    LAWS TAKE EFFECTThe California Chamber of Commerce

    has released a list of new employment lawsscheduled to take effect in 2012 or earlierthat will have an impact on businesses inCalifornia.

    In addition to the new employmentlaws, an order by the National LaborRelations Board (NLRB) is also impactingbusinesses in California. By January 31,2012, most private-sector employers mustbegin displaying an 11x17 poster thatprovides information to their employees

    Pacic Gas and Electric Company (PG&E)recently launched a new online tool to enhanceits 2011-2012 Winter Gas Savings program.The PG&E Winter Gas Savings ProgressTracker app is the rst Facebook-enabled, web-based tracking tool to help customers measuretheir progress toward meeting their energysaving goals.

    The annual PG&E Winter Gas Savingsprogram gives eligible residential and businesscustomers an automatic bill credit of up to20 percent when they reduce their natural

    gas usage in December 2011 and January2012 compared to the previous three winters,adjusted for weather. During the 2011 program,some 2.7 million customers earned bill creditstotaling $70 million.

    Always keeping innovation front of mind,

    QVMC was the rst medical facility in Napa

    County to purchase a linear accelerator,

    and was also the rst to offer magnetic-

    resonance imaging (MRI), lithotripsy and

    stereotactic breast biopsy. More recently,

    QVMC is the rst and only facility in the

    area to offer robotic surgery options withthe Da Vinci Surgical System. As a model

    for health and wellness QVMC became one

    of the rst hospitals in the nation and the

    rst in Northern California to take health

    and wellness to a new level by opening a

    medical tness center. The Synergy Medical

    Fitness Center integrates exercise and tness

    with disease prevention, disease management

    and rehabilitation services including weight

    management, diabetes wellness, nutrition/

    stress counseling, arthritis management, and

    complementary medicine.

    When asked about his reaction to the award

    notication, President and CEO Walt Mickens

    said, I am proud to be part of an organization

    that is committed to its mission to continually

    improve the health and quality of life of

    people in the communities we serve. Being apart of and caring for the Napa community is

    at the heart of who we are as individuals and

    as an organization. Its an honor to accept this

    award on behalf of the amazing physicians,

    medical professionals, staff, volunteers and

    donors whose hard work, dedication and

    support make the Queen a great hospital.

    Ambassador of the Year Award:

    Nancy Pridmore

    Nancy, who is a real estate broker with

    Davidson & Bennett Realtors, is a shining

    example of a community-involved participa

    who routinely goes above and beyond in he

    efforts to support a strong local economy.

    Always recognizing the value of Chambers

    of Commerce, Nancy was a founding Board

    Member of the Berryessa Chamber in the

    early 1960s. She has been a Napa ChamberAmbassador for over 25 years and served on

    the Napa Chamber Board for several years.

    When asked what her reaction was to hearin

    the news she said, I was absolutely shocke

    I didnt know what to say I was completel

    speechless which is rare for me!

    Nancy loves serving as an Ambassador as

    it gives her the opportunity to welcome new

    businesses and support existing ones. Beyon

    Ambassador duties, Nancy sees the Chamb

    of Commerce as critical to the areas busine

    the legislative action support to the busines

    community. We give businesses a voice at th

    table, and not just for members, we advoca

    for business in general. We operate as a

    consensus builder that brings together all th

    religious groups, we fnd we can be a help

    to one another. We try to keep everybody

    apprised of what is going on at the local, st

    The Progress Tracker app lets customerswho have gas SmartMeters graphicallycompare their current estimated averagedaily usage to their three-year daily average,so they can see if they are on track toearn full or partial bill credits. ThroughFacebook, customers can conveniently viewtheir savings performance and write postsabout it on their Wall. The app is available atwww.pge.com/wintergassavings and www.facebook.com/pacicgasandelectric.

    According to the utility, this new ProgressTracker app will let customers see howtheir conservation efforts are creating extrasavings opportunities this winter. By makingthe tracker available within Facebook,

    the company is bringing personal energyconsumption data to customers in a friendly

    environment, helping to make energymanagement a part of everyday life.

