BACKGROUND

On 4-14-09 in the late afternoon and early evening hours members of the Drug Enforcement Agency-New Haven Task Force (herein

referred to as DEA-TF) were in the area of Maple St and Maple Branch and were watching a known street level drug dealer who was making

deliveries to various people and vehicles This known drug dealer is street named Capone and his real name is Nemiah Allen This male

has been detained and arrested on numerous cocassions by members of the Meriden Police Department the Narcotics Unit and this writer

On 4-15-09 beginning around 1830 hours surviellance was re-set up in the area of Maple StRandolph Ave and West Main St Again

members of the DEA-TF and members of the Meriden PO-Crime Suppression Unit (herein referred to as CSU) observed Capone and

another individual hanging out on Randolph Ave and West Main St Capone was observed going between individuals on the street and

into an apartment on Maple Branch Surviellance was then set up where members of both teams had a clear and unobstructed view of

Capone going between Randolph Ave where he was hanging out and meeting up with people and the residence on Maple Branch During

this surviellance it was observed that Capone would obtain money from the buyers and then walk up to a residence on Maple Branch with

the cash in his hand He would then exit the residence and return to the buyer and give the buyer an item END OF BACKGROUND

Subsequently on 4-15-09 at approximately 1845 hrs members of the DEA-TF observed a transaction between a male in a white van and

capone in the same methoed as previous noted in the background section Once the transaction was completed the van drove off and was

stopped approximately a block away The bag of Crack Cocaine was recovered from the operator who was cooperative The operator was

arrested and provided a written statement detailing the transcation between Capone and himself which is what we also witnessed Once

this arrest was made it was decided that we would observe several more transactions and attempt to make several more buyer arrests

before arresting Capone

We then observed Capone meet up with an individual in a minivan and receive money and go to the address on Maple Branch however

once Capone went back to meet up with the operator it was done inside a convenience store so this vehicle was not stopped

We then observed Capone and a second individual who was aSSisting Capone with his street dealing They walked to Lewis Ave and

halfway down the street met up with an unknown individual in the shadows and then turned around and walked back We never

apprehended the individual and Capone and the other individual went right back to the area of Randolph Ave and West Main St and hung

out

We then observed the individual with Capone go into a residence on Randolph Ave and Capone remained outside Subsequently the

male came outside and handed Capone a cell phone that he was talking on Capone took the phone and spoke with the caller and

immediately began walking across West Main St to Maple St At the same time Sgt MennOne of the DEA-TF had observed an Acura type

vehicle park on Maple Branch facing Maple Street As Capone made his way to this vehicle the Acura began flashing his high beams at

Capone who walked quickly over to the side of the Acura The interior light of the Acura came on and the operator of the vehicle and

Capone conducted a transaction Capone then walked away and the Acura drove off turning onto Maple St heading towards Springdale

~ve The vehicle drove off at a normal rate of speed and both the surviellance team in Sgt Mennones vehicle and the take down team in

his writers vehicle began to follow the Acura The Acura turned onto Cliff St and came out onto Grove Street and drove to Foster St

vlembers of CSU in the take down vehicle that this writer was driving caught up to the vehicle on Foster St at Grove St as the vehicle

~pproached the intersection (We came into the area from a different street and both our undercover vehicle and the Acura ended up at the

bur way intersection of Grove St and Foster together) The operator of the Acura looked over at the unmarked SUV that this writer was

iriving and then turned onto Foster St

[his writer observed that the license plate on the vehicle was CT Reg 589-UKV and this writer ran an NCIC check on the license plate

hrough Police Communications HQ advised that the license plate was registered to a 2000 Mazda Millenia 4-door color gray however the

)Iate was on a gold colored Acura TL HQ also advised that the registration had expired on 5-1-08 and had been cancelled as of 2-29-08

~Q also reported that the plate was in the name of BRANDY CLAYTON of 85 Windsor Ave in Meriden CT

It should be noted that it is common for drug users (aka drug buyers) to have unregistered cars since they spend their money on their

Iddiction and do not maintain other issues in their life such as the insurance and registration on their vehicle

Ve then continued to follow this vehicle for several miles while Det Lt Merrigan attempted to catch up to us to stop the vehicle with a

1arked cruiser As we followed the vehicle which made numerous turns it was plainly obvious that the operator knew he was being

