Geometric decoration throughout with one side featuring a rosebud nosegay above a yellow band with the caption, McGregor, Iowa, Oct. 1892. The reverse depicts a maritime scene with cattails and lily pads in the foreground and sailing ships in the background; 7.25" high.

Andrew Clemens (1857-1894) of Dubuque, Iowa, spent most of his life in nearby McGregor. Due to voice encephalitis, he lost both voice and hearing and was sent to the Iowa Institute for the Education of the Deaf and Dumb. There, Clemens began experimenting with sand art, collecting multicolored sands from the Pictured Rocks region of Iowa. He fashioned special tools that he used to arrange the sand in intricate designs and then pack it tightly (he used no glue of any kind). Sizes and designs varied, and orders came to Clemens from around the world, each customer paying about five to seven dollars. As his skill developed, his subjects ranged from boats and ships to flowers, flags, and eagles. Clemens, dubbed “the portrait painter without a brush or paint,” died in 1894. He is thought to have produced hundreds of bottles during his lifetime, but few survive today.

56Freed SLave turned boxer, attributed portrait oF tom moLineaux,English, first quarter 19th century, oil on canvas. A half length portrait of a seated black gentleman, dressed in grey jacket with floral vest. Housed in later frame with interior gilt lining; measuring 23.5" high x 19.5" wide (sight).

Oral family history suggests this portrait depicts Tom Molineaux (1784-1818), a Virginia slave who gained his freedom boxing for his plantation owner. Molineaux later moved to England, the epicenter of professional boxing in the early 19th century. He was tutored and trained by Bill Richmond (1763-1829), “The Black Terror”, a self-trained boxer and also a freed American slave.

After continued success, Molineaux challenged the English title holder, Tom Cribb (1781-1848) in 1810. By all accounts, Molineaux proved impressive even with size disadvantages, and the fight was a wildly contested battle, with the crowd pushing into the ring during a lengthy tangle. Molineaux lost in the 35th round due to a hand injury deriving from the crowd’s charge.

A year later, the rematch between the two fighters did not meet expectations. Molineaux had apparently trained little, drank heavily, lost weight and ignored Richmond’s regimen, and was knocked out in the 11th round. Molineaux died impoverished and suffering from liver failure in 1818.

Several variables contribute to the attribution to Molineaux. First, the portrait reflects many stylistic tendencies common with British portraiture of the period. Second, and most obvious, the African American sitter is missing his two front teeth, perhaps the result of his fighting career. Other images of Molineaux bear similar resemblances, but depict the boxer at fighting age. Finally, Molineaux is depicted here engaging in the past-time which lead to his demise - drinking. An 18th century engraving by John Young (1755-1925)(Sold at Sotheby’s, Oct. 26, 1990), depicts a sturdy Molineaux in fighting position. A well known illustration by Rowlandson depicts the second match of Cribb and Molineaux, and a widely produced Staffordshire figure of Molineaux occasionally surfaces. In each depiction, Molineaux is shown with a very dark complexion. Other examples of British portraiture and sporting art are featured in this sale from the same collector.

Henry Philips (1767-1800) was the founder of Philipsburg, Pennsylvania. He came to America from England to open a branch office for the family’s export-import business, it’s headquarters were in Philadelphia and had accounts in major eastern cities. About 1795 the company began purchasing land. One of these areas of land in Pennsylvania, now Philipsburg, Henry was inducing pioneers to come settle. About 1798 he built a saw mill and gristmill then afterwards he moved there himself.

Charles Balthazar Julien Fevret De Saint-Memin (1770-1852), a French nobleman, came to New York in 1793, and began making portraits in 1796. With the help of the Physiognotrace, a mechanical device that allowed for the relatively easy creation of profile portraits, Saint-Memin produced hundreds of portraits in New York, Philadelphia, Baltimore, and elsewhere on the east coast.

The design includes neoclassical motifs, an angular handle with cast mask and Greek key borders along with neo-Grec engraved surfaces, typical of the middle and late 1860s. Marked Tiffany & Co/ 550 Broadway/ English Sterling 925-1000 with mark for J.C. Moore and Son, the ewer was likely the design of son Edward C. Moore. A similar ewer in the “Etruscan” pattern is pictured in Silver in American Life, by Barbara McLean and Gerald W.R. Ward, plate 182.