    Customers can take simple steps toreduce their gas consumption this winter: Lower the thermostat to 68 degreesduring the daytime (health permitting) Set the water heater to 120 degrees or thenormal setting Wash clothes in cold water instead of hot Open blinds and drapes on sunny days Microwave small amounts of foodinstead of heating them up in the oven.

    to producing the materials involved togetting this article onto that medium. Look ateach component of the process, recognizingeach stakeholder past, present, and future.Amazing how many relationships each

    business process has, isnt it? How theserelationships develop is largely up to the leaderof the business.

    Unfortunately, many business leadersharbor the misconception that becoming asustainable or green business is expensive.Sure, like anything else, it could be. But itdoesnt have to be. There are many things thatyou can do right now today to improveyour TBL that dont cost a dime but have the

    potential to save you a substantial amount ofcash.

    An easy place to start is right-sizing.What equipment does your business reallyneed? Could you achieve the same outcomewithout all the bells and whistles? Are you

    paying for more than you need? Or could youallocate your budget more wisely? Look at

    every aspect of your business with a showme the money attitude. The money you savewill help you better weather economic storms

    Despite differences about what ittakes to be sustainable, nearly everyoneacknowledges that three inuential, andoften competing factors social, economic,and environmental demands requireserious attention. In a small communitylike the Napa Valley (where everything andeveryone is connected) creating unbalanced,

    and, therefore, unhealthy relationshipsamong these three responsibilities cancause irreversible damage, especially for

    businesses.

    How does a business leader avoid that?By embracing a principle called the triple

    bottom line (coined in 1997 and also knownas TBL or 3BL). TBL focuses on the benetsof protecting people, planet, and prots. Nomatter how large or small a business, thecrux of TBL is responsibility to stakeholders,not just shareholders.

    One way to gure out who yourstakeholders are is to perform a lifecycle analysis. For example, consider the

    newspaper or computer screen you arereading. Now think of everything it took from educating and paying the labor force

    and it will help youcreate a thriving

    business orhousehold.

    Pregnancy Disability Leave

    SB 299 requires all employers with veor more employees to continue to maintain andpay for health coverage under a group healthplan for an eligible female employee who takesPregnancy Disability Leave (PDL) up to amaximum of four months in a 12-month period.Willful Misclassication of IndependentContractors

    SB 459 provides new penalties of

    between $5,000 to $25,000 for the willfulmisclassication of independent contractors.Written Commission Agreement

    AB 1396 requires employers who havecommission pay arrangements to put thoseagreements into a signed written contract. Thewritten contract must set forth the method bywhich the commissions will be computed andpaid. The bill is effective January 1, 2013.Employers have the entirety of 2012 to bringtheir commission agreements into compliance.Notice of Pay Details

    AB 469 requires employers toprovide nonexempt employees, at thetime of hire, a notice that species: The rate of pay and the basis,

    whether hourly, salary, piececommission or otherwise, includingany overtime rate. Allowances, if any, claimed as partof the minimum wage, including mealand lodging allowances. The regular pay day designated bythe employer as required under theLabor Code. The name of the employer, includingany doing business as names. The physical address of theemployers main ofce or principalplace of business and any mailingaddress, if different. The telephone of the employer. The name, address and telephone

    number of the employers workerscompensation carrier.Gender Expression

    AB 887 amends the Fair Employmentand Housing Act to further dene genderto include both gender identity andgender expression and to make clear thatdiscrimination on either basis is prohibited. AB887 also amends Government Code relating todress codes to include that an employee mustbe allowed to dress consistently with boththe employees gender identity and genderexpression.E-Verify

    AB 1236 allows employers to continue tochoose to use E-Verify, but prohibits Californiastate agencies and local governments frompassing mandates that require employers to useE-Verify.

    Several cities in California passed localordinances requiring the use of E-Verify incertain circumstances. This new law prohibitssuch state or local mandates, unless required byfederal law or as a condition of receiving federalfunds.Interference With Rights Under Leave Laws

    AB 592 adds language to the CaliforniaFamily Rights Act (CFRA) and the PregnancyDisability Leave law (PDL) that makes itunlawful to interfere with or in any way restrainthe exercise of rights under these laws.

