The Van Nuys BID's five-year operational life terminated on December 31, 2003 and no further assessments associated with the Van Nuys BID will be made. The special assessment associated with the Van Nuys BID was being collected by the County of Los Angeles Department of Auditor-Controller through a direct assessment placed on the property tax roles for the 1998/1999 through 2002/2003 tax years. Upon the expiration of the Van Nuys BID there remained unexpended assessment revenue that this Office recently refunded to the assessed property owners located In the Van Nuys BID. The method used to determine the individual refunds adjusted for delinquent accounts and reduced the refunds for those property owners accordingly. Pursuant to the report adopted by the City Council (attached), this correspondence shall serve as this Office's notification to the Department of Auditor-Controller of the expiration of the Van Nuys BID and that all assessments, including delinquent accounts, associated with the Van Nuys BID (Agency Account No. 189.55) are now satisfied. Dear Ms. Linschoten:

The Van Nuys Boulevard Auto Row Property and Business Improvement District (Van Nuys BID) was established for a five-year period pursuant to Section 36600 et seq. of the California Streets and Highways Code and through the Los Angeles City Council's adoption of Ordinance No. 172, 181 on August 18, 1998. The Van Nuys BID's five-year operational life terminated on December 31, 2003 and no further assessments associated with the Van Nuys BID will be made.

The special assessment associated with the Van Nuys BID was being collected by the County of Los Angeles Department of Auditor-Controller through a direct assessment placed on the property tax roles for the 1998/1999 through 2002/2003 tax years. Upon the expiration of the Van Nuys BID there remained unexpended assessment revenue that this Office recently refunded to the assessed property owners located In the Van Nuys BID. The method used to determine the individual refunds adjusted for delinquent accounts and reduced the refunds for those property owners accordingly.

Pursuant to the report adopted by the City Council (attached), this correspondence shall serve as this Office's notification to the Department of Auditor-Controller of the expiration of the Van Nuys BID and that all assessments, including delinquent accounts, associated with the Van Nuys BID (Agency Account No. 189.55) are now satisfied. No further collection activities of any remaining unpaid direct assessments associated with the Van Nuys BID should therefore be made. ·

Attached are the Prior Year Direct Assessment and Current Year Direct Assessment Correction Forms, which identify the subject tax years, the Assessor's Parcel Numbers, the original assessment amounts, and the corrected assessment amounts.

Recommendation for Council action:

DIRECT the City Clerk to the take the necessary actions to properly record the expiration of the Van Nuys BID with the Los Angeles County Department of Auditor-Controller and to notify said Department that all assessments, including delinquent accounts, associated with the Van Nuys BID are now satisfied and to suspend collection activities of any remaining unpaid assessments for the Van Nuys BID.

Fiscal Impact Statement: The City Clerk reports that this action will not impact the General Fund.

Summary:

In a March 2, 2004 report to Council (attached to the Council file}, the City Clerk requests authority to record the expiration of the Van Nuys Boulevard·Auto Row Property BID. Council established the Van Nuys BID on August 18, 1998. The Van Nuys BID did not renew after the end of Its five-year operational period on December 31, 2003 and therefore terminated .by operation of law. No further assessments E!SSociated with the Van Nuys BID will be made. The

The amounts of the individual refunds were determined by first calculating each stakeholders' proportionate share of the Van Nuys BID assessments which were actually expended by the Van Nuys Bl D's managing entity, and then refunding to each stakeholder the assessment amounts (plus accrued interest) which were paid in excess of each stakeholders' proportionate amount expended. This adjusted for delinquent accounts and reduced the refunds for those property owners accordingly.

REGARDING: VAN NUYS BOULEVARD AUTO ROW PROPERTY AND BUSINESS IMPROVEMENT DISTR.ICT CLOSE-OUT PROCEDURE

Honorable Members:

On August 18, 1998 the City Council established the Van Nuys Boulevard Auto Row Property and Business Improvement District (Van Nuys BID), by and through its adoption of Ordinance 172,181 (Council File No. 03-1733). The Van Nuys BID did not renew after the end of its five-year operational period on December 31, 2003 and therefore terminated by operation of law. No further assessments associated with the Van Nuys BID will be made. There remained, however, previously collected and unexpended assessment revenue and accrued interest in the City's possession that needed to be refunded to the Van Nuys BID's stakeholders.

This Office recently completed the necessary refund to the owners of real property located in the Van Nuys BID at the time of the Van Nuys BID's expiration. The amounts of the individual refunds were determined by first calculating each stakeholders' proportionate share of the Van Nuys BID assessments which were actually expended by the Van Nuys BID's managing entity, and then refunding to each stakeholder the assessment amounts (plus accrued interest) which were paid in excess of each stakeholders' proportionate amount expended. This adjusted for delinquent accounts and reduced the refunds for those property owners accordingly. The refund calculation complies with applicable law and City policy, including the requirement to reduce the demand on the Treasury stated in Section 264 of the Los Angeles City Charter, which reads, "No demand upon the Treasury shall be allowed by the Controller in favor of any person or entity indebted to the City without first deducting the amount of the indebtedness, to the extent permitted by law."

Since the special assessment associated with the Van Nuys BID was levied by being placed on the Los Angeles County Assessor Tax Roles, this Office will take the necessary action to properly record the expiration of the Van Nuys BID with the Los Angeles County Department of Auditor-Controller. In addition, this Office will notify the Los Angeles County Department of Auditor-Controller that all assessments, including delinquent accounts, associated with the Van Nuys BID are now satisfied and to suspend collection activities of any remaining unpaid assessments for the Van Nuys BID.

The Ordinance establishing this BID had a duration of five years, beginning January 1, 1999, and is no longer in effect. In order to complete the closeout of the Van Nuys BID, this final report is provided to recognize the Van Nuys BID's expiration and completion and to properly record the expiration of the ~ Van Nuys BID with the Los Angeles County Department of Auditor-Controller. Pursuant to Section 36600 et seq. of the California Streets and Highways Code (the "Act") and the City's interim procedure (CF 02-0941 ), the City Council on August 15, 2003 adopted Ordinance No. 175,434 declaring its intention to modify the District's Management District Plan in a manner described in said ordinance.

B. A public hearing was held this date. At said hearing, the City Council received and considered evidence from persons interested in the proposed modification of the District's Management District Plan, including any written protests against the proposed modifications.

C. There was no majority protest, since the City Council did not receive written protests against the proposed modifications from the owners of real property who are paying fifty percent.or more of the total assessments.

D. The proposed modifications to the Improvement and Activity Plan anq Five Year Operating Budget sections of the District's Management District Plan, as described in Ordinance No. 175,434 are hereby authorized.

Modifications to the Management District Plan. The District's Management District Plan is modified to include changes to the Improvement and Activity Plan and Five Year Operating Budget sections. A copy of the modified Management District Plan is attached hereto as "Attachment 1."

Certification and Publication. The City Clerk shall certify the passage of this Ordinance and have it published in accordance with Council policy, either in a daily newspaper circulated in the City of Los Angeles or by posting for ten days in three public.places in the City of Los Angeles: one copy on the bulletin board located in the Main Street lobby of the City Hall; one copy on the bulletin board located at the ground level at the Los Angeles Street entrance of

Developed by a growing coalition of property and business owners, the Van Nuys Boulevard Auto Row Business Improvement District (BID) is a benefit assessment district proposed to improve and convey special benefits to properties located along the heart of Van Nuys Bou).evard's legendary Auto Row. The BID will provide new improvements and activities, including image enhancement and maintenance programs, beyond those currently provided by the City. This approach has been used successfully in oth~ business districts to reverse negative image, attract new customers and increase sales, occupancies and property values.

n WHY A BID FOR VAN NUYS BOULEVARD? . There are several reasons why now is the right time to form a private sector business improvement district along the Van Nuys Boulevard Auto Row:

1. Improve Van Nuys Boulevard to Better Compete for Customers While Van Nuys Boulevard is historically the center for the San Fernando Valley's automobile shopping and related community activities, we have been challenged by increasing ·competitive pressures in the marketplace. A business improvement district will provide competitive advantages for Van Nuys, allowing us to retain and recapture customers that are attracted to newer automobile-oriented retail areas in Valencia, Glendale or Thousand Oaks. Our ability to attract and expand these markets will help all businesses along the corridor, both auto and non-auto related.

2. Create a Distinct Positive Identity for Van Nuys Boulevard. Nearly two-thirds of BID funds are to be expended on improvements and activities that promote and identify a clear .positive identity for 1he district New signage, banners, events, street beautification and parking enhancements will clearly communicate that Van Nuys Boulevard is back as a premier shopping destinatiqn.

S. Establish Private Sector Control and Accountability. A Van Nuys Boulevard'Auto Row BID will be governed by an advisory board consisting of property and business owners. Annual BID improvements, activities and budgets will be developed by the advisory board, ensuring that the BID wi,l1 be directly accountable to those who pay.

4. Strengthen the Clout and Leverage of the Van Nuys Boulevard Business · Community. · . · A Van Nuys Boulevard Auto Row BID will broaden the foundation for

· developing a viable and unified private sector voice for our community. One unified management entity with reliable resources will increase the Van Nuys Boulevard business community's collective clout and our ability to work effectively with the City, County and other civic partners.

m WHAT IS A BUSINESS IMPROVEMENT DISTRICT?

The International Downtown Association estimates that more than. 1,000 business improvement districts (BID) currently operate throughout the United States and Canada. A BID provides enhanced improvements and activities, such as maintenance and marketing, in addition to those provided by local government. Many BIDs have been formed in recent years as a local business community response to declining municipal budgets and services. BIDs are proven to work by providing serviceS-that improve the overall viability of business districts - resulting in higher property values and sales .

. The Van Nuys Boulevard Auto Row BID is being formed pursuant to a new state law. The "Property and Business Improvement District Law of 1994", which became effective on January 1, 1995, ushers in a new generation of BIDs in Califomia by allowing a greater range of services and independence from government The new law inclµdes provisions that

t Allows BIDs to undertake activities ranging from security to maintenance, marketing to capital improvements, economic development to special events.

t Allows r~enue for improvements and activities to be raised from assessments on property.

