"Sec. 3. SENTENCING GUIDELINES COMMISSION REQUIRED TO ADOPT RULES.

(a) The Minnesota Sentencing Guidelines Commission shall adopt further rules regulating howthe commission's hearings are to be conducted. These rules must ensure that proper notice of at leastseven days is provided to commission members and the public regarding the time and place for ameeting. This notice must include any proposed amendments or modifications to the guidelines tobe discussed and a detailed agenda that distinguishes between informational items, discussion items,and action items. The rules must prohibit items not included as action items from being acted on atthat hearing. Further, the rules must prohibit a vote on any proposal to amend or modify the guidelinesduring the same meeting that it was first presented. In addition, the rules must prohibit the finaladoption of a proposed modification to the guidelines that was forwarded for a public hearing andthat was amended in any substantive way at or following the public hearing, unless another publichearing is held on the revised language.

(b) Upon adoption of the rules required in paragraph (a), the commission shall report a summaryof them to the chairs and ranking minority members of the legislative committees with jurisdictionover criminal justice policy.

EFFECTIVE DATE. This section is effective the day following final enactment."

"Section 1. [62J.84] PRESCRIPTION DRUG PRICE TRANSPARENCY.

Subdivision 1. Short title. This section may be cited as the "Prescription Drug Price TransparencyAct."

Subd. 2. Definitions. (a) For purposes of this section, the terms defined in this subdivision havethe meanings given.

(b) "Biosimilar" means a drug that is produced or distributed pursuant to a biologics licenseapplication approved under United States Code, title 42, section 262(K)(3).

(c) "Brand name drug" means a drug that is produced or distributed pursuant to:

(1) an original, new drug application approved under United States Code, title 21, section 355(c),except for a generic drug as defined under Code of Federal Regulations, title 42, section 447.502;or

(2) a biologics license application approved under United States Code, title 45, section 262(a)(c).

(d) "Commissioner" means the commissioner of health.

(e) "Generic drug" means a drug that is marketed or distributed pursuant to:

(1) an abbreviated new drug application approved under United States Code, title 21, section355(j);

(2) an authorized generic as defined under Code of Federal Regulations, title 45, section 447.502;or

(3) a drug that entered the market the year before 1962 and was not originally marketed undera new drug application.

(f) "Manufacturer" means a drug manufacturer licensed under section 151.252.

(g) "New prescription drug" or "new drug" means a prescription drug approved for marketingby the United States Food and Drug Administration for which no previous wholesale acquisitioncost has been established for comparison.

(h) "Patient assistance program" means a program that a manufacturer offers to the public inwhich a consumer may reduce the consumer's out-of-pocket costs for prescription drugs by usingcoupons, discount cards, prepaid gift cards, manufacturer debit cards, or by other means.

(i) "Prescription drug" or "drug" has the meaning provided in section 151.44, paragraph (d).

(j) "Price" means the wholesale acquisition cost as defined in United States Code, title 42, section1395w-3a(c)(6)(B).

Subd. 3. Prescription drug price increases reporting. (a) Beginning October 1, 2021, a drugmanufacturer must submit to the commissioner the information described in paragraph (b) for eachprescription drug for which the price was $100 or greater for a 30-day supply or for a course oftreatment lasting less than 30 days and:

(1) for brand name drugs where there is an increase of ten percent or greater in the price overthe previous 12-month period or an increase of 16 percent or greater in the price over the previous24-month period; and

(2) for generic drugs where there is an increase of 50 percent or greater in the price over theprevious 12-month period.

(b) For each of the drugs described in paragraph (a), the manufacturer shall submit to thecommissioner no later than 60 days after the price increase goes into effect, in the form and mannerprescribed by the commissioner, the following information, if applicable:

(1) the name and price of the drug and the net increase, expressed as a percentage;

(2) the factors that contributed to the price increase;

(3) the name of any generic version of the prescription drug available on the market;

(4) the introductory price of the prescription drug when it was approved for marketing by theFood and Drug Administration and the net yearly increase, by calendar year, in the price of theprescription drug during the previous five years;

(5) the direct costs incurred by the manufacturer that are associated with the prescription drug,listed separately:

