The Right to Information Act, 2005 of Government of India. The Right to Information Act, 2005 of the Government of India has come into force on 15th June, 2005. As per Section 4(b) of these Acts, every public authority/competent authority has to publish the information on the points specified therein. Accordingly, the information pertaining to the organisation, functions and duties of Mumbai Metropolitan Region Development Authority (MMRDA) is given below: - (1) Particulars of the organisation, functions and duties: - 1.1 The Mumbai Metropolitan Region Development Authority is constituted and established under the law of the State Legislature called the Mumbai Metropolitan Region Development Authority Act, 1974 (Maharashtra Act IV of 1975). The Right to Information Act, 2005 of Government of India. The Right to Information Act, 2005 of the Government of India has come into force on 15th June, 2005. The Authority has a three-tired organisation, as depicted in Sections 3, 4A and 7 of the said Act. At the apex is the Authority presided by the Minister of Urban Development, presently the Chief Minister. At the second and intervening tier is the Executive Committee presided by the Chief Secretary to the State Government. The third tier is occupied by the Metropolitan Commissioner assisted by the Joint Metropolitan Commissioner and other officers.

1.3 The main object of the Authority as ordained in Section 12 is to secure the

development of the Mumbai Metropolitan Region (MMR) as defined in the Act. The functions devolving upon the Authority are stated as follows:-

a. review any physical, financial and economical plan; b. review any project or scheme for development which may be proposed or

may be in the course of execution or may be completed in the Metropolitan Region;

c. formulate and sanction for the development of the Metropolitan Region or any part thereof;

d. execute projects and schemes ; e. recommend to the State Government any matter or proposal requiring action

by the State Government or any other authority for the overall development of the Metropolitan Region;

f. participate with any other authority for inter-regional development;

  

g. finance any project or scheme for the development of the Metropolitan Region;

h. co-ordinate execution of the projects or schemes for the development of the Metropolitan Region.

i. supervise or otherwise ensure adequate supervision over the planning and execution of any project or scheme, the expenses of which, in whole or in part, are to be met from the Mumbai Metropolitan Region Development Fund;

j. prepare schemes and advise the concerned authorities in formulating and undertaking schemes for development of agriculture, horticulture, floriculture, forestry, dairy development, poultry farming, piggery, cattle breeding, fisheries and other similar activities.

k. prepare and implement schemes for providing alternative accommodation and for rehabilitation of persons displaced by projects and schemes which provide for such requirements;

l. do all such other acts and things as may be necessary for, or incidental or conducive to, any matters which arise on account of its activity and which are necessary for furtherance of the objects for which the Authority is established.

1.4 These functions are intended to provide for planned and balanced development of the MMR, with co-ordination being woven by the Authority at both the vertical and horizontal levels amongst the local authorities in the Region and the State Government.

1.5 The State Government has, in exercise of its power under Section 40 of the Maharashtra Regional and Town Planning Act, 1966, appointed the Authority to be the Special Planning Authority for four notified areas in Brihan Mumbai (Bandra-Kurla Complex, Backbay Reclamation, Oshiware District Centre, and Uttan-Gorai-Manori area) and one notified area in Kalyan ( Ambernath, Kulgaon-Badlapur and surrounding notified area). The Special Planning Authority propounds the land-use plan geared to the renewal or redevelopment of the notified area and upgrades the urban infrastructure.

1.6 The Govt. of Maharashtra has amended MMRDA Act, 1974 in accordance with Maharashtra Act No.(IV) 1975, on 9th January, 2003, enabling MMRDA to execute the main infrastructure development projects within the territorial limits of Brihanmumbai Municipal Corporation, and to prepare and execute the projects in accordance with Maharashtra Slum Areas (Improvements, Clearance and Redevelopment) Act, 1971. In accordance with these amendments, MMRDA have been conferred some powers.

1.7 The Authority has powers to sanction creation of posts of other officers and servants

subordinate to the Authority.

  

1.8 Powers and functions of the Executive Committee are as under :-

i. Appointment of the staff; ii. Planning and implementation of projects and schemes of the authority,

including approval or rejection of such projects and schemes; iii. Approval or rejection of tenders for projects and schemes of the Authority; iv. Grant of permission or refusal of permission, on behalf of the Authority, under

sub-section (3) of Section 13; v. Investment of surplus moneys of the Mumbai Metropolitan Region

Development Fund; vi. Institution, conduct and withdrawal of any legal proceedings on behalf of the

Authority; vii. The powers (except the power to make regulations) delegated or the

functions or duties imposed, from time to time, on the Executive Committee by the Authority.

(2) Powers and Duties of officers and employees of MMRDA.