Engraved on the body under the spout is a depiction of the Great Seal of the United States, replete with 33 stars representing the states in the Union. The engraving was one star short of the actual number of states on March 4, 1861, since Kansas had become the 34th state, admitted to the Union on January 29, 1861. Apparently, the ewer was commissioned between the election of November 1860 and January 1861. Seven states—Alabama, Florida, Georgia, Louisiana, Mississippi, South Carolina and Texas—had already seceded from the Union to form the Confederate States of America by the time of the inauguration on March 4, 1861. In the weeks following Lincoln’s inauguration, four more states seceded—Arkansas, North Carolina, Tennessee and Virginia, and on April 12, 1861, a signal round was fired over Fort Sumter, South Carolina, initiating the first battle of the Civil War.

The inscription around the seal reads To the President of the United States Abraham Lincoln from his Washington Friends March 4, 1861.

Who were the “Washington Friends”? They remain undisclosed. Lincoln papers, those housed at the Library of Congress in Washington, DC, show no acknowledgement of gratitude for such a gift, or mention of same. The White House inventories were not, at the time, keeping inventories of the President’s personal gifts, so no record of the piece is with White House papers. Were these friends potential lobbyists, seeking favor from the new president? The question remains unanswered and part of the historical aura of the piece.

After its presentation, the whereabouts of the ewer were unknown until the early 20th century. A Mr. Bartlett, Boston attorney turn antiquarian, owned a shop called "Old Russia". Most of its inventory were pieces from the Russian Imperial Court, so it is not known how he obtained the ewer. During the depression, the shop closed. At his death, Mr. Bartlett willed the ewer to Annette Pitts, his nurse. Ultimately, it was purchased from a Boston dealer by the father of the present owners. (See Butzen, JAMA pp 595)

An outstanding panoramic depicting the 31st OVI camped below Lookout Mountain near Chattanooga, Tennessee. There are several inscriptions on the reverse, including one on frame Lookout Mt. From Sketch by A.E. Mathews, 31st O.V.I./ 1864. Other inscriptions on canvas verso identify certain areas of the painting- “Nashville & Chattanooga R.R., Field Hospital, Cemetery, Corps”. These inscriptions mirror the precise area on the painting. The painting is housed in the original gilt and gesso frame and original stretcher patented 1886; 26" high x 34" wide (sight).

Lookout Mountain was a famous battle site during the Civil War (November 24, 1863), often referred to as the Battle Above the Clouds because of an unusual weather phenomenon causing fog to hang suspended, encircling the center of the mountain.

Alfred Edward Mathews (1831-1874), the son of a book publisher, immigrated to Rochester, Ohio at age two with his father. A book dealer himself, Mathews served in the 31st OVI during the Civil War. Several sketches of this period are known, but none have surfaced on the market. Mathews became known for his panoramic and topographical views during the Civil War. His work was said to be admired by Ulysses S. Grant. By 1865, Mathews was traveling in the Western regions of the United States, executing sketches of Colorado and California. The artist has remained obscure and little original sketches or lithographs have surfaced. (See Haverstock, "Artists in Ohio", pp. 581)

A period painting, the scene depicts what appears to be the 98th regiment. Inscribed in lower center with a large movement of troops fading into the distance. Stylistically, the painting is in the manner of the Hudson River School, even reminiscent of William Louis Sonntag (1822-1900) and his lush Ohio landscapes. In a period frame; 5" high x 8.25" wide (sight).

Henry Lovie (n.d.) was born in Prussia but primarily active in Cincinnati during the 1850s and 60s, working extensively as a sketch artist, topographer and illustrator for Leslie’s during the Civil War. His original works are rarely discovered. (See Haverstock, "Artists in Ohio", pp. 540)

260Midwestern, ca 1870-1880. A fine Aesthetic Movement bedroom suite consisting of bed, armoire, dresser and washstand, in walnut and burled walnut veneers. Factory made and embellished with hand-carved features, probably made for a newly-wed couple. The crown on the bed, dresser and washstand is highly carved with a stylized row of fiddlehead ferns on the crest, flanked by pierced rinceau. The frieze is carved in compartments of realistic flowers, each different and each compartment separated by an angled wooden bands. The flowers are on either side of a bird’s nest, carved with hovering birds. On the bed, two tiny eggs are visible within the nest, symbols of hopeful fecundity. Below the frieze is a central tablet, framed in a leaf-carved and stippled edge and flanked by an anchor (symbol of fidelity) on the right, and, on the left, a heart pierced by an arrow (signifying love struck).