+ Requires petition support from private property owners paying more than 50% of proposed private property assessments to form a BID.

The "Property and Business Improvement ~trict Law of 1994" is available upon request from the Van Nuys Boulevard Auto Row BID Property Owners Committee.

Since the creation of the Property and Business Improvement District Law, new BIDs have been established in a dozen California communities, including several linear commercial conidors similar to V.an Nuys Boulevard; Comparable districts include the Figueroa Corridor south of do~town Los Angeles and the Florin Road corridor in South Sacramento. More than a dozen additional districts are currently being formed in the greater Los Angeles _area.

To investigate the feasibility of establishing the Van Nuys Boulevard Auto Row BID, a study area was initially defined along Van Nuys Boulevard from Calvert Street to the north and Magnolia Boulevard to the sou~ Through site analysis and c~versations with area property owners, the boundaries of the propose~ Van Nuys Boulevard Auto Row BID are proposed to correspond with the initial study area.

The BID boundaries are recommended for the following reasons:

+ The BID boundary includes the heart of Van Nuys Boulevard's traditional auto row and complementary service and professional businesses.

+ By state statute, areas zoned for residential use are exempted from BID assessments. Residential areas within the BID study area have been omitted. .

+ Boundaries have been crafted in response to the stakeholder f~ groups, surveys, one-on-one meetings and plan review workshops that identified a willingness by property and business owners to consider paying for new improvements and activities through a property-based BID.

+ The BID could expand at a later date to encompass other businesses in the vicinity of ~e district.

A. Process to Establish the Improvement and Activity Plan

To form the improvement and activity plan for the Van Nuys Boulevard Auto Row BID, nearly 30 area property and business owners and civic leaders (or "stakeholders") have been ip.volved in a participatory process during the winter and spring of 1998. Key steps of the proces,s included:

1. . Van Nuys Boulevard Auto Row Property Owners Committee: As a springboard to initiate the BID formation process, a committee of about 10 key property and business owners along the corridor -have been meeting periodically to explore

· methods to improve the business distric~ The work of the group has included the identification of community improvements and priorities.

2. Community Fund Raising: To move the BID process forward, contributions from area business and property.owners and the City of Los Angeles (including support from Councilmember Miscikowski) were secured to retain a BID formation consultant The consulting firms of Hormann & ·· Associates and Progressive Urban Management Associates were selected~

3. One-On-One Meetings with Key Property Owners: The consultant team held a series of one-on-one meetings with property owners located throughout the Van Nuys Boulevard A~to Row BID study area.

4. Stakeholder Focus Groups: To involve property and business owners in the design and development of the plan, property and business owners participated in a series of 2 stakeholder focus groups conducted in April of 1998. The focus groups included a survey designed to assess service priorities and an appetite for financially supporting the Van Nuys Boulevard Auto Row BID.

5. Direct Mall Survey: A direct mail survey was sent to property owners within the Van Nuys Boulevard Auto Row BID study area. About 15 surveys were returned providing additional input into the design of the improvement and activity plan.

6. Plan Review Workshop: In May, a plan review workshop was held to tailor the improvement and activity plan to the specific needs of the district

Based upon these findings, four different improvement and activity centers are recommended for the Van Nuys Boulevard Auto Row BID. Final programs and budgets will be subject to the review and approval of the BID Advisory Boar~.

1. Image Enhancement

Programs to enhance the retail image of the Van Nuys Boulevard Auto Row were rated as high priorities by property and business owners throughout the BID study area. Several types of image enhancement activitie;s are proposed:

+ District Identity: A positive visual identity~ be developed for the district and will be reinforced through a variety of signage options, including tower signs to maximize Van Nuys Boulevard visibility from freeway access points and· landmark and directiOJ?al signage along the Boulevard

+ Street Beautification and Parking Enhancement: Options to improve the visual appearance of Van Nuys Boulevard include decorative banners, landscaping and street trees, attractive directional signage, and street furniture, including additional trash receptacles. Funds for design and engineering will be provided to develop streetscape options throughout the district Strategies to increase employee and customer parking will be-incorporated into plans. ·

+ · Events and Community Relations: Events and community relations initiatives will aim to fortify a Van Nuys Boulevard identity and convey a positive community image to consumers, investors and. the media. Events will ajm to capitalize on the Boulevard's. name recognition and nostalgic roots in the development of Los Angeles' automobile culture.

+ Planning and Design: In Year 1. of the Van Nuys Boulevard Auto Row BID, a marketing plan will be developed by a professional ~keting firm to guide the subsequent five year allocation of BID marketing funds. Key outcomes of the marketing plan will include a Van Nuys Boulevard consumer marketing strategy

that aides both automobile and non-auroin6oile relatedousiiiesses, including the identification of target markets and marketing tactics, a unified logo, design concepts for visually conveying a Van Nuys Boulevard identity through signage and banners, creation of a promotions and events calendar and media relations strategy. ·

2. Maintenance

The Van Nuys Boulevard Auto Row BID will provide resources for a variety of maintenance activities throughout the district Maintenance options, ·which will enhance existing City services, include: ·

+ · Daily sidewalk sweeping; + Periodic power washing of sidewalks; + Periodic removal of trash and debris; + Systematic graffiti removal; + Daily maintenance of bus shelters and bus stops; . + Maintenance of landscaping, trees, public art and other streetscape

improvements ·in public spaces that may be installed by the BID, property owners or the City.

The provision of maintenance activities will be determined by the BID Advisory Board. Maintenance services are expected to be managed by a private maintenance contractor that is selected pursuant to a competitive request for proposals.

MAINTENANCE WILL BE PERFORMED ON A MONTH-TO-MONTH BASIS THROUGH THE TERM OF THE CONTRACT AT AN ANTICIPATED RATE OF SEVEN HUNDRED AND SEVENTY FIVE DOLLARS ($775.00) PER MONTH.

MAINTENANCE SERVICES INCLUDE MAINTAlNING THE OXNARD AND BURBANK MEDIANS AND WEEDING TREE WELLS ON AN uAS NEEDED" BASIS.

3. Spedal Projects/Co:p.tingency

The special projects/ contingency fund will support district-wide improvements ~d activities that fortify an existing activity (i.e. image enhancement, . maintenance and/or program management). Yearly budgets and allocations for the· special projects/ contingency fund will be determined by the BID Advisory Board.

To reduce administrative expense and unnecessary overhead,· Van Nuys Boulevard Auto Row BID improvements and activiti~ will be managed by a part-time contract manager. BID (unds are also budgeted for bookkeeping, an annual audit and expenses required for Advisory Board meeting notices and other expenses. The final management structure will be subject to the review and approval of the BID Advisory Board.

THE BID WILL RETAIN THE SERVICES OF A CONSULTANT TO COMPLETE THE PROCESS OF CLOSING OUT THE BID AND ASSURING ASSESSMENTS ARE DISBURSED APPROPRIATELY. ANTICIPATED COST IS TWO raousAND DOLLARS ($2,000.00) PER MONTH PLUS ANY HARD COSTS THAT MAY BE INCURRED,

City and County Administrative Costs: The program management component of the budget includes funds to reimburse costs incurred by the City and County to administer the collection and disbursement of BID assessments. City and County costs will be associated with accounting administration by the City and assessment billing costs incurred ·by the County.

C. Improvement and Activity Plan Budgets

1. 1999 Operating Budget· Summary

The summary of the 1999 operating budget for the Van Nuys Boulevard Auto Row BID is provided on page 12. The total improvement and activity plan budget for 1999 is projected at $276,923 with the following components:

+ Image Enhancement:. Image enhancement includes a variety of improvements and activities aimed to convey and market a positive consumer identity for Van . Nuys Boulevard. Suggested first· year expenditures include a marketing plan, decorative banners, identity sigtlage and special events. The total 1999 image enhancement budget" is projected at $180,000, accounting for 65.0% of the total · BID budget

AS OF AUGUST 1, 2003 THROUGH DECEMBER 31, 2003 THE IMAGE ENHANCEMENT BUDGET WILL BE REDUCED TO ZERO ($0.00) DOLLARS.

+ Maintenance: Maintenance programs will aim to establish and maintain a uniform standard of cleanliness along the Van Nuys Boulevard corridor. Maintenance activities may include daily sidewalk sweeping, periodic power washing, periodic removal of trash and debris and systematic graffiti removal. To provide BID maintenance services, maintenance workers are budgeted for 60 hours per week. Maintenance costs amount to $39,930, or 14.4% of the overall BID budget.

A. Assessment Methodology

Property owners, businesses and other Van Nuys Boulevard stakeholders have emphasized that ari assessment formula for a BID be fair, balanced and commensurate with special benefits received ·

To 'develop the BID assessment methodology, the economic development consulting fiqn of Progressive Urban Management Associates (P.U.M.A.) and a certified engineer were retained. P.U.M.A .. evaluated several methods of assessment for conveying_ special benefits from the type of improvements and activities described within the Van Nuys Boulevard Auto Row BID Management Plan.

Allocation of Service Benefit· Service benefits are distributed to assessable frontage and lot square footage

through a "cost allocation" approach - the costs of specific services are allocated to the primary assessment variables that benefit most .from services. Allocations of service benefit include:

+ The costs of image enhancement activities and special projects are allocated to lot square footage since improvements to the area's image are viewed as enhancing the income and value potential of commercial lots.

+ '.I'he costs of maintenance activities are allocated to linear frontage along Van Nuys Boulevard sb:)ce these services· are anticipated.to provide direct benefit to sidewalks along the Boulevard.

+ The costs of program management activities are allocated on a pro rata basis to the preceding clusters of image enhancement/ special project and maintenance activities.

B. Calculation of Assessments The preceding methodology is applied to a database that has been constructed by the consultant team. The process for compiling the property database includes the following steps:

+ Property data was first obtained from· the County of Los Angeles Assessor's Office.

