 ~es, motion carried.

Mr. 1nga Haug, Secretary of the- Planning Commission, read the minutes of the Planning Commission meeting. A discussion was held on the subject of a setback variance for the building of a garage at 5046 Longview Drive by Richard S. lohnson. Trustee Christensen suggested and the council co~ curred that the Secretary of the Planning Commission write a letter to Mr. Johnson stating what is required of him before the variance can be considered.

The subject of the open ditch located off Lambert Street on the play­gound in that area was discussed in order to develop that playground without being divided by the ditch. Referred to the Engineer for investigation and report. '

A discussion was held concerning the subject of a county park in the northwest corner of the county which could concievably be in Mounds View. A study of this park site to be made by the Planning Commission.

A request for subdivision by Mr. Frederick Meckola was brought to the council and referred to the Planning Commission for study and action. Clerkls office to Call Mr. Meckola and Obtain three more copies of his plat plan.

The council was informed . that the next IIe eting of the Planning Com­mission would be Ju~ 26, 1960.

Mr. Kenneth Ballenger, Civil Defense Director, reported on the work of the Civil Defense Unit. He ' stated that the Civil Defense Rescue truck was being readied for service so that it could be placed in service in the near future.

Mr. Robert Eickstadt, Chairman of the Police Commtssion read the mont~ Police report which will be placed on file in the Clerk's Office.

A report was given by the Village Engineer regarding the waterworks construction. It was also mentioned that the plans for the sewer system was near completion aqd that the decision remaining was one of locating the outlet for the sewer. Mayor Crane announced that there will be an informal discussion meeting of the Council on July 18, 1960 at 7:00 p. m. in the village office.

It was also announced that the next regular meeting would be Monday, Ju11 25. 1960 at 8:00 p. m. at the Red Oak School.

An Ordinance was given to the council for study amending the well ordinance. Mr. Meyers, Village Attorney stated that basically the changes are that all commercial wells in the Vil­lage shall comply with the Minnesota State Department of Health add Public "Hater supply requirements. This would ammend the last two pages of the well ordinance.

The subject of vacations for village employees was again brought to the attention of the council and that several reso­lutions had been prepared for this purpose. Motion by Christensen seconded by Crane to accept ~he general vacation &x Resolution subject "A RESOLUTION PROVIDING FOR VACATIONS FOR THE EMPLOYEES OF THE VILLAGE OF MOUNDS VIE"'i'l". 5 ayes, motion carried.

Motion by Crane seconded by Malvin, that Grabowski, Rustad and Slifer be granted two wee1ts vacation "lith pay. 5 ayes, motion carried.

Motion by Hodges seconded by Malvin that Patrolman Pierce be granted XXB Two weeks vacation with pay. Motion amend­ed by Christensen that Pierce be granted one wmek with pay and one week without pay due to the short time of service with the Police Force.

Clerk Smith explained that the meeting had been called in order to pay a claim on the village by Lametti and Sons for work on the water project. Smith explained that the check approved at the meeting of July 25th was only part payment and that the check he presented at this meeting was part of the full amount w1il.ich was overlooked ",hen p resented to tho Clerk's office for payment.

Mayor Orane then moved that Walter Skiba be appointed Chief Fire Marshall and Gordon Ha:tslund be appointed as Assistant Fire Marshall for the village. Motion seconded by Christensen. Smith and Malvin then pointed out that Mr. Skiba had quite a lot of other village work to do at the present time with the waterworks program and as a village inspector and that he ~ not have the time to give to this appointment and the is­suance of burning permits. Mr, Skiba who was present at the meeting then agreed to tr,y the job and stated that he would notify the council if it was necessary to give it up because of interference with other necessar,y village work. Upon call of roll all members voted ~e; motion carried.

The Transient Peddler1s Ordinance was discussed and tabeled until the next meeting.

Mayor Crane announced that a meeting would be held at 1:00 P. M., Saturd~, July .30, 1960, at the village office to form an Industrial Comndttee, and that anyone interested in serving on this committee was welcome to attend this meeting.

O 'L~0063 The possibility of preparing a weed ordinance requiring the cutting of

weeds on private property was again discussed. The Village A»torney stated the Village could cut weeds on private property and add the cost of cutting to the tax rolls for the property concerned. The council decided that any complaint received by the village would be investigated and the party con­cerned allowing weeds to grow on his property wbere neighbors consider it a nuisance would be requested to cut his weeds and if not so done" the party would be informed that the village would do so and add the cost to the tax rolls for t~t property.

The purchase of property on Woodcrest Avenue between Brighton Lane and Sunnyside Road for playground purposes was discussed. Village Attorney and Trustee Hodges to investigate the possible purchase of this land and report at a future meeting.

A meeting between the Attorney for JOhft Robertus and the village council was discussed as per request from said attorney. Said meeting decided to be held on '!fednesd~, July 27th, 1960 at. 7:00 P. 14. Meeting with the Village Engineer to be held the same evening at 8:00 P. M. tm discuss the waterworks construction~

A report was given by Mr. Lester Knutson from the firm of Comstock and DaVis, Village Engineers, concerning the waterworks construction and possible addition of the laterals requested in the petitions received from the Xnollwood area and Laport Drive. Further information on the petitions and program to be given to the council and discussed at length with the Engineers at the meeting on Wednesd~ night, July 27th.

Attorney Meyers read the Water Hookup Agreement which will be used between the village and interested property owners who must construct shallow wells before village water is available. The council discussed and agreed that anyone building new homes who wish to build a shallow well must enter into this agreement with the village or adhere to the building code requiring deep wells.

A request for a temporary building to be erected by Mr. Donnetelli for use as a storehouse for liquor and other storage for approximately three months was discussed by the council. It was the general feeling of the coun­cil that such building should not be allowed as the precedence set would allow others to build under the same circumstances thus attracting erratic building in the village.

The cronstruction of gas mains and service to the homes in the village was again discussed by the council. Clerk Smith stated that he had received the addresses of three gas companies from the village engineer, to which he had written letters asking that a representative of each of the companies meet with the council in order that the council could arrange for the best possible franchise for the residents of the village.
