1 Introduction

1.1 Background

The Government of Karnataka (GoK) is undertaking Karnataka Municipal Reforms Project (KMRP) with the World Bank (WB) loan assistance. The project is implemented by the Urban Development Department through Karnataka Urban Infrastructure Development and Finance Corporation (KUIDFC). The project components are grouped under four categories – two reforms and two investment components:A. Institutional Development & Technical Assistance (TA) Component

(Reforms): This component consists of the following TA studies.

B. Investment Support Component (Investment) This component consists of General Urban Investment Component and Public Health Investment Support.

C. Bangalore Development Component (Investment) C1. Capacity Building SupportC2. Investment Component: This include support to Roads (improvements), Grade Separators, Footpaths and Storm Water DrainageC3. Greater Bangalore Water Supply and Sewerage Project (GBWASP)

D. Project Management Support to KUIDFC (Reforms)

1.2 Proposed Sub-ProjectThe present assignment is concerned with Bangalore Development Component. The Bangalore Mahanagara Palike (BMP) has proposed 138.70 KM of roads for rehabilitation. The sub-project is named Rehabilitation of High/ Medium Density Corridors. The abstract of the roads proposed are given below in Table 1.1.

The above roads are strategic city roads and include the Ring Road, National Highways, State Highways and other PWD Roads.

1.3 Objectives and Scope of Sub-Project

The objectives of the sub-project are as given below:o Improve road safety in the cityo Improve the connectivity to the Ring Road and National Highways

and State Highwayso Rehabilitate the roads requiring improvements

The scope includes the following improvements along the listed roads:o Making the carriageway width uniform (lane multiples)o Strengthening and reconstruction (if any) of the road and CD

structureso Improvements to road geometrics where required with in RoWo Continuous paved footpathso Adequate drainage (tertiary/ shoulder)o Provision of lighting with sensors to achieve required illumination

levelo Enhancement of road safety

1.4 Environmental Assessment KUIDFC has prepared and adopted a Social and Environmental Management Framework (SEMF) for the project. A Sectoral Social and Environmental Assessment (SSEA) was conducted to analyze the wider social and environmental issues in the project. Subsequently, the environmental impacts and mitigation measures were identified for all sub-projects under KMRP. To address the Resettlement and Rehabilitation (R&R) issues, an R&R Policy was also prepared and adopted. The present project Rehabilitation of High/ Medium Density Corridors has been classified as Category Sc (Social) and Ec (Environmental) as per the SEMF. As this is the first year investment programme in BMP under the KMRP and this is first such sub-project of this type under KMRP an Environmental Management Plan is prepared. This opportunity has been used to test and validate the SEMF. As per this the SEMF will be revised. This report also addresses social issues and advises on the necessity of

conducting a social assessment and preparation of a Resettlement Action Plan.

1.5 Sub-Project Clearance RequirementsSince this is only a rehabilitation of existing roads, no clearances are required from the agencies like MoEF, PCB, etc. The proposed roads are not going through any forest lands; hence clearance from Forest Department is not required.Apart from the clearances for overall sub-project works, it is included in the contract documents that the contractors obtain required clearances from various agencies for operating the equipment and carrying out construction. The statutory requirements under which the contractor has to obtain clearances are listed in Annexure 1.1.

2 Impacts Summary

2.1 IntroductionThis section describes various environmental and social impacts the sub-project might cause to the environment.

2.2 Physical ResourcesThe proposed roads are existing roads that are internal to the city and in predominantly plain terrain and no substantial cut-and-fill operations are planned. Hence, there will be no impact on the physiography of the area.

No borrow material will be used as the proposed sub-project is only rehabilitation of the existing roads. Only existing quarries, with the requisite environmental clearances and redevelopment plans, will be used and no new quarries have been proposed.

2.3 Water Resources2.3.1 Surface water resources

There are no surface water sources to be impacted due to the proposed sub-project. These roads do not cut across any water bodies. As per the present proposals of BMP, there are no bridges to be constructed.

The design stage has taken care of the drainage across the sections as part of good engineering practice. The provision of adequately sized cross drainage structures will improve drainage in the vicinity of the proposed roads.

