    Trust on the subject real property. The subject real property is situated in Washington County, Oregon.Both the Plaintiff and the Defendant having actual or contingent interest therein, and further for thepurpose of declaring the first priority lien position of the deed of trust, the Court has venue andjurisdiction over this proceeding pursuant to ORS 14.040 and ORCP 4F.

    II. DESCRIPTION OF REAL ESTATE2.

    The real property subject to tlus action and encumbered by the Deed ofTrust is legallydescribed as:

    Lot 32, Padgett Park, in the City oflli llsboro, COWlty of Washington and State ofOregon .The real property subject to this action and which was encumbered by the Deed ofTrust is morecommonly known as 767 Northwest Damielle Street, Hillsboro, Oregon 97124 ("Property").

    III. PARTIES3.

    dated July 16, 2010 and recorded July 23,2010 as Document No. 2010-056015 ("Tax Lien"). A trueand accurate copy of the Tax Lien is attached hereto as Exhibit A. Any interest claimed by saidDefendant in the Property may not have been extinguished via a foreclosure (trustee'ssale) ofa Deed of Trust held by PlaintiffCha

    and Deed ofTrust, the Successor Trustee commenced a non-judicial foreclosure ofllie Propertypursuant to 86.705 et seq. As evidence of such foreclosure, the Successor Trustee recorded a Notice ofDefault and Election to Sell in the records of Washington County on December 29, 2008 as DocumentNo. 2010-053061. The Successor Trustee also recorded an Affidavit of Mailing Trustee's Notice ofSale in the records of Washington COlmty on November 16,2010 as Document No. 2010-091604.Plaintiff Chase was the successful bidder at the Successor Trustee' s auction of the Property on March29,2011. On September 25,2009, the NWTS as Successor Trustee conveyed to Plaintif f Chase aTrustee's Deed, which was recorded April 6, 20] 1 as Document No. 20] 1-026163. True and accuratecopies of the Notice of Default and Election to Sell, the Affidavit of Mailing Trustee's Notice of Sale,and Trustee's Deed are attached hereto as Exhibits D through F respectively.

    DEFENDANT'S OMITTED JtJNIOR LINEHOLDER STATUS: After the non-judicialforeclosure was completed, PlaintiffNWTS discovered that it may no t have provided notice of thetrustee's sale to Defendant, and to that extent, Defendant's Tax Lien may be an omitted lien, juniorto Plaintiffs interest. To the extent that Defendant has any right to redeem the Property, Plaintiff nowseeks to strictly foreclose any such right of redemption that may exist, or alternatively, have the courtdeclare that no such right exists.

    VI. CLAIM FOR RELIEF - STlUCT FORECI"OSURE9.

    Plaintiff fe-alleges paragraphs 1-8 of its Complaint.10.

    default, the Successor Trustee enforced the Deed of Trust via foreclosure by advertisement and salepursuant to ORS 86.740 to 86.755. To the extent that Defendant has any right to redeem the Propertyas an "omitted person," pursuan t ORS 86.742 (6), Plaint iff is entitled, and now seeks, to foreclosestrictly Defendant's claimed right of redemption by requiring Defendant to redeem the Property now, orbe forever barred from redeeming the Property or otherwise having any remaining interest thereinwhatsoever.

    11.The tenus of the Note and Deed of Trust provide that in the event of any action to coHect the

    Note or to foreclose the Deed of Trust there shall be recoverable a reasonable sum for attorney's feesand costs.

    12.Plainti ff has no adequate remedy at law.

    VII. PRAYER FOR RELIEF

    13.\VHEREFORE, on Plainti:ffs' Claim for Relief, Plaintiffs request a general judgment of strict

    foreclosure from this Court as follows:A. That Defendant be ordered to redeem the Property within 30 days or otherwise be

    forever barred from redeeming the Property or otherwise having any remaining interest thereinwhatsoever.
