IMPORTANT ACTIVITIES UNDERTAKEN BY THE LEGAL SERVICES INSTITUTIONS IN THE STATE OF KERALA

INTROUCTION

At the commencement of 2018, KeLSA has initiated several projects which would go a long way in strengthening the liaison with common people, thus facilitating the deserving persons to enjoy the benefits of legal services. Special attention is taken in the case of under trial prisoners with the introduction of Under Trial Review Committee in all the districts. The highlights of the activities during January – March were the new model legal services camps in selected villages, commencement of legal literacy clubs in selected schools as per NALSA guidelines and digitisation of legal services clinics in jails. KeLSA and DLSAs will be involved in the legal services activities with renewed vigor in order to reach more legal aid seekers. Details of legal aid provided are given below.

HIGHLIGHTS OF ACTIVITIES

POCSO ALERT: POCSO ALERT is a project to create legal awareness regarding POSCO Act and JJ Act among stakeholders and for their sensitization. The DLSA Kozhikode has initiated the second phase of the project, to cover more than 21,000 teachers in the district, with approval from KeLSA. The first phase of the project was for police officials.

LEGAL DEBATE: Legal literacy clubs formed by DLSA, Kozhikode in Schools conducted ‘Legal debate’ with the participation of Judicial officer, Police officer, Senior Lawyer and Social workers.

BEGGER FREE AND HUNGER FREE MUNICIPALITY: The DLSA Pathanamthitta in association with the district administration has declared Pathanamthitta Municipality as Hunger Free and Beggar free Municipality as part of NALSA Scheme. This is done by arranging food to all persons in need of it.

CARE (COMPREHENSIVE ACTION FOR RURAL EMPOWERMENT): The Taluk Legal Service Committee, Changanassery, Kanjirappally, Kottayam have successfully completed the first phase of the Scheme ‘CARE’ which was implemented by the District Legal Service Authority, Kottayam.

GOTHRAJYOTHI: This project is for empowerments of tribals. The project envisages visit to tribal families every month by Para Legal Volunteers , organising Lok Adalat/meeting of stakeholders, including government officials every three months , coaching classes for competitive examinations, encouragement to involve them in arts and sports activities to prevent alcohol and drug abuse and organizing visit of tribal students to Government offices, Courts, Collectorate , Scientific institutions etc.

SAHAYATHRASANGAMAM (Seminar on Women Empowerment): In connection with Women’s day, all DLSA have conducted different seminars on women empowerment with participation of judicial officers, Police officers, Excise Officers, Senior Lawyer, Government Pleader and Social workers.

PAEDIATRICT CLINIC ON SUNDAYS: DLSA, Pathanamthitta has started a Sunday clinic for Children at Kennady Chacko Charitable Trust, Pathanamthitta. The programme was arranged as part of NALSA Scheme, 2015 “Child Friendly Legal Services to Children. The Doctors of Indian Academy of Paediatrics arranged a Paediatric Clinic for Children on Sundays protection”. Hon’ble District Judge, Sri.John K Illikkadan inaugurated the programme.

LEGAL SERVICES CAMP AS PER NEW MODULES[1.1.2018 TO 31.3.2018]: 38 Legal Services Camps were conducted during January to March across the state on different themes thereby more than 40,000 persons were benefited. Several requests for service from government departments, complaints etc were resolved in the camps itself. Necessary follow up actions are being taken by the DLSAs in respect of complaints that required follow up action,

SURVEY IN HEALTH SECTOR: On the basis of CARE (comprehensive action for rural empowerment) Para Legal Volunteers have done a survey in health sector of rural people. The study encompassed on the general aspect of hospitals PHC’s, sub centres, palliative care, continuing health care, persons with mental and physical challengers their well being, pension schemes.etc. In the next stage PLV’s will tie up with departments concerned and take up the main issues and violation of public rights.

AWARENESS PROGRAMME ON RIGHTS OF TRANSGENDERS: DLSA, Kottayam conducted 6 such awareness programmes on taluk basis in association with School of Legal Thought Kottayam. All the taluks conducted one awareness programme each in February. In this particular programme the classes were lead by Transgender PLVs on who is a transgender, why they need acceptance, violation of their rights etc.

“NIRANJANA 2018- PROGRAMME FOR TRANSGENDERS :Another important programme during this quarter was the programme for Transgenders by name “Niranjana 2018”. We have 4 PLV who belong to this category. With their help a cultural programme was conducted for TG. A special Adalat for was conducted for Transgenders.