+ County assessor property data was crosschecked with reliable private sector sources, including a real estate information service. ·

+ As an attachment to the Management Plan, an assessment notice will be sent to all property owners within the proposed BID. Based upon the methodology, property data compiled by the consultant team, and the BID budget presented on page 11, approximate annual frontage and lot square footage assessments are calculated Assessments will not exceed the following amounts during the first year of the BID:

C. Annual Assessment Adjustments

Budget Adjustment: Any annual budget surplus or deficit will be rolled into the following year's 'BID budget Assessments will be set accordingly, within the constraints of the CPI adjustment, to adjust for surpluses or deficits that are carried forward.

D. Time and Manner _for Collecting Assessments

As provided by state law, the Van Nuys Boulevar<:J. Auto Row BID assessment will appear as a separate line item on annual property tax bills prepared by the County

- of Los Angeles. Property tax bills are generally distributed in the fall and payment is expected by lump sum or installment

Existing laws for enforcement and appeal of property taxes apply to BID. assessments, ·

Properties owned by not-for-profit organizations that are exempt from ad valorem property taxes may. not be subject to assessment, provided that the own_er of such property submits valid documentation of exemption to the BID (see page 20).

E. Disestablishment

State I.aw provides for t:Q.e disestablishment of a BID pursuant to an annual review process. Each year that the BID is in existence, there will be a 3<klay period during which the property owners will have the opportunity to request disestablishment of the district This 30-day period begins each year on the anniversary day 1;hat the district was first established by City Coundl. ·

Within that 30-day period, if a written petition is submitted by the owners of real property who pay ·so percent (50%) or more of the assessments levied, the BID may be disestablished. The City Council will hold a public hearing· on disestablishing the BID prior to actually doing so.

F. Government Assessments

The Van Nuys Boulevard Auto Row BID Management Plan does not assume that the City of Los Angeles and _other government entities will pay assessments for the special benefits conferred to government-owned property within the boundaries of the· BID. However, Article :xm D of the California Constitution was added in November of 1996 to provide for these payments: ·

"Parcels within a district that are owned or used by any agency, the State of Otliforttuz or ~~ the United States shall not be exempt from assessments unless the agency can 'demonstr~te by clear and convincing evidence that those publicly owned parcels in fact receive no special benefit".

The federal government has also recently adopted a policy encouraging participation in BIDs. Through an executive order, the General Services Administration is encouraging that the federal government contract with BIDs for direct services, sueh as public safety and maintenance, that benefit federally owned properties.

The BID Property Owner's Committee has determined that if assessments are paid by the City and other governmental agencies, the overall improvement and activity plan budget will be increased accordingly.

City-owned property is limited to a parcel located at the northwest comer of Van Nuys Boulevard and Oxnard, accounting for less than 5% of the land square footage within the proposed BID.

VU. BUSINESS IMPROVEMENT DISTRICT GOVERNANCE

A. How BIDs are Governed

Consistent with business improvement district (BID) legislation throughout the nation, California's. "Property 8;lld Business Jmpr~vement District Law of 1994" establishes a BID governance framework that allows property owners who pay assessments to determine how the assessments are used. The following components are required within a BID's governing structure:

t City Councll: Following the submission of petitions from property owners representing more than 50% of the assessments to be paid, the City Council holds a series of public hearings and then may form the BID. The BID is established by an ordinance of the City Council, therefore the BID is officially a quasi­governmental entity with the power to levy assessments on property.

t Advisory Board: Prior to establishing the BID, the City Coundl must appoint an advisory board that will make recommendations on the operations of the BID. The advisory board is typically composed of property owners, businesses and other assessment payers within the BID. Per the state law, .the Advisory Board~ the policy-making body for the BID, governing the assessment levy and use of

. funds - it makes recommendations to the City Coundl on annual budgets and assessment rates.

If the management organization does not perform and provide a level of service that is acceptable to the City Council and the BID Advisory Board, then the contract can be terminated and an alternative management organization can be selected. ·

For the Van Nuys Boulevard Auto Row BID, an advisory board and nuµlagement organization structure is proposed that will meet the following objectives: .

+ Create and manage programs that carry out improvements and activities outlined in the Van Nuys Boulevard Auto Row BID Management Plan.

+ Maximize coordination with government and dvic organizations to leverage resources and avoid duplication of services.

+ Deliver programs through a cost-effective non-bureaucratic and easy to access organizational structure.

+ Provide for accountability to those who pay.

B. . Van Nuys Boulevard Auto Row BID Advisory Board

Consistent with the "Property and Business Improvement District Law of 199411

the BID Advisory Board would develop budgets and program priorities for the BID and authorize and monitor contracts with service providers.

The Advisory Board is proposed as a 5 to 7 member board that would be composed of property and business owners representing assessment payers ·by geographic location along the corridor and/ or industry segment. Industry segments that should be represented include:

+ Automobile dealerships; + Automobile-related services and parts; + Non-automobile-related services; + Retail.

Advisory board representatives should be sought with a mix of business and property types - i.e. small and large property owners. As required by the "Parking and Business Improvement District Law of 199411

, at least one member of the Adyisory Board must be a business licensee who is not a property owner.

City Council would then appoint the advisory 1?<>ard. ·

C. Van Nuys Boulevard Auto Row BID Management Organh:a.tion

The Advisory Board described on the preceding pages · will influence the development of BID policies, budgets and ass~ents, but it will not implement day-to­day improvements and activities. The City Council, upon the recommendation of the Advisory Board, will contract with a management organization to deliver programs.

For the Van Nuys Boulevard Auto Row BID, a new management organization is proposed to run BID programs. Based upon a management organization model that is used widely in major cities throughout the nation, the new entity will be a 5.0l(c)(6) non-profit private corporation.

Pursuant to a contract with the City Council to manage BID programs, the new management organization will provide central administration, communications and overall management of BlD programs.

The management organization will be governed by a board of directors that is representative of major private sector interests in the Van Nuys Boulevard Auto Row BID, including property owners and businesses. Various public agencies and repr~tatives of elected officials, such as the City of Los Angeles Police Department, City Council and Office of the Mayor, could also serve on the Management Corporation board to facilitate communication with the City. The initial board of directors and corporate structure of the new management organization will be developed by the BID Property Owner Committee prior to the establishment of the BID.

Vlll. CONTINUATION OF CITY SERVICES

Throughout the process to establish the Val:l Nuys Boulevard Auto Row BID, business and property owners have voiced concerns that the City of Los Angeles maintain existing services at verifiable "baseline~ service levels. ·A formal base levels of service policy.ensures that existing City services are enhanced, not replaced, by new BID improvements and activities.

The Los Angeles· City Council has established a policy that aims to ensure that existing City services will continue to be provided within a BID: "It is the intent of the

IX. BUSINESS IMPROVEMENT DISTRICT RULES AND REGULATIONS

Pursuant to the Property and Business Improv~t Law of 1994, a business improvement district (BID) may establish rules and regulations that uniquely apply to the district Initial rules and regulations to be employed by the Van Nuys Boulevard Auto Row BID:

1. Assessment Policy on 501(c)(3) Organi7.ations

An owner of real property located within the Property and Business Improvement District may reduce the amount of the assessment to be levied if all of the following conditions are met

a. Tiie property owner is a non-profit corporation which has obtained federal tax­exemption under Internal Revenue Code Section 501(c)(3) or California franchise tax-exemption under Revenue and Taxation Code Section 23701d. ·

b. The class or category of real property is eligible for exemption, in whole or in part, from real property ~ti.on.

c. The property owner makes the request in writing to the BID prior to the submission of the BID assessment rolls to the County Assessor, accompanied by documentation of the tax-exempt status of the property owner and the class or category of real property. ·

If all of these condi'l:ions are met, the amount of the assessment to be levied shall be reduced in the same proportion to the real property tax exemption granted to the property. .

2. Compe~ve Bidding

· Following the formation of the BID, the Advisory Board shall develop a bidding policy to purchase su.bstantial amounts of services, products and/ or equipment. The ~licy will aim to maximize service quality, efficiency and cost effectiveness.

3. Treatment of Residential Housing

A 1996 revision to the Property and Business Improvement District Law of 1994 clarifies that properties zoned exclusively for residential use are exempt from BID assessments. For-the Van Nuys Boulevard Auto Row BID, all property used exclusively

4. Local Purchasing Preference Policy

The Van Nuys Boulevard Auto Row BID will adopt a local purchasing preference policy that directs BID funded improvements and activities to utilize goods and services from area vendors provided that pricing and standards of quality remain competitive.

X. IMPLEMENTATION TIMETABLE

The Van Nuys Boulevard Auto Row BID is expected to be operational by Januazy 1, 1999. In order to meet this goal, the following procedural timetable is anticipated:

This report is prepared, as directed by the City Council, in relation to the Van Nuys Boulevard Auto Row Business Improvement District pursuant to Section 3600 m,. RQ... of the California Streets and Highways Code (the "Property and Business Improvement District Law of 1994") and pursuant to the newly adopted_Article XIIID Section 4(b) of the California Constitution (Proposition 218).

The Van Nuys Boulevard Auto Row Business Improvement District (the "BID") is designed to improve ~d benefit properties in the Van Nuys Boulevard Auto Row business area by providing image enhancement, maintenance programs, and district management. Only properties within the BID shall receive the direct benefit of the proposed impr9vements and a~ivities. It is estimated that each property will benefit from the propo~ed improvements and activities. A detailed description of the improvements and activities to be provided is set forth in Exhibit A . . .

The duration of the proposed BID is five (5) years and an estimated budget for the BID improvements and activities is set forth in Exhibit B. The budget reflects a potential for an annual increase in the assessment, which may not exceed the annual increase in.the consumer price index. Funding for the BID improvements and activities shall be derived from a property based assessment of each parcel in the BID, subject to any exemptions due to the use of particular parcel. A detailed description of the methodology for determining the benefit assessment for each parcel is set forth in Exht'bit c. This report includes the following attached exhibits:

Maintenance The Van Nuys Boulevard Auto Row BID will pro'Yi:de resources for a variety of maintenance activities throughout the district. Maintenance options, will enhance existing City services, include:

The provision of maintenance activities will be determined by the BID Advisory Board. Maintenance services are expected to be managed by a private maintenance contractor th~ is selected pursuant to a competitive request for proposals. ·

Special -Projects/Contingency The special projects/contingency fund will s.upport district-wide improvements and activities that fortify an existing activity (i.e. image enhancement, maintenance and/or program management). Yearly budgeis-and allocations for the special projects/contingency fund will be determined by the BID Advi-sory Board. .