Degradation of water quality can occur during construction stage from increased sediment load into watercourses near the construction site.

The increase in paved impervious surface is likely to cause increased surface runoff along the roadsides. The engineering design includes design of cross drainage structures, which shall take care of the extra flow.

2.3.2 Ground Water Resources

There are no groundwater sources like wells and hand pumps located in the roads proposed for rehabilitation. If any new roads are added at a late stage and ground water sources like hand pumps, if found, will be relocated at suitable locations prior to start of construction in consultation with the community. Therefore, eventually there will not be any impacts due to the proposed widening on ground water resources.

2.4 Air QualityImpacts on air quality during construction stage are due to operation of construction yards, material transport on trucks and fugitive emissions from the construction sites. These are not permanent in nature, but minor, temporary and mitigeatable. Mitigation measures required for avoiding the air quality impacts are presented in the Environmental Management Plan given in Annexure 7.2.

2.5 Noise LevelsWhile keeping in mind that the roads proposed are in a busy city like Bangalore, no significant impact due to noise would be observed. Construction workers will be provided with protection equipment to guard against the noise impacts. The construction activities will be limited to certain duration of the day as agreed with the community and nearby institutions. The noise sensitive areas along the sub-project roads are to be listed in the format given under annexure 7.3. The rehabilitation of road is being taken up in phases. 20% of the roads are being made ready for tendering. The design consultants should fill this format after detailed topographic surveys. As the design of the remaining roads progress, the design consultants have to attach these details to the EMP before attaching the EMP to the tender documents.

2.6 Biological EnvironmentThere are no natural biological habitats nearby the proposed roads. No Reserve Forest areas are located close to the roads proposed. BMP has not proposed any tree cutting. In exceptional cases, BMP might trim some trees, where necessary. Pruning trees is the responsibility of BMP as per the BMP act. As the roads are located with the city and only rehabilitation is proposed, there will not be any significant impacts. However, in case if tree cutting becomes a necessity either along the present 20% of the roads or along the rest, the proposed mitigation measure of planning double the number of trees at locations agreed with the Forest Department will come into effect.

2.7 Social

2.7.1 Resettlement and Rehabilitation

As mentioned earlier, the proposed sub-project rehabilitates the existing roads. There is no land acquisition envisaged. As per the strip maps prepared by the PIU and design consultants and investigations and field visits to these roads, there are no squatters in these portions of the roads. In addition, BMP is initiating the following to in order to make sure that there is no land acquisition and displacement of any type.

Sub-project activities will be limited to within RoW Rehabilitation of the pavement would be restricted to within the

existing carriage way and foot path Rehabilitation/ Strengthening of the carriage way is limited to the

existing width of carriage way. If carriage way is extended then the foot path width is reduced and vice versa. Footpath width will be increased, if the carriage way width is more than the standards, or vice versa.

Trees will not be cut. Pruning is done where necessary. This is one of the statutory duties of BMP for safety.

There will not be any land acquisition, as widening is not proposed. There are some commercial structures which are temporary and

movable in nature along the pavements. These will not be disturbed. The commercial activities along foot paths will not be disturbed. If any

movable structure like the telephone booths or Lidkar (Leather Industries Development Corporation of Karnataka) booths are to be moved during construction, they will be brought back to their original place.

The schematic strip maps with details such as widths, structures, etc. are given in annexure 7.5. As mentioned earlier, only 20% of the roads are surveyed in detail by the design consultants. As the surveys of the remaining roads progress, the design consultants have to attach detailed maps to the EMP before attaching the EMP to the tender documents.

As there is no land acquisition or displacement of people, conducting a social assessment and thereby preparation of a Resettlement Action Plan would not be required.

2.7.2 Cultural Properties

The proposed roads does not pass through any sites of religious, historical, and/or cultural significance.

3 Mitigation Measures

3.1 IntroductionDescription of various mitigation management measures to be taken up during the project life cycle are provided in this chapter. 3.2 Pre-construction stagePrior to the contractor mobilization, the PIU will ensure that an encumbrance free RoW is handed over to enable the start of construction. The pre-construction stage involves mobilization of the contractor, the activities undertaken by the contractor pertaining to the planning of logistics and site preparation necessary for commencing construction activities. The activities include: Joint field verification of EMP by the Engineer and Contractor Modification (if any) of the contract documents by the Engineer. Procurement/ identification of existing construction equipment/

machinery such as crushers, hot mix plants, batching plants and other construction equipment and machinery.