Standing as brackets on the sides of the headboard are highly carved cranes, with arched necks, standing amid broad leaves and nettles. The lower section of the headboard has carved, stylized leaves and tablets of overlapping diamonds, an adaptation of Japanese motifs that influenced the Aesthetic Movement.

The dowel joints on the drawers of the case pieces confirm that the case pieces are factory made. As discussed by Carron in Grand Rapids Furniture, joining machines were patented in the 1860s and Grand Rapids, Michigan, and firms were using them in making both inexpensive and expensive pieces. Two Grand Rapids firms, Berkey & Gay and Nelson Matter & Co., used dowel joints, as did others. Carron notes that Berkey & Gay used this joinery on drawers sides, front and back, on expensive and moderately-priced pieces, but in the 1870s, some expensive Berkey & Gay pieces were showing hand-cut dove tails with scribe lines.

The bed has no marks or labels; 96" high x 65" wide x 86.5" long. The armoire; 97.5" high x 60" x 25" deep. The dresser has a bowed marble top over a center drawer, the interior fitted with two lidded compartments; 97" high x 60" wide x 22.5" deep. The washstand with marble backsplash and top; 87" high x 41" wide x 22.25" deep.

262marbLe buSt by natHan FLint baker (b. 1822),American, mid-19th century, carved marble bust of a woman. Stylistically Roman, with simple, elegant curves and a slight tilt of the head. Signed on verso in large Classical print, N.F. Baker., with combed back and original marble base; 23.25" high (including base).

This is the first example by Cincinnati sculptor Nathan Flint Baker (1822-1891) offered by Cowan’s Auctions, and almost certainly the first example to surface in recent years.

Little is known about Baker’s life and activities, due in part to his extensive travels. The son of wealthy real estate magnate John Baker, Nathan Flint seems to have had little sense of urgency and even less sense of direction as an artist. Baker’s family connections lead him to Nicholas Longworth, the well-known Ohio congressman and Cincinnati art patron. With Longworth’s help, Baker traveled to Rome in 1842 to study with Hiram Powers, renowned American neoclassical sculptor and expatriate. Powers’ Florentine studio served as a haven for numerous budding Cincinnati sculptors, and Baker trained there, completing his first significant works in marble. The work represented here shows clearly Powers’ influence, both in form and classical simplicity.

From the time of Baker’s departure for Italy and onward, only scattered bits of information are known of the artist. Baker traveled extensively, occasionally returning to Cincinnati to exhibit works, most notably a bust of John James Audubon at the National Academy of Design in 1847. He also executed a massive statue of Cincinnatus, which is no longer in existence.

Baker’s independent wealth must have afforded him many opportunities,

and this may explain his propensity for abruptly abandoning some efforts. An occasional interest was photography, as evidenced by an extraordinary trip with friend and photographer Leavitt Hunt (1831-1907). It resulted in the pair being credited with the first significant photographic images of the Middle East. Using the wax paper process (quickly learned and practiced in Rome prior to the journey), Baker and Hunt traveled throughout the Middle East and North Africa between 1851-52, producing 60 negatives. They returned to Paris and could not properly market the images. Back in the United States, Baker attempted, unsuccessfully, to distribute the images through a New York dealer. These pioneering images, like Baker’s sculptural work, are obscure and rarely surfaces today.

Baker returned to Cincinnati permanently in 1873, and continued his sculptural work until his death in 1891.

Two possibilities suggest the identity of the bust: The subject could be an idealistic study of Egeria, executed during Baker’s first trip to Italy and likely completed under the tutelage of Hiram Powers. Baker would have been a young artist and heavily influenced by the well-established sculptor. A second, full length version of the same subject exists today in Spring Grove Cemetery and was executed during the same period.

