1. Chair Agostinelli called the meeting to Order at 4:04 p.m.

3. Approval of the Agenda: Peregon moved and Wenzel seconded the approval of the Agenda. Motion Carried.

4. Approval of Minutes: Wenzel moved and Ferguson seconded the approval of January 19, 2017 minutes. Motion Carried.

5. Citizens Comments: 8 citizens present. No comments.

6. Consent Agenda – Invoices

a. $ 983.25 – Varnum Invoice – Stryker Project

Carew moved and Milks seconded the approval of Consent Agenda. Motion Carried.

7. Discussion and/or Action Calendar

a. Discussion/Action: 343 W. Prairie (former Cole Krum Property), Village of Vicksburg i. Part I Application

Dan and Kelly Oswalt gave brief presentation regarding proposed project at site. The former Cole Krum car dealership/repair shop had been in business since 1964 but property has been vacant for 5 years. There is potential petroleum based contamination. The Oswalt’s are planning to renovate the first floor as a commercial lease space and the second floor into 3-5 residential units. This would include the addition of second story to the building. They are currently in discussions with interested tenants for the commercial space.

Purchase Agreement in place and wanting to start construction fall of 2017.

Grimwood moved and Wenzel seconded the approval of Part I Application contingent upon receipt of application fee. Motion Carried.

Rogers requested completed Part II application and job information in leased space.

Grimwood moved and Rogers seconded the approval of the Work Order in the amount of $13,000 for Phase I & Phase II contingent upon receipt of the fee. Motion Carried.

b. Discussion/Action: 383 S. Pitcher – City of Kalamazoo i. Brownfield Plan

Lisa Phillips of Phillips Environmental Consulting presented the combined Brownfield Plan and Act 381 Work Plan with tables.

The former Superior Colour Graphic Building was built in 1887 and another part of the building was built in 1891. New owner PS383, LLC, is planning to redevelop the one-story section of the building for after-market performance vehicle upgrades. The two-story part of the building will be redeveloped for future professional office space.

Environmental conditions of the property from Phase I and Phase II environmental assessment indicates metals, petroleum hydrocarbons, and chlorinated hydrocarbons in soil and groundwater that exceed cleanup criteria.

Peregon moved and Carew seconded the approval of the Brownfield Plan. Motion Carried. Grimwood and Wenzel abstained.

Staff will circulate the draft Brownfield Plan to the MEDC and MDEQ and will inform the Board of any changes.

c. Discussion/Action: Stryker Project

i. Development Agreement with City of Portage

The Brownfield Plan was officially approved by the County Board of Commissioners. The Development agreement is between the KCBRA and the City of Portage for the infrastructure improvements made by the City of Portage in support of the Stryker redevelopment.

Ferguson moved and Rogers seconded the approval for the Chair to execute the Development Agreement with City of Portage. Motion Carried.

Final approval of Act 381 Work Plan will be in front of the Michigan Strategic Fund Board Tuesday, February 28th. Agostinelli will be in attendance along with Stryker representatives.

d. Discussion/Action: Midlink Development Agreement Amendment #2

The Board received the signed Development Agreement from East Cork Street Investors.

Peregon moved and Wenzel seconded the approval for the Chair to execute the Development Agreement Amendment #2. Motion Carried.

e. Discussion/Action: EPA Grant Invoices

i. $425.00 ($212.50 Hazardous; $212.50 Petroleum)– Site Inventory – EPA Grant WO #2 Basic inventory is complete.

ii. $805.00 ($402.50 Haz.; $402.50 Petroleum)– Programmatic/Outreach– EPA Grant WO#3

Community outreach event was held on February 15th with total attendance of 51 including KCBRA members and staff. Lauren Coombs from EPA was also present.

Activity from the approved Work Order is finishing up.

iv. $2,995.85 (Haz.) – Quality Precast, Alamo Twp. – WO#7

Conducted the Phase I and did not identify environmental concerns. The report has been completed.

