On March 9, 2013, King County Animal Services Officer Shelby Russell issued the Appellant the above described Notice of Violation and Order to comply, which set a $125 civil penalty for violating KCC 11.04.030 A, Unlicensed pet-altered, a $50 civil penalty for violating KCC 11.04.230 B, Animal trespassing on private property. Additionally, a $500 civil penalty was issued for violating KCC 11.04.290, Vicious Animals, and a civil penalty of $50 was issued for violating KCC 11.04.250, Rabies Vaccination required.At the time charges were entered, Whisker City was being remodeled and all records were off site. The shelter manager was not able to provide the records upon request and Officer Shelby Russell was unable to locate the licenses on the KCC website. A neighbor accused one of the shelter's cats of entering her home and biting a 17 year old nephew. It appears that this is the first time a housecat has ever been deemed a vicious animal. This is also the first time a shelter manager has been deemed the "owner" of a shelter cat and charged with housing a vicious animal. The shelter manager appealed the charges and lost on all counts. None of her exhibits or evidence are referenced in the appeal.The "BEFORE THE BOARD OF APPEALS FOR KING COUNTY" document has a number of errors and actually makes statements that were never introduced into evidence. Errors:1."Sergeant Shelby Russell represented King County Animal Services Section."Officer Russell was represented by an attorney.2. "Taylor Haines, a reporting person's son also testified"Tyler Haines is the 17 year old nephew of Kerrin Haines the reporting person. Tyler Haines claims a cat from Whisker City ran into his home and bit him on the wrist. Taylor Haines is Kerrin Haines 18 year old daughter.3."He asked her about rabies shots and the Appellant cut him off". This statement is nowhere in the record and was not said during the hearing.4. "She denied it was her cat that bit him". This statement is nowhere in the record and was not said during the hearing.
