versity (WSU) intends to lease available land and build-ing space. The university will consider leasing such property and/or space to those whose presence on cam-pus would advance the university’s applied learning vi-sion or its mission as an educational, cultural, and eco-nomic driver for Kansas and the greater public good, or otherwise provide supporting services and amenities to the campus community (such as restaurants, retail establishments, financial institutions, etc.). Notice of Intent to Lease Real PropertyPublic notice is hereby given that Wichita State Uni-

versity (WSU) intends to directly lease, and indirectly sublease through its affiliate corporation Wichita State Innovation Alliance, Inc., subject to all required state approvals, an approximate ground area consisting of 150,000 square feet or less with the potential for expan-sion for parking, for the private development of one or more partnership buildings. This private development shall be located west of Oliver, between 17th and 18th streets, on the Wichita State University main campus. The university is interested in leasing such ground to any individual, organization, or entity whose presence on campus would advance the university’s applied learn-ing vision or its mission as an educational, cultural, and economic driver for Kansas and the greater public good, and specifically an emphasis on supporting and growing advanced laboratories for research, testing, and innova-tion in data infrastructure/storage, video surveillance storage, IOT, security, analytics, visualization/modeling, and machine learning/AI. The university intends to lease such ground for any period of time up to sixty-five years, but extended terms and renewal options would be con-sidered. Interested tenants must be willing to be a good fit with the university’s educational mission and identify anticipated benefits to the university, its students, and the WSU community (i.e. applied learning, joint research, faculty start-up, WSU curriculum or program support, etc.), and must agree to the essential ground lease terms and restrictive covenants. Interested tenants will be evaluated on: proposal terms, demonstrated benefit to WSU, design concepts, financial stability, and proposed use. Rental rate shall be assessed per leased or leasable square foot of the building but is negotiable based on term of lease and benefit to the university. The university will consider serious offers and inquiries with detailed proposal terms from any financially qualified individu-al, group, organization, or company and such offers will

Sealed bids for Old Town – Area 1 Street Lighting Proj-ect 2020 CDBG will be accepted by the City of Lenexa, Kansas at the Community Development Department, Lenexa City Hall, 17101 W. 87th St. Pkwy., Lenexa, KS 66219 until 10:00 a.m. (CST) March 10, 2020, at which time bids will be publicly opened and read aloud at the Lenexa City Hall. Any bid received after the designated closing time will not be considered and will be returned unopened.

All bids shall be submitted to the Community Devel-opment Department Customer Service Staff (Main Lev-el) in sealed envelopes addressed to the City of Lenexa, Kansas, Attention: City Clerk, and marked “Bid for: Old Town – Area 1 Street Lighting Project 2020 CDBG. insurance certificates and other required documents shall have been furnished and the contract documents have been executed by the successful bidder.

In the event the low bidder is unable to execute the contract, for whatever reason, within the time provided in the Notice of Award, the city may annul the Notice of Award and the bid deposit may be forfeited and the city shall exercise its legal prerogatives, including, but not limited to, enforcement of its rights as to the bid security or specific performance.

The city reserves the right to accept or reject any and all bids and to waive any technicalities or irregularities therein. Bids may be modified or withdrawn by written request of the bidder received in the office of City Clerk, prior to the time and date for bid opening.

From and after the release of this notice, any party in-tending to bid on the above referenced project, includ-ing their officers, employees, agents, or contractors are specifically prohibited from communicating with any elected or appointed official of the city, directly or indi-rectly, with regard to the award of the contract for the project listed above, except as specifically authorized by the instructions to bidders. Any such unauthorized com-munication may result in the automatic disqualification of such bidder.

All bidders agree that rejection shall create no liability on the part of city because of such rejection, and the filing of any bid in response to this notice shall constitute an agreement of the bidder to these conditions.

Notice of Permit Modifications at Hazardous Waste Facilities

The Hazardous Waste Permits Section of the Bureau of Waste Management (BWM) has available for review a list of all approved permit modifications for Resource Con-servation and Recovery Act (RCRA) permitted facilities that treat, store, or dispose of hazardous waste in Kansas. The list has been updated to reflect permit modifications approved in 2019 and is available for review at http://www.kdheks.gov/waste/p_pubnot_hw.html.

The publication of this notice fulfills the requirement of a Memorandum of Agreement (MOA) between the Kansas Department of Health and Environment and the Environmental Protection Agency (EPA). The MOA es-tablishes policies, responsibilities, and procedures for the State of Kansas’s Hazardous Waste program authorized under Section 3006 of RCRA by EPA Region 7 Adminis-trator on June 27, 2013.