Identification and selection of material sources (quarry and borrow material, water, sand etc).

Selection, design and layout of construction areas, hot mix and batching plants, labour camps etc

Planning traffic diversions and detours including arrangements for temporary land acquisition.

3.3 Construction stageConstruction stage is the most crucial stage in terms of activities that require careful management to avoid environmental impacts. Activities that trigger the need for environmental measures to be followed include: Imbibing environmental principles at all stages of construction as good

engineering practices. Implementation of site-specific mitigation/management measures

suggested Monitoring the quality of environment along the construction sites (as

air, noise, water, soil etc). Monitoring of environmental conditions through approved monitoring

agency

3.4 Operation StageOperation stage actives are to be carried out by the Environmental Cell of the PIU. The activities involved are as follows;

Monitoring of operational performance of the various mitigation measures carried out as a part of the sub-project.

3.5 Other Activities of the PIU

Other than the above mentioned activities PIU has the following activities to be carried out across all stages of the sub-project. Orientation of Implementation agency staff towards project specific

issues of EMP implementation. Training sessions on Social and Environmental Assessment of projects.

The sessions can commence immediately after the completion of the orientation. The agency selected for carrying out the orientation will be responsible for conducting the training sessions.

Conducting studies on issues identified during any stage of sub-project preparation/implementation for mid-course corrections and planning use.

3.6 Table of Mitigation Measures

A table listing the impacts and mitigation measures for the sub-project is given in Annexure 7.2. The table also includes the project phase, where each of the mitigation measures needs to be considered and also indicates the implementation responsibility.

4 Monitoring

4.1 Introduction

The monitoring programme is devised to ensure that the envisaged purpose of the project is achieved and results in the desired benefit to the target population. To ensure effective implementation of the EMP, it is essential that an effective monitoring programme be designed and carried out. Broad objectives of the monitoring programme are: To evaluate the performance of mitigation measures proposed in the

EMP To suggest improvements in the management plans, if required To satisfy the statutory and community obligations To provide feedback on adequacy of EMP

The monitoring programme contains monitoring plan for all performance indicators. Monitoring plan for performance indicators and reporting system is presented in the following sections.

4.2 Performance Indicators

Physical, biological and environmental management components identified as of particular significance in affecting the environment have been suggested as Performance Indicators (PIs). The PIs shall be evaluated under two heads as:

(a)Environmental condition indicators to determine efficacy of environmental management measures in control of air, noise, water and soil pollution;

(b)Environmental management indicators to determine compliance with the suggested environmental management measures

4.3 Monitoring Plans

For each of the environmental components, the monitoring plan specifies the parameters to be monitored; location of the monitoring sites; frequency and duration of monitoring. The monitoring plan also specifies the applicable standards, implementation and supervising responsibilities. The monitoring plan for the various environmental condition indicators of the project in construction is presented in Table 4.2. The details of monitoring locations are presented in Table 4.3.

4.4 Reporting System

Reporting system for the suggested monitoring program operates at two levels as:

(a)Reporting for environmental condition indicators and environmental management indicators

(b)Reporting for operational performance indicators at the PIU level.

Contractor and PIU operate the reporting system for environmental condition and environmental management indicators. The Environmental Cell of PIU will operate the reporting system for environmental management indicators. The PIU will set the targets for each activity envisaged in the EMP beforehand and all reports will be against these targets.

Contractor will report to the Engineer designated by PIU, on the progress of the implementation of environmental conditions and management measures as per the monitoring plans. The PIU in turn report to the WB on a quarterly basis. The quarterly reports of the EMP will form an integral part of the Quarterly Progress Reports that are to be regularly submitted to the Bank. A detailed reporting system for all the Performance Indicators has been developed and is presented in Table 4.1. Reporting formats to be developed will form the basis of monitoring, by the Engineer and/or the Environmental Cell as required. A sample reporing format is enclosed in Annexure 7.4. The details of reporting to be followed for the sub-project are presented in Table 4.4.