· Program Management . To reduce administrative expense and unnecessary overhead, Van Nuys Boulevard Auto Row BID improvements and activities will be m~aged by·a part-time contract manager. BID funds are also budgeted for bookkeeping, an annual audit and expenses required for Advisory Board meeting notices and other expenses. The final management structure will be subject to the review and approval of the BID Advisory Board.·

Baekaround . In early 1998, business owners and civic leaders began to develop an improvement and ·activity plan for the Van Nuys ('!District"). The District's primary objective .is to enhance the image and provide maintenance and District management. To address these issues the District wants the City ofLos Angele., to f~mi a Property and Business Improvement District to finance the proposed improvements and activities (11Improve1:t1ents11

) as outlined in Exhibit A These Improvements will extend or are above those improvements the City _of Los Angeles currently provides and will continue to provide. The property owners in the District area will bear the cost of the proposed Impro~ements through

TheDisttict is approximately a one-mile stretch of Van Nuys Boulevard, including an area bounded by Magnolia Boulevard to the south and Calvert Street to the north.

General The Property and Business Improvement District Law of 1994 and.P~oposition 218 require that

Detennining the proportionate share of special b~nefit among the parcels of real. property, including ·the two government owned parcels, :within the proposed ~sessment district w~ch benefit from the . proposed Improvements is the result of a four step process: 1) defining the proposed Improvements; 2) identifying how each parcel specially benefits from the proposed Improvements; 3) determining

· the amount of the special benefit each parcel receives from the proposed Improyements; and 4) apportioning the cost of the proposed Improvements to each parcel based on the special benefit that each parcel receives from the propos¢ Improvements.

Assessment Method The proposed Improvements will provide a higher level of se~ce than the City provides with City funds to those parcels in the District ar~. Therefore, every parcel in the District that benefits from the Improvements should pay its fair share of the costs based on that parcel's special benefit. The proposed Improvements will provide image enhan~ment, maintenance and special projects to every

parcel in the District. Since every parcel in the District is either commercial or business related they will all benefit ftom these Improvements.

The assessment method uses a combination of lot size and street ftont footage as weighting factors to apportion the costs of the Improvements to the.parcels in the District. Lot size distinguishes smaller size lots from larger size lots. Smaller lots require iess public.improvements than larger lots. The lots benefit directly from the image enhancement programs and special projects. Street front foo_tage is ~levant to the need for services along streets, sidewalks and building fronts. The longer the street front the .more required services. The street front benefits dir~y from the maintenance programs.

The tota1 BID budget of $276,923 is divided into four main categories as shown in the table below and the assessment method for each is described following the table. ·

· Maintenance· Maintenance benefits every par®l in the district, therefore, f?{ery parcel should pay its fair share of the Maintenance cost. · The maintenance portion of the budget is aimed at cleaning the streets. and sidewalks and removing graffiti. Since maintenance services provide a higher level of service to the front of the building and the sidewalk the street front footage should be responsible for paying this portion of the budget and its .pro-rata share of the program m.anagement·budget. ·

· Row Property and Business Improvement District (•District").

WHEREAS, the Los Angeles City Council on August 18, 2098 adopted Ordinance 172,181, which established the Van Nuys Boulevard Auto Row Property and Business Improvement District; and,

WHEREAS, pursuant to Section 36600 et seq. of the California Streets and Highways Cope (the "Act") and the City's int~rim_procedure for modifying Management District Plans of property-based Business Improvement Districts (CF 02-0941), the City Council may, upon the written request of the District, make modifications to the Management District Plan; and,

WHEREAS, Van Nuys Boulevard Auto Row Management Corporation, a nonprofit California corporation, has prepared and filed a revised Management District Plan that includes changes to the District's Improvements and Activities and Budget sections; and,

WHEREAS, the subject Management District Plan complies with the provisions of Section 36600 of the Act and the City's interim procedure (CF 02-0941 );

THE CITY COUNCIL OF THE CITY OF LOS ANGELES DOES ORDAIN AS FOLLOWS:

DECLARA TIQN. The City Council hereby declares its intention to modify the Improvements and Activities and Budget sections of the Management District Plan for the Van Nuys Boulevard Auto Row Property and Business Improvement District.

REVISED MANAGEMENT DISTRICT PLAN. The revised Management District Plan and a Summary of the proposed modifications to the Management District Plan, as prepared by the Van Nuys Boulevard Auto Row Management Corporation and as filed with the City Clerk, including modifications to the Improvements and Activities and Budget sections, are attached hereto as "Attachment 1" and •Attachment 2," respectively, and are incorporated herein by reference as though fully set forth herein.

PUBLIC HEARING. One public hearing shall be held before the City Council on SEP 2 3 2003 ,2003 at 10:00 a.m., or as soon thereafter as this matter may be

heard, in the John Ferraro Council Chamber in Room 340 at City Hall, 200 North Spring Street, Los Angeles, California 90012. At this hearing the City Council will consider adoption of the Ordinance modifying the Management District Plan. At this hearing the City Council will also hear all persons for or against the proposed modifications to the Management District Plan. ·

PROTESTS. At the public hearing, the City Council shall hear and consider all protests against the revised Management District Plan, including the modifications to the Improvements and Activities and Budget sections. A protest may be made orally or in writing by any interested person. Any protest pertaining to the regularity or sufficiency of the proceedings shall be in writing and shall clearly set forth the irregularity or defect to which the objection is made.

Every written protest shall be filed with the City Clerk prior to or during the public hearing. The City Council may waive any irregularity in the form or content of any written protest and at the public hearing may correct minor defects in the

proceedings. A written protest may be withdrawn in writing at any time prior the conclusion of the public hearing. ___ . _ ·- ____________ _

Each written protest shall contain a description of the real property in which the property owner subscribing the protest owns. Written protests that do not comply with these requirements shall not be counted in determining a majority protest. Only written protests will be counted to determine whether there exists a majority protest

Written protests can be on a form supplied by the City Clerk (Form SAS 143E). The form may be obtained at the Council and Public Services public counter in Room 395 at City Hall, 200 North Spring Street, Los Angeles, California 90012 or by telephoning (213) 978-1099.

If written protests are received from owners of real property in the District who will pay fifty percent (50%) or more of the assessments that are levied and protests are not withdrawn so as to reduce the protest level to less than fifty percent (50%), the Management District Plan, including the modifications to the Improvements and Activities and Budget sections, will not be revised for a period of one year from the date of the finding of a majority protest by the City Council.

If the majority protest is only against the furnishing of a specified type or types of improvement or activity within the District, those types of improvements or activities shall be eliminated.

QUESTIONS OR COMMENTS. Any person having a question or comment regarding the hearing proceedings may telephone (213) 978-1099 [facsimile (213) 978-1130) and state such question or comment to the Deputy City Clerk assigned to answer inquiries regarding the hearing proceedings. ·

NOTICE REQUIREMENT. The City Clerk shall give notice of the public hearing by the publication of this Ordinance in a newspaper of general circulation in the City of Los Angeles not less than seven (7) days prior to the public hearing, and by the mailing of the notice of the public hearing together with a complete copy of this Ordinance of Intention, a revised management district plan and a summary of the modifications by first-class mail to each stakeholder il'.l the District within seven (7) days of the City Council's adoption of the Ordinance of Intention.

The City Clerk shall certify the passage of this Ordinance of Intention and have It published in accordance with Council policy, either in a daily newspaper circulated in the City of Los Angeles or by posting for ten (10) days In three public places in the City' of Los Angeles: one copy on the bulletin board located in the Main Street lobby to the City Hall; one copy on the bulletin board located at the ground level at the Los Angeles Street entrance to the Los Angeles Police Department; and one copy on the bulletin board located at the Temple Street entrance to the Los Angeles County Hall of Records.

HOUSING, COMMUNITY AND ECONOMIC DEVELOPMENT COMMITTEE REPORT and ORDINANCE relative to modifications to the Van Nuys Boulevard Auto Row Property and Business Improvement District (Van Nuys Auto Row BID) Management District Plan.

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

1. ADOPT the accompanying Ordinance declaring the City's intent to make the proposed modifications to the Van Nuys Auto Row BID Management District Plan.

2. INSTRUCT the City Clerk, to:

a. Schedule a public hearing before the City Council regarding consideration of the Ordinance and to notify all affected parties of the hearing.

b. Prepare an Ordinance authorizing the changes to the Van Nuys Auto Row BID Management District Plan for Council consideration during the required public hearing, subject to the approval of the City Attorney as to form and legality.

Fiscal Impact Statement: The City Clerk reports that there is no impact to the General Fund. Direct costs associated with Departmental administrative expenses for the Van Nuys Auto Row BID are being recovered from the assessments collected. There are no assessable City-owned properties located the Van Nuys Auto Row BID.

Summary:

In its transmittal dated August 8, 2003, the City Clerk reports that the Van Nuys Auto Row BID will not be renewing after the end of its five-year establishment period on December 31, 2003. For the past five years, and as outlined in the BI D's Management District Plan, the Van Nuys Auto Row SID has been trying to install a tower sign along either the 405 or 101 freeways. The BID has been reserving assessment funds over the past five years in hopes of seeing this project to fruition. Ultimately, the project BID was unable to get required approval and therefore the BID's operating entity, the Van Nuys Boulevard Auto Row Management Corporation and its Advisory Board have voted not to renew the BID and to return the assessment funds held in reserve equitably to those stakeholders paying into the BID. ·

The City Clerk further reports that the BID's management entity is now proposing to significantly reduce the Bl D's services and budget to a bare minimum for the remainder of the Bl D's operating period. Therefore, a modification to the Improvement and Activity Plan and Budget Sections of the Bl D's Management District Plan will be necessary. According to the existing BID legislation, upon the written request of the BID, Council may initiate proceedings to make modifications to the Management District Plan, including changes to the BID's Improvement and Activity Plan and Budget Sections.