)lIowed by an unmarked Police vehicle The operator was stopping at every intersection and waiting 15-30 seconds before going He had

laced his seat belt on and was using his blinker for every turn The operator went from driving without using these items to text book

riving He also was constantly looking back in his rear view mirror at us (This writer was driving the unmarked vehicle Det Visconti was in

fter making over approximately five more turns the vehicle came to the intersection on Camp St at Center St and pulled to the shoulder of

e road The traffic light on Camp St at Center St was red and there was a car at the light stopped in front of us It appeared that the

cura had pulled over as if we had emergency lights on and the operator was looking back at us At this point Oet Lt Merrigan had

dioed that he was still a distance away and this writer drove partially pass the Acura and stopped and Oet Visconti and Off Fonda exited

e undercover vehicle with their badges displayed hanging on chains around their neck Both told the operator that they were Police

fficers and Off Fonda actually grabbed his badge and pushed it out from his chest showing the operator This writer could also see the

perator clearly and the operator seemed calm and motion that it was not a problem Off Fonda then began to say something to the

perator who placed the car in reverse and began to back up Oet Visconti who was going to the passenger side of the Acura to cover

hat side during the MV stop (which is standard operating procedure taught to all Officers who are not going to be the main Officer talking

gt the operator) Det Visconti said something to the operator like Whoa leave the car in park as the car backing up surprised him

uddenly the car went forward right at Oet Visconti who had placed his hands on the hood of the car as it was driving at his legs The car

led up and Det Visconti who was now running backwards withb his hands still on the hood could not get out of the way The operator of

le Acura then took off at a high rate of speed and Oet Visconti was thrown up onto the hood of the car slamming into the windshield and

nding on the hood of the Acura on his rear end with his back against the windshield The vehicle had made a right turn onto Center St as

did this which prevented Oet Visconti from leaping out of the way before theincreased speed catapulted Oet Visconti onto the hood I

Both teams in the unmarked vehicle were completely helpless to do anything as Det Visconti was now being driven at over 50 MPH

Southbound on Center St while he was sitting on the hood of the vehicle Indian style holding onto the windshield wipers Both unmarked

vehicles then took off after the vehicle and we were radioing HQ what had just occurred The Acura drove one and a half blocks passing

Park St and drove a second City block approaching Pratt St As the vehicle approached Pratt St we could see that Det Visconti was rolling

slightly to his side while on the hood The Acura came upon a slow moving large vehicle and the Acura drove across the double yellow lines

into the NIB lane passing this vehicle As the Acura went to pass this vehicle the slow moving vehicle was actually making a left turn into a

driveway and the Acura struck the side of the slow moving vehicle spinning the slow moving vehicle at of the way When the Acura struck

the slow moving vehicle Det Visconti was shot off of the hood of the acura like a rocket and was thrown approximately 20-30 feet into

the parking lot of Meriden Glass Company at the corner of Center St and Pratt St

The Acura continued to travel SIB at a high rate of speed and never stopped or slowed down The Acura as it went around the slow moving

vehicle which was now heavily damaged nearly ran over Det Visconti who was laid out on the ground and appearred to be seriously

injured Sgt Mennone radioed to this writer that he would take care of Det Visconti and to go after the Acura Off Fonda and this writer

then went after the Acura which had just ran the red light on Center St at Pratt St still gOing SIB at a high rate of speed with no lights on

and debris from the Acura coming off of the car This writer tried to catch up to the car which was traveling at over 80 MPH on Center St as

this writer was doing approximately 60 MPH and could not catch up The Acura drove approximately a half mile coming to Uberty St which

had a red light The Acura ran the red light now traveling SIB on the one way section of Center Street approaching East Main St at a very

high rate of speed Because of the speed and highly populated neighborhood we did not try to keep up with the vehicle and gave its

location to Police HQ As we came upon the one way section of Center St there were two vehicles sideways on the side of the road and the

individuals were pointing towards East Main St to us This writer then drove up Center St to East Main St and upon reaching East Main St

there were several people on the sidewalk who were shaking their heads and talking This writer showed these individuals his badge and

said Police where did that car go The individuals stated several swear words towards the operator of the Acura and stated that it almost

ran them over and turned onto Broad St going SIB This writer then drove up to Broad St looking Southbound and observed that three

blocks up there were two Meriden Police cruisers on the side of Broad St at Olive St with their emergency lights on

Believing that they had the vehicle stopped this writer radioed to them and they stated that the Acura never came by them (They were on

an unrelated MV stop) At this point numerous Meriden Police Officers swarmed into the area and began checking numerous streets

looking for the vehicle During this time the vehicle was located abandon in a parking lot of a commercial business on Charles Street This

was found because a citizen called the Police Department reporting that a vehicle was dumped and the operator ran in a Westerly direction

towards Elm and Olive Streets Several perimiters were set up in the area and members of the Meriden Police and DEA Task Force were

joined by numerous State Troopers searching for the operator Several Troopers responded with a german shepard canine and a blood

hound canine and completed tracks from the abandon vehicle While the tracks were being done one of the Agents with the DEA was

approached by two individuals named Jessica Michonski and Daniel Pelrin They stated thatthey saw the male from the car running

towards Elm Street towards the Olive Street area This was the same direction that the two canine teams were also moving in Around the

same time Off DeGumbia found a blue sweat shirt on the side of a building on Olive St at Akron St that had fresh blood on it (It should

be noted that when Officers arrived at the Acura which had been dumped there were three bullet holes in the windshield and fresh blood in

the vehicle) This was also in the same direction that the canines were traveling on the scent of the suspect

