I. JURISDICTION

These Director's Final Findings and Orders (Orders) are issued to Kevin J. Vaughn.(Respondent) pursuant to the authority vested in the Director of the Ohio Environmental

Protection Agency (Ohio EPA) under Ohio Revised Code (ORC) Chapter 6111. and §3745:01.

II. PARTIES BOUND ..

These Orders shall apply to and be binding upon Respondent and heirs and successorsin interest liable under Ohio law.

'. III. DEFINITIONS

Unless otherwise stated, all terms used in these Orders shall have the same meaning asdefined in ORC Chapter 6111: and the rules promulgated thereunder.

IV. FINDINGS

The Director of Ohio EPA (Director) has determined the following findings:

1. Respondent holds a Wastewater Operator III Certificate No. 3-91-010, issued May20, 1991, Certificate being renewed thereafter.

2. Respondent is the Superintendent of the Village of Millersburg (Village) wastewatertreatment plant (WWTP) in Holmes County, Ohio; Respondent has held thisposition since at least 1993.

3. The Village WWTP has been classified by the Director as a Class II wastewaterworks pursuant to Ohio Administrative C:ode (OAC) Rule 3745-7-04.

4. The Village holds a national pollutant discharge elimination system (NPDES) permitfor the WWTP discharge to Killbuck Creek. This NPDES permit contains effluentlimitations for concentrations of total suspended solids (TSS) and carbonaceousbiochemical oxygen demand (CBOD).

5. From sometime in February 1998 through sometime in August 2000, Respondentsubmitted approximately nineteen (19) monthly operating reports (MORs) whichcontained a total of approximately eighty (80) statements which Respondent knewwere false aod under-reported concentrations C?fTSS and CBOD which Respondentknew concealed the Tact that the WWTP was in viofation of its NPDES permit.

6. For a period in May 2000 and July 2000., Respondent failed to maintain the benchsheets prepared by Village employees at the time that they conducted the testsrequired by the NPDES permit. To conceal NPDES permit violations, Respondentprepared and created a second set of bench sheets that had not been prepared bythe employees who conducted the tests and were not prepared at the time the testswere conducted, in violation of standard testing practices and procedures utilizedat the WWTP.

7. This matter was investigated by a joint task force comprised of the Ohio Bureau ofCriminal Identification and Investigation, Ohio EPA, and the United StatesEnvironmental Protection Agency (US EPA), all members of the Northeast OhioEnvironmental Crimes Task Force.

8. On September 27, 2000, special agents of the US EPA executed a search warrantat the Village WWTP.

9. Also on September 27, 2000, Ohio EPA actively began to supervise theadministration of the WWTP to ensure the results of tests required by the NPDESpermit were reported correctly. For a number of months thereafter, the WWTPreported constant TSS, CBOD, and fecal coliform results that were in violation ofits NPDES permit. .

10. On May 27, 2003, Respondent entered a voluntary plea of guilty to making falsestatements to the Ohio EPA. As part of this plea agreement, a copy of which is

, attached hereto and incorporated as if fully rewritten herein, Respondent has

agreed to waive all right to notice and hearing regarding his wastewater operatorlicense(s), and agreed to not contest, and to withdraw any challenge to, thecancellation of such license(s).

11. On August21, 2003, a criminal judgment was entered against Respondent in UnitedStates District Court, Northern District of Ohio, Eastern Division, Case Number5:03crO0200-001.

12. Pursuant to the judgment in Finding #11, Respondent has been placed on probationfor two (2) years, shall participate in the Home Confinement Program with ElectronicMonitoring for six (6) months, and shall pay a special assessment of $100.00 anda fine of $2,000.00.

13. Pursuant to OAC Rule 3745-7-12, the Director may revoke the certification of anoperator upon a finding that the operator has knowingly or negligently submittedmisleading, inaccurate, or false reports to Ohio EPA.- During the time of revocationthe operator shall not apply for certification.

14. Respondent has knowingly or negligently submitted misleading, inaccurate, or falsereports to Ohio EPA during his employment as Superintendent of the VillageWWTP.

15. Pursuant to OAC Rule 3745-7-12 (E), after the period of ineligibility (revocation) hasexpired, Respondent may apply for examination for certification under OAC Chapter3745-7.

16. The Director has given consideration to, and based his determination on, evidencerelating to the technical feasibility and economic reasonableness of complying withthese Orders and to evidence relating to conditions calculated to result fromcompliance with these Orders, and its relation to the benefits to the people of theState to be derived from such compliance in accomplishing the purposes of ORCChapter 6111.

V. ORDERS

1. Upon the effective date of these Orders, Respondent's Wastewater Operator IIICertificate No. 3-91-010 shall be revoked for five (5) years.

2. Within seven (7) days of the effective date of these Orders, Respondent shallreturn, via certified mail, Wastewater Operator III Certificate No. 3-91-010.

3. After the five (5) year period of revocation has expired, Respondent may apply forexamination for certification under OAC Chapter 3745-7.

VI. TERMINATION .

Respondent's obligations under these Orders shall terminate when Respondent certifiesin writing and demonstrates to the satisfaction of Ohio EPA that Respondent hasperformed all obligations under these Orders and the Chief of Ohio EPA's Division ofDrinking and Ground Waters acknowledges, in writing, the termination of these Orders.If Ohio EPA does not agree that all obligations have been performed, then Ohio EPA willnotify Respondent of the obligations that have not been performed, in which caseRespondent shall have an opportunity to address any such deficiencies and seektermination as described above.

The certification shall contain the following attestation: "I certify that the informationcontained in or accompanying this certification is true, accurate and complete." Thiscertification shall be submitted by Respondent to Ohio EPA and shall be signed by

Respondent.

VII. OTHER CLAIMS

Nothing in these Orders shall constitute or be construed as a release from any claim,cause of action or demand in law or equity against any person, firm, partnership orcorporation, not a party to these Orders, for any liability arising from, or related to, theRespondent's operations at the Village WWTP.

VIII. OTHER APPLICABLE LAWS

All actions required to be taken pursuant to these Orders shall be undertaken in, accordance with the requirements of all applicable local, state, and federal laws and

regulations. These Orders do not waive or compromise the applicability and enforcementof any other statutes or regulations applicable to Respondent.

IX. NOTICE

All documents required to be submitted by Respondent pursuant to these Orders shall beaddressed to:

X. RESERVATION OF RIGHTS

Nothing contained herein shall be construed to prevent Ohio EPA from seeking legal orequitable relief to enforce the terms of these Orders or from taking other administrative,legal or equitable action as deemed appropriate and necessary, including seeking civil oradministrative penalties against the Village for the violations specifically cited in theseOrders. Nothing contained herein shall be construed to prevent Ohio EPA from exercisingits lawful authority to require Respondent to perform additional activities pursuant to ORCChapter 6111. or any other applicable law in the future. Nothing herein shall restrict theright of Respondent to raise any administrative, legal or equitabl~ claim or defense withrespect to such further actions which Ohio EPA may seek to require of Respondent.Nothing in these Orders shall be construed to limit the authority of Ohio EP A to seek relieffor violations not addressed in these Orders.

XI. EFFECTIVE DATE

The effective date of these Orders is the date these Orders are entered into the Ohio EPADirector's journal.
