BOARD OF MEDICAL EXAMINERS OF THE STATE OF NORTH CAROLINA The Wilmington Hilton Wilmington, North Carolina October 12-15, 1978 The Board of Medical Examiners of the State of North Carolina met .at The Wilmington Hilton Hotel, Wilmington, North Carolina, October 12-15, 1978, for the purpose of interviewing applicants for license by endorsement of credentials and conducting other business. Drs. E. Wilson Staub, President, Charles B. Wilkerson, Jr. , Secretary-Treasurer, Bruce B. Blackmon, David S. Citron, Bryant L. Galusha, J. J. Pence, Jr. , and Joyce H. Reynolds were present. Also present were Bryant D. Paris, Jr. , Executive Secretary, Lee A. Denney, Investigator, Betty Joe Barick, Assistant Executive Secretary and Diane Freeman. In addition, present as guests of the Board at this meeting were Dr. Louis T. Kermon and Dr. A. T. Pagter, Jr. , members-elect of the Board. Their term as Board members will be November 1, 1978 through October 31, 1984. Thursday, October 12 2:00 p. m. The Board convened for business and reviewing of applications for physicians applying for license by endorsement of credentials. RE: Dr. Sheng H. Chang, Winston-Salem, N. C. -- The Board reviewed correspon- dence from Dr. Chang regarding the hearing that is scheduled before the Board in December, 1978. On motion made, seconded and duly passed, the hearing will be held as scheduled. 3: 00 p. m. RE: Dr. Theodore C. Rozema, Tryon, N. C. -- A hearing was held before the Board of Medical Examiners of the State of North Carolina upon and concerning charges and accusations preferred by the Board in this matter at The Wilmington Hilton Hotel, Wilmington, North Carolina, on Thursday, October 12, 1978, at which hearing Dr. Rozema did appear and was represented by counsel, William McFarland, Esq. Following this hearing and presentation of evidence, and upon motion duly made, seconded and passed, Dr. Rozema's license to practice medicine in the State of North Carolina was revoked; revocation suspended upon the terms and conditions as set forth in the Fi;ndings of Fact, Conclusions of Law and Order. of the Board RE: Dr. Ali Shirkhoda, Chapel Hill, N. C. -- The Board reviewed Dr. Shirkhoda's request for special consideration for licensure in North Carolina although he does not hold the alien registration receipt card. On motion made, seconded and duly passed, Dr. Shirkhoda is to be informed that the Board regrets this situation has occurred, but the rules and regulations prohibit their granting his special request. RE: Dr. Emil Ascheim, Long Island, N. Y. -- The Board . considered Dr. Ascheim's ten months of clinical clerkship training in New York as to whether it will meet the Board's requirements of satisfactory completion of one year of postgraduate training for licensure in North Carolina. On motion made, seconded and duly passed, the Executive Secretary was instructed to advise Dr. Ascheim that the Board must abide by the Medical Practice Act in regard to postgraduate training requirements, and his one year of clinical clerkship is not approved by the Board. RE: Dr. Kamineni S. Rao, Goldsboro, N. C. -- Dr. Rao has a resident's training license to work as a staff physician at O'Berry Center. He has taken and failed the December, 1977 examination after advising he took the FLEX examination once before out of state. However, information has now reached the Board that Dr. Rao took and failed the FLEX on two previous occasions rather than just once as had been reported, and he should not have been issued the resident's training license to work as a staff physician. However, he is scheduled to take the December, 1978 FLEX examination in North Carolina. On motion made, seconded and duly passed, Dr. Rao can continue working at O'Berry Center under his resident's training license until the results of the December, 1978 FLEX examination are received.

The Board of Medical Examiners of the State of North Carolina met .at TheWilmington Hilton Hotel, Wilmington, North Carolina, October 12-15, 1978, forthe purpose of interviewing applicants for license by endorsement of credentialsand conducting other business.

Drs. E. Wilson Staub, President, Charles B. Wilkerson, Jr. , Secretary-Treasurer,Bruce B. Blackmon, David S. Citron, Bryant L. Galusha, J. J. Pence, Jr. , and JoyceH. Reynolds were present. RE: Dr. Sheng H. Chang, Winston-Salem, N. C. -- The Board reviewed correspon-dence from Dr. Chang regarding the hearing that is scheduled before the Board inDecember, 1978. On motion made, seconded and duly passed, the hearing will be heldas scheduled.

RE: Dr. Theodore C. Rozema, Tryon, N. C. -- A hearing was held before the Boardof Medical Examiners of the State of North Carolina upon and concerning charges andaccusations preferred by the Board in this matter at The Wilmington Hilton Hotel,Wilmington, North Carolina, on Thursday, October 12, 1978, at which hearing Dr.Rozema did appear and was represented by counsel, William McFarland, Esq. Followingthis hearing and presentation of evidence, and upon motion duly made, seconded andpassed, Dr. Rozema's license to practice medicine in the State of North Carolinawas revoked; revocation suspended upon the terms and conditions as set forth in theFi;ndings of Fact, Conclusions of Law and Order. of the Board

RE: Dr. Ali Shirkhoda, Chapel Hill, N. RE: Dr. Edward L. Jones, Thomasville, N. C. -- Following review of informationpresented, and on motion made, seconded and duly passed, the Board voted to institutethe proper procedures to prefer charges against Dr. Edward L. Jones, and he be sonotified in writing, and advised that he will be given a hearing on such chargesthat will be presented against him.