(i) to manufacture the prescription drug;

(ii) to market the prescription drug, including advertising costs; and

(iii) to distribute the prescription drug;

(6) the total sales revenue for the prescription drug during the previous 12-month period;

(7) the manufacturer's net profit attributable to the prescription drug during the previous 12-monthperiod;

(8) the total amount of financial assistance the manufacturer has provided through patientprescription assistance programs, if applicable;

(9) any agreement between a manufacturer and another entity contingent upon any delay inoffering to market a generic version of the prescription drug;

(10) the patent expiration date of the prescription drug if it is under patent;

(11) the name and location of the company that manufactured the drug; and

(12) if a brand name prescription drug, the ten highest prices paid for the prescription drugduring the previous calendar year in any country other than the United States.

(c) The manufacturer may submit any documentation necessary to support the informationreported under this subdivision.

Subd. 4. New prescription drug price reporting. (a) Beginning October 1, 2021, no later than60 days after a manufacturer introduces a new prescription drug for sale in the United States that isa new brand name drug with a price that is greater than the tier threshold established by the Centersfor Medicare and Medicaid Services for specialty drugs in the Medicare Part D program for a 30-daysupply or a new generic or biosimilar drug with a price that is greater than the tier thresholdestablished by the Centers for Medicare and Medicaid Services for specialty drugs in the MedicarePart D program for a 30-day supply and is not at least 15 percent lower than the referenced brandname drug when the generic or biosimilar drug is launched, the manufacturer must submit to thecommissioner, in the form and manner prescribed by the commissioner, the following information,if applicable:

(1) the price of the prescription drug;

(2) whether the Food and Drug Administration granted the new prescription drug a breakthroughtherapy designation or a priority review;

(3) the direct costs incurred by the manufacturer that are associated with the prescription drug,listed separately:

(i) to manufacture the prescription drug;

(ii) to market the prescription drug, including advertising costs; and

(iii) to distribute the prescription drug; and

(4) the patent expiration date of the drug if it is under patent.

(b) The manufacturer may submit documentation necessary to support the information reportedunder this subdivision.

Subd. 5. Newly acquired prescription drug price reporting. (a) Beginning October 1, 2021,the acquiring drug manufacturer must submit to the commissioner the information described inparagraph (b) for each newly acquired prescription drug for which the price was $100 or greater fora 30-day supply or for a course of treatment lasting less than 30 days and:

(1) for a newly acquired brand name drug where there is an increase of ten percent or greaterin the price over the previous 12-month period or an increase of 16 percent or greater in price overthe previous 24-month period; and

(2) for a newly acquired generic drug where there is an increase of 50 percent or greater in theprice over the previous 12-month period.

(b) For each of the drugs prescribed in paragraph (a), the acquiring manufacturer shall submitto the commissioner no later than 60 days after the acquiring manufacturer begins to sell the newlyacquired drug, in the form and manner prescribed by the commissioner, the following information,if applicable:

(1) the price of the prescription drug at the time of acquisition and in the calendar year prior toacquisition;

(2) the name of the company from which the prescription drug was acquired, the date acquired,and the purchase price;

(3) the year the prescription drug was introduced to market and the price of the prescriptiondrug at the time of introduction;

(4) the price of the prescription drug for the previous five years;

(5) any agreement between a manufacturer and another entity contingent upon any delay inoffering to market a generic version of the manufacturer's drug; and

(6) the patent expiration date of the drug if it is under patent.

(c) The manufacturer may submit any documentation necessary to support the informationreported under this subdivision.

Subd. 6. Public posting of prescription drug price information. (a) The commissioner shallpost on the department's website, or may contract with a private entity or consortium that satisfiesthe standards of section 62U.04, subdivision 6, to meet this requirement, the following information:

(1) a list of the prescription drugs reported under subdivisions 3, 4, and 5, and the manufacturersof those prescription drugs; and

(2) information reported to the commissioner under subdivisions 3, 4, and 5.

(b) The information must be published in an easy-to-read format and in a manner that identifiesthe information that is disclosed on a per-drug basis and must not be aggregated in a manner thatprevents the identification of the prescription drug.