Notice of Application for a Municipal Solid Waste Landfill

The Kansas Department of Health and Environment (KDHE) received an application from Haskell County for a new Municipal Solid Waste Landfill located at 475 CR 210, Satanta, Kansas.

The applicant proposes a total facility permitted area of approximately 160.49 acres, and a disposal area of ap-proximately 108.33 acres.

The Haskell County Commissioners have certified that the application described herein is consistent with the county’s solid waste management plan and compatible with surrounding land use. KDHE has reviewed the ap-plication and found it to be in conformance with state solid waste statutes and regulations.

KDHE is providing public notice for the new permit application by Haskell County. A final decision to issue the permit has not been made, and KDHE will consider information gathered during the public comment period before making a final decision. A copy of the permit ap-plication, engineering drawings, and draft permit with respect to this permit action will be available for public review at www.kdheks.gov/waste from February 20, 2020 through March 23, 2020, and during normal busi-ness hours at the following locations:

Notice Concerning Proposed Kansas Air Quality Class I Operating Permit Renewal

Notice is hereby given that the Kansas Department of Health and Environment (KDHE) is soliciting comments regarding a proposed air quality operating permit. Cof-feyville Resources Crude Transportation, LLC – Broome Station has applied for a Class I operating permit renew-al in accordance with the provisions of K.A.R. 28-19-510 et al. The purpose of a Class I permit is to identify the sources and types of regulated air pollutants emitted from the facility; the emission limitations, standards, and requirements applicable to each source; and the moni-toring, record keeping, and reporting requirements ap-plicable to each source as of the effective date of permit issuance.

Coffeyville Resources Crude Transportation, LLC – Broome Station, PO Box 3516, Bartlesville, OK 74006, owns and operates a crude oil storage and transportation station located at Section 4, Township 35S, Range 14E, Montgomery County, Kansas.

A copy of the proposed permit, permit application, all supporting documentation, and all information re-lied upon during the permit application review process are available for public review during normal business hours of 8:00 a.m. to 5:00 p.m. at the KDHE, Bureau of Air (BOA), 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366 and at the Southeast District Office, 308 W. 14th St. Chanute, KS 66720. To obtain or review the pro-posed permit and supporting documentation, contact Allan Ddamulira, 785-296-1691, at the central office of the KDHE or Doug Cole, 620-860-7235, at the Southeast District Office. The standard departmental cost will be assessed for any copies requested. The proposed permit, accompanied with supporting information, is available, free of charge, at the KDHE BOA Public Notice website, http://www.kdheks.gov/bar/publicnotice.html.

Please direct written comments or questions regarding the proposed permit to Allan Ddamulira, KDHE, BOA, 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366. In order to be considered in formulating a final permit de-cision, written comments must be received no later than 12:00 p.m. Monday, March 23, 2020.

A person may request a public hearing be held on the proposed permit. The request for a public hearing shall be in writing and set forth the basis for the request. The written request must be submitted to Allan Ddamulira, KDHE BOA, 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366, no later than 12:00 p.m. Monday, March 23, 2020 in order for the Secretary of Health and Environ-ment to consider the request.

The U.S. Environmental Protection Agency has a 45-day review period, which will start concurrently with the public comment period, within which to object to the proposed permit. If the EPA has not objected in writing to the issuance of the permit within the 45-day review period, any person may petition the administrator of the EPA to review the permit. The 60-day public petition pe-riod will directly follow the EPA’s 45-day review period.

Interested parties may contact KDHE to determine if the EPA’s 45-day review period has been waived.

Any such petition shall be based only on objections to the permit that were raised with reasonable specificity during the public comment period provided for in this notice, unless the petitioner demonstrates that it was im-practicable to raise such objections within such period, or unless the grounds for such objection arose after such period. Notice Concerning Proposed Kansas Air Quality Class I Operating Permit Renewal

Notice is hereby given that the Kansas Department of Health and Environment (KDHE) is soliciting comments regarding a proposed air quality operating permit. Nat-ural Gas Pipeline Company of America, LLC has applied for a Class I operating permit renewal in accordance with the provisions of K.A.R. 28-19-510 et al. The purpose of a Class I permit is to identify the sources and types of reg-ulated air pollutants emitted from the facility; the emis-sion limitations, standards, and requirements applicable to each source; and the monitoring, record keeping, and reporting requirements applicable to each source as of the effective date of permit issuance.

Natural Gas Pipeline Company of America, LLC, 2 N. Nevada Ave., Colorado Springs, CO 80903, owns and operates a natural gas compression station located at S7, T8S, R4W, Cloud County, Kansas.

