Minutes of the Ninth meeting of the Special Committee for Interlinking of Rivers held under the Chairpersonship of Sushri Uma Bharti, Hon’ble Minister for Water Resources, River Development and Ganga Rejuvenation on 29.04.2016 at New Delhi.

The ninth meeting of the Special Committee for Interlinking of Rivers chaired by Sushri Uma Bharti, Hon’ble Minister for Water Resources, River Development and Ganga Rejuvenation was held on 29.04.2016 at 11:00 hours at Vigyan Bhavan, New Delhi. Shri Girish Mahajan, Hon’ble Minister of Water Resources, Government of Maharashtra and members/representatives from various Central Government and State Government organizations attended the meeting. The list of the Members and participants who attended the meeting is placed at Annex-I.

At the outset, Hon’ble Minister for Water Resources, River Development and Ganga Rejuvenation extended a warm welcome to the members of the Special Committee and participants in the meeting. She mentioned that the Interlinking of Rivers Programme is very important for enhancing water and food security of the country and would be very helpful in providing water to water short, drought prone and rain fed farming areas. The Government of India was committed for Implementation of ILR Programme with the consensus and cooperation of the concerned State Governments.

The Hon’ble Minister (WR,RD&GR) mentioned that she had a meeting with Shri Naveen Patnaik, Hon’ble Chief Minister, Odisha on 3rd February, 2016 at Bhubaneswar regarding Mahanadi-Godavari link project and was hopeful for a positive response from Government of Odisha in this regard. She further stated that in the meeting with the Hon’ble Chief Minister, Odisha, it was decided that there would be a Joint Committee of the officers of Central and State Governments, which would discuss and sort out all the issues regarding the link and the next meeting with the Hon’ble Chief Minister, Odisha would be held after six months from the first meeting.

Regarding the Ken Betwa Link Project, the Hon’ble Minister (WR, RD & GR) mentioned that its various clearances were in advanced stage of processing and advised Director General, NWDA to get the Wildlife clearance expedited. After obtaining all the clearances, a Note would be submitted to the Union Cabinet, wherein the mode and launching pattern for the link project would be proposed. She directed NWDA to deal with all the concerned issues on priority.

The Hon’ble Minister (WR,RD&GR) stated that the issue of water sharing between Gujarat and Maharashtra in respect of Damanganga-Pinjal and Par-Tapi-Narmada link projects was being taken up on priority. In view of the drought situation in various parts of the country, this was the right time to have Par-Tapi-Narmada link, which would benefit the drought prone areas of Saurashtra and Kutch in Gujarat. The Damanganga-Pinjal link project would transfer water to Mumbai City, which would meet domestic water requirements of the city upto 2060 AD. She, therefore, sought cooperation and assistance of Hon’ble Minister (Water Resources), Maharashtra for the implementation of Damanganga-Pinjal and Par-Tapi-Narmada link projects. The Hon’ble Minister (WR,RD&GR) mentioned that she would be having a meeting with the Hon’ble Chief Minister of Mahrashtra on 3rd May, 2016, wherein she would discuss both the link projects as well as Tapi Mega Recharge Scheme. She stated that there was drought in some parts of the country such as Latur and at the same time there were floods in other parts of the country such as Assam. Therefore, there was necessity of interlinking of rivers through which surplus flood water would be transferred to water deficit areas. She expressed hope that an agreement on water sharing related to Damanganga-Pinjal and Par-Tapi-Narmada link projects would be reached with the co-operation of both the States at an early date.

The Hon’ble Minister (WR,RD&GR) solicited the cooperation and assistance of all members especially the concerned State Governments, which was very essential for the successful implementation of Interlinking of Rivers Programme.

Hon’ble Minister (WR,RD&GR), thereafter, requested the Hon’ble Minister of Water Resources, Government of Maharashtra to express his views.