Beginning August 2003 until the expiration of the Bl D's operational life on December 31, 2003, the .Van Nuys Auto Row Bl D's management entity is proposing to make the following reductions to the Bl D's authorized improvements and activities: 1) the Image Enhancement activities will be stopped and the corresponding budget reduced to $0.00; 2) Maintenance activities will reduced and the corresponding budget limited to $3,875 in order to allow for required maintenance to the Oxnard and Burbank Boulevard medians and for tree well weeding; 3) the Special Projects/Contingency costs will limited to $3,000 in order to allow for administrative a,.nd possible audit/review costs; and, 4) Program Management costs will be limited to $8,000 in order to pay for contract management of the BID until December 31, 2003, at a rate of $2,000 per month. Finally, the proposed modification includes a provision for the refund of approximately $770,000 in previously collected assessment revenue being held in reserve to the Van Nuys Auto Row BID stakeholders by the end of the~BID's operational life or.December 31, 2003.

The City Clerk notes that the City's interim procedure for modifying Management District Plans for property-based BIDs where no new or increased assessments are to be levied was adopted recently by Council (Council file No. 02-0941 ). The City's interim procedure requires the adoption of an Ordinance of Intention to modify the Management District Plan and a public hearing to be held prior to the adoption of an Ordinance that would authorize the modifications.

The City Clerk further notes that it received and reviewed the revised Van Nuys Auto Row BID Management District Plan that incorporates the requested modifications, as prepared by the Van Nuys Auto Row Management Corporation, and recommends Council approval.

At its regular meeting held August 13, 2003, the Housing, Community and Economic Development Committee discussed this matter with City staff. At that time, the City Clerk noted a technical correction to its report and recommended that Council limit the Bl D's Program Management costs to $10,000 (rather than $8,000 as previously recommended) in order to pay for contract management of the BID until December 31, 2003. The Committee concluded its consideration of this matter and recommended that Council approve the recommendations of the City Clerk, as submitted in its report dated August 8, 2003, and as amended above. This matter is now submitted to Council for its consideration.

Honorable Members:

On August 18, 1998 the City Council adopted Ordinance 172,181, which established the Van Nuys Boulevard Auto Row Property and Business Improvement District (Van Nuys Auto Row BID) (Council File No. 97-1926-81). The Van Nuys Auto Row BID will not be renewing after the end of its five-year establishment period on December 31, 2003. For the past five years, and as outlined in the BID's Management District Plan, the Van Nuys Auto Row BID has been trying to install a tower sign along either the 405 or 101 freeways. The BID has been reserving assessment funds over the past five years in hopes of seeing this project to fruition. SUMMARY OF PROPOSED MODIFICATIONS

MODIFICATION PROCESS

The City's interim procedure for modifying Management District Plans for property-based Business Improvement Districts where no new or increased assessments are to be levied was adopted recently by the City Council (CF 02-094-1 ). The City's interim procedure requires the adoption of an Ordinance of Intention to modify the Management District Plan and a public hearing to be held prior to the adoption of an Ordinance that would authorize the modifications. We have received and reviewed the revised Van Nuys Auto Row BID Management District Plan that incorporates the requested modifications, as prepared by the Van Nuys Auto Row Management Corporation. A copy of the revised Van Nuys Auto Row BID Management District Plan is attached as "Attachment 1." A summary of the proposed revisions to the BID's Management District Plan is also attached as "Attachment 2."

FISCAL IMPACT

Direct costs associated with Departmental administrative expenses for the Van Nuys Auto Row BID are being recovered from the assessments collected. There are no assessable City-owned properties located the Van Nuys Auto Row BID. Therefore, there is no potential impact to the General Fund associated with this action.

RECOMMENDATIONS:

1. ADOPT an Ordinance declaring the City's intent to make the proposed modifications to the Van Nuys Auto Row BID Management District Plan.

2. INSTRUCT the City Clerk, to schedule a public hearing before the City Council regarding consideration of the Ordinance and to notify all affected parties of the hearing.

3. INSTRUCT the City Clerk, subject to City Attorney approval, to prepare an Ordinance authorizing the changes to the Van Nuys Auto Row BID Management District Plan, for Council consideration during the required public hearing.

L . VAN NUYS BOULEVARD AUTO ROW BUSINESS IMPROVEMENT DISTRICT AT-A-GLANCE

Developed by a growing coalition of property and business owners, the Van Nuys Boulevard Auto Row Business Improvement District (BID) is a benefit assessment district proposed to improve and convey special benefits to properties located along the heart of Van Nuys Boulevard's legendary Auto Row. The BID will provide new improvements and activities, including image enhancement and maintenance programs, beyond those currently provided by the City. This approach has been used successfully in other business districts to reverse negative image, attract new customers and increase sales, occupancies and property values.

Location: Approximately a one-mile stretch of Van Nuys Boulevard, including an area bounded by Magnolia Boulevard to the south and Calvert Street to the north.

Improve ments& Activities:

Image Enhancement programs aimed to attr~ct consumers to Van Nuys Boulevard, enabling us to compete with other automobile retail destinations in the Los Angeles region. Activities will include signage and banners to fortify the district's identity, street beautification and parking improvements, consumer marketing and events.

Maintenance programs to pick up trash, maintain landscaping, remove graffiti and generally provide a uniform standard of cleanliness along the corridor.

Method of Levy of assessments upon real property that benefits from improvements Financing: and activities.

Budget: Total district budget for its first year of operation is $276,923.

Cost: Annual assessments based upon an allocation of program costs and a calculation of lot square footage and linear frontage along Van Nuys Boulevard. First year assessments will not exceed:

Assessments may be subject to changes in the annual Los Angeles Consumer Price Index for all urban consumers, not to exceed 3% per year.

The Los Angeles City Council has established a policy that formation of a BID will not affect the level of services currently provided by the City.

Duration: The district will have a 5-year life beginning January 1, 1999. After 5 years, the petition process must be repeated for the district to continue.

II. WHY A BID FOR VAN NUYS BOULEVARD? There are several reasons why now is the right time to form a private sector business improvement district along the Van Nuys Boulevard Auto Row:

1. Improve Van Nuys Boulevard to Better Compete for Customers While Van Nuys Boulevard is historically the center for the San Fernando Valley's automobile shopping and related community activities, we have been challenged by increasing competitive pressures in the marketplace. A business improvement district will provide competitive advantages for Van Nuys, allowing us to retain and recapture customers that are attracted to newer automobile-oriented retail areas in Valencia, Glendale or Thousand Oaks. Our ability to attract and expand these markets will help all businesses along the corridor, both auto and non-auto related.

2. Create a Distinct Positive Identity for Van Nuys Boulevard. Nearly two-thirds of BID funds are to be expended on improvements and activities that promote and identify a clear positive identity for the district New signage, banners, events, street beautification and parking enhancements will clearly communicate that Van Nuys Boulevard is back as a premier shopping destination

3. Establish Private Sector Control and Accountability. A Van Nuys Boulevard Auto Row BID will be governed by an advisory board consisting of property and business owners. Annual BID improvements, activities and budgets will be developed by the advisory board, ensuring that the BID will be directly accountable to those who pay.

4. Strengthen the Clout and Leverage of the Van Nuys Boulevard Business Community. · A Van Nuys Boulevard Auto Row BID will broaden the foundation for developing a viable and unified private sector voice for our community. One unified management entity with reliable resources will increase the Van Nuys Boulevard business community's collective clout and our ability to work effectively with the City, County and other civic partners.

IIL WHAT IS A BUSINESS IMPROVEMENT DISTRICT?·~~

The International Downtown Association estimates that more than 1,000 business improvement districts (BID) currently operate throughout the United States and Canada. A BID provides enhanced improvements and activities, such as maintenance and marketing, in addition to those provided by local government. Many BIDs have been formed in recent years as a local business community response to declining municipal budgets and services. BIDs are proven to work by providing services that improve the overall viability of business districts - resulting in higher property values and sales .

. The Van Nuys Boulevard Auto Row BID is being formed pursuant to a new state law. The "Property and Business Improvement District Law of 199411

, which became effective on January 1, 1995, ushers in a new generation of BIDs in California by allowing a greater range of services and independence from government The new law includes provisions that

+ Allows BIDs to undertake activities ranging from security to maintenance, marketing to capital improvements, economic development to special events.

+ Allows revenue for improvements and activities to be raised from assessments on property.

+ Requires petition support from private property owners paying more than 50% of proposed private property assessments to form a BID.

+ Requires formation of a property and business owner advisory board to supervise BID operations and submit a yearly service plan.

+ Provides up to a 5-year life for a BID and requires a new petition process to renew a district.

The "Property and Business Improvement District Law of 199411 is available upon request from the Van Nuys Boulevard Auto Row BID Property Owners Committee.

Since the creation of the Property and Business Improvement District Law, new BIDs have been established in a dozen California communities, including several linear commercial corridors similar to Van Nuys Boulevard. Comparable districts include the Figueroa Corridor south of downtown Los Angeles and the Florin Road corridor in South Sacramento. More than a dozen additional districts are currently being formed in the greater Los Angeles area.

IV. VAN NUYS BOULEVARD AUTO ROW BID BOUND.ARY

To investigate the feasibility of establishing the Van Nuys Boulevard Auto Row BID, a study area was initially defined along Van Nuys Boulevard from Calvert Street to the north and Magnolia Boulevard to the south. Through site analysis and conversations with area property owners, the boundaries of the proposed Van Nuys Boulevard Auto Row BID are proposed to correspond with the initial study area .

. The BID boundaries are recommended for the following reasons:

• The BID boundary includes the heart of Van Nuys Boulevard's traditional auto row and complementary service and professional businesses.

• By state statute, areas zoned for residential use are exempted from BID assessments. Residential areas within the BID study area have been omitted.

• Boundaries have been crafted in response to the stakeholder focus groups, surveys, one-on-one meetings and plan review workshops that identified a willingness by property and business owners to consider paying for new improvements and activities through a property-based BID.

• The BID could expand at a later date to encompass other businesses in the vicinity of the district.

The final boundaries of the Van Nuys Boulevard Auto Row BID are provided on the maps on the following pages.

