Dear Mr. Kenny:

The United States Environmental Protection Agency ("EP A") is charged with responding to therelease andlor threatened release of hazardous substances, pollutants, and contaminants'into theenvironment and with enforcement responsibilities under the Comprehensive EnvironmentalResponse, Compensation, and Liability Act of 1980, as amended ("CERCLA"), 42 V.S.C. §9601et~. Based on the results of previous CERCLA remedial, investigation activities and otherenvironmental studies performed at the Diamond Alkali Superfund Site ("Site"), which includesthe Lower Passaic River Study Area, EPA has decided to further expand the area of study toinclude Newark Bay and portions of the Hackensack River, the Arthur Kill,and the Kill VanKull. This expanded area of the study is known as the Newark Bay Study Area. EPA hasdocumented the reJease or threatened release of hazardous substances, pollutants andcontaminants into the Newark Bay Study Area.

By this letter, EPA is notifYing General Cable Industries, Inc. ("General Cable") of its potentialliability relating to the Newark Bay Study Area of the Site pursuant to Section 107(a) ofCERCLA, 42 D.S.C. § 9607(a). Under CERCLA, potentially responsible parties ("PRPs")include current and past owners and operators, as well as persons who arranged for the disposalor treatment of hazardous substances, or the transport of hazardous substances. Based oninformation that EPA evaluated during the course of its investigation, EP A believes thathazardous substances were released from the General Cable facility located at 236 West First

Street in Bayonne, New Jersey into the Newark Bay Study Area. Hazardous substances,'pollutants and contaminants released from the facility into ,the Newark Bay StUdy Area present arisk to the environment and the humans who may ingest contaminated fish and shellfish.Therefore, General Cable may be potentially liable for response costs which the government mayincur relating to the Newark Bay Study Area. In addition, responsibie parties may be reqUired topay damages for injury to, destruction of, or loss of natural resources, including the cost ofassessing such damages.

For the first phase of the Newark Bay Study, the EPA is proceeding with a multi-year study to·determine an appropriate remediation plan for the Newark Bay Study Area. The study'involvesinvestigation of environmental impacts and pollution sources, as well as evaluation of alternativea,ctions, leading to recommendations of environmental remediation activities. Enclosed is a list of the other PRPs who have received Notice letters. This list represents EPA'sfindings on the identities of PRPs to date. ,We are continuing efforts to locate additional PRPswho have released hazardous substances, directly or indirectly, into the Newark' Bay Study Area.Exclusion from the'list does not constitute a final determination by EPA concerning the liabilityof any party for the release or threat of release of hazardous substances into the Newark BayStudy Area. Be advised that notice of your potential liability at the Site may be forwarded to allparties on this list as well as to the Natural Resource Trustees.

We request that you participate in the EPA-approved activities underway as part of the NewarkBay Study. You, along with other such parties, will be expected to both participate in and fundthis CERCLA study. For those who choose not to cooperate, EPA may apply the CERCLAenforcement process, pursuant to Sections 106(a) and 107(a) of CERCLA, 42 V.S.C. § 9606(a)and § 9607(a) and other laws.

In February 2004, EPA signed an Administrative Order on Consent ("AOC") with OccidentalChemical Corporation ("aCC") to conduct a multi-year remedial investigation/feasibility studyin Newark Bay pursuant to CERCLA. This study is being conducted by Tierra Solutions, Inc.with EPA oversight. Tierra Solutions, Inc. is an affiliate of the company from which acepurchased Diamond Shamrock Chemicals (a former owner of a chemical plant at 80 ListerAvenue in Newark, New Jersey), and is performing the work pursuant to that company'sindemnity obligation to acc. Be advised that notice of your potential liability is beingforwarded to acc by EPA.

SUMMARY

ObjectiveThis investigation was conducted to determine whether the

permittee is in compliance with the requirements and limitationsof NPDES Permit No. NJ 000 2986 issued June 30, 1978.

This report relates to compliance with the relevant NPDESpermit terms. It does not relate to compliance or lack thereofwith any other water quality limitation, standards, Or require-ments which may be applicable.Findings and Conclusions

Based upon a December 8, 1977, inspection of the plant andrecords,and a February 16, 1978 effluent survey, the PirelliCable Corporation is not in compliance with all terms and conditionsof the permit. (See Discussion).

RecommendationsIt is recommended that appropriate action be taken to assure

compliance with the permit.

IV. WASTE DISCHARGE AND TREATMENT

1. DischargeAll process, cooling, boiler, and storm wastewater is dischargedvia one 24" outfall to the Kill Van Kull.

2. Discharge flow is monitored and recorded using a V-notch weirand a strip chart recorder with totalizer. The recorder andtotalizer were out of calibration during the sampling period.A flow proportioning sampler is used to monitor the waste stream.Samples thus collected are analyzed monthly by U.S. Testing Lab-oratories for the permitted parameters (COD, TSS, O&G, CU, Ni,Pb,& Cr).

3. Waste TreatmentA wastewater monitor station has been constructed to permitsampling of all plant waste and storm water to assure non-contamination from tidal waters. An emergency impoundmentdevice has been constructed in the system to prevent dischargeof oil in the event of a spill. There is an emergency (manual)bypass line from the bottom of the collection tank. This valveis opened only when plant property or life is threatenedusually by flooding due to heavy rain.

2. Preliminary InspectionA preliminary inspection of the plant and records was made onDecember 8, 1977 with the following personnel attending:

3. Effluent SurveyAn unannounced 24-hour effluent survey was conducted onJanuary 31, & February 1, 1979 by the Interstate SanitationCommission with the following personnel in attendance:

The effluent survey was conducted for 24 hours from 0930 hours1/31/79 to 0830 hours 2/1/79. The wastewater was sampled asit came over the flow measurement weir at the entrance to theoutfall pipe.Samples were collected manually and composited hourly. Four6-hour composite samples were collected for COD and TSS, andtwo 12-hour composites were collected for metals. Four 1 litergrab samples were taken for oil & grease. All samples werepreserved as required by the Federal Register analytical pro-cedures.Chain of custody and approved Federal Register analytical pro-cedures were followed.