Maharashtra:

Shri Girish Mahajan, Hon’ble Minister of Water Resources, Government of Maharashtra stated that the issue of sharing of water between Gujarat and Maharashtra in Damanganga-Pinjal and Par-Tapi-Narmada link projects needed to be resolved on priority. In this regard, he mentioned that a meeting of Hon’ble Chief Ministers of Maharashtra and Gujarat with Hon’ble Minister (WR,RD&GR) may be held at an early date to reach an agreement. Prior to that, it would be necessary that the officials of both the States may discuss the issues with the officials of the Union Ministry. He stated that these meetings were proposed earlier also but the same could not been held so far. Hon’ble Minister further stated that the Government of Maharashtra had conveyed their observations on the pre-feasibility report of Koyna-Mumbai City Intra-State Link and requested to expedite the work of preparation of its DPR.

Thereafter, the Hon’ble Minister (WR,RD&GR) requested Director General, NWDA to take up the agenda items for discussion.

Item No. 9.1: Confirmation of the minutes of the 8th meeting of the Special Committee for Interlinking of Rivers held on 8th February, 2016 at New Delhi

Director General, NWDA informed that the minutes of eighth meeting of the Special Committee for Interlinking of Rivers were circulated vide letter dated 11th March, 2016. No comments had been received from any of the members of the Committee and therefore, the minutes were confirmed as circulated.

Item No. 9.2: Follow-up action on the decisions taken during the last meeting

Director General, NWDA informed the follow-up action on various decisions taken during the 8th meeting of the Special Committee as under:

i. The representative of Government of Karnataka had requested that since the issue regarding Ponnaiyar (Krishnagiri) - Palar Link was related to Karnataka, a copy of the observations of Government of Tamil Nadu as well as reply sent to them by NWDA may be made available to Government of Karnataka. As decided, a copy of the observations of Government of Tamil Nadu as well as reply sent to them by NWDA were made available to Government of Karnataka vide letter dated 11th April, 2016. The above position was mentioned in the Agenda Notes.

The representative of Government of Karnataka stated that the contention of the Government of Tamil Nadu that if Karnataka utilized recycled water then consequently it has to reduce the drawal from Cauvery basin, was wrong and untenable. He clarified that requirement of water for the area of Bangalore City outside the Cauvery basin, which was two-third of Bangalore City was being met by cutting down their allocated water and also from their own resources because the Cauvery Waters Disputes Tribunal had not allocated any water for this area. He requested to bring this statement on record and mentioned that the detailed reply would also be sent to NWDA.

ii. It was decided that Shri B.N. Navalawala, Chief Advisor, Ministry of WR,RD&GR and Chairman, Task Force for ILR along with the Sub-Committee for System Studies would consider the issue of ‘surplus water’ for the purpose of Interlinking of Rivers and would give its recommendations to the Special Committee on ILR in two months time.

In this regard it is mentioned that, the issue of ‘surplus water’ for the purpose of Interlinking of Rivers was discussed in detail in the third meeting of the Task Force under the Chairmanship of Shri B.N. Navalawala held on 28.4.2016. The representatives of the Governments of Andhra Pradesh, Gujarat, Maharashtra, Rajasthan and Telangana also attended the meeting. It was decided that the present Guidelines of Technical Advisory Committee (TAC) of NWDA would be circulated to all the member States of TAC of NWDA so as to receive their views in two weeks time. Thereafter, the TAC of NWDA headed by Chairman, Central Water Commission would consider and review the Guidelines in light of the views received from the States and revise appropriately. The revised Guidelines would be placed before the Task Force for ILR in its next meeting for consideration likely to be held in first week of June 2016.

The Chief Advisor (WR,RD&GR) stated that the issue of surplus water being a complex one was discussed thread-bare in the meeting of the Task Force. The Guidelines are a compendium of the decisions of the TAC taken from time to time in context of the specific situation/problem. These guidelines were never considered in a holistic manner. He mentioned that this fact was noted in the yesterday’s meeting of the Task Force and it has consciously been decided in the meeting that the existing guidelines would be re-examined by the TAC of NWDA.

The Hon’ble Minister (WR,RD&GR) desired that a representative of the Ministry of Environment, Forests & Climate Change may also be invited in the meetings of the Task Force so that the issues concerning environment and forests are well understood and sorted out so that the environment & forest clearances would be easier and faster.