This writer who had given out a physical description of the operator remembered that he was wearing a sweatshirt at the time A second

track was started from the sweatshirt and continued in a Westerly direction

t this time Off Fonda and this writer went back to the Randolph Ave area to look for Capone to arrest him for the previous sale case

o hours earlier (See 09-9109) and attempt to find out who was the male in the Acura

As we turned onto Randolph Ave we observed Capone sitting on a porch where he was hanging out making his sales We exited our

vehicle and Capone looked at us and started to get up This writer yelled at him to stay there that we were the Police (however Capone

clearly knew this writer was a Narcotics Detective with the Meriden Police from numerous previous arrests including last year where this

writer arrested him and he was given jail time and was just recently released Members of CSU had just stopped him a week earlier for

suspected drug activity and this writer had a conversation with him)

Capone ignored this writers commands and he was told that he was under arrest He tried to take off and this writer knocked him to the

ground and he raised his hands trying to either punch this writer or push this writer away from him so he could escape This writer struck

him several times and Off Fonda assisted with forcibly placing his hands behind his back and he was handcuffed Because every Police

ruiser and Officer in the City was tied up with the search for the suspect or protecting the different scenes Off Fonda and this writer

ransported Capone to the Police Department Capone was advised of what happen and was given his Miranda Warnings He stated

hat he only knew the guy in the Acura as Fleef a dealer from Waterbury who makes deliveries of Crack Cocaine He stated that Fleet

Nas going to give him some Crack for making sales for him yet he did not and drove off As this writer was talking with Capone HQ

alled this writer and asked for a call HQ reported that a female named BRANDY CLAYTON had called the Police Department and wanted

0 report her Acura stolen from her home HQ reported that this female was at the Broad St Citgo waiting for the Police because she did

lot have a phone that worked When Capone who was with us heard the name Brandy he stated that that is Fleets girlfriend and he

an ID her He also stated that Fleets cell phone number is in his phone and he showed Off Fonda the outgoing call Capone made to

It should be noted that for over a year members of CSU have tried to identify Fleet who we have received information about from

umerous arrestees and several Informants We also made a controlled purchase from Fleet in the fall of 2008 using a Cooperative Witness

owever were unable to ID him then were unable to make a second purchase so an arrest warrant was never completed

fficer Fonda and this writer then transported Capone to the Broad St Citgo where this writer met up with a female who was ID as Brandy

layton capone told Off Fonda who stayed in the vehicle that that girl is Fleetsll girlfriend This writer then asked this female if she

ailed the Police Department and she stated that she did and if I was a Detective I stated that I was and she said that she was with her

ister (who was present) and that her sister brought her home and she found that her car had been stolen She stated that she had no idea

ho took her car and that it was not registered she had her old license plate from her old vehicle on it This writer asked her if she had the

eys to the car and she stated that she did that the ignition must of been popped on the vehicle

It should be noted that Sgt Zimnoch radioed that he is very familiar with Brandy Clayton and that she runs with various drug dealers

lcluding a male named Kennedy Johnson who this writer has arrested on numerous occassions He also stated that the igntion on the

cura was not damaged

his writer then confronted this female with the fact that her car had been involved in a drug transaction that the guy that was driving the

ura struck and seriously injured a Police Detective with the car and that the operator may have been shot in the v~_hicle

is female did not seemed fazed by this and she was asked what her boyfriends street name was and she stated that it was Fleet She

s asked what his real name was and she stated that it was Kareem Thomas and that he was around 19 years old She stated that she

s not seen him for several days and that he was having an affair with another girl and she dumped him She was asked what his cell

one was and she stated that it was (which the same phone number given to us by Capone) She was then confronted

out the ignition not being damaged on her car and that the operator had a set of keys to the car with him She stated that she has a

cond set of keys to the car and they should be in the apartment or the car At this time several more Officers Detectives and Supervisors

rived at the Citgo to assist Ms Claytons sister who was standing by asked if she could leave as she does not normally associate with

andy and was just hanging out with her tonight The sister stated that she does not know or has seen her sister Brandys boyfriend The

