RuZes Suspended ~ AMENDMENT OF TITLE 2, CHAPTER 8 OF MUNICIPAL CODE OF CHICAGO CONCERNING

REDISTRICTING OF CITY WARDS.

Alderman Mell moved to Suspend the Rules Temporarily for the immediate consideration ofand action upon a proposed substitute ordinance amending Title 2, Chapter 8 of the Municipal Code of Chicago concerning the redistricting of the fifty wards of the City of Chicago. The motion Prevailed.

Thereupon, on motion of Alderman MeU, the said proposed substitute ordinance was Passed by yeas and nays as follows:

WHEREAS, Article VII, Section 6(a) of the Constitution of the State of lUinois provides that a home rule unit may exercise any power and perfoi-m any function relating to its govemment and affairs; and

WHEREAS, The City of Chicago, having a population in excess of twenty-five thousand (25,000) is a home rule unit; and

WHEREAS, The redistr ict ing of the wards of the City of Chicago is a mat ter relating to the govemment a n d affairs of the City; and

WHEREAS, Pu r suan t to the Illinois CompUed Sta tu tes , Chapte r 65 , Act 20, Article 2 1 , Section 3 8 , the City CouncU shall by ordinance redistr ict the City of Chicago on the basis of the mos t recent national census ; now, therefore,

Be It Ordained by the City Council of the City of Chicago:

SECTION 1. Chapter 2 of the Municipal Code of the City of Chicago is hereby amended by deleting therefrom existing Sections 2-8-300 th rough 2-8-810 and subs t i tu t ing therefor new Sections 2-8-300 through 2-8-810, a s follows:

2-8-300. Wards Created - Basis - Redistricting.

The city is hereby divided into 50 ujards a n d redistricted a s provided in this chapter.

In the yea r following the national decennial census, the City Coundl shall redistrict the City on the basis o f such census. In the formation ofzuards in such redistricting, a s nearly a s practicable, each ward shall be compact, contiguous, and of substantially ecjual population with an acceptable deviation to respect established communities oflnterest or to achieve other legally valid a n d permissible objectives. This provision shall be subject to Section 21-39 o f the Revised Cities and Villages Act, provided that no substi tute redistricting ordinance shal l be submitted to the voters pu r suan t to Section 21-39 unless one-fifth or more o f t h e aldermen elected, who did not vote to p a s s the first proposed redistricting ordinance, file with the dty clerk a substitute ordinance together with an appropriate petition signed by them, any other provision to the contrary notwithstanding.

2-8-310. First Ward.

Redistricting Impact Statement.

The proposed map satisfies the requirements of the United States Voting Rights Act, the United States Constitution and the Illinois Constitution in that this map provides fair and equal opportunity for minority residents of the City of Chicago to elect representatives of their choice. The map creates twenty (20) wards in which a majority of the total population is African-American and eleven (11) wards in which a majority ofthe total population is Hispanic. In six (6) wards, moreover, no racial group or language minority group constitutes a population majority; minority communities combine to form a majority in each of these stx (6) wards.

El mapa propuesto Uena los requisites de la Ley sobre Derechos de Voto de los Estados Unidos, de la Constitucion de los Estados Unidos y de la Constitucion de Illinois, por cuanto este mapa provee oportunidad justa y equitativa a los residentes de la minoria de la Ciudad de Chicago para elegir a los representantes de su preferencia.
