A NIGHTMARE.
The approaching session of the
Legislature "casts its shadow
ahead ;" the shadow has fallen on
our respected contemporary atllilo, and appears to have produceda distressing nightmare. While in
this condition the "Uccord" gets offthe following: "At the presentcrisis, when concord is most needed,we find our Cabinet divided, andthat, too, when the near approachof the sesston of the Legislaturecalls for unanimity in the measuresto be proposed. If it i not so whatcan we expect ftom a Legislature, composed as ours is, of two oppos-
ing parties about equally matched? The one trying to keep the presentform of good government, and theother working to break it down andto have it restored to the old style. If our Ministers disagree, what canwe expect but that at least a partialoverthrow of the era of progressand reform, and that, as far as it is
possible, the one man power be re-
stored, with all the evils attendingsuch a state of government."
Had the "Kecord" not been, forthe lime being, subject to an irra-
tional influence, instead of regard-
ing the near approach of the Legis-
lative session as a circumstancerendering a disagreement in theCabinet as specially unfortunate, the conclusion would have been thatti disagreement could not have oc-
curred at a much moie opportunetime. AVe concede that irreconcil-able differences between membersof u Cabinet, at any time, are usu-
ally iindesiinblc ; but if they do hap-
pen, they cannot happen more for-
tunately than when the Legislatureis in session, and the next best timeto that is when the session i- - near athand ; because, under our Constitu-
tion, the Legislature has the powerto secure an acceptable Cabinet. Aclose ot the session might keep thedisagreement occurring after the(Jovernuicnt in a turmoil for thenext two years; for there is no legalpower to compel cither the minorityor the majority to resign; or if
there he an equal division, to com-
pel either half, or the whole, to re-
linquish their poitl'olios; and if theCabinet irsign the people have nolegal power to prevent the appointment of another composed of unlitmen, who might commit endlessmischief before the next session.
Whereas the Legislatutc, while in
lessiouj can vote out any set ofmen. and keep on voting out, untilan acceptable Cabinet is obtained.
As to ' unanimity in measures, tobo piopood," that is a trilling mut-
ter, eonsidoiiiig that any .Ministerhas :t right to iiilioduce any measurehe may wish, and, if the past is tolie a precedent tor the future, the
Legislature will not estimate itsmerit by Ministerial unanimity orthe lack theicot.
Where the 'Id-cor- d V nightmaregels the strongest grip is when thecomparison is drawn between thetwo pm ties composing the Legisla-
ture, "the one trying to keep up the
pi esent form ot good government, and ilie other working to break itdown, and to have it restored to theold style." Some people arc soconstituted that they can utter aniintiutli, knowing 1t to be an un-
truth, and by lepeated utterancesof the same convince themselvesthat they are speaking the truth.By a great .stretch ot charity we in-
cline to the bcliot that such is thecase with many people who talk in
thc.stialnsnt the "Keeord," and thatthe "Ileeord" itself is in that condi-
tion. In fact, the sentences justnow quoted, although they havebeen spoken and printed a thousandtimes, are singularly untruthfulthey are, indeed. Think of the ab-
surdity of believing that men withlarge interests in the country, thoseinterests being as much depeudenton good government as the iutciestsof the people on the other side ofpolitics, "working to break down"good government! The fact is, themajority of each party desires goodgovernment, and probably a coin-pariR-
of views regarding thomeaning ot the term would showthat in the main there is but littledifference between thorn. For our-
selves, wc have confidence thatthere is sutlleient sense in the Le-
gislature as u who e to avoid the en-
actment of any glaring folly.

The statement having gained cur-
rency tlmt kerosene oil below thelegal test Is now being imported andsold hero, Marshal Soper invited
of the press to hisolllcc this morning, for the purpose
t of laving the facts of the ease befoiethem. The Marshal it the olllcial !
entrusted with the duty of testing ',
kerosene, and seeing that it is of
that quality to fulfil theof law. lie makes the tests andkeeps a record thereof. The lawprovides that oil which will not standa test of 100 degrees bhall not beadmitted. The Marshal Is notifiedby the Custom House when a ship-
ment of oil arrives, and u test ismade before n permit to land is
granted. A : matter of fact, two
shipments have been recentlyto Sun Frauciseo because
they did not stand the test, and no
oil has been permitted to land be-
low the required 100 degrees. Pro-
bably there may be inferior oil inthe market, but this Is owing to thefact that the legal test is placed toolow. Anyhow, this is the opinion ofmen competent, to judge. That is a
question for the consideration of the
A LIVE
Duirou Hii.i.etin:We think the editorial in the Ad-
vertiser of yesterday, headed "Whatwill they do about" it," puts moreinto the question then really belongsthere. We think that everythingrelating .to theshould be stricken trom tho ques-tion, which the Legislature may becalled upou to consider.
The question as to "what is aConstitutional Cabinet," has beenalreadv decided, not onlv by allcivilized constitutionalbut by our own highest tribunal, and that decision is, that all themembers ot a Cabinet or a majorityof lliein, are the "Cabinet" for busi-
ness purposes. That one memberof a Cabinet should disagree onsome point not a killing matter, nor an occurrence;but to tlnd four men of
intelligence who could examinemany momentous questions for twoyears without a thatwould be indeed.
Tor the Lecislaturo to vote n
"want of confidence" m the Cabinetbecause one member disagreed withtho other three would be childish,or for tho Legislature to spend timetrying to oust a Cabinet Ministerbecause hu disagreed with the ma-jorit- v,
we would think equally weak.Where would such a perniciousprinciple end if given I00-.- 0 reins? The may disagreewith the Cabinet ,, and theMinister of Foreign Affairs may dis-
agree with the Cabiuetand the Minister of thodisagree with the Cabinet next day,and -- o on. If all ot these in turnmust be dismissed because theycan't agiee with the Cabinet, such acourse wouM destroy the best ofCabinets,
ho we think the Legislature hasnothing to do with the want of unityin the Cabinet, as long as the Cabi-net attend to their duties m anacceptable manner; and if theydon't the Legislature will know justwhat to do.
Neither do we think the Legisla-ture dioiild take any uolice of theunwise council given to the King bythe ; let each bearhis own whs.
Now, we come to the ital ques-tion with which the country mu-.- t insome way deal, vu. : tho refusal ofHis Majesty to obey the laws as in-
terpreted by our Supreme Court. For His Majesty to urge thu near as-
sembling ot tho Legislature as tinexcuse for not obeying the law, orto lay the blame upon the
as a scape-go- at to bearaway his sin of omission is, to saythe least, a careless negligence of aconfided duty because it is
in its tendencies, by thusdefying the law which he lias swornto obey. It he had obeyed the lawand let the sin of the measure leston the Cabinet, his skirts wouldhave been clean and his act justi-fied Until by the law and the people.
Whether the Legislature will beable to instruct the Throne in itsduty h not clear to us, but the as-

LoKoniLi.r. The name is com-

of a suitable length and an agree-able cadence. It has a pleasant