A. Process to Establish the Improvement and Activity Plan

To form the improvement and activity plan for the Van Nuys Boulevard Auto Row BID, nearly 30 area property and business owners and civic leaders (or "stakeholders") have been involved in a participatory process during the winter and spring of 1998. Key step~ of the process included:

1. Van Nuys Boulevard Auto Row Property Owners Committee: As a springboard to initiate the BID formation process, a committee of about 10 key property and business owners along the corridor have been meeting periodically to explore methods to improve the business district. The work of the group has included the identification of community improvements and priorities.

2. Community Fund Raising: To move the BID process forward, contributions from area business and property owners and the City of Los Angeles (including support from Councilm.ember Miscikowski) were secured to ·retain a BID formation consultant. The consulting firms of Hormann & Associates and Progressive Urban Management Associates were selected.

3. One-On-One Meetings with Key Property Owners: The consultant team held a series of one-on-one meetings with property owners located throughout the Van Nuys Boulevard Auto Row BID study area.

4. Stakeholder Focus Groups: To involve property and business owners in the design and development of the plan, property and business owners participated in a series of 2 stakeholder focus groups conducted in April of 1998. The focus groups included a survey designed to assess service priorities and an appetite for financially supporting the Van Nuys Boulevard Auto Row BID.

5. Direct Mail Survey: A direct mail survey was sent to property owners within the Van Nuys Boulevard Auto Row BID study area. About 15 surveys were returned providing additional input into the design of the improvement and activity plan.

6. Plan Review Workshop: In May, a plan review workshop was held to tailor the improvement and activity plan to the specific needs of the district.

B. Van Nuys Boulevard Auto Row BID Improvement and Activity Plan

As determined by area property and business owners, the top priorities for improvements and activities within the Van Nuys Boulevard Auto Row BID boundary include: ·

+ A consistent level of sidewalk and landscape maintenance along the corridor.

+ Flexibility for special projects and initiatives that strengthen efforts to market and maintain the area.

+ Program management by a contract director that can advocate on behalf of Van Nuys Boulevard businesses, advance community improvement initiatives and coordinate marketing programs and events.

Based upon these findings, four different improvement and activity centers are recommended for the Van Nuys Boulevard Auto Row BID. Final programs and budgets will be subject to the review and approval of the BID Advisory Boar<:f.

1. Image Enhancement

Programs to enhance the retail image of the Van Nuys Boulevard Auto Row were rated as high priorities by property and business owners throughout the BID study area. Several types of image enhancement activities are proposed:

+ District Identity: A positive visual identity will be developed for the district and will be reinforced through a variety of signage options, including tower signs to maximize Van Nuys Boulevard visibility from freeway access points and landmark and directional signage along the Boulevard.

+ Street Beautification and Parking Enhancement: Options to improve the visual appearance of Van Nuys Boulevard include decorative banners, landscaping and street trees, attractive directional signage, and street furniture, including additional trash receptacles. Funds for design and engineering will be provided to develop streetscape options throughout the district. Strategies to increase employee and customer parking will be incorporated into plans.

+ Events and Community Relations: Events and community relations initiatives will aim to fortify a Van Nuys Boulevard identity and convey a positive community image to consumers, investors and the media. Events will aim to capitalize on the Boulevard's. name recognition and nostalgic roots in the development of Los Angeles' automobile culture.

+ Planning and Design: In Year 1. of the Van Nuys Boulevard Auto Row BID, a marketing plan will be developed by a professional marketing firm to guide the subsequent five year allocation of BID marketing funds. Key outcomes of the marketing plan will include a Van Nuys Boulevard consumer marketing strategy

that aides both automobile and non-automobiltt'elated businesses, including the identification of target markets and marketing tactics, a unified logo, design concepts for visually conveying a Van Nuys Boulevard identity through signage and banners, creation of a promotions and events calendar and media relations strategy.

2. Maintenance

The Van Nuys Boulevard Auto Row BID will provide resources for a variety of maintenance activities throughout the district Maintenance options, which will enhance existing City services, include:

+ Daily sidewalk sweeping; + Periodic power washing of sidewalks; + Periodic removal of trash and debris; + Systematic graffiti removal; + Daily maintenance of bus shelters and bus stops; + Maintenance of landscaping, trees, public art and other streetscape

improvements in public spaces that may be installed by the BID, property owners or the City.

The provision of maintenance activities will be determined by the BID Advisory Board. Maintenance services are expected to be managed by a private maintenance contractor that is selected pursuant to a competitive request for proposals.

MAINTENANCE WILL BE PERFORMED ON A MONTil-TO-MONTH BASIS THROUGH THE TERM OF THE CONTRACT AT AN ANTICIPATED RATE OF SEVEN HUNDRED AND SEVENTY FIVE DOLLARS ($775.00) PER MONTH.

MAINTENANCE SERVICES INCLUDE MAINTAINING THE OXNARD AND BURBANK MEDIANS AND WEEDING TREE WELLS ON AN "'AS NEEDED" BASIS.

3. Special Projects/Contingency

The special projects/ contingency fund will support district-wide improvements and activities that fortify an existing activity (ie. image enhancement, maintenance and/ or program management). Yearly budgets and allocations for the special projects/ contingency fund will be determined by the BID Advisory Board.

Program Management

To reduce administrative expense and unnecessary overhead, Van Nuys Boulevard Auto Row BID improvements and activities will be managed by a part-time contract manager. BID funds are also budgeted for bookkeeping, an annual audit and expenses required for Advisory Board meeting notices and other expenses. The final management structure will be subject to the review and approval of the BID Advisory Board.

THE BID WILL RETAIN THE SERVICES OF A CONSULTANT TO COMPLETE THE PROCESS OF CLOSING OUT THE BID AND ASSURING ASSESSMENTS ARE DISBURSED APPROPRIATELY. ANTICIPATED COST IS TWO moUSAND DOLLARS ($2,000.00) PER MONm PLUS ANY HARD COSTS THAT MAY BE INCURRED.

City and County Administrative Costs: The program management component of the budget includes funds to reimburse costs incurred by the City and County to administer the collection and disbursement of BID assessments. City and County costs will be associated with accounting administration by the City and assessment billing costs incurred by the County.

C. Improvement and Activity Plan Budgets

1. 1999 Operating Budget Summary

The SlllI1li'Ulry of the 1999 operating budget for the Van Nuys Boulevard Auto Row BID is provided on page 12. The total improvement and activity plan budget for 1999 is projected at $276,923 with the following components:

+ Image Enhancement: Image enhancement includes a variety of improvements and activities aimed to convey and market a positive consumer identity for Van Nuys Boulevard. Suggested first year expenditures include a marketing plan, decorative banners, identity signage and special events. The total 1999 image enhancement budget is projected at $180,000, accounting for 65.0% of the total BID budget

VL ASSESSl\lENTS

A. Assessment Methodology

Property .owners, businesses and other Van Nuys Boulevard stakeholders have emphasized that an assessment formula for a BID be fair, balanced and commensurate with special benefits received.

To develop the BID assessment methodology, the economic development consulting fiqn of Progressive Urban Management Associates (P.U.M.A.) and a certified engineer were retained. P.U.M.A. evaluated several methods of assessment for conveying special benefits from the type of improvements and activities described within the Van Nuys Boulevard Auto Row BID Management Plan.

Allocation of Service Benefit· Service benefits are distributed to assessable frontage and lot square footage

through a "cost allocation'' approach - the costs of specific services are allocated to the primary assessment variables that benefit most from services. Allocations of service benefit include:

+ The costs of image enhancement activities and special projects are allocated to lot square footage since improvements to the area's image are viewed as enhancing the income and value potential of commercial lots.

+ The costs of maintenance activities are allocated to linear frontage along Van Nuys Boulevard since these services are anticipated·to provide direct benefit to sidewalks along the Boulevard.

+ The costs of program management activities are allocated on a pro rata basis to the preceding clusters of image enhancement/ special project and maintenance activities.

B. Calculation of Assessments The preceding methodology is applied to a database that has been constructed by the consultant team. The process for compiling the property database includes the following steps:

+ Property data was first obtained from the County of Los Angeles Assessor's Office.

+ County assessor property data was crosschecked with reliable private sector sources, including a real estate information service.

+ As an attachment to the Management Plan, an assessment notice will be sent to all property owners within the proposed BID. The assessment notice will contain property frontage and lot square footage information. Property owners may request final verification of data on or before July 1, 1998, which is one month prior to the submission of assessment information to the County Assessor.

A list of properties to be included in the BID is provided within Appendix 1.

Based upon the methodology, property data compiled by the consultant team, and the BID budget presented on page 11, approximate annual frontage and lot square footage assessments are calculated. Assessments will not exceed the following amounts during the first year of the BID:

• $ 4.71 per linear foot of frontage; plus • $ 0.115 per lot square foot

The method of assessment calculation is provided below the budget on page 11.

C. Annual Assessment Adjustments

CPI Adjustment: For the initial five years of the BID, annual assessments may be adjusted by the BID Advisory Board and approved by the City Council for annual changes in the Los Angeles Consumer Price Index (CPI) for all urban consumers, or 3%, whichever is less. Actual annual adjustments may range from 0% to 3%. In any event, assessments will not exceed the following levels:

Budget Adjustment: Any annual budget surplus or deficit will be rolled into the following year's ·BID budget. Assessments will be set accordingly, within the constraints of the CPI adjustment, to adjust for surpluses or deficits that are carried forward.

D. Time and Manner for Collecting Assessments

As provided by state law, the Van Nuys Boulevard Auto Row BID assessment will appear as a separate line item on annual property tax bills prepared by the County of Los Angeles. Property tax bills are generally distributed in the fall and payment is expected by lump sum or installment.

Existing laws for enforcement and appeal of property taxes apply to BID. assessments.

Properties owned by not-for-profit organizations that are exempt from ad valorem property taxes may not be subject to assessment, provided that the owner of such property submits valid documentation of exemption to the BID (see page 20). ·

E. Disestablishment

State law provides for the disestablishment of a BID pursuant to an annual review process. Each year that the BID is in existence, there will be a 30-day period during which the property owners will have the opportunity to request disestablishment of the district. This 30-day period begins each year on the anniversary day that the district was first established by City Council.