RE: Dr. Susanne S. Carlan, Charlotte, N. C. -- Following review of informationpresented, and on motion made, seconded and duly passed, the Board voted to institutethe proper procedures to prefer charges against Dr. Susanne S. Carlan, and soadvise notify her in writing, and advise her that she will be given a hearing onsuch charges that will be presented against her.

RE: Dr. Wilson S. Rippy, Asheville, N. C. -- Following review of informationpresented, and on motion made, seconded and duly passed, the Board voted to institutethe proper procedures to prefer charges against Dr. Wilson S. Rippy, and instructedthat he be so notified in writing, and advised that he will be given a hearing onsuch charges that will be presented against him.

RE: Dr. Richard G. Stuelke, Durham, N. C. -- Following review of informationpresented, and on motion made, seconded and duly passed, the Board voted to insti-tute the proper procedures to prefer charges against Dr. Richard G. Stuelke, andinstructed that he be so notified in writing, and advised that he will be given ahearing on such charges that will be presented against him.

RE: University of North Carolina, Area Health Education Centers Program--Request from the AHEC Program Director of Evaluation, Thomas J. Bacon, to passon requests from the AHECs for mailing lables for physicians in each region toreceive announcements about AHEC-sponsored continuing education programs to theHealth Services Research Center without seeking approval from the Board of MedicalExaminers for each individual request. On motion made, seconded and duly passed,the Executive Secretary was authorized to review each request and approve same ashe deems appropriate, but blanket approval for these types of requests not begranted.

RE: Dr. William M. C. Wilhoit, Pensacola, Florida -- Request for reinstatementof his license to practice medicine in North Carolina, which was suspended forfailure to register. On motion made, seconded and duly passed, Dr. Wilhoit's licenseto practice medicine in North Carolina was reinstated, and he was invited to appearat the Board's next meeting.

RE: North Carolina Medical Assistance Program -- The Executive Secretarypresented a letter from the N. C. Medical Assistance Program requesting the Board'soffice to supply them, as a routine matter, all information regarding Board actionon physicians' licenses. This office is Program Integrity, Department of HumanResources, Division of Medical Assistance. On motion made, seconded and duly passed,the Board voted to honor this request.

RE: Insurance proposal -- Insurance and bonds for the office staff and officecontents: The Executive Secretary presneted a proposal from the Medical InsuranceAgency, Inc. , which is lower than the present rates being paid to Charles E. Johnsonand Sons, Inc. On motion made, seconded and duly passed, the Board instructed theExecutive Secretary to accept the proposal as presented and purchase the insurance.

RE: Emergency Medical Technicians -- Information was presented to the Boardfrom Colonel Charles Speed, Chief, Office of Emergency Medical Services, regardingthe unauthorized medical acts performed by emergency medical technicians, and thatoffice's continued follow-up on the problems such as this. The Board received thisas information.

On motion made, seconded and duly passed, the Board voted to write Mr. ChrisGentile, who has resigned from the North Carolina Office of Emergency Medical Services,to assume a new position in another state, a letter expressing the Board's thanksfor the services he rendered to the Board, and expressing their congratulations andgood wishes on his new position.

RE: Knight Publishing Co. v. Board of Medical Examiners -- On motion made,seconded and duly passed the -oar".. a&~roved the vesol»tion that all ~e ~e-semployees, agents and officers of the Board of Medical Examiners comply with therequirements of Chapter 132 of the General Statutes of the State of North Carolina,and Article 1 of Chapter 90 of the North Carolina General Statutes.

RE: Dr. Akhtar Ashraf, Morganton, N. C. -- Dr. Ashraf holds a resident's train-ing license to work at Broughton Hospital, which was issued to him until he passesthe FLEX examination, which he did on the June, 1978 examination. Dr. Ashraf hasnot met the Board's requirements concerning completion of one year of post-graduateeducation prior to receiving a full North Carolina license. It was moved, secondedand passed that Dr. Ashraf be asked to come to the December, 1978 meeting to discussthis situation with the Board, and his resident's training license remain in effectuntil that time.

RE: Dr. Stephen Lee Kash, P .A. -- Professional corporation name change: Dr.Kash wishes to change the name of his corporation to Coastal Carolina Eye Clinic,P.A. , which has already been done by the Secretary of State's office, withoutDr. Kash or his attorney checking with the Board's office first, as required in therules and regulations, to determine if anotherprofessional association has a similarname. Another professional association does have a similar name, which was submittedin June, 1975, reading: Coastal Eye Clinic, P.A. Dr. Kash's attorney has asked theBoard's consideration in determining if these two corporate names are so similar asto cause problems. It was moved, seconded and duly passed that this name change begranted if the professional association, Coastal Eye Clinic, P.A. , in New Bern,North Carolina, has no objections to this.

