The Permit System has been in place since the mid-1980’s to track and monitor overweight (non-divisible loads) and over-dimension trucks on oil county roads

In the beginning it was not a Uniform System – each county set their own rules and fees

In the mid-1990’s a group of county sheriffs and commissioners worked hard toward making the system uniform for all participating counties, and eventually succeeded in doing so.

The Permit System legal weight is 105,500 lbs. GVW and below. Any load heavier than that requires a permit◦ State law is 80,000 lbs. max for gravel roads◦ Permits are valid on non-divisible loads only – if the load can be

divided down, the load must be reduced to 105,500 or below The system started as a Self-issue Permit System on a

graduated rate scale from 105,500 lbs – 200,000 lbs. Over 200,000 lbs - $5/ton/mile

◦ Self Issue Permits are ordered online at ndenergy.org Cost - $4 each The forms are in triplicate Any number may be ordered, and we mail the order out

◦ If overweight or over-dimension, the truck driver fills out a self-issue permit before taking the trip

◦ He must have a completed permit with him in the truck if checked by law enforcement

◦ When the trip is completed, the hard copy of the permit must be mailed into our office within one week. The two additional copies are for the company to keep

◦ The information from each Self-Issue Permit received is entered into our system

◦ At the end of the month, we invoice the companies for the trips taken in that month, on behalf of the counties

◦ We send a monthly report to each county detailing what funds they should expect from each company traveling in their county

◦ The counties are responsible for collecting the funds

In 2012, the County Road Restriction Communication System was implemented◦ Counties can post their load restrictions, road

closings, etc., and have the option to have information emailed or texted out to anyone signed up to receive the notifications.

◦ We have had to upgrade texting and emailing systems in order to accommodate the large number of recipients. This service is very popular with the Industry and the counties appreciate the communication tool

In 2013, the Xcess Permit was added ◦ This permit assesses a ton per mile fee on loads

over 150,000 lbs. gross vehicle weight (previously the ton/mile formula started at 200,000 lbs. and up)

◦ This permit must be approved or declined by the county within two days. (Typically happens much faster)

◦ Formula - $5 per ton per mile over 150,000 lbs. gross vehicle weight

In 2013-14, we implemented a Data Sharing service with ND DOT ◦ If a company has purchased a state permit, and

they need a county permit, there is a link that will take them to our website to purchase the county permit

◦ Additionally, they may enter their state permit number into our County Road ePermit form, and the common information will be populated from the state permit, saving the user data entry time

In 2015, the Restricted Road ePermit was added◦ Requested by the industry to make the restricted

permits more ‘uniform’ from county to county◦ This permit is required on all restricted county roads◦ This permit must be approved or declined by the

NORTH DAKOTA ASSOCIATION OF OIL AND GAS PRODUCING COUNTIES

COUNTY PERMIT AGREEMENT

I. PURPOSE The following shall be the official policies of the various North Dakota counties that are members of the “Association of Oil and Gas Producing Counties.” The policies are established by the participating counties with input from the Industry. The purpose of this agreement is as follow: 1. To establish size and weight limitations for vehicular traffic on public roads in the various

jurisdictions. 2. To control the size and weight of vehicles operating in excess of the maximums specified

herein. 3. To reduce damage to public roadways. 4. To provide for the safety of the general public using the roadways. 5. To establish a system of permits for the legal operation of vehicles of excess size and/or weight

on a uniform basis throughout the state. 6. To set and collect uniform road use fees for the operation of vehicles of excessive size and

weight.

II. SIZE AND WEIGHT

Unless otherwise provided, no vehicle shall be operated on roads covered under this agreement in excess of the following limitations: 1. Width, height and length shall not exceed the limitations as set forth in Section 39-12-04 of the

NDCC. 2. Weights shall not exceed the limitations as set forth in Section 39-12-05 of the NDCC. 3. The maximum gross vehicle weight, including the load therein, shall not exceed 105,500

pounds. However, maximum gross vehicle and/or axle weight may be restricted to a lesser amount as authorized by Section 39-12-03, NDCC, whenever road or weather conditions require such restrictions.

4. It shall be the local governing bodies responsibility to identify roads and bridges restricted to a

lesser amount than found in Section 39-12-05, NDCC, within their jurisdiction.