In addition to these formats, to ensure that the environmental provisions are included at every activity of the implementation by the contractor, it is suggested that the approval of the environmental personnel of the PIU is required in the Request for application to proceed or other similar reporting formats used by the contractor. These will not only ensure that the environmental provisions are addressed but also link the satisfactory compliance to environmental procedures prior to approval of the Interim Payment Certificate (IPC) by the Engineer. The activities by the contractor that can impact the environment will be identified based on discussions between the Environmental Specialist of the PIU and the Engineer. The decisions will be communicated to the contractor prior to the start of the construction activities.

5 Implementation Arrangements

5.1 Introduction

The BMP is responsible for the implementation of the provisions made within the EMP through the PIU. The PIU has been set up to monitor the construction activities and to assist BMP in implementation. In addition to the monitoring of the implementation of the environmental provisions by the Engineer of the PIU (one engineer in the PIU will be designated as the Engineer for each region), the Environmental Cell (EC) created within the PIU will oversee the effective implementation of the measures suggested. Part time Social and environmental expertise will be outsourced to provide key inputs to the Environmental Cell, especially during the initial stages of project implementation and during audits. The Environmental Cell will include the Environmental Engineer from the PIU and the part-time inputs from the Social and Environmental consultants outsourced. All the AEs in the PIU will be deputed to the field level. The EMP implementation arrangements for the sub-project are summarized in figure 5.1. When necessary, the advice and services of the Forest Department will be requisitions with regard to cutting, planting and protection of trees.

The BMP is in the process of appointing /deputing the members of the Environmental Cell, so that the EC is in place before the start of construction activity.

5.2 Implementation Arrangements

The contractors’ engineers would be primarily ensuring compliance with the EMP. There will not be any supervision consultants. The Engineers in the PIU, in particular the EC, will be monitoring the implementation of the EMP. The contractors’ engineers and the EC will be the people working on the sub-project on the ground. The monthly progress reports which will have information regarding the compliance with the EMP and monitoring details of compliance with EMP will be forwarded to KUIDFC in addition to the WB. KUIDFC will monitor the compliance with SEMF and participate in the audits.

5.3 Orientation of members of the environmental cell

Members of the Environmental Cell and Contractors’ engineers will be trained in social and environmental protection both in theoretical and practical aspects by the outsourced part time social and environmental consultants. While the theoretical aspects will form the bedrock of the orientation programme, it will be the practical site visits and /or hands-on training at project site itself, which will be of direct use to the project. The crux of the orientation will be on the Social and Environmental Assessment, SEMF and the EMP. Though there is no RAP, these members will be sensitized to the requirements of the RAP as well.

Basic orientation required for environmental awareness shall be provided initially and then experts in specific aspects of road-related works who will train the officials regarding the detailed procedures will be identified and procured by the outsourced part time social and environmental consultants. Specific modules customized for the available skill set shall be devised after assessing the capabilities of the members of the Environmental Cell and the requirements of the project. The entire orientation programme would cover basic principles of environmental assessment and management; mitigation plans and programmes, implementation techniques, monitoring methods and tools. The modules designed will be suitable for both upgradation and maintenance components. Specific issues for upgradation and maintenance shall be taken up in separate sessions.

5.4 Integration of EMP with project

Environmental provisions to be implemented in the project are presented as pert of the EMP. A detailed monitoring plan and reporting formats and schedules for ensuring the effective implementation of those measures is suggested as part of the EMP. The environmental measures suggested as part of sub-project broadly falls into the following categories: Management measures that are stand-alone items and can be

implemented by the contractor (as provision of oil interceptors, monitoring of environmental components etc)

Management measures that are to be taken up incidental by the contractor as part of Good Engineering practices (dust suppression during earthworks, slope protection measures etc)

The environmental management measures have to be integrated into the Bid documents. This will be ensured by Providing the EMP as part of the pre-bid documents to the

bidders, By discussing the EMP during Pre-bid meetings and Making the EMP as part of the Bid documents.

The SEA To ensure this, the Design Consultant has to cost these provisions (environmental measures other than good engineering practices) and include these in the overall costs of the sub-project, so that sufficient funds would be available for implementation of these provisions.