RE: Dr. Dennis R. S. Osborne, Durham, N. C. -- postgraduate training: It was moved,seconded and duly passed that Dr. Osborne's training be approved by the Board . asmeeting the requirements for one year of post-graduate training.

RE: Registered nurses performing medicalacts -- subcommittee report: Dr. Citron,Chairman of the Joint Subcommittee of the Board of Medical Examiners and Board ofNursing, reported on the meeting held with the subcommittee members on Friday,October 13, at 9:00 a.m. He indicated that some of the subjects discussed werethe Bowman Gray Neurosurgical Nurse Practitioner Program; continuing education fornurse practitioners; the Joint Practice Committee's statement regarding core curri-cula for nurse practitioners, recommending that this be required of all nurse prac-titioner programs, which the subcommittee accepted in principle; and consideration ofapplications for registered nurses performing medical acts. Also discussed was theCommentary of the Board of Medical Examiners regarding assistants to physiciansand nurse practitioners, a copy of which will be circulated to members of the jointsubcommittee following its final approval by the Board of Medical Examiners.

Dr. Citron advised the Board that he would no longer be a member of the jointsubcommittee in view of his increasing duties to the Board as President for 1978-79,and that Dr. A. T. Pagter would become the third member on the joint subcommitteerepresenting the Board of Medical Examiners. Dr. Joyce Reynolds will become theChairman of the subcommittee.

It was moved, seconded and passed that the subcommittee report be accepted andthe actions of the joint subcommittee be approved. Those applications for nursesperforming medical acts are as follows:

RE: Dr. Robert E. Aiken, Gulfport, Ms. -- The Executive Secretary advised theBoard that Dr. Aiken had asked that his application for licensure in North Carolinabe withdrawn; however, his license number had already been assigned prior to thisrequest, and all records in the Board, 's office reflected that he had been issuedhis North Carolina license. On motion made, seconded and duly passed, Dr. Aiken'srequest for his application to be withdrawn was honored, and the license number wasvoided.

RE: New Board members -- The President of the Board recognized Dr. A. T. Pagter,Jr. and Dr. Louis T. Kermon as new members of the Board, whose term of office willbe November 1, 1978 through October 31, 1984. Dr. Kermon and Dr. Pagter indicatedtheir acceptance of their election as members of the Board.

RE: Dr. Carl E. Bosley, Jacksonville, N. C. -- Dr. Bosley, an osteopathic physician,appeared to discuss with the Board;their rules and regulations regarding licensingof doctors of osteopathy, and the North Carolina General Statutes in that regard.The Board advised Dr. Bosley that the North Carolina Board of Medical Examinersdid not and had never recognized the examination of the National Board of Examinersfor Osteopathic Physician and Surgeons, although they had requested a copy of thatexamination for their review, which had not yet been received. Dr. Bosley was alsoadvised by the Board that his one y'ear of training in the Pontiac OsteopathicHospital in Pontiac, Michigan was not a training program that is approved by theBoard as meeting the requirements for satisfactory completion of one year ofpost-graduate training.

He was advised that upon satisfac'tory completion of credentials, he would be eli-gible to take the FLEX examination in this state, and once he had completed oneyear of postgraduate training in a Board-approved program, if he passed FLEX, hewould be eligible for licensure in North Carolina. It was stressed to Dr. Bosleythat at present this was the only method of licensure for him in North Carolina.

Dr. Bosley said this was a severe problem for him since he did not want to repeata year of postgraduate training, and that he would look into the question of licensurein other states for osteopathic physicians and would then make his decision. He

stated he was not pursuing this as much personally for himself as he was hoping"to open the door so that if any other osteopathic physicians wanted to come in,maybe some things could be worked out so that it would be possible for them. "Dr. Bosley thanked the Board for discussing this situation with him, and said hewould be in touch with the Board at a later date.

C. -- A hearing was held before the Boardof Medical Examiners of the State o'f North Carolina on Saturday, October 14, 1978,Wilmington, North Carolina regarding the Petition filed on behalf of Michael T.Newton v. Board of Medical Examiners of the State of North Carolina, at which hear-ing Dr. Carl W. Hoffman, Mr. Michael T. Newton and Mr. H. E. Stacy, Jr. , Attorneyfor Plaintiff, were present. RE: Assistants to physicians and registered nurses performing medical actsCommentary of the Board: Following review of the final draft of the "Commentaryof the Board of Medical Examiners of the State of North Carolina RegardingAssistants to Physicians and Registered Nurses Performing Medical Acts", and onmotion made, seconded and duly passed, the Commentary was approved by the Board.The Executive Secretary was instructed to distribute copies of this Commentaryto all supervising physicians, all assistants to physicians and all registerednurses performing medical acts, and to include a copy when an application is sentto any assistant or nurse and physician applying for approval from the Board.

Dr. Staub, President of the Board, expressed his thanks to the Board andstaff for their work and assistance during his tenure as President of the Boardand also during his six years as a member of the Board. Dr. Staub and Dr. Wilkersonwere commended by the Board for the'ir work while serving as Board members andeach as President of the Board for a one year period, and thanked for theircontinual efforts on behalf of the Board and the State of North Carolina.