A copy of the proposed permit, permit application, all supporting documentation, and all information re-lied upon during the permit application review process are available for public review during normal business hours of 8:00 a.m. to 5:00 p.m. at the KDHE, Bureau of Air (BOA), 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366 and at the North Central District Office, 251 Market Pl., Suite D, Salina, KS 67401. In order to be considered in formulating a final permit de-cision, written comments must be received no later than 12:00 p.m. Monday, March 23, 2020.

A person may request a public hearing be held on the proposed permit. The request for a public hearing shall be in writing and set forth the basis for the request. The written request must be submitted to Allan Ddamulira, KDHE BOA, 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366, no later than 12:00 p.m. Monday, March 23, 2020 in order for the Secretary of Health and Environ-ment to consider the request.

The U.S. Environmental Protection Agency has a 45-day review period, which will start concurrently with the public comment period, within which to object to the proposed permit. If the EPA has not objected in writing to the issuance of the permit within the 45-day review period, any person may petition the administrator of the EPA to review the permit. The 60-day public petition pe-riod will directly follow the EPA’s 45-day review period. Interested parties may contact KDHE to determine if the EPA’s 45-day review period has been waived.

Any such petition shall be based only on objections to the permit that were raised with reasonable specificity during the public comment period provided for in this notice, unless the petitioner demonstrates that it was im-practicable to raise such objections within such period, or unless the grounds for such objection arose after such period. The proposed action is to reissue an existing pretreatment permit for an existing facility. This facility manufactures metal hand tools. Tools are processed in a black oxide (metal coloring) process, which is considered a conversion coating operation. Outfall 001 consists of process wastewater from the rinse tanks in the metal coloring oper-ation. Outfall 002 consists of heat treat rinse water. Wastes from two parts washing operations are not discharged to the city sewer but are hauled off-site for treatment and disposal. The proposed permit con-tains pretreatment limitations for pH, total toxic organics, cadmium, chromium, copper, lead, nickel, silver, zinc, and cyanide.

It is expected the analysis will include a thorough review of KDOT’s cur-rent policies, review of policies of other states that have implemented Performance-Based Practical Design, and development of guidelines for KDOT that are based on factors that include, but are not limited to traffic volume, truck volume, speed, alignment, and route classification. Tools that may be used in performing the analysis in-clude: Highway Safety Manual (HSM), Interactive High-way Safety Design Model (IHSDM), United States Road Assessment Program (usRAP), Roadside Safety Analy-sis Program (RSAP) or other similar analysis tools. The analysis would include applying the analytical tools to determine minimum values and guidance for lane and shoulder widths on non-interstate routes on the state highway system. In addition, the project will include the development of objective guidance on recommendations for maintenance of traffic (MOT) on state highway bridge replacement and repair projects. This guidance will con-

sider the various approaches for handling traffic during construction and is to be based on a benefit/cost approach that considers factors such as user costs (time delay and adverse travel cost for both passenger cars and trucks), construction time, and construction cost estimates.

It is anticipated that this will be a multi-phase contract. These activities would be considered phase 1 with a target completion date of September 30, 2020. Additional phases, if added, would include similar analyses of other design elements incorporation into KDOT’s performance-based practical design policies. Proficient abilities in such areas as highway geometric design, highway capacity analysis, and traffic analysis modeling are required.Qualifications-Based Selection Process

K.A.R. 28-44-12. General provisions. Updates the ac-ceptable forms of payment. Adds a statement of penalty fees for owner or operator non-compliance, specifies re-quired compliance dates, and provides for contractor li-cense suspension or revocation if specified requirements are not met.

K.A.R. 28-44-13. Program scope. Updates adoption by reference to the July 1, 2015 40 C.F.R. 280 to meet Tech-nical Standards and Corrective Action Requirements for Owners and Operators of Underground Storage Tanks (UST). Adds requirements for previously deferred stor-age tank systems.

K.A.R. 28-44-14. Definitions. Removes defined terms found in the Kansas Storage Tank Act and federal regu-lations. Adds adopted defined terms of 40 C.F.R. 280.12, 280.92, and 280.250. Adds the following terms: “drop ticket,” “EPA,” “installation,” “license,” “out-of-service,” “site assessment,” “storage tank operation,” “these regu-lations,” and “UST remover.”

K.A.R. 28-44-15. Application for installation or mod-ification of an underground storage tank. Adds the re-quirement of installing an anchoring system at all times. Increases the tank installation application fee from $20/tank to $100/tank and includes the UST registration fee and the first-year operating permit fee. Adopts by refer-ence the Kansas Storage Tank Program Document.