Within that 30-day period, if a written petition is submitted by the owners of real property who pay 50 percent (50%) or more of the assessments levied, the BID may be disestablished. The City Council will hold a public hearing on disestablishing the BID prior to actually doing so.

F. Government Assessments

The Van Nuys Boulevard Auto Row BID Management Plan does not assume that the City of Los Angeles and other government entities will pay assessments for the special benefits conferred to government-owned property within the boundaries of the BID. However, Article XIIl D of the California Constitution was added in November of 1996 to provide for these payments:

"Parcels wi.thin a district that a1'e owned or u"Sed by any agency, the State of Caltfornia or the United States shall not be exempt from assessments unless the agency can demonstrate by cl.ear and convincing evidence that those publicly owned parcels in fact receive no special benefit".

The federal government has also recently adopted a policy encouraging participation in BIDs. Through an executive order, the General Services Administration is encouraging that the federal government contract with BIDs for direct services, such as public safety and maintenance, that benefit federally owned properties.

The BID Property Owner's Committee has determined that if assessments are paid by the City and other governmental agencies, the overall improvement and activity plan budget will be increased accordingly.

City-owned property is limited to a parcel located at the northwest comer of Van Nuys Boulevard and Oxnard, accounting for less than 5% of the land square footage within the proposed BID.

VII. BUSINESS IMPROVEMENT DISTRICT GOVERNANCE

A. How BIDs are Governed

Consistent with business improvement district (BID) legislation throughout the nation, California's "Property and Business Improvement District Law of 1994" establishes a BID governance framework that allows property owners who pay assessments to determine how the assessments are used. The following components are required within a BID's governing structure:

+ City Council: Following the submission of petitions from property owners representing more than 50% of the assessments to be paid, the City Council holds a series of public hearings and then may form the BID. The BID is established by an ordinance of the City Council, therefore the BID is offidally a quasi­govemmental entity with the power to levy assessments on property.

+ Advisory Board: Prior to establishing the BID, the City Council must appoint an advisory board that will make recommendations on the operations of the BID. The advisory board is typically composed of property owners, businesses and other assessment payers within the BID. Per the state law, the Advisory Board is the policy-making body for the BID, governing the assessment levy and use of funds - it makes recommendations to the City Council on annual budgets and assessment rates.

• Management Organization: To deliver day-to-day BID improvements ~ --- -activities, the City Council enters into a contractual relationship with a private sector management organization. The management organization implements programs and is financed in part by proceeds from BID assessments. In most large cities throughout the nation, the management organization is a non-profit private sector business organization. If the management organization does not perform and provide a level of service that is acceptable to the City Council and the BID Advisory Board, then the contract can be terminated and an alternative management organization can be selected. ·

,For the Van Nuys Boulevard Auto Row BID, an advisory board and management organization structure is proposed that will m~t the following objectives:

+ Create and manage programs that carry out improvements and activities outlined in the Van Nuys Boulevard Auto Row BID Management Plan.

+ Maximize coordination with government and civic organizations to leverage resources and avoid duplication of services.

+ Deliver programs through a cost-effective non-bureaucratic and easy to access organizational structure.

+ Provide for accountability to those who pay.

B. Van Nuys Boulevard Auto Row BID Advisory Board

Consistent with the "Property and Business Improvement District Law of 1994" the BID Advisory Board would develop budgets and program priorities for the BID and authorize and monitor contracts with service providers.

The Advisory Board is proposed as a 5 to 7 member board that would be composed of property and business owners representing assessment payers by geographic location along the corridor and/ or industry segment. Industry segments that should be represented include:

+ Automobile dealerships; + Automobile-related services and parts; + Non-automobile-related services; + Retail.

Advisory board representatives should be sought with a mix of business and property types - i.e. small and large property owners. As required by the "Parking and Business Improvement District Law of 1994", at least one member of the Advisory Board must be a business licensee who is not a property owner.

The iidtial Advisory Board will be appointed by the City Council prior to~ ··· ·~­establishment of the BID. Initial nominations for Advisory Board members will be submitted by the BID Formation Steering Committee plus at-large nominations from assessment payers. Two to three year staggered terms are recommended. In subsequent years, nominations for Advisory Board members would be submitted to the City Council by the existing Advisory Board and at-large nominations from assessment payers. City Council would then appoint the advisory board.

C. Van Nuys Boulevard Auto Row BID Management Organization

The Advisory Board described on the preceding pages will influence the development of BID policies, budgets and assessments, but it will not implement day-to­day improvements and activities. The City Council, upon the recommendation of the Advisory Board, will contract with a management organization to deliver programs.

For the Van Nuys Boulevard Auto Row BID, a new management organization is proposed to run BID programs. Based upon a management organization model that is used widely in major cities throughout the nation, the new entity will be a 501(c)(6) non-profit private corporation.

Pursuant to a contract with the City Council to manage BID programs, the new management organization will provide central administration, communications and overall management of BID programs.

The management organization will be governed by a board of directors that is representative of major private sector interests in the Van Nuys Boulevard Auto Row BID, including property owners and businesses. Various public agencies and representatives of elected officials, such as the City of Los Angeles Police Department, City Council and Office of the Mayor, could also serve on the Management Corporation board to facilitate communication with the City. The initial board of directors and corporate structure of the new management organization will be developed by the BID Property Owner Committee prior to the establishment of the BID.

vm. CONTINUATION OF CITY SERVICES

Throughout the process to establish the Van Nuys Boulevard Auto Row BID, business and property owners have voiced concerns that the City of Los Angeles maintain existing services at verifiable "baseline" service levels. A formal base levels of service policy ensures that existing City services are enhanced, not replaced, by new BID improvements and activities.

The Los Angeles City Council has established a policy that aims to ensure that existing City services will continue to be provided within a BID: "It is the intent of the

. Council that the level of seroices presently being provided by the City in the area within the proposed.district will not 'be affected by the creation of the district or the levying of the proposed

~ assessments." (from the Resolution of Intention forming other existing BIDs in the City of Los Angeles.)

A similar commitment will be formalized prior to the establishment of the Van Nuys Boulevard Auto Row BID.

· IX. BUSINESS IMPROVEMENT DISTRICT RULES AND REGULATIONS

Pursuant to the Property and Business Improvement Law of 1994, a business improvement district (BID) may establish rules and regulations that uniquely apply to the district. Initial rules and regulations to be employed by the Van Nuys Boulevard Auto Row BID:

1. Assessment Policy on 501(c)(3) Organizations

An owner of real property located within the Property and Business Improvement District may reduce the amount of the assessment to be levied if all of the following conditions are met

a. The property owner is a non-profit corporation which has obtained federal tax­exemption under Internal Revenue Code Section 501(c)(3) or California franchise tax-exemption under Revenue and Taxation Code Section 23701d.

b. The class or category of real property is eligible for exemption, in whole or in part, from real property taxation.

c. The property owner makes the request in writing to the BID prior to the submission of the BID assessment rolls to the County Assessor, accompanied by documentation of the tax-exempt status of the property owner and the class or category of real property.

If all of these conditions are met, the amount of the assessment to be levied shall be reduced in the same proportion to the real property tax exemption granted to the property.

2. Competitive Bidding

Following the formation of the BID, the Advisory Board shall develop a bidding policy to purchase substantial amounts of services, products and/ or equipment. The policy will aim to maximize service quality, efficiency and cost effectiveness.

3. Treatment of Residential Housing

A 1996 revision to the Property and Business Improvement District I.aw of 1994 clarifies that properties zoned exclusively for residential use are exempt from BID assessments. For the Van Nuys Boulevard Auto Row BID, all property used exclusively

The Van Nuys Boulevard Auto Row BID will adopt a local purchasing preference policy that directs BID funded improvements and actiyities to utilize goods and services from area vendors provided that pricing and standards of quality remain competitive.

X. IMPLEMENTATION TIMETABLE

The Van Nuys Boulevard Auto Row BID is expected to be operational by January 1, 1999. In order to meet this goal, the following procedural timetable is anticipated:

This report is prepared, as directed by the City Council, in relation to the Van Nuys Boulevard Auto Row Business Improvement District pursuant to Section 3600 m,_ ~ of the California Streets and Highways Code (the "Property and Business Improvement District Law of 1994") and pursuant to the newly adopted Article XIIID Section 4(b) of the California Constitution (Proposition 218).

The Van Nuys Boulevard Auto Row Business Improvement District (the "BID") is designed to improve and benefit properties in the Van Nuys Boulevard Auto Row business area by providing image enhancement, maintenance programs, and district management. Only properties within the BID shall receive the direct benefit of the proposed impr9vements and activities. It is estimated that each property will benefit from the proposed improvements and activities. A detailed description of the improvements and activities to be provided is set forth in Exhipit A.

The duration of the proposed BID is five (5) years and an estimated budget for the BID improvements and activities is set forth in Exhibit B. The budget reflects a potential for an annual increase in the assessment, which may not exceed the annual increase in the consumer price index.

. Funding for the BID improvements and activities shall be derived from a property based assessment of each parcel in the BID, subject to any exemptions due to the use of particular parcel. A detailed description of the methodology for determining the benefit assessment for each parcel is set forth in Exhibit C.

This report includes the following attached exhibits:

EXHIBIT A: DESCRIPTION OF IMPROVEMENTS AND ACTIVITIES

The property and busin~ss owners in the District area determined that the following improvements and activities are top priority:

+ Image e~cement programs to promote a positive retail image for Van Nuys Boulevard in the Los Angeles regional market.

+ A consistent level of sidewalk and landscape maintenance along the corridor.

+ . Flexibility for special projects and initiatives that strengthen efforts to market and maintain the area.

+ Program management by a contract- director that can advocate on behalf of Van Nuys Boulevard businesses, advance community improvement initiatives and coordinate marketing programs and events:

Based upon these findings, four different improvement and activity centers are recommended for the Van Nuys Boulevard Auto Row BID. Final programs and budgets will be subject to the review and approval of the BID Advisory Board.