2.1 As per Section 4A of the MMRDA Act, the Metropolitan Commissioner is the Chief Executive Officer of the Authority and exercises such powers and performs such functions or duties as the Authority may, by the Resolution passed in this behalf, determine. The Metropolitan Commissioner supervises and controls all its officers and servants, including any officers of Govt. appointed from time to time, on deputation to the Authority or any Committee or body thereof. The Metropolitan Commissioner is responsible for collection of all sums due to the Authority and payment of all sums payable by the Authority. He ensures adequate security of all assets, including cash balances, of the Authority. He is also responsible for performing all executive functions in connection with the works of the Authority.

2.2 As per the amendments made to the MMRDA Act, 1974 in accordance with Maharashtra Act No.(IV), 1975 on 9th January, 2003, for the purpose of preparation and execution of a project or scheme within the territorial limits of Brihanmumbai Municipal Corporation and in accordance with the Maharashtra Slum Areas (Improvements, Clearance and Redevelopment) Act, 1971, the Metropolitan Commissioner is deemed to be the ‘Municipal Commissioner’ and ‘Slum Rehabilitation Authority’.

  

2.3 Next in the hierarchy is the Joint Metropolitan Commissionerand Project Director,

Mumbai Urban Transport Project. Thereafter there are various Divisions in MMRDA as given below which are headed by the respective Chiefs –

1. Finance and Accounts Division headed by the Chief Accounts Officer and Financial Adviser;

2. Engineering Division headed by the Chief Engineer; 3. Transport and Communications Division headed by the Chief, Transport and

Communications Division; 4. Town and Country Planning Division headed by the Chief, Town and Country

Planning Division; 5. Planning Division headed by the Chief, Planning Division.

2.4 As mentioned above, the Metropolitan Commissioner is the Chief Executive Officer of the Authority. In the administrative matters the Metropolitan Commissioner is assisted by the Secretary, Executive Committee and the Personnel Officer. The Chief, Town and Country Planning Division is assisted by Lands Manager, Estate Manager and Marketing Manager.

2.5 MMRDA has taken up two major infrastructure projects viz.(a) the World Bank aided Mumbai Urban Transport Project (MUTP), and (b) the Mumbai Urban Infrastructure Project (MUIP). For MUTP, a Project Management/Monitoring Unit (PMU) has been set up in MMRDA to implement and monitor the resettlement and rehabilitation activities along with co-ordination and monitoring of the transport investment programme under MUTP. The PMU is headed by the Joint Metropolitan Commissioner and Project Director, MUTP, who is assisted by the Chief (R&R), Project Managers and the Joint Project Directors. For implementing the Mumbai Urban Infrastructure Project the funds are provided by MMRDA, Brihanmumbai Municipal Corporation and the Government of Maharashtra.

2.6 The Chiefs of the Division and PMU is assisted by various other senior officers and

staff members. 2.7 Certain administrative powers delegated by the Authority and Executivestate Manager. (3) Procedure followed in the decision making process, including channels of supervision

and accountability.

The projects, schemes and studies to be taken up during the year are included in the Annual Works Programme and Annual Budget, which is submitted to the Authority for approval. If any additional projects/ schemes/studies are required to be taken up during the year, they are taken up and implemented after approval of the Authority/ Executive Committee, and revised budget estimates are submitted to the Authority for approval at year end. For the engineering works, tenders are invited and put up to the Executive Committee for approval if the estimated cost of the work exceeds Rs.50.0 lakhs. Also for the project consultancies approval of the Executive Committee is obtained. After approval of the Authority/Executive Committee further

  

action is taken by the Metropolitan Commissioner according to the authorisation by the Authority/Executive Committee. As mentioned above, certain administrative powers have been delegated by the Authority and the Executive Committee to the Metropolitan Commissioner. In such cases the proposals are submitted to the Metropolitan Commissioner for taking decision in such matters. Further as mentioned in para.2.1 above, the Metropolitan Commissioner supervises and controls all its officers and staff members. The Joint Metropolitan Commissioner as well as Chiefs of respective Division also supervise the work carried out by the respective Division.

(4) Norms set for the discharge of functions.

The schemes and projects incorporated in the Annual Works Programme which are approved by the Authority and Government, are implemented during the year.

(5) Rules, regulations, instructions, manuals and records, held by MMRDA or under

MMRDA’s control or used by its employees for discharging its functions.

The following Rules and Regulations have been made under the provisions of the MMRDA Act –

1. The Mumbai Metropolitan Region Development Authority (Conduct of Business at Meetings) Regulations, 1975.

2. The Mumbai Metropolitan Region Development Authority (Conduct of Business at the Meetings of the Committees) Regulations, 1977.