(c) The commissioner shall not post to the department's website or a private entity contractingwith the commissioner shall not post any information described in this section if the information isnot public data under section 13.02, subdivision 8a; or is trade secret information under section13.37, subdivision 1, paragraph (b); or is trade secret information pursuant to the Defend TradeSecrets Act of 2016, United States Code, title 18, section 1836, as amended. If a manufacturerbelieves information should be withheld from public disclosure pursuant to this paragraph, themanufacturer must clearly and specifically identify that information and describe the legal basis inwriting when the manufacturer submits the information under this section. If the commissionerdisagrees with the manufacturer's request to withhold information from public disclosure, thecommissioner shall provide the manufacturer written notice that the information will be publiclyposted 30 days after the date of the notice.

(d) If the commissioner withholds any information from public disclosure pursuant to thissubdivision, the commissioner shall post to the department's website a report describing the natureof the information and the commissioner's basis for withholding the information from disclosure.

Subd. 7. Consultation. (a) The commissioner may consult with a private entity or consortiumthat satisfies the standards of section 62U.04, subdivision 6, the University of Minnesota, or thecommissioner of commerce, as appropriate, in issuing the form and format of the informationreported under this section; in posting information pursuant to subdivision 6; and in taking any otheraction for the purpose of implementing this section.

(b) The commissioner may consult with representatives of the manufacturers to establish astandard format for reporting information under this section and may use existing reportingmethodologies to establish a standard format to minimize administrative burdens to the state andmanufacturers.

Subd. 8. Enforcement and penalties. (a) A manufacturer may be subject to a civil penalty, asprovided in paragraph (b), for:

(1) failing to submit timely reports or notices as required by this section;

(2) failing to provide information required under this section; or

(3) providing inaccurate or incomplete information under this section.

(b) The commissioner shall adopt a schedule of civil penalties, not to exceed $10,000 per dayof violation, based on the severity of each violation.

(c) The commissioner shall impose civil penalties under this section as provided in section144.99, subdivision 4.

(d) The commissioner may remit or mitigate civil penalties under this section upon terms andconditions the commissioner considers proper and consistent with public health and safety.

(e) Civil penalties collected under this section shall be deposited in the health care access fund.

Subd. 9. Legislative report. (a) No later than January 15 of each year, beginning January 15,2022, the commissioner shall report to the chairs and ranking minority members of the legislativecommittees with jurisdiction over commerce and health and human services policy and finance onthe implementation of this section, including but not limited to the effectiveness in addressing thefollowing goals:

(1) promoting transparency in pharmaceutical pricing for the state and other payers;

(2) enhancing the understanding on pharmaceutical spending trends; and

(3) assisting the state and other payers in the management of pharmaceutical costs.

(b) The report must include a summary of the information submitted to the commissioner undersubdivisions 3, 4, and 5."

(c) "Biogas" means gas created by the anaerobic digestion of biomass, gasification of biomass,or other effective conversion processes.

(d) "Natural gas utility" means a public utility as defined in section 216B.02, subdivision 4, thatprovides natural gas sales or transportation services to customers in Minnesota.

(e) "Power-to-hydrogen" means the use of electricity generated by an eligible energy technologyas defined in section 216B.1691, subdivision 1, paragraph (a), or section 216B.2422, subdivision1, to create hydrogen for injection into a natural gas utility or interstate pipeline system.

(f) "Renewable natural gas" means biogas that has been processed to be interchangeable withconventional natural gas and has lower lifecycle greenhouse gas intensity than conventional fossilnatural gas.

(g) "Renewable gaseous fuel" means renewable natural gas or hydrogen produced viapower-to-hydrogen that has lower lifecycle greenhouse gas intensity than conventional fossil naturalgas.