Milks moved and Carew seconded the approval of the EPA Grant Invoices in items 7.e.i - iv. Motion Carried.

f. Discussion/Action: EPA Grant

i. Memo EPA Grant updates

Updates noted in Item 7.e. - EPA Grant Invoices.

ii. Recap/Results - Community Outreach Session

iii. Community Outreach Food Invoice $592.43, not covered under EPA Grants.

Milks moved and Rogers seconded the approval of payment in the amount of the $592.43. Motion Carried.

g. Discussion/Action: MDEQ Loan/Grant 555 Eliza St.

i. $ 17,755.37 - Envirologic Invoice – MDEQ Loan Work Order #21

The work related to eligible activities including concrete removal. Approval recently received from MDEQ to bid for the insolation of the sub-slab system.

Carew moved and Peregon seconded the approval to pay invoice for work related to WO#21 in the amount of $17,755.37. Motion Carried.

8. Financial Reports

a. Discussion: Fund 247 and 643 Grover gave explanation of the report. She is working with Nancy Culp on TIF from Oshtemo. Summer and Winter Tax Increment Revenue estimated for 2016 is $142,000.

9. Staff Report

a. Davis Creek Project

Agostinelli gave a description of a project in the City of Kalamazoo. Staff has communicated with the City the potential use of EPA grant funds to assist the developer with due diligence costs and some additional assessment related at building location at the property. The site is currently in the City Brownfield Plan. The City verbally agreed they would be willing to reimburse the KCBRA for EPA Grant costs but not until after developer is reimbursed for eligible costs. Developer is still negotiating a Purchase Agreement with the City Kalamazoo.

Hawkins noted this site will need additional site assessment.

Rogers requested that a written agreement with the City should be executed regarding KCBRA reimbursement.

10. Committees - times dates and places

a. Land Bank Report – Next Meeting May 11, 2017 – 8:30 a.m. Rachael attended the meeting, no project specific. Grover received an email on Vicksburg Mill project. Plan expected in April.

b. Project/Finance Committee – Thursday, March 9th, 2017, 4:00 p.m. New potential projects and EPA site inventory needs follow-up.

Jarnefelt requested purchase of Adobe Pro license in the amount $320.00 for staff. Board requested Planning Department consider purchase for County equipment. Funds are not currently available in Planning budget. No action taken.

Jarnefelt has scheduled a meeting with County Finance to talk about Brownfield Administrative costs. Her proposal is to request full time positon to be paid for by TIF.

Governor Snyder 2017-2018 Budget recommendation to transfer $15 million from the Refined Petroleum Fund to MDEQ redevelopment and cleanup activities. KCBRA has been encouraged by various organizations and MDEQ to support this transfer of funds in the Governor’s budget. Wenzel requested that a support letter also include support for Michigan Legislators to find a more sustainable solution for funding redevelopment and cleanup activities across the State of Michigan.

Rogers moved and Ferguson seconded the approval for staff to draft letter to Representative Hoadley on behalf of the KCBRA. Motion carried.

1. Scope of Services Work performed under this Work Order shall include activities related to meetings/consultations and the review of various documents including but not limited to: Client communications, Project information and environmental reports, review of Brownfield Plans, Project Applications, Act 381 Work Plans, Development and Reimbursement Agreements and various requests for reimbursement including invoice review. Additionally as directed by the KCBRA and Staff, Envirologic will assist staff with various Authority administrative activities including, but not limited to:

• Tracking, developing and issuing statements for the collection of tax increment for the various active KCBRA Brownfield Plans (anticipated semi-annual statements);

• Developer update notices for annual reporting; • MEDC Annual Reporting; • Other tasks as directed by the KCBRA or staff.