A second possibility is another documented classical bust entitled Stella, Bust of a Roman Girl, exhibited at the 1872 Cincinnati Industrial Exposition. Unfortunately, the marble is only listed, and no image, no size or visual documentation of the bust could be found.

tHe weber coLLectionRobert Ross Weber (1920-2008) was born and raised in Dover, Tuscarawas County, Ohio, but spent 57 years of his life as a resident of Seven Mile, Ohio in Butler County. Bob’s love for antique cars was second only to his love of his devoted wife of 65 years, Mary Jane, their four children and ten grandchildren.

When Bob was in High School, he was so fond of his brother’s 1927 Model T Ford that the two of them drove from Ohio to Canada on a summer fishing trip. After that adventure, Bob was smitten and began his own collection of early Ford motor cars.

In 1952, Bob took first place at the Hamilton County, Ohio, Antique Car Show with his Ford 1930 Model A Coupe (lot 273). His collection consisted mainly of Ford Motor cars, in particular, convertibles. After getting caught in the rain at too many car shows, he and Mary Jane used only the 1930 Model A in inclement weather. Some of the cars he purchased came from meets in Hershey, Pennsylvania. Then, there were those cars Bob noticed in West Virginia farmlands where he traveled for business and would invariably stop to make offers. Cowan’s is pleased to offer Bob’s better finds in this choice selection of cars from his collection.

This truck is believed to be a Martin-Parry Truck Body, with a unique three-tier truck bed. The car was purchased from Borcher’s Ford in Dayton, Ohio, in 1919. The truck was later purchased by Ellerman’s Grocery in West Milton, Ohio. The truck was eventually sold to Hahn’s Bakery of West Milton, Ohio. The current owner purchased it in 2003.

Cowan’s is pleased to offer an important group of five paintings by noted artist Paul Sawyier. Originally owned by Mayme Bull (presumably gifts from Sawyier), the watercolors descended in the Bull family to Mayme’s niece, Elizabeth Bull Howard, probably through Mayme’s sisters. The paintings were then bequeathed to the current owner, a close friend of Elizabeth Bull Howard.

Paul Sawyier (1865-1917) was born the son of a physician in Madison County, Ohio. His family moved to Frankfort, Kentucky, when Paul was young. Showing artistic inclinations which were cultivated by his parents, Sawyier was enrolled in the Cincinnati

Art School in 1884. In two years, he had opened a studio in Cincinnati. After a stint in New York, studying under William Merritt Chase at Art Students League, Sawyier came back to Cincinnati and studied under Frank Duveneck. At the 1893 Columbian Exposition in Chicago, Sawyier’s work achieved a level of popularity and respect. His work exhibited there

demonstrated that, unlike most Kentucky contemporaries, Sawyier had embraced Impressionism.

Between 1908 and 1913, Sawyier spent his time living on a houseboat on the Kentucky River, outside Frankfort, painting his surroundings.

Proud of his status as a professional artist, Sawyier generally refused to engage in other pursuits, even when money was short (which it often was). In 1913, Sawyier moved again, this time to Brooklyn, New York, where he lived with his widowed sister. A

couple of years later, he moved to the Catskill Mountains where he died in 1917.

In 1887, Paul Sawyier first met Mary “Mayme” Bull (1865-1914), also of Frankfort. Although the two became engaged, they never married, the results of caring for their aging and ailing parents and Sawyier’s constant financial instability. Little else is known of their relation because Sawyier’s sisters burned all of the couple’s correspondence upon the death of their brother Paul.

rookwood Faience From miLLS reStaurantJ. O. Mills, a native of Marysville, Ohio, found very little good, home cooked food while on the road in his early career as a traveling salesman. To meet that need, and utilizing his background in hotel and restaurant accounting, Mills opened a small restaurant in 1915 in Columbus, Ohio, and put into practice his primary concept—good food at a moderate price. The popularity of this restaurant led him to open a small restaurant in the same year on Government Square in Cincinnati. It too, met with great success, so much so that Mills moved to a much larger location at 31-39 E. Fourth Street, (between the Dixie Terminal and the Hotel Sinton), which opened on Thursday, August 18, 1921.