DISTRIBUTION OF AWAS CARD: The Government of Kerala launched Awaz health insurance scheme for Migrant workers in the state. The objective of this scheme is to provide health insurance coverage for Migrant laborers working across the state. This is a first of its kind scheme in the country that is providing health insurance to all migrant laborers. Under the scheme, laborers aged between 18 and 60 are covered. The initiative was officially started on November 25, 2015. It ensures an amount of Rs. 2, 00,000 for the families, on the death of any migrant worker. The Awaz card will be provided to the workers on examining any of their identity proof. DLSAs have conducted several programmes across the state in association with the department of labour for enrolment of migrant labourers in the insurance scheme.

MINI CAMP FOR MIGRANT LABOURS: TLSC, Kottayam conducted a minicamp for migrant labourers residing within Kottayam municipality .The camp set as a mini model of NALSA legal services camp with a core theme. in the pre planning stage para legal volunteers took a survey of particular group and made a blue print of their needs and wants. after the survey TLSC identified 270 migrants without AWAS insurance and other medical needs. TLSC Kottayam arranged a meeting with contractors and labour, excise, police departments and Municipality. The participating departments ensured their full support and financial support..116 migrant workers registered in the camp and all of them got the insurance card and many of them got free medicine and medical checkup.

TRAINING PROGRAMME – SPECIAL JUVENILE POLICE: As part of the ‘Athijeevanam’ DLSA, Pathanamthitta conducted one day training programme for the Special Juvenile Police in the district.

NIRAMAYA INSURANCE CARD FOR DISABLED PERSONS: In connection with the activities of NALSA Scheme, 2015 “Legal Services to the Mentally Ill and Mentally Disabled Persons”, DLSA, Pathanamthitta in association with the Block Panchayat, Kudumbasree and Asha Workers made arrangements to renew the Niramaya Insurance and issue new insurance cover to the disabled persons.

MEDICAL CAMP and LOK ADALAT: DLSA, Thrissur conducted a medical camp and Lok Adalat with the help of Medical College, Thrissur. The Health Department was provided free medicines for the community. In the lok Adalat set up in the camp, apart from other cases, a long pending dispute between the forest department and tribal laborers regarding non payment of wages for the tribals for the work carried out by them under the forest department was settled.

JANASAMBARKAM: DLSA had set up 9 counters for each department. The community members submitted their petitions to departments concerned. Most of the petitions were regarding the APL to BPL conversion of ration card and petitions for financial aid for house building. The Civil supply department and panchayath were given instruction to take up the matter urgently.

SOLACE TO JOSEPHINE: Mrs. Josephine a resident of Valiyathura, Thiruvananthapuram was abandoned by her family and friends. She had availed financial assistance to build a house near the International Airport, Thiruvananthapuram, under the Prime Minister Avas Yojana. The International Airport, Airport Authority of India denied her NOC (No Objection Certificate) as she could not fulfill certain expensive pre-requisites. Consequently the Thiruvananthapuram Corporation denied her building permit. At this juncture, She approached the DLSA Thiruvananthapuram seeking assistance to tackle the predicament. A Para Legal Volunteer, Mr. Akhil, was deputed. As a result of the unrelenting and timely actions of the DLSA the said Josephine was able to get the expensive surveys done at a mean rate and consequently get building permit from Thiruvananthapuram Corporation. This is another instance where DLSA has effectively lent assistance to the under privileged and marginalized sections of our society.

SUPPORT TO 85- YEAR- OLD GRANDMOTHER, WHO WAS ASSAULTED BY THE GRAND DAUGUTER- ACTION TAKEN ON THE BASIS OF A VIDEO CIRCULATED IN SOCIAL MEDIA. TIMELY ACTION HAS HELPED THE FAMILY TO GET SUPPORT FROM VARIOUS AGENCIES INCLUDING GOVERNMENT DEPARTMENTS

The Kannur City Police on 19.03.2018 arrested 39 year old Deepa, a resident of Ayikkara, on the charges of continuous assault on her 85 year old grandmother. With the video of Deepa assaulting her maternal grandmother emerging on social media, the matter came to the notice of Secretary of District Legal Services Authority Kannur. A surprise inspection of the Victim’s residence by a team from DLSA Kannur lead by its Secretary, revealed the pathetic condition of Deepa and her family. Residing in an old shack were five human beings, Deepa, her mother, her maternal grandmother and her two children. They solely depended on welfare pension which the two old women receive once in a while for their livelihood. Poverty coupled with the insecurities and uncertainties gifted by fate had driven Deepa paranoid, it is understood. The entire family was temporarily shifted to a Shelter home. The intervention by the DLSA in the matter brought attention by the general public and other Government Departments. The family now got substantial aid from various agencies including Government Departments.

