I, Betty Rose Danielski of the City of Toronto and Province of Ontario, MAKE

OATH AND SAY AS FOLLOWS:

I. I purchased the property located at 29 - 3 1Marshall Street, on or about October

24d\ 2000. pursuant to a Deed dated October 2 4 1 1 t , 2000. registered in the York County Registry

Office on October 3 l !II, 2000, as Official Number 114900S I. in Book 2270. at Page 403, a copy

of which is annexed hereto and marked Exhibit ··A" to this Affidavit.

2. [obtained a Mortgage to Royal Bank of Canada dated October 26th• 2000,

registered in the York County Registry Office October 31 st. 2000, as Official Number 1)490993.in Book 2270. at Page 409. a copy of which is annexed and marked Exhibit "B" to this Affidavit.

3. I purchased this property for the purpose of residing there with my daughter,

Monica Danielski. and her "common-law husband", Craig McGregor and their two children.

4. Soon after moving into the subject property. Mr_.McGregor and I had very serious

and extreme conflict which caused me to leave New Brunswick in great distress and fear.

5. Soon after J left. my daughter left the home with the two children. leaving Mr.

.\1cGregor behind in the property.

6. [ had various contacts with Mr. McGregor asking him to take over the mortgage

payments or to allow a sale of the property to be met. however, without success. I allowed the

situation to continue for the sake of my grandchildren who for a period of time, did visit their

fa th er. M r . McG re go r, a t th e h om e . I

1. Apparently Mr. McGregor took in the Defendant, Andre Murray as a "tenant" at

some point in time. Ihave found Mr. Murray on the internet under "Tattoo Artists", and believethat he possibly resides there at the present time.

8. To the best of my information and belief. Mr. McGregor left the property and quit

New Brunswick over a year ago. without notice to me or my daughter, and I have been unable to

contact him since that time although he has sent me emails from various addresses.

9. I have been forced to cover utility bills left 'behind by him inmy name for almost$1.500.00 and mortgage payments have also gone on unpaid.

10. 1am informed by my daughter. Monica Danielski. and do verily believe that there

have been repeated police visits to the property related to Mr. McGregor. and on one occasionwhere I am informed that Andre Murray was p e p p e r sprayed by the police for causing a

disturbance.

11. l have attempted to beg the occupants to leave the property bye-mail and by

letter, I have contacted the rentalsman in New Brunswick who advised that he could not help as

it he considered it to be a "family situation".

12. I have sent real estate agents and home insurance agents to the property. and am

informed by them and do verily believe that their requests for access to the property were denied.

13. [ gave my consent to (he Royal Bank of Canada in writing to enter the propertyand take possession of the property. and urged them to do so "with caution and a mind to your

safety ....

14. I consent to an Order that the property be vacated so that the Royal Bank of

Canada can proceed with a sale of the subject property.

15. Attached hereto and marked Exhibit "C' to this Affidavit is a copy of a Lien

Claim which apparently has been filed against the subject property. I do not know Andre Murray

nor do I know what possible claim he could have against me nor the basis for same. [ have had

no contact whatsoever with Mr. Murray other than to send a letter to the property addressed to

him some time ago advising that I had discontinued my responsibility for utility payments on the

property.

16. I am informed by George Leblanc, lawyer for the Royal Bank of Canada that Mr.

Murray claims to have a long term Lease to the subject property but has refused to provide a

copy. I have not signed any Lease for the property with anyone.

17. As a result of the foregoing circumstances, I have not been able to obtain

possession of the property-which I own. located at 29 - 31 Marshall Street, Fredericton. NewBrunswick and the mortgage has fallen into default. I feel helpless to deal with this unfortunate

situation and support any application by the Royal Bank. of Canada to gain possession of the

subject property so that it may be sold.

18. This Affidavit is made in support of an Application by the Royal Bank of Canada

and the intended purchaser of the property for vacant possession of the subject property.