Clayton was then asked if she was familiar with a male named Capone and was with Fleet when he conducted transactions with

apone but knows nothing about drug dealing Ms Clayton was then asked if we could search her apartment on Twiss Ave (a block

vay) for Fleet and she said that we could and restated that she has not seen or talked with him for several days She signed a consent to

en this information about the cell phone location was broadcasted over the Police Radio Sgt Zimnoch had stated that Brandy Claytons

hin minutes from this information being broadcasted Officer DeGumbia who was in the rear of 33 Galloppi was approached by an

ividual from inside 33 Galloppi This individual was ID as Dawn Zaler the resident of 33 Galloppi and the sister of BRANDY CLAYTON

asked him who he was looking for and Off DeGumbia responded that he was searching for a person Ms Zaler asked are you looking

Fleet and Off DeGumbia stated that he was Ms Zaler then stated that Fleet was inside the house hiding and allowed Officers and

ectives to enter the home Ms Zaler told Officers that he was in the house somewhere and several Officers found him hiding in a closet

I bedroom under clothes He at first refused to exit the closet and because Officers were told by the residents in the home that there

-e guns in the home several Officers ordered him to show his hands He at first only showed one hand and Officers grabbed him and he

struck several times until the other hand was displayed He was then handcuffed and led out of the home

Fonda and this writer who had dropped Caponelf off at the Police station for processing had arrived on Galloppi around the same time

observed the male in custody in the home This was the same male that we saw drive by us in the Acura after the transaction the

same male that had pulled over in the Acura on Camp St near Center St for Officers and the same male who intentionally struck Det

Visconti with the Acura drove approximately 3 blocks with Det Visconti on the hood of the car and struck a vehicle seriously injuring Det

Visconti the same male who then eluded Police by vehicle and on foot for several hours till his apprehension This male was then positively

identified as Kareem Thomas the boyfriend of Brandy Clayton

Located in the closet where the male was hiding was a cell phone with blood on it This cell phone was seized and found to be cell phone

number the same number that Capone called to order a quantity of Crack Cocaine and the same number that BrandyI

stated that belongs to her boyfriend Kareem Thomas AKA Fleet

At this pOint Detective Clements interviewed and took written statements from Dawn laler the resident of 33 Galloppi and the sister

Wendy Trella who had actually gone back to 33 Galloppi after leaving this writer and her sister Brandy Clayton behind at the Citgo Gas

station a half hour earlier

Dawn laler stated in her two and a half page written sworn statement the following

Sometime after 8 PM her sister Wendy Trella woke her up and stated that We have a problem She stated that Wendy went on to state

that there was a bad drug deal and a cop was in critical condition and that Fleet had something to do with it and came to our house and

was hiding in it (It should be noted that Wendy Trella had this informnation from this writer who had told her a half hour earlier when she

lied saying that she did not know Fleet or where he was when all along he was in their families home hiding) Ms laler continued to state

that she went into the kitchen and saw Fleet who she knows and he said to her This is Bad She stated that she told him to leave and

he began begging her not to make him leave and to not do this to me She stated that she told him to give himself up as the cops were 1

outside and told the Police She stated that she then let the Police in and they started searching the home as he went and hid somewhere

She stated that he was apprehended and as he was being escorted out of the home he said to her Why Why Why She stated that she

has known Fleet for about a year or two and knows his first name as Kareem and that he has been dating Brandy for that time

Separately and without being present for the interview of Dawn Zaler Det Clements interviewed and took a written statement from Wendy

Trella Det Clements also did this not knowing that this writer had previously interviewed Ms Trella at the Citgo where Brandy Clayton

was trying to file a false stolen MV complaint

Ms Trella then provided a 3 page writtenl signed sworn statement as follows

That Brandy called her and wanted her to come pick her up to take her to their fathers house at 33 Galloppi Ms Trella stated that this was

at around 9PM (a half hour after Det Visconti had been struck and injured by Brandys car) Ms Trella stated that when Brandy and her

arrived at 33 Galloppi Fleet was there in the house as well and had a conversation with Brandy his Girlfriend She stated that Brandy then

asked to get a ride back to her house to pick up some clothes for her child (Brandys) who lives with Brandys father Ms Trella stated that

when she got back to the house Brandy said that her car was stolen and called the Police from the Citgo Gas Station Ms Trella stated that

a Detective at the Citgo Gas Station told her that the car had been involved in a shooting and that Fleet was involved She stated that when

she returned to 33 Galloppi she woke up her sister Dawn and told her what was going on and saw that Fleet was still there She stated that

investigations completed for the accident involving the car that was turning into a driveway that Thomas had struck while Det Visconti was

Nith Visconti on it to the speeds of 80+ MPH had he not struck the car Det Visconti would have been more seriously injured or probably