    Administrative Penalties

    AB 240 allows an employee thatalleges a minimum wage violation torecover liquidated damages pursuantto any complaint brought before theDivision of Labor Standards Enforcement(DLSE). This new law would allow theLabor Commissioner to also award suchdamages. Under the new liquidated damagesprovision, the employee would be entitledto recover an amount equal to the wagesunlawfully unpaid, plus interest.Wage Penalties

    AB 551 increases the maximum penaltyfrom $50 to $200 per calendar day foreach worker paid less than the determinedprevailing wage and increases the minimumpenalty from $10 to $40 per day forviolations of prevailing wage obligations.It also increases the penalty from $25 to$100 per calendar day, per worker, againstcontractors and subcontractors that fail torespond to a written request for payrollrecords within 10 days.

    Farm Labor Contractors Wage Notices

    AB 243 amends the Labor Codeto expand the information that must beincluded on pay statements, but only forfarm labor contractors. Employers that arefarm labor contractors must now disclose onthe itemized payroll statement furnished totheir employees, the name and address of alllegal entities (for example other growers orother farm labor contractors) that secured theemployers services.Agricultural Labor Relations

    SB 126 affects certication ofbargaining representatives for agriculturalemployees. The new law, SB 126, providesthat if the Agriculture Labor Relations Board(ALRB) nds employer misconduct thatin addition to affecting the outcome of theelection, would render slight the chancesof a new election reecting the free andfair choice of employees, then the ALRBcan certify the labor union as the exclusivebargaining agent for employees.Insurance Non-Discrimination Act

    SB 757 closes an existing loophole andprevents employers that operate in multiplestates from discriminating against same-sexcouples by not providing the same insurance

    NEw LAwScontinued from page 1... coverage for domestic partners as they do forspouses.State Contracts Gender or SexualOrientation Discrimination

    SB 117 outlaws the state of Californiafrom entering into contracts of more than$100,000 with companies that discriminateagainst the employees on the basis of genderor sexual orientation with regard to benets.The new law makes it clear that companiesdoing business with the state of Californiacannot deny equal benets to same-sexspouses.Workers Compensation Legislation

    The governor signed these ve workerscompensation bills that were all supported byCalChamber. AB 335 Requires the workerscompensation administrative director (AD)to work with the Commission on Healthand Safety and Workers Compensation(CHSWC) to develop regulations regardingnotices to injured workers; requires AD

    and CHSWC to develop and makeaccessible a booklet written in plainlanguage about the workers compclaims process; streamlines andsimplies other notices to employees. AB 378 Lowers workers

    compensation costs by establishingguidelines for dispensing compounddrugs, the circumstances under whichthose drugs would be covered and thereimbursement amount, and removesthe incentives for physicians to referpatients to pharmacies in which thephysician or physicians family has anancial interest. AB 397 Seeks to address theunderground economy problem bysingling out contractors that do nothave workers compensation coveragebut requiring contractors that areexempt from having coverage at thetime they are licensed to certify theyare still exempt or have gotten coverage

    at the time of their license renewal. AB 1168 Lowers costs foremployers and insurers by establishing

    a fee schedule for vocational expertsservices. AB 1426 Streamlines the workerscomp process and eliminates duplicativebureaucracy and inconsistency by eliminatingthe court administrator position.

    The governor also signed a WorkersCompensation related bill that CalChambertook no position on: AB 228 Amends California InsuranceCode to authorize the State CompensationInsurance Fund (SCIF) to provide workerscompensation coverage to a Californiaemployer whose California employeestemporarily work outside the state and whoseinjuries while performing out-of-state workmight lead to workers compensation liabilityin some other state.DFEH Procedural Regulations

    Effective October 7, 2011, theDepartment of Fair Employment and Housing(DFEH) has instituted new regulationsrelating to procedures for ling, investigatingand processing discrimination and harassmenclaims. Overall, the regulations make it easierfor claimants to le their complaints andinitiate a DFEH investigation.