3. The Mumbai Metropolitan Region Development Authority (Allowances to Members) Regulations, 1979.

(7) Particulars of any arrangement that exists for consultation with or representation

by, the members of the public in relation to the formulation of its policy or administration thereof.

7.1 The MMRDA is a “Special Planning Authority” for Bandra-Kurla Complex, Backbay Reclamation Area, Oshiware District Centre and Ulhasnagar, Ambernath, Kulgaon-Badlapur and surrounding Notified Area. MMRDA has prepared Development Plans for these areas. Prior to carrying out any modification to these Development Plans, as per the Maharashtra Regional & Town Planning Act, 1966, a notice is published in the official gazette as well as in the newspapers inviting objections and suggestions with respect to the proposed modification, and after giving a hearing, the proposed modification is submitted to the State Government for sanction.

7.2 MMRDA has taken up Mumbai Urban Transport Project (MUTP) with a view to improve traffic and transportation situation in the Mumbai Metropolitan Region. This project has been taken up with loan assistance from World Bank. MMRDA is responsible for implementation and monitoring of the resettlement and rehabilitation activities under the MUTP along with co-ordination and monitoring of the transport investment programme under the MUTP. All the eligible families have to be rehabilitated as per the R&R Policy formulated by Govt. of Maharashtra for MUTP. The Non-Governmental Organizations have been appointed for carrying out Baseline Socio-Economic Surveys of the project affected persons (PAPs), preparation of Rehabilitation Action Plans (RAPs) and Community Environmental Management Plans (CEMPs) and providing implementation support. The preparation and implementation of RAPs and CEMPs is done with active participation of the eligible PAPs.

7.3 MMRDA has carried out various studies for project preparation. Public consultation

workshops are held to discuss the findings of the study and to hear to the suggestions of the public in respect of the proposed project.

(8) A statement of the boards, councils, committees and other bodies consisting of two

or more persons constituted as its part or for the purpose of its advise, and as to whether meetings of those boards, councils, committees and other bodies are open to the public, or the minutes of such meetings are accessible for public.

8.1 As per Section 4 of the MMRDA Act, the Metropolitan Authority consists of the

  

following members :-

(i) The Minister for Urban Development; (ii) The Minister for Housing; (iii) The Minister of State for Urban Development; (iv) The Mayor of Mumbai; (v) The Chairman, Standing Committee, Municipal Corporation of Brihan Mumbai; (vi), (vii) and (viii) Three Councillors of the Municipal Corporation of Brihan Mumbai, elected by the Corporation, the election being held by ballot according to the system of proportional representation by means of the single transferable vote. (ix) and (x) Two members of the Maharashtra Legislative Assembly, representing constituencies falling, wholly or partly, within the limits of the Mumbai Metropolitan Region to be nominated by the State Government. (xi) One member of the Maharashtra Legislative Council, to be nominated by the State Government; (xii) The Chief Secretary to the Government of Maharashtra; (xiii) The Municipal Commissioner of the Municipal Corporation of Greater Mumbai; (xiv) The Secretary to the Government of Maharashtra, Urban Development Department; (xv) The Secretary to the Government of Maharashtra, Housing Department; (xvi) The Managing Director, City and Industrial Development Corporation of Maharashtra; (xvii) The Metropolitan Commissioner.

The Minister for Urban Development is the Chairman, and the Metropolitan Commissioner is the Member-Secretary of the Authority.

8.2 As per Section 7 of the MMRDA Act, the Executive Committee of MMRDA consists of the following members :-

(i) The Chief Secretary to Government; (ii) The Metropolitan Commissioner; (iii) The Secretary to Government, Urban Development Department; (iv) The Secretary to Government, Housing Department; (v) The Municipal Commissioner, Mumbai Municipal Corporation; (vi)The Managing Director, City and Industrial Development Corporation of Maharashtra; (vii), (viii) and (ix) Three members who are experts in the field of urban planning and development, to be appointed by the State Government.

The Chief Secretary is the Chairman of the Executive Committee.

8.3 The Authority or the Executive Committee may invite any officer of Government or

local authority to attend its meeting or meetings as a special or permanent invitee for the purpose of assisting or advising it on any matter or matters.

8.4 The meetings of the Authority and the Executive Committee are not open to the

  

public. The minutes of the meetings of the Authority and Executive Committee are also not accessible to public.

8.5 Independent Monitoring Panel for MUTP :-

Independent Monitoring Panel has been set up by the Government of Maharashtra to review the progress of resettlement and rehabilitation activities under Mumbai Urban Transport Project. The composition of the panel is as under:-

8.6 For the projects/studies taken up by MMRDA, certain Committees are set up for advising on technical matters and reviewing the progress. However, such Committees are project-specific and cease to exist after the project/study is completed.