(h) "Total incremental cost" means the sum of:

(1) capital investments in infrastructure for the production, processing, pipeline interconnection,storage, and distribution of renewable natural gas or alternative resources included in a utilityalternative resource plan approved pursuant to subdivision 3, including the cost of capital establishedby the commission in the natural gas utility's most recent general rate case;

(2) operating costs associated with capital investments in infrastructure for the production,processing, pipeline interconnection, storage, and distribution of renewable natural gas or alternativeresources included in a utility alternative resource plan approved pursuant to subdivision 3;

(3) the incremental cost to procure renewable natural gas from third parties; and

(4) the incremental costs to administer programs included in a utility alternative resource planapproved pursuant to subdivision 3. Less the sum of:

(i) any value received by the natural gas utility upon the resale of renewable gaseous fuels orthe sale of its by-products not used for service to Minnesota customers, including any environmentalcredits included with the resale of the renewable gaseous fuels; and

(ii) any cost savings achieved through avoidance of conventional natural gas purchases, includingbut not limited to any avoided commodity purchases or avoided pipeline costs.

Subd. 2. Renewable natural gas and alternative resource goals. A natural gas utility mayassist the state in meeting its renewable energy and greenhouse gas reduction goals under sections216C.05, subdivision 2, clause (3), and 216H.02, subdivision 1, by using alternative resources tomeet customer energy demands. The natural gas utility's total incremental cost to achieve greenhouse

gas reductions under this subdivision must not exceed five percent of the natural gas utility's totalannual revenue requirement excluding gas costs, as determined in the natural gas utility's most recentgeneral rate case.

Subd. 3. Alternative resource plans. (a) A natural gas utility may file an alternative resourceplan with the commission. An alternative resource plan must include the recommended alternativeresources the utility plans to implement to advance the state's goals established in sections 216C.05and 216H.02, within the requirements and limitations set forth in this section. The utility'srecommended plan must discuss:

(1) any pilot program proposed by the natural gas utility related to the development or provisionof renewable natural gas or alternative resources, including an estimate of the total incremental coststo implement the pilot;

(2) a third-party analysis of the lifecycle greenhouse gas intensity of any alternative resourcesproposed to be included in the plan taking into account emissions associated with the production,processing, transmission, and consumption of energy associated with the resource;

(3) a third-party analysis of the forecasted lifecycle greenhouse gas emissions reductions achievedor the lifecycle greenhouse gas emissions avoided if the alternative resources are implemented,including any:

(i) avoided emissions attributable to utility operations;

(ii) avoided emissions from the production, processing, and transmission of fuels prior to receiptby the utility; and

(iii) avoided emissions at the point of end use;

(4) the process used to develop the lifecycle greenhouse gas accounting methodology usedconsistently throughout the plan, including descriptions of how the utility engaged interestedstakeholders and ensured the plan reflects current scientific knowledge;

(5) whether the recommended plan supports the development and use of alternative agriculturalproducts, waste reduction, reuse, or anaerobic digestion of organic waste, and the recovery of energyfrom waste water;

(6) a description of third-party systems and processes the utility plans to use to:

(i) track the proposed alternative resources included in the plan so that environmental benefitsare used only for this plan and not claimed for any other program; and

(ii) verify the environmental attributes and greenhouse gas intensity of proposed alternativeresources included in the plan;

(7) a description of known local job impacts and the steps the utility and its energy suppliersand contractors are taking to maximize the availability of construction employment opportunitiesfor local workers; and

(8) a report on the utility's progress toward implementing the recommendations contained in itspreviously filed alternative resource plan, if applicable.

(b) The commission must approve, modify, or deny the plan within 12 months of filing. Anatural gas utility may propose an alternative resource plan no more frequently than every 24 months.In deciding whether to approve, modify, or deny a plan, the commission shall consider whether theplan promotes the natural gas utility's ability to achieve the goals established in sections 216C.05and 216H.02 at a cost level consistent with this section. The commission may not approve renewablenatural gas as part of an alternative resource plan unless it finds that the renewable natural gasincluded in the plan will have a lower lifecycle greenhouse gas intensity than conventional fossilnatural gas. The commission may not approve any alternative resource for inclusion in an alternativeresource plan unless it finds that reasonable systems will be used to track and verify the environmentalattributes of the alternative resource, taking into account any third-party tracking or verificationsystems available.