Item No. 9.3: Ken-Betwa Link Project Phase-I-Status of various statutory clearances

Director General, NWDA stated that Ken-Betwa Link Project Phase-I was considered by Expert Appraisal Committee (EAC) of MoEF & CC for environmental clearance in its 91st meeting held on 8-9 February,2016 at New Delhi. In this meeting, the EAC after considering the compliance report submitted by the project proponent i.e. NWDA, decided that the project would be considered for environmental clearance (EC) only after Wild Life Clearance of the project was obtained from National Board of Wild Life (NBWL). NWDA has been advised to submit the proposal again to EAC, MoEF&CC along with the decision of NBWL. He further informed that the proposal for wild life clearance was duly

considered in 37th meeting of Standing Committee of the National Board of Wildlife (NBWL) chaired by Hon’ble Minister of State (I/C) Environment, Forest and Climate Change held on 26th February, 2016. The Special Secretary (WR, RD&GR) had made a presentation of the project proposal before the Standing Committee of NBWL. The Standing Committee, NBWL after detailed discussion constituted a committee comprising representatives of NTCA, Wildlife Institute of India, Dehradun, Dr. R. Sukumar, IISc, Bangalore and Member of NBWL, Dr. H.S. Singh, Retired PCCF and Member of NBWL, representative of Chief Wildlife Warden, Madhya Pradesh and representative of NWDA to visit the project site in Panna Tiger Reserve and examine the relevant wildlife issues. The above Committee visited the concerned areas of Panna Tiger Reserve (PTR) coming under the submergence of proposed Daudhan Dam during 8-11 April,2016. It was mentioned that the report of the committee was under preparation and would be finalized soon. He further informed that NWDA had submitted the proposal for forest land diversion clearance online to MoEF & CC and made all the compliance of queries raised by them, except marking of trees below 2 m and below 4 m of FRL in submergence area. This is being carried out expeditiously.

Hon’ble Minister (WR,RD&GR) asked Director General, NWDA to clarify Phase-I & Phase-II of the project to the members of the Special Committee. The Director General, NWDA explained the details of both the phases showing the dam/reservoir, link canal and the command area and the benefits to the two States. Hon’ble Minister (WR,RD&GR) observed that the clearances of Phase-I of the project should be obtained first on priority basis and thereafter, the clearances for the Phase-II may be pursued. She directed that the Ministry of Environment, Forests & Climate Change and Government of Madhya Pradesh may be requested to expedite the various clearances for the Phase-I of the project. She advised NWDA to arrange a visit of the members of the Special Committee to the Ken-Betwa link project area as was done for the members of the Consultative Committee of MoWR,RD&GR.

Secretary (WR,RD&GR) mentioned that three clearances were required from the Ministry of Environment, Forests & Climate Change i.e. (i) Wildlife, (ii) Forest and (iii) Environmental. The wildlife clearance and environmental clearance were separate. There were two stages clearances for forest viz. stage-I and stage-II. Stage-I clearance was necessary before launching of the project. He advised the representative of the Government of Madhya Pradesh to expedite the forest clearance by the State Government.

Item No. 9.4: Ken-Betwa Link Project Phase –II – Present status of DPR

Director General, NWDA informed that the proposal for environmental clearance of Lower Orr Dam was duly considered during 91st meeting of Expert Appraisal Committee (EAC) of MoEF&CC held on 8th February, 2016. The EAC had raised certain issues on soil mapping, e-flows, additional command area and linkage with Ken-Betwa Link Project, Phase-I. The compliance to the issues/ observations had been submitted to MOEF&CC, which would be considered by the EAC for according Environmental clearance in its next meeting. He further informed that after accepting the proposal online by MOEF&CC, the hard copies of the proposal for diversion of forest land under Lower Orr Dam had been submitted to Collector and District Forest Officer (DFO) Ashok Nagar and Shivpuri for processing the case. Additional Principal Chief Conservator of Forest (APCCF) has submitted the complete proposal with their recommendation to Government of Madhya Pradesh. The same has been submitted by State Forest Department, Government of Madhya Pradesh to MoEF & CC with their recommendations for consideration and according forest land diversion clearance.