· Image Enhancement . Programs to enhance the retail image of the Van Nuys Bo1,1levard Auto Row were rated as high priorities by property and business owners throughout the BID study area. Several types of image enhancement activities are proposed: ·

+ District Identity: .The visual identity developed for the district through the marketing· plan will be reinforced through a variety of signage options, including tower signs to maximize Van Nuys Boulevard visibility from freeway access points and landmark and directional signage along the Boulevard.

+ Street Beautification and Parking Enhancement: Options to improve the visual appearance of Van Nuys Boulevard include decorative banners, landscaping and street trees, attractive directional signage, and street furniture, including additional trash receptacles. Funds for design and engineering will be provided to develop streetscape options throughout the district. Strategies.to. increase employee and customer parking will be incorporated into plans.

• Events and Community Relations: Events and community relations fnitiatives will aim to fortify a Van Nuys Boulevard identity and convey a positive community image to consumers~ investors and the media. Events will_ aim to capitalize on the Boulevard's

name recognition and nostalgic roots in the development of Los Angeles' automobile culture.

+ Planning and Design: In Year I ·of the Van Nuys Boulevard Auto Row BID, a marketing plan will be developed by a professional marketing firm to guide the subsequent five year allocation of BID marketing funds. Key outcomes of the marketing plan will include a V-an Nuys Boulevard consumer marketing strategy that aides both automob~e and non­automobile related businesses, including the identification of target markets and marketing tactics, a unified logo, design concepts for visually conveying a Van Nuys Boulevard identity through signage and banners, creation of a promotions and events calendar and media relations strategy.

Maintenance The Van Nuys Boulevard Auto Row BID will provide resources for a variety of maintenance activities throughout the district. Maintenance options, will enhance existing City services, include:

+ Daily sidewalk sweeping; + Periodic power washing of sidewalks; + P.eriodic removal of trash and debris; + Systematic graffiti removal; . + Daily maintenance of bus shelters and bus stops; + Maintenance of landscaping, trees, public art and other streetscape improvements in

public spaces that may be installed by the BID, property owners or the City.

The provision of maintenance activities will be determined by the BID Advisory Board. Maintenance services are expected to be managed by a private maintenance contractor that is selected pursuant to a competitive request for proposals.

Special Prqjects/Contingency The special projects/contingency fund will support district-wide improvements and activities that fortify an existing activity (i.e. image enhancement, maintenance and/or program management). Yearly budgets and allocations for the special projects/contingency fund will be determined by the BID Advisory Board. .

Program Management To reduce administrative expense and unnecessary overhead, Van Nuys Boulevard Auto Row BID improvements and activities will be managed by· a part-time contract manager. BID funds are also budgeted for bookkeeping, an annual audit and expenses required for Advisory Board meeting notices and other expenses. The final management structure will be subject to the review and approval of the BID Advisory Board.

City and County Administrative Costs: The program management component of the budget includes funds to reimburse costs incurred by the City and County to administer the collection and disbursement of BID assessments. The total improvement and activity plan budget for 1999 is projected at $276,923 with the following components:

• Jmage Enhancement: Image enhancement includes a variety of improvements and activities aimed to convey and market a positive consumer identity for Van Nuys Boulevard. Suggest~ first year expenditures include a .marketing plan, decorative banners, tower signage, special events and a street beautification and parking enhancement plan. The total 1999 image enhancement budget is projected at $180,000, accounting for 65.0 % of the total BID budget.

• Maintenance: Maintenance programs will aim to establish and maintain a uniform standard of cleanliness along the Van Nuys Boulevard corridor. Maintenance activities may include daily sidewalk sweeping, periodic power washing, periodic removal of trash and debris and systematic graffiti removal. To provide BID maintenance services, maintenance workers are budgeted for 60 hours per week. Maintenance costs amount to $39,930, or 14.4 %. of the overall BID budget.

• Special Projects/Contingency: A $15,000 special projects/contingency fund is budgeted to fortify BID. activities (i.e. image enhancement, maintenance and/or program management) as needed each program year. The special projects fund accounts for 5.4% of the overall BID budget.

• Program Management: $41,993 is budgeted for management and overhead costs associated with operating the BID, accounting for 15.2% of the BID budget.

In early 1998, business owners and civic leaders began to develop an improvement and activity plan for the Van Nuys eDistrict"). The District's primary objective is to enhance the image and provide maintenance and District management. To address these issues the District wants the City of Los Angeles to form a Property and Business Improvement District to finance the proposed improvements and activities ("Improvements") as outlined in Exhibit A. These Improvements will extend or are above those improvements the City of Los Angeles currently provides and will continue to provide. The property owners in the District area will bear the cost of the proposed Improvements through

. an assessment which will be calculated based on the special benefit each par~l receives from the proposed Improvements.·

The District is approximately a one-mile stretch of Van Nuys Boulevard, including an area bounded by Magnolia Boulevard to the south and Calvert Street to the north.

General The Property and Business Improvement District Law of 1994 and P~oposition 218 require that assessments be levied according to the special benefit each parcel receives from the improvements. Proposition 218 added to the state constitution Article XIIID S.ection 4(a) which states in part:

"'lhe proportionate special benefit derived by each ide,itifted parcel shall be determined in relationship to the entire'ty of the capital cost of a public improvement ... No assessment shall be imposed on any parcel which exceeds the reasonable cost of the proportianal special benefit conferred on that parcel ... Parcels within a district that are owned or vsed by any agency, the State <!f California or the United States shall not be exempt from assessment unless the agency can demonstrate by clear and convincing evidence that those publicly owned parcels in fact receive no special benefit. ''

Detennining the proportionate share of special benefit among the parcels of real. property, including the two government owned parcels, within the proposed l!l,SSessment district which benefit from the . proposed Improvements is the result of a four step process: 1) defining the proposed Improvements; 2) identifying how each parcel specially benefits from the proposed Improvements; 3) determining the amount of the special benefit each parcel receives from the proposed Improvements; and 4) apportioning the cost of the proposed Improvements to each parcel based on the special benefit that each parcel receives from the propos~d Improvements.

Assessment Method The proposed Improvements wiU provide a higher level of service than the City provides with City funds to those parcels in the District ar(?a. Therefore, every parcel in the District that benefits from the Improvements should pay its fair share of the costs based on that parcel's special benefit. The proposed Improvements will provide image enhancement, maintenance and special projects to every

parcel in the District. Since every parcel in the District is either commercial or business related they will all benefit from these Improvements.

The assessment method uses a combination of lot size and street front footage as weighting factors to apportion the costs of the Improvements to the .parcels in the District. Lot size distinguishes smaller size lots from larger size lots. Smaller lots require less public improvements than larger lots. The lots benefit directly from the image enhancement programs and special projects. Street front footage is relevant to the need for services along streets, sidewalks and building fronts. The longer the street front the _more required services. The street front benefits directly from the maintenance programs.

The total BID budget of $276,923 is divided into four main categories as shown in the table below and the assessment method for each is described following the table. ·

Image Enhancement, Special Projects and Program Management Every parcel and building in the District will benefit from image enhancement, special projects and program management. Therefore, eveJY parcel should pay its fair share of these improvement costs. Since all parcels and buildings benefit from these improvements lot square footage is used as the b~s to calculate assessments for these portions of the budget.

To calculate each parcel's assessment for these improvements divide the total budget amount of $229,856 ($180,000 + $15,000 + $34,856 (pro-rata share for Program Management)) by the total number of lot square feet 2,000,000 which equals $0.115 per lot square foot.

Maintenance Maintenance benefits every parqel in the district, therefore, every parcel should pay its fair share of the Maintenance cost. · The maintenance portion of the budget is aimed at cleaning the streets. and sidewalks and removing graffiti. Since maintenance services provide a higher level of service to the front of the building and the sidewalk the street front footage should be responsible for paying this portion of the budget and its.pro-rata share of the program management·budget.

To calculate each parcel's assessment for the Maintenance portion of the budget plus the pro-rata share of the program management budget, divide the total budget amount of $47,067 ($39,930 + $7,137 (pro-rata share for Program Management)) by the total number of linear street frontage 10,000 which equals $4.71 per linear street foot.

For example to calculate the-assessment for· a parcel that has a 20, 000 square foot lot and 100 linear feet multiply 20,000 by $0.115 (the assessment amount per lot square foot) plus multiply 100 by $4. 71 ( the assessment amount per linear foot) equals $2, 771 total parcel assessment.

Annual Assessment Adlustments CPI Adjustments: Total program revenue may be adjusted each year by the annual change in the Los Angeles Consumer Price Index (CPI) for all urban consumers, or 3 %, whichever is less. Actual annual increases will range from O % to 3 % and will be-subject to the annual review and approval of the BID Advisory Board.

The Van Nuys Boulevard Auto Row Management Corporation Board of Directors, the management corporation of the Van Nuys Boulevard Auto Row BID, and the Van Nuys Boulevard Auto Row BID Advisory Board recommend that the budget allocation in the Management District Plan be revised for the remaining months of the District, August

-through December 31, ~3.

The BID is proposing to reduce its services to a bare minimum until the contract with the City of Los Angeles. is expired. These reductions. are outlined in the attached revised Management District Plan. ·

For the past five years, and as outlined in the BID's Management District Plan, the Auto Row BID has been trying to install a tower sign along either the 405 .or 101 freeways. The BID has worked with two Council Offices and various City and State Departments to achieve this goal. The Board has been reserving funds over the past five years in hopes of seeing this project to fruition.

Since the BID is unable to utilize this assessment revenue for its original purpose,. ·the Advisory Board and the Management Corporation's Board of Directors have voted to return this money equitably to those stakeholders paying into the district.

The process of returning assessment monies to the stakeholders should begin immediately so that the revenue may be returned in an expeditious manner upon expiration of the district. It is expected that the process will be completed no later than December 31, 2003 and assessments will be returned to the stakeholders in January 29()4.

The District will not renew after the contract expires. There is over $770,000 in assessment revenue of which a portion is in the _"_::~: ~-::-.-.- :-..zcount (approximately $467,00) and a portion is being held by the Los Angeles City Clerk's Special Assessment Section (over $300,000 in 2003 assessments). Current anticipated expenses from August 1, 2003 through December 31, 2003 are outlined in the revised Plan and.will be paid from the BID's account.