(c) Commission approval of a plan constitutes prima facie evidence of the reasonableness ofthe investments and costs incurred pursuant to the plan. Actual incremental costs incurred pursuantto an approved plan and costs incurred by obtaining the third-party analysis required in paragraph(a), clauses (2) and (3), are recoverable either:

(1) under section 216B.16, subdivision 7, clause (2), via the utility's purchase gas adjustment;or

(2) in the natural gas utility's next general rate case. The utility bears the burden to prove theactual incremental costs incurred to implement the approved alternative resource plan were reasonable.A transportation customer of a natural gas utility shall not bear any costs incurred to implement anapproved alternative resource plan, except to the extent the transportation customer elects toparticipate in a pilot program.

(d) Without filing an alternative resource plan, a natural gas utility may propose, and thecommission may approve cost recovery for:

(1) alternative resources acquired to satisfy a commission-approved green tariff program thatallows customers to choose to meet a portion of the customers' energy needs through alternativeresources; or

(2) utility expenditures for alternative resources within five percent of the average of Venturaand Demarc index price for conventional natural gas at the time of the transaction. Any approvedgreen-tariff program must include provisions to ensure reasonable systems are used to track andverify the environmental attributes of alternative resources included in the program, taking intoaccount any third-party tracking or verification systems available.

(e) A natural gas utility with an approved plan must provide annual status reports to thecommission regarding the work completed pursuant to the plan, including the costs incurred underthe plan; the resulting progress toward meeting the state's goals in sections 216C.05 and 216H.02;a description of the processes used to track, verify, and retire the alternative resources and associatedenvironmental attributes; and an update on the lifecycle greenhouse gas accounting methodologyconsistent with current science. As part of the annual status report the natural gas utility may propose

modifications to pilot programs in the plan. In evaluating a utility's annual report the commissionmay:

(1) approve the continuation of pilot programs, with or without modifications;

(2) require the utility to file a new or modified plan to account for changed circumstances; or

(3) disapprove the continuation of pilot programs.

(f) A utility may file an alternative resource plan at any time after this section becomes effective.

Sec. 3. RENEWABLE GASEOUS FUEL INVENTORY.

(a) By June 15, 2021, the Department of Commerce must develop an inventory of renewablegaseous fuel resources as defined in Minnesota Statutes, section 216B.2427, subdivision 1, paragraph(g), available to Minnesota. The inventory must include but is not limited to:

(1) a list of the potential renewable natural gas sources in Minnesota and the estimated potentialproduction quantities available at each source;

(2) an estimate of the energy content of listed renewable natural gas sources;

(3) a description of the technologies available to Minnesota for renewable gaseous fuel productionand an estimate of the potential energy production by technology, including:

(i) an estimate of the renewable gaseous fuel production potential using power-to-hydrogen;

(ii) separate estimates for production from excess renewable electricity that would otherwisebe curtailed and for production from dedicated renewable generation facilities; and

(iii) an ideal site characterization that details the aspects of a power-to-hydrogen facility thatwould contribute to the facility's technical and economic success;

(4) a list of the existing biogas and renewable natural gas production sites in Minnesota thatincludes:

(i) the location of each site;

(ii) an estimate of the lifecycle greenhouse gas emissions associated with the fuel produced ateach site including the production, processing, transmission, and consumption of the biogas orrenewable natural gas; and

(iii) an assessment of the supply-chain infrastructure associated with the site;

(5) an assessment of the market viability of Minnesota renewable natural gas production takinginto account renewable natural gas sales prices, the cost of infrastructure needed to produce andtransport renewable natural gas, the size of producers, and the availability of renewable natural gasfeedstocks in the state;

(6) for the potential sources identified in clause (1), a discussion of the best use or uses for eachpotential energy resource. The discussion shall take into account:

(i) estimated lifecycle greenhouse gas emissions;

(7) a discussion of whether development of a system of tradable thermal credits would bebeneficial for the development of renewable thermal resources in the state. This discussion shouldconsider system designs that could best facilitate development of renewable thermal resources whileensuring adequate tracking and verification of environmental attributes associated with thoseresources.

(b) The department may assess natural gas utilities serving more than 800,000 customers withinthe state during the last calendar year for the costs necessary to carry out the purposes of this section.Those assessments are not subject to the cap on assessments provided in Minnesota Statutes, section216B.62, or any other law.

EFFECTIVE DATE. Sections 1 to 3 are effective the day following final enactment."