A CANVAS FOR AWARENESS AND CHANGE

A splash of colours on a large canvas spreading beautiful messages about women empowerment the - District Legal Services Authority, Kannur made a passersby’s day with a massive canvas painting on 8th March 2018 in front of BEM School, Thalassery. Female artists from Thalassery locality and nearby Arts School participated in the programme. The programme was conducted mainly for spreading the messages of women empowerment, motherhood and also to prevent cruelties against women. The participation of women Para Legal Volunteers in the programme made the event very elegant.

WOMAN HELD CAPTIVE IN HER OWN HOUSE-RESCUED The plight of 30 year old lady locked up in her own house would have gone unnoticed, hadn’t the Para Legal Volunteers of Kannur DLSA visited her home for a survey related to the camp for senior citizens held on 25.02.2018. It was the neighbours who spilled the beans to the PLVs and informed them about the lady being locked up in her home where her parents and siblings also reside. The matter was immediately brought to the notice of Secretary of DLSA Kannur, who in turn contacted the Police Department. The Police Officers and PLVs inspected the house to find the unfortunate woman lying on a straw mattress. Victim’s brother claimed that they kept her locked up in the room because she is mentally unsound. Both the victim and her brother were given treatment in a private hospital.

WOMAN ‘CONFINED’ IN DARK ROOM BY HER FAMILY-INTERVENTION BY DISTRICT LEGAL SERVICES AUTHORITY KANNUR, HITS TARGET: 65 year old Devaki @ Devoti was rescued from the locked room of her nephew’s home at Meruvambayi near Koothuparamba. The woman’s ordeal began when her husband passed away 4 years back. With no children to take care of her, her health failing on her and her old age taking its toll, her life turned into utter hell. Physical ailment gifted to her by her old age partially hindered her mobility and she needed help of another for her activities like bathing, dressing or. even using a toilet. District Legal services Authority received a tip off about her plight after a team of women from the Panchayat visited her neighbourhood for collecting plastic waste. As reported by them, the lady was seen gesturing them through a small window of her room in which she was confined. She then pleaded their help and begged them to rescue her. The matter was informed to DLSA Kannur. An enquiry followed and intervention by DLSA was found imperative. A team comprising of Secretary of DLSA Kannur, District Social Justice Officer and Para Legal Volunteers visited the place to find Devaki unwashed, with uncut nails and matted hair lying on her bed drenched in urine. The lady pitifully pleaded them to rescue her. The odour given off by the room was so rank, that it was impossible to stay longer in there. The woman was rescued and admitted in Government Hospital, Koothuparamba with the help and care of One Stop Centre, Koothuparamba. Later on she was shifted to an old age home at Koothuparamba. PROGRAMME FOR CHILDREN: Mobile awareness programme in connection with Zero drop out campaign was done at Vythiri from 01.02.18 to 05.02.18. A peculiar situation is there in this District in which the Students especially the tribal students will stop attending the classes due to various reasons. As a step to protect the rights of children including their right to education, DLSA, Wayanad has started this programme. WELFARE OF FAMILY MEMBER OF PRISONER: With great effort by DLSA the family members of the Prisoner in the Vythiri Sub Jail was able to be traced out and their reunion was a great moment LEGAL LITERACY CLUBS IN SCHOOLS: Legal literacy clubs were started as per the recent guidelines issued by NALSA at the rate of five such clubs in every district. These clubs were provided with computer, furniture, books etc. The purpose of digitisation of legal literacy clubs is to impart legal awareness among students. The clubs will organise workshop, seminar, competitions etc on legal issues under the guidance of District Legal Services Authorities concerned.

HONORARIUM FOR MEDIATORS

Apart from variety of activities across the state like training and refresher programmes for mediators, judicial officers, awareness programmes for lawyers, public and other stake holders, KeLSA could clear arrears of honarairum of mediators up to 31.3.2018. The State Government had allotted Rs 6, 00, 000, 00/-(Six Crore) to pay honorarium to Mediators through Kerala State Legal Services Authority. During the year 2017-18 honorarium to the mediators was paid as per the fee structure approved by the Mediation and Conciliation Project Committee in the year 2014. The Hon’ble Board of Governors, Kerala State Mediation and Conciliation Centre, in the meeting dated 05/02/2018 has resolved to revise the honorarium payable to mediators with effect from 01/04/2018 at par with the new MCPC fee structure – 2015
