Building Consensus for Tax ReformAbout ten years ago, I was elected chairman of the St. Charles
Plan Commission. Part of our task was to make recommendationsto the City Council about amendments to the ordinance that wereproposed from time to time. St. Charles had been engaged in mu-nicipal planning since 1928, but the first true zoning ordinance inSt. Charles was adopted in 1960. It had them been updated on apiecemeal basis in most of the years since. I soon came to the con-clusion that instead of trying to fix the old ordinance, we shouldwrite a whole new one. And in May 2003, I was appointed to chair aCommission that would spend the next three-and-a-half years devel-
oping a new zoning ordinance for St. Charles.
In the beginning, we thought we would finish in about 24 months-but it ended uptaking 40. It was a lot of work, but the end result was worth it. To.this day, I firmly be-lieve that one of the main reasons for our success was that we took our time, sought in-put from all stakeholders (property owners, residents, developers, etc.), listened to allsides of all issues, and built consensus for our proposed new ordinance.
There are some parallels to this experience and to the Illinois Property Tax Code.There have been property taxes in Illinois since its admission to the Union in 1818(remember, property tax law was one of Abraham Lincoln's specialties as a lawyer), butour current law dates primarily to the Revenue Act of 1939-with many, many, manychanges made piecemeal since that time.
Last fall, the state legislature created the Illinois Property Tax Reform and Relief TaskForce. The act that created the task force mandated that it "shall conduct a study of theproperty tax system in Illinois and investigate methods of reducing the reliance on prop-erty taxes and alternative methods of funding." The act also required that the task force"shall submit its findings to the General Assembly no later than January 1, 2010, at whichtime the Task Force is dissolved."
This summer, I had the opportunity to attend one of the Task Force's meetings, and Iwas impressed by their process. They are taking their time, seeking input from all stake-holders of the issue (including the input of the assessment community), listening to allsides of all issues, and building consensus for reforming our property tax system. Theyare also trying to stay on schedule and finish by January 1, 2010 (as my commissionfound out, that can be a tall order).
As legislative and policy chairman for Area One (roughly north of 1-80) of the IllinoisCounty Assessment Officer's Association, I am currently working with my counterparts inother counties to make legislative proposals, including recommendations to the TaskForce. I am hopeful that we will be able to make a positive impact on the work of theTask Force, and help build consensus for a better property tax system for the citizens ofIllinois.

On Saturday, October 18, 2008 the public is invited to the HomeownershipExpo 2008 at East Aurora High School Freshman Center, 5th and Smith in Aurora,Illinois. The Expo will run from 9 a.m. to 3:30 p.m., and the event is free and opento the public.
Home Ownership Expo 2008 is a collaborative partnership of Joseph Corpora-tion, City of Aurora, Kane County, Red Cross and the Aurora Fire Department.
Workshops include "First time Home Buyer", "Maintain and Remodel" and"Protect your Investment". There will also be a Fire Prevention Demonstration andFree Fire Prevention Kits. Exhibitors will include housing related firms, the KaneCounty Treasurer, the Kane County Assessment Office, and other governmentagencies.
The County entities participating as part of the Kane County Board's Help forHomeowners initiative. The Kane County Assessment Office will be on hand to re-view the exemption status of everyone in attendance. At previous clinics, home-owners were found eligible for many exemptions they did not yet receive, includingthe General Homestead Exemption, the Senior Citizen Homestead Exemption, theSenior Citizen Assessment Freeze homestead Exemption, and the Disabled Per-sons Homestead Exemption.
Help for Homeowners does not create any new programs, but is designed tomake homeowners aware of the programs that already exist, such as:
• The Housing Rehabilitation Program, which helps homeowners maintain theirhomes by providing funds to correct code violations and eliminate substandardliving conditions.
• The Emergency Repair Program, which helps homeowners who are facing acrisis home-repair situation.
• The FirstTime Homebuyer Program, which helps make the dream of homeownership a reality.
• Foreclosure Prevention Counseling, which helps Kane County homeowners fac-ing the prospect of defaulting on their mortgage with free counseling and assis-
owner is qualified. If not, the staff will assist the homeowner through the exemp-tion process right there.

Review
The Kane County Board of Review will offereight Property Tax Clinics for Kane County tax-payers this fall. The clinics will:
.Help taxpayers understand how propertytaxes work , including an explanation of re-cent changes in the law.
• Dispel myths about taxes and assess-ments.
Explain the appeal process , and providethe necessary forms and rules for filing ap-peals.
• Provide an opportunity for taxpayers tomake sure they have all homestead ex-emptions to which they are entitled.
The clinics will also include in=formation from the Kane County
's Help for HomeownersBoardinitiative.
The clinic is not a forum to discuss any spe-cific individual assessment; these questionsare best directed to the Assessor of the Town-ship in which the property is located.