K.A.R. 28-44-16. Underground storage tank systems: design, construction, installation, modification, and no-tification. Updates adoption by reference to the July 1, 2015 40 C.F.R. 280 to meet Technical Standards and Cor-rective Action Requirements for Owners and Operators of USTs. Adds requirements for secondary containment and under-dispenser containment (UDC), implement-ed in 2013. Adds a reference to the Kansas Storage Tank Program Document that describes additional methods of corrosion protection.

K.A.R. 28-44-17. Underground storage tank registra-tion and operating permit. Separates registration no-tification fees and operating permit fees. Increases the one-time UST registration notification fee from $10/tank to $20/tank and the late penalty from $10/facility to $50/tank. Increases the annual UST operating permit fee from $10/tank to $25/tank and increases the late penalty from $10/facility to $50/tank. Requires an additional late pen-alty of $100/tank if documents or payment, or both, have not been received by August 1 each year. Adds a refer-ence to the Kansas Storage Tank Program Document.

K.A.R. 28-44-18. Registration of nonregulated under-ground storage tanks. Updates and clarifies language for current regulatory style.

K.A.R. 28-44-19. General operating requirements. Up-dates adoption by reference to the July 1, 2015 40 C.F.R. 280 to meet Technical Standards and Corrective Action Requirements for Owners and Operators of USTs. Adds 40 C.F.R. 280.35 and 280.36 that add requirements and compliance dates for various equipment testing and the enhanced walkthrough inspections. Adds a reference to the Kansas Storage Tank Program Document.

K.A.R. 28-44-20. Underground storage tank contrac-tor licensing. Updates and clarifies language for current regulatory style.

K.A.R. 28-44-21. Underground storage tank installer and remover licensing. Provides for a combination of installer and remover licenses. Adds a reference to the Kansas Storage Tank Program Document.

K.A.R. 28-44-22. Underground storage tank tester li-censing. Provides for a combination of tester licenses. Adds a reference to the Kansas Storage Tank Program Document.

K.A.R. 28-44-23. Release detection. Updates adoption by reference to the July 1, 2015 40 C.F.R. 280 to meet Tech-nical Standards and Corrective Action Requirements for Owners and Operators of USTs. Adds new release de-tection compliance dates and requirements for waste oil storage tanks and standby generator tanks. Removes va-por monitoring and groundwater monitoring as accept-able methods of release detection at storage tank facilities except that vapor monitoring can be used for two types of previously deferred tanks.

K.A.R. 28-44-24. Release reporting, investigation, and confirmation. Updates adoption by reference to the July 1, 2015 40 C.F.R. 280 to meet Technical Standards and Corrective Action Requirements for Owners and Oper-ators of USTs.

K.A.R. 28-44-26. Out-of-service UST systems and clo-sure. Updates adoption by reference to the July 1, 2015 40 C.F.R. 280 to meet Technical Standards and Corrective Action Requirements for Owners and Operators of USTs. Removes vapor monitoring and groundwater monitor-ing as acceptable methods of release detection at storage tank facilities. Provides for enhanced timing criteria for permanent closure of USTs.

K.A.R. 28-44-27. Financial responsibility. Updates and revises adoption by reference to the July 1, 2015 40 C.F.R. 280 to meet Technical Standards and Corrective Action Requirements for Owners and Operators of USTs. Adds an exception to a full adoption of the federal reg-ulation subpart to clarify wording in related insurance documents pertaining to the Petroleum Storage Tank Re-lease Trust Fund.

K.A.R. 28-44-29. Aboveground storage tank operat-ing permit. Increases the late penalty from $10/facility to $50/tank.

K.A.R. 28-44-30. Operator training and requirements. New regulation establishing requirements for owners and operators to designate different classes of operators for each UST system. Requires designated operators to be trained every 4 years. Removes the option for opera-tors to complete a comparable exam. Adopts by reference 40 C.F.R. 280.240 through 280.245. Adds the requirement that the designated Class A operator reside or be sta-tioned within 4 hours of their managed facilities. Adds a reference to the Kansas Storage Tank Program Document that describes additional testing requirements for Class A and Class B operators and adds that Class C operators shall be trained by a Class A or Class B operator.

K.A.R. 28-44-31. UST systems with field-constructed tanks and airport hydrant fuel distribution systems. New regulation establishing requirements for owners and operators of UST systems that were previously de-ferred from federal and state storage tank regulations with adoption by reference of the July 1, 2015 40 C.F.R. 280.251 and 280.252. Adds a reference to the Kansas Stor-age Tank Program Document that includes the scheduled requirements for compliance.Economic Impact:

Cost to the agency: The proposed regulations will not increase costs to the agency.