The entire design scheme and decorations were suggested by Mills, using Rookwood Faience tile for the complete interior of the main dining room, including ceilings, ventilator grills, columns and floors. His original and exclusive designs carried out a Dutch motif including the “Mills Windmill”, the trademark of the company. A conservative estimate indicates that more than 400,000 pieces of tile were used throughout the restaurant. Mills relied heavily on local suppliers, contractors, and vendors, including Charles L. Shannon and Sons of Cincinnati, who executed the tile work. The following Lots 452-459 represent the variety of Rookwood Faience used in the restaurant, which was demolished in 1989.

peter HuntPeter Hunt, a Cape Cod folk artist from the 1920s to 1960s, held broad appeal across the United States for his whimsical designs and painted furniture. He borrowed from American and European folk motifs, using the bold brushstrokes of folk designs to decorate and renew cast-off furniture. Hunt invented himself with stories of a royal heritage and worldly adventures to charm his way into New England’s old money set. His pieces were found in some of the finest homes and, soon after, displayed in the best department stores in New York.Hunt’s popularity was both his blessing and his curse. In the 1960s, he was over exposed, teaching others to paint in the manner of Hunt, writing articles, and having furniture painted by others, in the manner of Hunt. Tastes and friends moved on.Pieces offered here were given to one of his few very close friends who often escaped with him to play abroad, particularly in Paris, and who was gifted with these and several more pieces that have yet to surface.

termS and condition For bidderSBy registering and bidding in an auction conducted by Cowan’s Auctions, Inc. (“Cowan’s”), bid-ders (whether present in person, by telephone, by agent, by written or telephone absentee bid instruction, or through a live internet connection) agree to be bound by these terms. These are the complete and only terms and conditions on which all property is offered for sale. Cowan’s retains the right to bar any bidder from participating in any auction and to exclude or reject any bid.

1) regiStration. All bidders must register their name, permanent street address (no P.O. Boxes), and telephone number prior to the auction. Unless known to Cowan’s, all registrants are required to present two forms of identification, at least one of which must include a current photograph. Bidders may be required to present a valid Visa or MasterCard. By registering with Cowan’s or submitting an absentee bid form, a individual registrant authorizes Cowan’s to obtain a copy of his or her consumer credit report and authorizes Cowan’s, at its sole discretion, to use the information contained therein to make business decisions regarding the registrant’s participa-tion in the bidding process.

2) acceptance oF termS. Bidding on any item, whether in person, by phone, by absentee bid or via a live internet auction indicates the bidder’s agreement to be bound by these Terms and Conditions for Bidders. Any right of bidder under this agreement shall not be assignable and shall only be enforceable by the original buyer. The rights and obligations of the parties shall be governed by the laws of the state of Ohio. All bidders submit to the personal jurisdic-tion of the state and federal courts in Ohio.

3) termS oF SaLe. Announcements made the day of auction take precedence over any pre-vious communication. The auctioneer reserves the right to withdraw any lot at any time before its final sale and to reject any bid for any reason. The highest bidder for each lot acknowledged by the auctioneer shall be the “buyer”. If any dispute arises as to any bidding, or between two or more bidders, at the sole discretion of the auctioneer, the successful bidder will be determined or the disputed lot shall be put up again at the last undisputed bid and resold.

4) buyer’S premium. Buyers shall pay the final bid price (the “hammer price”) of the lot, plus a buyer’s premium for the lot equal to 17½% of the hammer price up to and including $200,000, plus 10% of the amount by which the hammer price exceeds $200,000. Un-catalogued auctions and purchases made though live online auctions may have different buyer’s premium calcula-tions.

5) eStimateS and reServeS. Presale estimates are intended to be guides and may or may not reflect the ultimate hammer price of a lot. Cowan’s retains the right to change estimates on any lot up to time of sale. A reserve is a confidential minimum price agreed upon by the seller of the lot and Cowan’s. In the case of reserved lots, the seller has authorized Cowan’s to bid on seller’s behalf until the reserve price is reached. In no case will the reserve be higher than the low presale estimate. Cowan’s standard house reserve on all property at auction is one-half of the low estimate.