SUBJECT: FY16 EPA BROWNFIELD ASSESSMENT GRANT UPDATES

DATE: 3/23/2017 This memorandum serves to provide information regarding updates for the Kalamazoo County Brownfield Redevelopment Authority (KCBRA) for activities and services rendered on various projects related to the EPA Brownfield Assessment Grants. 1. Site Inventory and Prioritization Project No: 160360 – W.O. 2

Update: Envirologic has completed the inventory and will update it based on community input in the future. The County GIS team developed numerous maps that locate and identify the inventory properties. These maps were available at the Educational Event on February 16, 2017. Envirologic continues to meet with Rachael Grover to update and solicit additional information for candidate sites. The Site Candidate Survey is in the process of being updated and will be emailed/distributed to the contact database that has been created for the KCBRA.

3. Community Outreach and Programmatic

Project No: 160361 - W.O. 3 Update: Envirologic and Rachael Grover continue to plan outreach activities. The current plan is to conduct a meeting with Kalamazoo Township to review sites from the inventory with them as well as discuss other priorities they may have. Meetings are also being planned with MDEQ and EPA. An outreach breakfast is also being planned which will focus on developers, brokers, realtors and lenders. In addition to the outreach planning efforts, Envirologic and Rachael Grover have had meetings with the owners of the Hoekstra Hardware property owners and Jodi Milks, Rock of Ages Church and Comstock Schools. Rachael Grover has also had or will be having telephone conversations with the Family Health Center, B and W Charters and Hardings – Howard Street.

4. Jhamin, LLC – 8212 Shaver Rd., Portage, MI Project No: 160362 W.O. 4 Update:

Envirologic finally received the necessary approvals from EPA to proceed with sampling at the site. Envirologic conducted sampling during the week of January 2nd, 2017 for the soil sampling. We defined the extent of the problem associated with the air compressors and he is planning limited removal. We did not confirm contamination with the storm water area. Additionally, the pcb area was not found to be impacted. The air sampling was conducted on January 24, 2017, results indicated the presence of TCE in ambient air throughout the building. Currently the levels are below OSHA PELs, however, it does not meet future MDEQ criteria. Further activities related to this issue are being evaluated.

The Kalamazoo County BRA has supported this redevelopment project through adoption of a Brownfield Plan. The redevelopment is underway by the property owner (D&D Realty LLC). When D&D Realty LLC acquired the property, they completed a Phase I and II Environmental Site Assessment and disclosed a Baseline Environmental Assessment to the MDEQ. However, these documents did not identify the eventual user (operator) of the property, Metal Mechanics, Inc. Thus, a Phase I Environmental Site Assessment and Baseline Environmental Assessment are needed for Metal Mechanics, Inc. so that this business entity has the same liability protections as the land ownership entity.

In addition, both D&D Realty LLC and Metal Mechanics, Inc. have Due Care Obligations which is required to be documented. Envirologic is making full use of the existing documents to the extent possible. Envirologic is underway with the project.

6. Select Products Limited – Oshtemo Township Site Project No:170027, W.O. 8 Update:

Envirologic completed and received the Eligibility Demonstrations/Approvals from both EPA and MDEQ. Envirologic has initiated the Phase I ESA including a site reconnaissance. Envirologic is experiencing a few delays by the MDEQ for our request for file information. However, the project is moving forward.

7. Former Cole Krum Site – 343 West Prairie St., Vicksburg, MI Project No. 170081, W.O. 10 Update: Envirologic completed and received the Eligibility Demonstrations/Approvals from MDEQ on March 9, 2017. The Phase I ESA is underway.

SUBJECT: NORTHSIDE ASSOCIATION FOR COMMUNITY DEVELOPMENT (NACD) AND FAMILY HEALTH CENTER

DATE: 3/09/2017 This memorandum serves to provide information regarding the NACD and FHC Projects and potential costs associated with assessment activities.