Cost to the public and regulated community: The an-nual cost to the regulated communities is $1,027,403.00. The regulated entities include businesses and local gov-ernments who own or operate underground storage tanks containing regulated substances. The estimated cost of pass-through to non-regulated businesses and the public is not anticipated to be included in the cost of fuel at the pump.

Cost to other governmental agencies or units: There are no known costs to other governmental agencies, unless they own or operate an underground storage tank as de-scribed above.

A detailed economic impact is provided in the eco-nomic impact statement that is available from the agency contact person or at the KDHE Storage Tank Section web-site, as listed below.

The time period between the publication of this notice and the scheduled hearing constitutes a 60-day public comment period for the purpose of receiving written public comments on the proposed regulations. A public hearing will be conducted by the Wildlife, Parks and Tourism Commission at 6:30 p.m. Thursday, March 26, 2020, at the Kansas State Historical Society and Museum, 6425 SW 6th Ave., Topeka, Kansas, to consider the approval and adoption of the proposed regulations of the Kansas Department of Wildlife, Parks and Tourism.

A general discussion and workshop meeting on the business of the Wildlife, Parks and Tourism Commis-sion will begin at 1:30 p.m., March 26, 2020 at the lo-cation listed above. The meeting will recess at approx-imately 5:00 p.m. and then resume at 6:30 p.m. at the same location for the regulatory hearing and more busi-ness. There will be public comment periods at the be-ginning of the afternoon and evening meeting for any issues not on the agenda and additional comment pe-riods will be available during the meeting on agenda items. Old and new business may also be discussed at this time. If necessary to complete business matters, the Commission will reconvene at 9:00 a.m. March 27, 2020 at the location listed above.

K.A.R. 115-25-7. This exempt regulation sets the sea-son, bag limit, and permits for antelope. The proposed version of the regulation would adjust the season dates and permit numbers for the new year.

Economic Impact Summary: The proposed version of the regulation is expected to generate $36,532 to the agency, all of which would accrue to the wildlife fee fund and generate a corresponding collateral economic impact to the State of Kansas estimated at $940,512. Otherwise, no substantial negative economic impact to the depart-ment, other state agencies, small businesses, or individu-al members of the public is anticipated.

Article 19.—VICTIM INFORMATION AND NOTIFICATION EVERYDAY ADVISORY BOARD

16-19-1. Definitions. Each of the following terms, as used in this article of the attorney general’s regulations, shall have the meaning specified in this regulation:

(a) “Board” means the advisory board appointed by the attorney general.

(b) “Chairperson” means the VINE coordinator.(c) “VINE coordinator” means the person appointed

by the attorney general to oversee the implementation and operation of the VINE system throughout the state.

(d) “VINE system” means the Kansas victim infor-mation and notification everyday system, which allows victims of crime and the general public to use the tele-phone, a mobile application, or the internet to search for information regarding the custody status of an offender housed in a Kansas county jail and to register to receive notification by telephone, text message, or electronic mail, or any combination of these, whenever the offend-er’s custody status changes. (Authorized by and imple-menting K.S.A. 75-771; effective March 6, 2020.)16-19-2. Membership; meetings. (a) The board is

hereby established by this regulation. The board shall consist of the following members appointed by the attor-ney general:

(1) The VINE coordinator, who shall serve as the chair-person;

(2) a representative of the Kansas sheriffs’ association, who shall be appointed in consultation with and agree-ment of the Kansas sheriffs’ association;

(3) a representative from a victim advocacy organiza-tion; and

(4) up to two other individuals as deemed necessary by the attorney general.

(b) The board shall meet upon the call of the chairper-son and shall maintain minutes of each meeting. (Au-thorized by and implementing K.S.A. 75-771; effective March 6, 2020.)16-19-3. Duties. (a) The board shall make recom-

mendations for the implementation and operation of the VINE system to the attorney general.

(b) To fulfill its duties, the board shall have the author-ity to perform the following:

(1) Take testimony or gather and receive information;(2) establish subcommittees or working groups on

particular topics, which may be composed exclusively of members of the board or may, at the discretion of the chairperson, include persons who are not members of the board;

(3) coordinate and engage in activities for educa-tion, outreach, and awareness of the services provided through the VINE system; and

(4) undertake any other tasks as may be requested by the attorney general.

(c) The board and members of established subcommit-tees or working groups shall comply with the Kansas open meetings act and the Kansas open records act.

(d) The board shall have the authority to request legal counsel and any other staff for its support from the office of the attorney general. (Authorized by and implement-ing K.S.A. 75-771; effective March 6, 2020.)