The details as given in the Agenda Notes were noted by the Committee.

Item No.9.5: Damanganga-Pinjal and Par-Tapi-Narmada Link Projects – Present status of DPRs

Director General, NWDA mentioned that Damanganga-Pinjal link would benefit Maharashtra by providing drinking water to the Mumbai City whereas Par-Tapi-Narmada link would benefit Gujarat.

The Special Secretary (WR,RD&GR) stated that he had a meeting with the officers of the Government of Gujarat at Gandhinagar and also met Hon’ble Chief Minister, Gujarat, wherein he made a presentation before her citing the benefits to both the States. Hon’ble Chief Minister, Gujarat mentioned that she would discuss the matter with her officers and get back to Ministry of WR,RD&GR. Hon’ble Minister (WR,RD&GR) requested the representative of Government of Gujarat to inform the present status in the matter. The representative of Gujarat stated that the matter had been discussed at the officers level and file had been put up to the Hon’ble Chief Minister, Gujarat and the outcome was likely to be conveyed in about a fortnight. Hon’ble Minister (WR,RD&GR) stated that the meeting with the Hon’ble Chief Minister of Mahrashtra was to be held on 3rd May, 2016 and, therefore, the outcome should be known prior to that. She requested Shri B.N. Navalawala, Chief Advisor, Ministry of WR,RD&GR, who is also Advisor to Hon’ble Chief Minister of Gujarat to expedite the case. She requested Hon’ble

Minister (Water Resources), Maharashtra to take up the issue of water sharing in positive direction by his State also. Hon’ble Minister (Water Resources), Maharashtra requested that the meeting of both the Chief Ministers should be convened to reach an agreement. Hon’ble Minister (WR,RD&GR) mentioned that she would be convening the meeting of both the Chief Ministers at New Delhi but only after the meeting of officers of both the States and my Ministry on the issue.

The representative of Gujarat stated that Maharashtra is demanding 300 MCM of water from Tapi river in lieu of the contribution to Par-Tapi-Narmada link but there was no surplus water in Tapi basin and therefore, the same could not be given to Maharashtra. The Special Secretary (WR,RD&GR) stated that during his meeting with Gujarat officials, it was indicated that Maharashtra was to get 140 MCM of Narmada waters. He suggested that Gujarat may provide 140 MCM of water to Maharashtra in Tapi basin at Ukai, and in lieu of this, Gujarat may be compensated through Par-Tapi-Narmada link. The Chief Advisor (WR,RD&GR) clarified that the issue of water sharing between Narmada and Tapi had a legal implication and as per award of Narmada Water Disputes Tribunal, any change in the allocation would require consent of all the four party States. He added that this arrangement of 140 MCM of waters can only be permitted with the approval of Narmada Control Authority. Hon’ble Minister (WR,RD&GR) advised that a meeting of the officers of Gujarat and Maharashtra and Chief Advisor (WR,RD&GR) and Special Secretary (WR,RD&GR) may be held after the meeting to crystallize the issues regarding sharing of waters in respect of both the link projects.

It was decided that both the State Governments of Gujarat and Maharashtra would expedite their observations on the DPR of Par - Tapi - Narmada link project and furnish the same to NWDA at the earliest.

Item No. 9.6 : System Simulation Studies of Mahanadi-Godavari link

Director General, NWDA informed that the NIH, Roorkee had submitted the draft report on water balance study of the Mahanadi-Godavari link project to NWDA on 19th April, 2016. This report would be discussed and finalized during the next meeting of the Sub-Committee for System Studies to be held shortly, wherein Engineer-in-Chief (Planning), WRD, Odisha would also be invited to give their views. Thereafter, the Final Report of the Water Balance Study would be presented to the Special Committee. Hon’ble Minister (WR,RD&GR) desired that the meeting of the Sub-Committee may be convened early.

The representative of Odisha requested for a copy of the report. Director General, NWDA stated that the same would be sent shortly.

