A RESOLUTION OF THE BOARD OF COMMISSIONERSOF THE KEY LARGO WASTEWATER TREATMENTDISTRICT, ESTABLISHING A PROGRAM FOR LOW-FLOW NON-RESIDENTIAL PARCELS REQUIRED TOCONNECT TO A FORCE MAIN; SETTING THEREQUIREMENTS THEREFORE; AND ESTABLISHINGAN EFFECTIVE DATE.

WHEREAS, the Key Largo Wastewater Treatment District ("District") was created asanindependent special district and apublic body corporate and politic by chapter 2002-337, LawsofFlorida, the '̂'Key Largo Wastewater Treatment District Act"'-, and

WHEREAS, the Key Largo Wastewater Treatment District Act became the District'sCharter; and

WHEREAS, the District's powers, functions, and duties are set forth inits Charter and inchapter 189, Florida Statutes, asboth may from time totime be amended; and

WHEREAS, the Charter gives theDistrict the power and duty to plan, develop, purchaseorotherwise acquire, construct, reconstruct, improve, extend, enlarge, equip, repair, maintain,and operate any wastewater management system and facilities within the territorial limits ofthedistrict; and

WHEREAS, theCharter's definition of the District Wastewater Management System("District System") includes any works or equipment necessary for the collection, treatment, anddisposal of sewageand wastewater; and

WHEREAS, the Charter gives theDistrict the power and duty to fix andcollect rates,rentals, fees, andcharges for the use of any District System facilities; and

WHEREAS, in certain portions ofthe District's service area, parcels have been providedwith a pressurized main pipe, Imown asaforce main connection, instead ofa vacuumconnection; and

WHEREAS, there are, in such portions of theDistrict's service area, a number of non-residential parcels that have asingle-building, will require only a single-connection, have beenassigned bytheDistrict notmore than six(6)Equivalent Dwelling Units, andmust connect tothe District's System via a force main connection ("Non-Residential Low-Flow Parcels"); and

WHEREAS, insuch cases, had it been practicable and possible for the District to providea vacuumconnection insteadof a force main connection, those Non-Residential Low-FlowParcels could have been served with a standard vacuum connection; and

WHEREAS, insuch cases, the provision ofa force main connection has significantly anddisproportionately increased the cost for those Non-Residential Low-Flow Parcels to connect to

WHEREAS, the District has determined that itwould be inthe best interests oftheDistrict and its ratepayers to develop a program to assist those Non-Residential Low-Flow _Parcels who, due to circumstances beyond their control, could not be served with astandard gvacuum connection and were instead provided with a force-main connection. «

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERSOF THE KEY LARGO WASTEWATER TREATMENT DISTRICT THAT:

1) The District will make available to the owners ofrecord of qualifying Non-ResidentialLow-Flow Parcels a one-time Discount ("Discount") on the System Development Charge("SDC") applicable to said parcel, which Discount will be the lesser of:

a. Fifteen Thousand ($15,000.00) Dollars, or

b. The actual costof connecting said parcel to District System.

2) In order to qualify for the Discount, owners ofrecord must file an application with theDistrict and must demonstrate to the satisfaction of the District that:

a. The parcel is improved by not more than one (1) structure that generates sewagethat will be managedby the District System.

b. The parcel \vill require not more than one (1) connection to the District Systemand will not require a buffer tank.

c. The parcel has been assigned not more than six (6) Equivalent Dwelling Units bythe District, as computed in accordance with Section 10.02 ofthe District's Rulesand Regulations.

d. The parcel has been provided with a force main connection instead ofavacuumconnection.

3) Ifthe Discount exceeds the outstanding balance ofthe SDC applicable to the parcel, theDistrict shall refund to the owner of record of the Non-Residential Low-Flow Parcel theamount by which the Discount (as calculated above) exceeds the balance ofthe SDC,which refund will bemade in accordance with section 10.16 of theDistrict's Rules andRegulations.

4) In order to receive the Discount, owners ofrecord ofqualifying Non-Residential Low-Flow Parcels:

a. Must have made application to the District for the said Discount within 365 daysfrom the effective date of this resolution.

b. Must have satisfactorily completed the process ofconnecting the said parcel toDistrict System.

5) This resolution shall take effect upon adoption by the Board ofCommissioners.

RICHARD CHANG'S STATEMENT

My mother is the property owner, and she has progressive Alzheimer's disease, so I am helping her. I have brought herpsychological evaluation from 2015, which confirms that she has dementia, in case ifany ofyouwould like to see it.ALL of the rental incomefrom this commercial property has always gone to a Chinese church which my motherfoundedmany years ago. Because of chronic poordonations, the church's and my mother's finances are tight.

A former property manager informed me in 2012that the property needed a sewer connection and that contractorMichael Murphy was already familiar with the situation and would help me. Since at least 2012, Michael Murphy hasbeen speaking with KLWTD on our, and othersmall commercial properties, behalf. I have emails which he forwarded tome in 2012, 2013, and 2014 from Rebecca Orozco and Suzi Rubio stating that the KLWTD Board had not yet made anydecisions regarding the pumps needed for the sewer connection or any financial help.

Apparently, the Board did makea decision in August 2015. If any notification was sent to my mother then, itwould havebeen ignored because she has Alzheimer's disease. My sister is now receiving her mail.

The application forms for the Discount Program were first emailed to me by Mr. Murphy in December 2015. However, Ihad no idea howto fill out the blanks. I especially did not knowhowto fill out the the cost of the work. For the next 2months, I sent Mr. Murphy multiple emails requesting the cost of the work so that the application form could be filledout. I have forwarded these emails to you. During this time I also called him multiple times and was able to speak to himtwice onthe phone. He initially told me that he would fill out the forms for us. He then told me, just before the applicationdeadline, that he vwll still having discussions with KLWTD.

Mr. Murphy did not get backto me afterwards until April 2016, when I received a proposal of$48,600 for the work.Because of the very high cost, I contacted you immediately afterwards.

I am asking the KLWTD to kindly make an exception for our late application for the discount program because firstly, theproperty owner, my mother, has progressive Alzheimer's disease, andsecondly, I did make my very best effort tocomply with the deadline.

I did speak to Mr. Murphy a week and a half ago. He said that he was still speaking with theCounty and would send us the completed forms (with all the information filled in) for us to signwhen he was finished. My only minor concern is that the deadline stated on the forms is February10, but I think that they would make an exception ifMr. Murphy is still speaking with them. Couldyou please ask Mr. Murphy about this?