In Illinois, the primarymeans that taxpayers arenotified of assessmentchanges is publication in anewspaper of "generalcirculation", and the mainrequirement in choosing anewspaper is its place of
publication.
For the purposes of theproperty tax code, theplace of publication is thelocation where a newspa-per is first made availableto the general public; thislocation can be a news-stand, retail store, vendingbox, delivery point, or amail room where the news-papers are labeled for maildelivery. A newspaper mayhave no more than oneplace of publication.
In selecting a newspaperin which to publish theassessment changes, thestate property tax code hasthe following requirement:
The publication ... shallbe printed in some publicnewspaper or newspaperspublished in the county. Inevery township or assess-

ment district in which thereis published one or morenewspapers of general cir-culation, the list of thattownship shall be publishedin one of the newspapers.(35 ILCS 200/12-10, em-phasis added)
Therefore, only newspa-pers published in KaneCounty (or in a particulartownship) can be consid-ered for publications.

PTAB Rules on Kane County PropertySPRINGFIELD-The Illinois Property Tax
Appeal Board (PTAB) made the followingrulings in September 2008:
12-17-476-004 - Kohl's DepartmentStores, Inc. appealed the 2005 ruling of theKane County Board of Review that placedthe assessment of this Geneva Townshipcommercial property at $2,499,984. Priorto the hearing the parties reached anagreement as to the assessment of thesubject property. The PTAB concurred andruled the correct assessment to be$2,031,985. (Docket 05-02567.001-C-3).
15-05-451-003 - Oberweis Dairy ap-pealed the 2006 ruling of the Kane CountyBoard of Review that placed the assess-ment of this Aurora Township commercialproperty at $411,586. Prior to the hearingthe parties reached an agreement as to theassessment of the subject property. ThePTAB concurred and ruled the correct as-sessment to be $354,094. (Docket 06-01829.001-0-2).
09-36-276-034 - Ohio Avenue LLC ap-pealed the 2006 ruling of the Kane CountyBoard of Review that placed the assess-
ment of this St. Charles Township industrialproperty at $3,005,260. Prior to the hear-ing the parties reached an agreement as tothe assessment of the subject property.The PTAB concurred and ruled the correctassessment to be $2,930,821. (Docket06-01909.001-1-2).
12-17-476-004 - Kohl's DepartmentStores, Inc. appealed the 2006 ruling of theKane County Board of Review that placedthe assessment of this Geneva Townshipcommercial property at $2,683,483. Priorto the hearing the parties reached anagreement as to the assessment of thesubject property. The PTAB concurred andruled the correct assessment to be$2,075,000. (Docket 06-01983.001-C-3).
12-23-380-006 - Robert & BonnieWozniak appealed a 2006 assessment of$132,469 based on a prior year decision ofthe PTAB placing the EAV at $116,557.Based on the prior ruling and a townshipequalization factor of 1.0332, the PTABruled that the correct equalized assessedvalue of the property for 2006 should be$120,426. (Docket 06-02831.001-R-1).

2008 Certification ProgressThe 2008 assessment rolls continue to be processed by the Kane County As-
sessment Office, and more progress is coming with each passing day. As of thiswriting, ten townships have been fully processed, with notices mailed and pub-lished in local newspapers. Four more have recently certified their rolls to the Su-pervisor of Assessments and are in various stages of review. The remaining twotownships are anticipated to be certified within the next ten days.
Once a township's assessment roll has been published, taxpayers have 30days to file a complaint with the Kane County Board of Review. Complaint formsand the Board's Rules of Government are available on the Board's web site atwww.co.kane.il.us soa bor.htm.

September 2008 Production ReportDuring the month of September 2008, the County Assessment Office proc-
essed more than 5,700 documents, bringing the year-to-date total to nearly55,000. Major work in September also included the certification of the assess-ment rolls of four townships to the Board of Review (bringing the year-to-datetotal to eight), and processing the receipt of assessment rolls from an addi-tional six townships.

WHEREAS, the Village of Pingree Grove (the "Village") has heretofore established or will establishSpecial Service Area No. 18 (the "Special Service Area") within the Village; and
WHEREAS, the Special Service Area is for the installation of public improvements madenecessary by development within the village; and
WHEREAS, the Village desires that the County of Kane enter into an intergovernmental agreementto extend, bill, and collect the special tax levied by the Village for the properties in the Village's SpecialService Area with full reimbursement to be made to the County for any and all direct or indirect costsassociated with the billing and collection of the special tax.