6 Budgetary Provisions

6.1 Introduction

Budgetary provisions to be made by the contractor includes all environmental management measures envisaged as part of the EMP. These have to be worked out based by the contractor while bidding. However, the following may be noted.

The mitigation measures suggested are good engineering practices. Hence there is no need for a separate budgetary provision in the estimates.

There are no enhancement measures suggested in the EMP. The EMP will be discussed during the pre-bid meetings. Hence,

the bidders will take this (the cost of putting into practice good engineering practices)into account while bidding. Updated EMP will be provided to all bidders as a part of tender documents.

The design consultants should take the EMP into consideration while working out the sub-projects costs. They should also coordinate with the social and environmental consultants for costing the EMP items, if any, separately.

Location of disposal sites will be finalized prior to completion of the earthworks on any particular section of the road. The Engineer shall approve these disposal sites conforming to the following (a) These are not located within designated forest areas. (b) The dumping does not impact natural drainage courses (c) No endangered/rare flora is impacted by such dumping. (d) Settlements are located at least 1.0km away from the site. (e) Not located 1 Km within any mangrove vegetation/ecologically sensitive areas.

18 Stripping, stocking and preservation of top soil

The topsoil from borrow areas, areas of cutting and areas to be permanently covered will be stripped to a specified depth of 150mm and stored in stockpiles. At least 10% of the temporarily acquired area will be earmarked for storing topsoil. The stockpile will be designed such that the slope does not exceed 1:2 (vertical to horizontal), and the height of the pile is to be restricted to 2m. Stockpiles will not be surcharged or otherwise loaded and multiple handling will be kept to a minimum to ensure that no compaction will occur. The stockpiles will be covered with gunny bags or tarpaulin. It will be ensured by the contractor that the topsoil will not be unnecessarily trafficked either before stripping or when in stockpiles. Such stockpiled topsoil will be returned to cover the disturbed area and cut slopes. The management of topsoil shall be reported regularly to the Engineer.

19 Blasting Except as may be provided in the contract or ordered or authorized by the Engineer, the Contractor will not use explosives. Where the use of explosives is so provided or ordered or authorized, the Contractor will comply with the requirements of the regulations in force besides the law of the land as applicable. All existing highways and roads used by vehicles of the contractor, or any of his sub -contractor or suppliers of materials or plant and similarly roads which are part of the works will be kept clean and clear of all dust/mud or other extraneous materials dropped by such vehicles. 21 Planning Traffic Diversions & Detours

Temporary diversions will be constructed with the approval of the Engineer. Detailed Traffic Control Plans will be prepared and submitted to the Engineer for approval, 5 days prior to commencement of works on any section of road. The traffic control plans shall contain details of temporary diversions, details of arrangements for construction under traffic, details of traffic arrangement after cessation of work each day, safety measures for transport of hazardous material and arrangement of flagmen. Environmental personnel of the Engineer will assess the environmental impacts associated as the loss of vegetation, productive lands and the arrangement for temporary diversion of the land prior to the finalization of diversions and detours. Special consideration will be given to the preparation of the traffic control plan for safety of pedestrians and workers at night.The Contractor will ensure that the diversion/detour is always maintained in running condition, particularly during the monsoon to avoid disruption to traffic flow. He shall inform local community of changes to traffic routes, conditions and pedestrian access arrangements. The temporary traffic detours will be kept free of dust by frequent application of water.

Unless otherwise arranged for by the local sanitary authority, arrangement for disposal of excreta by putting a layer of night soils at the bottom of a permanent tank prepared for the purpose shall be taken up by the contractor. It should be covered with 15 cm layer of waste or refuse and then with a layer of earth for a fortnight (by then it will turn into manure).