6) warrantieS and diScLaimerS. Cowan’s makes a limited warranty only to the original buyer of record concerning the authenticity of each lot for a period of 14 days after bidder’s re-ceipt of the purchased lot. If a buyer is not satisfied that the lot purchased is genuine, the buyer may, at his or her own expense, obtain the opinion of two mutually agreed upon recognized experts in the field of the disputed lot. If these experts determine that the item is not genuine, the buyer’s sole and exclusive remedy shall be the rescission of the sale and refund of the amount paid for the item. It is specifically understood and agreed that the rescission of the sale and refund is exclusive and in lieu of any other remedy which might otherwise be available as a matter of law or in equity, and such remedy is conditioned upon the buyer returning the prop-erty in the same condition as at the time of sale. Cowan’s shall not be liable for any incidental or consequential damages. All sales are final, with no returns or refunds except as provided in this limited warranty.

Except as provided in the immediately proceeding paragraph, EVERY LOT IS SOLD “AS IS”, without any representations or warranties by Cowan’s or the seller as to merchantability, fitness for a particular purpose, condition or value of the property, or the correctness or completeness of the catalogue or other description of the property, and no statement, whether written or oral, shall be deemed such a representation, warranty or assumption of liability. Cowan’s makes no representation or warranty that the buyer of manuscript material, photographs, prints or works of art will acquire any copyright or reproduction rights. Cowan’s does not guarantee the working order of any clock, watch, electronic or mechanical device. Dimensions given in the catalogue descriptions may be approximate.

7) deFinitionS oF autHorSHip. “By” or “Maker/Artist” — in our opinion, the work is by the artist or maker stated“Attributed to” — in our opinion, the work is probably, but not definitely, by the artist or maker

stated“Signed” or “Marked” — in our opinion, the signature or mark is that of the stated artist or maker“Bearing the signature (or mark) of” — in our opinion, the signature or mark is probably, but not

definitely, that of the artist or maker stated“Circle of” — in our opinion, the work is of the period and by an artist or maker closely associated

with the stated artist or maker“School of” — in our opinion, the work is by a pupil or follower of the stated artist or maker“Manner of” — in our opinion, the work is of the period and done in the style of the stated artist

or maker“After” — in our opinion, the work is a copy of a work by the stated artist or maker

8) inSpection. All lots are available for inspection prior to the auction. Condition reports for most items can be found online at Cowan’s website, www.cowans.com. Cowan’s does not warrant the condition of any item. Buyers interested in the condition of an item are encouraged to contact Cowan’s and, to the best of our ability, Cowan’s will document for the prospective bidder the condition status on any lot. Condition is always a subjective evaluation and final responsibility rests with the buyer to assess the condition of any item sold by Cowan’s.

abSentee, teLepHone and internet bidding

Absentee and telephone bidding is offered as a free service to our customers and prospec-tive bidders. Cowan’s shall not be responsible for any errors or failures in executing bids, either absentee, telephone or via the internet.

9) abSentee bidding. Absentee bids are accepted via mail, fax or email. Such bids will be posted with the time and date of arrival, with ties being awarded to the earliest bidder.

All absentee bids must be made on Cowan’s absentee bid form, and signed by the prospective bidder. An absentee bidder unknown to Cowan’s may be required to submit a bank letter of credit prior to the auction, or, using a credit card, deposit with Cowan’s a fee equaling 30% of the absentee bid.

All absentee bids are executed competitively by a member of the auction staff. The auction staff will try to purchase the lot for the lowest price possible and will bid up to the amount designated by the absentee bidder only if necessary. Cowan’s does not accept “buy bids,” or absentee bids which have no limit. In the event of a tie bid between a floor and an absentee bid-der, the floor bid will be honored.

All absentee bids must be received no later than 6:00 p.m. eastern standard time, the day before the start of each auction session.

10) teLepHone bidding. Bidding live via the telephone is available on a first come, first served basis for those lots with a low estimate of $500 or greater. In order for Cowan’s to ef-ficiently serve the needs of those who wish to bid by phone, please note the following:

• To participate in the auction by telephone, potential bidders must complete and sign the absentee bid form and check “I WISH TO BID BY TELEPHONE” for the designed lots.

• Telephone bidders are advised to indicate an “insurance bid”, which amount will become an absentee bid, pursuant to the absentee bidding process set forth above, if Cowan’s can not reach the bidder by telephone for a particular indicated lot.