NACD- The Northside Association for Community Development has been pursuing the re-use of the building and property behind their offices. They own the property which includes a two story building and associated land. Their dream is to utilize the property to support urban agriculture and a farmers market. They hope to also develop a hydroponics operation on the second floor. There are some environmental issues associated with a former abandoned in-place underground storage tank that was used by the historic dairy for fuel oil for their boilers. Soil samples previously obtained at the site have indicated remaining contamination. Additionally this contamination appears to be creating an odor problem in the building. Based on this issue, the NACD will be applying to the KCBRA for potential assistance to possibly remove the tank, pursue any necessary cleanup and conduct sub-slab sampling to asses for potential vapor intrusion issues. It is possible to utilize the assessment grant to remove a tank if it is necessary to conduct further testing beneath the tank. Additionally, Envirologic has been communicating with the MDEQ to possibly provide additional funding to assist with these efforts. Further communication with UST Removal contractors would be required to insure that the UST can be removed without threatening the building. As a placeholder for estimating future project funding consideration under the assessment grants, Envirologic has provided below estimated costs that may be associated with the activities discussed above.

• Vapor Intrusion Assessment $6,500 • Soil and/or Groundwater Sampling beneath UST and UST removal oversight $5,500 • UST Removal Activities (Estimated) $10-15,000

Potential EPA Assessment Grant (Petroleum) Investment $22,000-$27,000

Family Health Center Project (FHC) The FHC is intending on purchasing a piece of property from the City of Kalamazoo that parallels the trail between Alcott Street and Bryant Street in the area of the former Performance Paper Site – Mill C. They are planning on building an outdoor fitness park that would be made available to their clients. Although different phases of investigation have occurred, apparently FHC is being told that further assessment focused on the specific area and use would be necessary. Envirologic has had limited access to detailed information from this site. Envirologic has communicated with the MDEQ and they have indicated there are several reports available for work conducted by the MDEQ and they provided these reports to the City of Kalamazoo. Rachael Grover is also pursuing any information that the County may have from previous assessments they conducted when they were considering this site. Without a better understanding of the available data, it is difficult to estimate the level of effort that would be necessary to insure that the site can be safely used for the intended purpose. Additionally, information would be needed to help contractors understand what may be needed to work in this area during the installation of the recreation equipment.

RE: Phase I Kalamazoo County Brownfield Redevelopment Authority Funding Application

Dear Ms. Jarnefelt:

Thank you for the opportunity to apply for Kalamazoo County Brownfield Redevelopment

Authority funding. Family Health Center (FHC) is seeking funds to help develop a public

outdoor fitness park as part of a progressive Health Campus on East Alcott Street that will

positively impact local residents and improve neighborhood quality. The outdoor fitness

park will compliment other services provided along Alcott Street including: Family Health

Center, Community Mental Health, Goodwill Industries, Housing Resources, Inc., and the

Kalamazoo Literacy Council.

The outdoor fitness park will utilize just over a quarter of an acre of 409 East Alcott Street

and be accessible from the city of Kalamazoo's walking trail as well as Alcott Street. The

fitness park will be free to the public and accessible 24 hours a day. Improvements to the

property will include: installation of solid and rubberized surfaces, fitness machines, play

structure, and a basketball court. An 816 square foot pavilion will be the only structure

erected onsite. The outdoor fitness equipment will include accessibility stations, cardio

equipment, and weight lifting equipment. In addition to the equipment, fitness and

wellness classes will be provided on site.

FHC is a non-profit 501(c)(3) organization committed to ensuring all members of the

community have access to quality, comprehensive, patient centered care. This includes

access to fitness and wellness opportunities. FHC identified the Edison neighborhood as

being vastly underserved with limited access to quality healthcare. In addition,

socioeconomic factors present in the neighborhood meant that, by comparison to other

area neighborhoods, stability and attention to personal health were not a focus for

residents. In order to help reverse that trend and improve quality of life, FHCdeveloped

its Health Campus and will progressively work to positively impact not only area residents'

health but that of the public at large. Because the chosen location is the former

Performance Paper site - and there is a history of potential soil and groundwater

contaminations - certain steps must be taken in order to properly develop this site for

use.