23 Operation of construction equipments and vehicles

All vehicles and equipment used for construction will be fitted with exhaust silencers. During routine servicing operations, the effectiveness of exhaust silencers will be checked and if found to be defective will be replaced. Noise limits for construction equipment used in this project (measured at one metre from the edge of the equipment in free field) such as compactors, rollers, front loaders, concrete mixers, cranes (moveable), vibrators and saws will not exceed 75 dB(A), as specified in the Environment (Protection) Rules, 1986Notwithstanding any other conditions of contract, noise level from any item of plant(s) must comply with the relevant legislation for levels of noise emission. The contractor will ensure that the AAQ concentrations at these construction sites are within the acceptable limits of industrial uses in case of hot mix plants and crushers and residential uses around construction camps. Dust screening vegetation will be planted on the edge of the RoW for crushers. Monitoring of the exhaust gases and noise levels will be carried out by the agency identified for Environmental Monitoring for the project.

24 Material Handling at Site

All workers employed on mixing asphaltic material, cement, lime mortars, concrete etc., will be provided with protective footwear and protective goggles. Workers, who are engaged in welding works, would be provided with welder’s protective eye-shields. Workers, engaged in stone breaking activities will be provided with protective goggles and clothing and will be seated at sufficiently safe intervals. The use of any herbicide or other toxic chemical will be strictly in accordance with the manufacturer’s instructions. The Engineer will be given at least 6 working days notice of the proposed use of any herbicide or toxic chemical. A register of all herbicides and other toxic chemicals delivered to the site will be kept and maintained up to date by the Contractor. The register will include the trade name, physical properties and characteristics, chemical ingredients, health and safety hazard information, safe handling and storage procedures, and emergency and first aid procedures for the product.No man below the age of 14 years and no woman will be employed on the work of painting with products containing lead in any form. No paint containing lead or lead products will be used except in the form of paste or readymade paint. 25 Precautionary/Safety Measures During Construction

All relevant provisions of the Factories Act, 1948 and the Building and other Construction Workers (regulation of Employment and Conditions of Service) Act, 1996 will be adhered to. While planning or executing excavations the Contractor will take all adequate precautions against soil erosion as per regulations. Turfing on critical road embankment slopes with grass sods, in accordance with the recommended practice for treatment of embankment slopes for erosion control. The work will be taken up as soon as possible provided the season is favorable for the establishment of sods. Other measures of slope stabilization will include mulching, netting and seeding of batters and drains immediately on completion of earthworks. Dry stone pitching for apron and revetment will be provided for bridges and cross drainage structures.

Silt fencing will be provided around stockpiles at the construction sites close to water bodies. The fencing needs to be provided prior to commencement of earthworks and continue till the stabilization of the embankment slopes, on the particular sub-section of the road. Construction materials containing fine particles will be stored in an enclosure such that sediment-laden water does not drain into nearby watercourses. All discharge standards promulgated under Environmental Protection Act, 1986, will be adhered to. All liquid wastes generated from the site will be disposed off as acceptable to the Engineer.

35 Cutting/Filling of Surface water bodies

Earth works shall be undertaken such that the existing embankments of water bodies are not disturbed. In case of cutting of embankments, the same shall be reconstructed with appropriate slope protection measures and adequate erosion control measures. Filling of surface water bodies will be compensated by digging an equal volume of soil for water storage. Such dug-up soil will be used for spreading as topsoil. Wherever digging is undertaken, the banks will be protected as designed or as approved by the Engineer. The excavation will be carried out in a manner so that the side slopes are no steeper than 1 vertical to 4 horizontal, otherwise slope protection work, as approved by the Engineer will be provided. As far as practicable, and as approved by the Engineer, excavation for replacement of water bodies will be at the closest possible place/location, with respect to the original water body or part thereof consumed by filling.

36 Sub-Base & Base The contractor will take all necessary measures/ precautions to ensure that the execution of works and all associated operations are carried out in conformity with statutory and regulatory environmental requirements. The contractor will plan and provide for remedial measures to be implemented in event of occurrence of emergencies such as spillage of oil or bitumen or chemicals. 38 Mitigation Measures for Noise Sensitive Receptors

Noisy construction operations in residential and sensitive areas (hospitals, schools and religious places) should be restricted between 7.30 a.m. to 6.00 p.m. Preventive maintenance of construction equipment and vehicles would be done to meet emission standards and to keep them with low noise. Provision of ear plugs to operators of heavy machinery and workers in near vicinity. During night, material transport should be uniformly distributed to minimize noise impacts.