• Telephone bidders must disable any caller ID or other call blocking mechanism. • Cowan’s sells about 100 lots per hour, so telephone bidders should plan accordingly. Cowan’s

will attempt to reach each telephone bidder, but Cowan’s is in no way responsible for missed calls.

All reservations for telephone lines must be received no later than 6:00 p.m. eastern standard time the day before the start of each auction session.

11) internet bidding. Internet bidding via ebayliveauctions.com may be available for cer-tain auctions. There may be terms which apply to internet bids that should be reviewed on line at the time of sale. Cowan’s is not responsible for any failure to execute a bid and shall have no liability to any bidder for any technical or other failure associated with an internet auction.

12) bidding incrementS. The following increments are used at the auction. Absentee bids must fall within these increments. Cowan’s will automatically reduce any absentee bid to the closest increment if the bid falls outside the published range of increments.

aFter tHe auction

13) buyer’S reSponSibiLity. Upon the fall of the hammer, title to the offered lot shall pass to the buyer and the buyer immediately (a) assumes full risk and responsibility for the lot, in-cluding liability for loss or damage and (b) is liable for payment of the Purchase Price (as defined below) to Cowan’s.

14) purcHaSe price and payment. The “Purchase Price” for each lot shall equal the hammer price, buyer’s premium, sales tax and, if applicable, all packing, handling, insurance and shipping costs. Payment may be made with cash, personal or traveler’s check, Visa or Master-Card. Cowan’s reserves the right to hold a purchased lot until a check has cleared.

Buyers who are present at the auction must pay the full Purchase Price at the time of the sale. Buyers who bid by telephone or who are absentee bidders will be invoiced within 5 days after the close of the auction and must pay the full Purchase Price for each purchased lot within 14 days after the date of the auction. By signing the absentee bid form or placing a bid by telephone, an absentee bidder authorizes Cowan’s to charge the Purchase Price for each lot for which such bidder is the successful bidder to the credit card number provided by telephone or on the absentee bid form, unless payment in full or alternative payment instruction is received within 14 days after the date of the auction. No property will be released by Cowan’s unless the Purchase Price has been paid in full.

Institutional billing may be available, and should be arranged prior to the auction.

Cowan’s may impose late charges of 1.5% per month (or the highest interest rate allowed) on any amount owed to Cowan’s that remains unpaid after 30 days. Buyer shall be liable for any collection costs or attorney’s fees incurred by Cowan’s to collect payment, to the extent permitted by law.

15) SaLeS tax. Buyers are required to pay any applicable state and local sales tax.

16) SHipping. At the request of the buyer, Cowan's will authorize the shipment of purchased items through our agent, Wrap-it Postal, LLC. Wrap-it Postal operates independently in Cowan's facility and usually ships within two weeks after payment has been received. Shipment is generally made via UPS or Fed-Ex Ground. Unless buyer gives special instructions, the shipping method shall be at the sole discretion of Wrap-it Postal. Cowan's is in no way responsible for the acts or omissions of independent handlers, packers or shippers of purchased items or for any loss, damage or delay from the packing or shipping of any property.

ADVICE TO INTERNATIONAL BUYERS: Cowan’s will not ship any package containing a firearm to any location other than within the United States. Buyers outside the United States must make their own shipping arrangements taking full risk for the transportation of any firearm.

17) SHipping cHargeS. Buyers are required to pay for all packing, shipping and insurance charges. Overseas duty charges are the responsibility of the successful bidder. Be aware that for larger and/or valuable items, shipping charges can be substantial.

18) removaL and Storage oF property. If purchased property has not been removed, or Cowan’s has not received shipping instructions within 21 days after the auction date, a $10 per item per day storage fee may be charged to the buyer.

19) canceLLation oF SaLe. If purchased property remains in the custody of Cowan’s for a period of 60 days following the auction, Cowan’s may, at its option, cancel the sale, retaining as liquidated damages any payments made by the buyer, or resell the property at auction or by any other commercially reasonable means, for the account and at the risk of the buyer, and in such event, buyer shall be liable for the payment of all deficiencies plus all of Cowan’s costs, includ-ing but not limited to storage and costs of both sales. This right of cancellation is in addition to any and all other remedies available to Cowan’s.