Item No. 9.7: Status of Intra-State link proposals

The status of the Intra-State link proposals as given in the Agenda Notes was noted by the Committee.

Item No. 9.8: Restructuring of National Water Development Agency

The Report of the Sub-committee for Restructuring of National Water Development Agency was submitted to the Ministry of WR, RD&GR in September, 2015 and a presentation of the Report including the recommendations of the Committee was also made by the Chairman of the Sub-Committee-III during the sixth meeting of the Special Committee held on 15.9.2015. The Report of the Sub-Committee for Restructuring of National Water Development Agency had also been placed on the website of NWDA.

During the last meeting of the Special Committee, it was decided that the Report may be processed by the Ministry of WR,RD&GR for approval of the Government at an early date. It was mentioned that the Report on the Restructuring of NWDA was being processed in the Ministry.

Shri M. Gopalakrishnan, Chairman of the Sub-committee for restructuring of NWDA mentioned that NWDA was obtaining various clearances for Ken Betwa Project. The staff strength of NWDA was very low compared to the tasks assigned to them and, therefore, the strengthening of NWDA was required to be done on priority. He added that if the recommendations of the Sub-committee for immediate strengthening of the NWDA were implemented, various works could be carried out smoothly and timely. Hon’ble Minister (WR,RD&GR) advised Secretary (WR,RD&GR) that the report may be processed on priority. She desired that a meeting of the Special Secretary (WR,RD&GR) with Director General, NWDA and Shri M. Gopalakrishnan may be held after the meeting to discuss about the processing and approval of the report.

Item No. 9.9: Any other item with the permission of the Chair

Hon’ble Minister (WR,RD&GR) invited the members to express their views, if any, before the committee.

Shri Virag Gupta, a member of the Committee stated that the Special Committee for interlinking of rivers was constituted on the direction of the Hon’ble Supreme Court. Any direction of the Hon’ble Supreme Court is also a law under the Constitution of India, if not challenged by anybody. He suggested that a ‘Calendar of ILR’ may be prepared, which may include the details of the projects, various clearances required, time frame etc. so that the delays could be avoided or minimized. observed that the suggestion was good and it would also help the State Governments to follow the Calendar of ILR. Hon’ble Minister (WR,RD&GR) advised that the ‘Calendar of ILR’ may be prepared for all the link projects.

The representative of Kerala stated that the Hon’ble Union Minister (WR,RD&GR) had earlier mentioned that Pamba - Achankovil - Vaippar link project would not be pursued without the consent of the State Government. He added that there was not enough water in Pamba and Achankovil basins and, therefore, Kerala opposed it. He was categorical that Kerala was not opposing the interlinking of rivers programme. He requested to bring this on record. Hon’ble Minister (WR,RD&GR) stated that the request of the Kerala was agreed but the link project would not be removed from the list of ILR Programme. The project would be considered by the Task Force on ILR and further action in this regard would be taken only after the consent of the concerned States.

The representative of Andhra Pradesh stated that under Peninsular River Development component, three link projects were related to Andhra Pradesh. He mentioned that the preparation of DPR of some intra state link projects including Krishna-Pennar-Palar link had been taken up by the Government of Andhra Pradesh with their own funds. He added that the reports, when completed, would be submitted to NWDA.

The representative of Bihar stated that the DPRs two Intra-State link projects viz. (i) Burhi-Gandak-Noon-Baya-Ganga and (ii) Kosi-Mechi of Bihar were pending for clearance in CWC. He requested for expediting the same. Hon’ble Minister (WR,RD&GR) mentioned that the Hon’ble Minister of Water Resources, Bihar had also requested her in this regard. The Director General, NWDA, who is also Member (WP&P), CWC assured that he would get the techno-economic appraisal of the projects expedited.

Hon’ble Minister (WR,RD&GR) stated that the DPRs of interlinking projects are prepared by NWDA and the CWC officers also contribute in preparation of these reports. She advised that the CWC and NWDA officers’ team should work together and avoid delays in the appraisal of the ILR projects.

The meeting ended with a vote of thanks to the Chair.
