JACKASS FLAT NATIVE VEGETATION
PRECINCT PLAN
1. Introduction
This Native Vegetation Precinct Plan relates to native vegetation within defined areas of Jackass Flat. This Precinct Plan is incorporated into the Greater Bendigo Planning Scheme and listed in the schedule to clause 52.17.
The Jackass Flat Native Vegetation Precinct Plan area is located on the fringe of the suburb of Jackass Flat to the north west of Bendigo. Part of the area abuts forested areas which are in both public and private ownership. The area contains patches of remnant vegetation combined with land that has been cleared and used as farm land.
The Jackass Flat Native Vegetation Precinct contains 4 Ecological Vegetation Classes (EVCs) they are Alluvial Terraces Herb-rich Woodland, Grassy Woodland, Creekline Grassy Woodland and Box Ironbark Forest
A flora and fauna assessment of the study area revealed that the site contains one area of very high conservation value, areas of high conservation value vegetation in, Alluvial Terraces Herb-rich Woodland, Grassy Woodland and Creekline Grassy Woodland. Box Ironbark Forest was also identified on site. Its conservation value is low and medium.
The objective of this Native Vegetation Precinct Plan is to retain and protect the areas of vegetation identified as worthy of protection. Scattered trees and other less significant vegetation throughout the study area will not be protected in order to permit the residential transformation of the overall study area.
Where possible, offset liabilities generated by the permissible removal of non-significant native vegetation throughout the site may be met through works on the retained areas within the study area.
The overall goal is to allow for the establishment of a new residential area with remnant patches of native vegetation buffering and complementing the adjoining public and private forested areas.

2. Purpose
The purpose of this plan is to: Recognise the conservation significance of the 4 ecological vegetation classes
represented in this precinct and to retain linear linkages where practical.
Where possible ensure that areas set aside for the retention and protection of native vegetation are managed to protect the ecological values of habitat and the natural values of the area.
Ensure that any removal, destruction or lopping of native vegetation is consistent with the principles set out in Victoria’s Native Vegetation Management – a Framework for Action 2002.
Specify:
i. native vegetation to be retained;
ii. areas necessary to ensure the health of the native vegetation to be retained ; and
iii. any areas set aside for drainage in which native vegetation may be established.
Specify the native vegetation to be removed, destroyed or lopped.
Specify works to be provided to offset the removal, destruction or lopping of native vegetation;
Relate the need for the works or other actions to the proposed removal, destruction or lopping of native vegetation in the area.
3. Area to which the plan applies
This Native Vegetation Precinct Plan applies to the following areas in Jackass Flat:

Site 2 North-East 1 sub site
Site 3 South includes 63 sub sites

The area contains native vegetation of 4 Ecological Vegetation Classes (EVCs), being Grassy Woodland, Box-Ironbark Forest, Creekline Grassy Woodland and Alluvial Terraces Herb-rich Woodland. Parts of sites 1 and 2 are adjacent to public forest and part of site 3 is adjacent to private forest areas. These areas will provide an important transition between forested areas and the urban area.
There are a number of existing buildings throughout the sites including farmhouses and sheds although a majority of the site has been cleared and used as farming land. A number of dams are also scattered across the sites.
4. The native vegetation to be retained
The native vegetation to be retained is:
those areas specified in Appendix 1 to this Plan; and
5. The native vegetation to be removed, destroyed or lopped
The native vegetation specified in Appendix 2 to this Plan is allowed to be removed, destroyed or lopped, subject to the requirements of this clause of this Plan being complied with to the satisfaction of the Responsible Authority.
Any native vegetation (excluding native vegetation set aside as an offset in accordance with this clause of this Plan) within the area shown on Map 2 will require no permit or offsets for removal. Vegetation" may be removed, destroyed or lopped without a permit and without the need for offset measures or compliance with this clause of this Plan.
The removal, destruction or lopping of any native vegetation specified in Clause 3 to this Plan is exempt from the need for a planning permit and the requirement for offset measures and compliance with this clause of this Plan if:
The native vegetation is a tree that presents an immediate risk of personal injury or damage to Property where the danger cannot be practically avoided. The exemption applies only to those works necessary to remove the risk and not necessarily to the total removal of the tree.
The native vegetation is not of local provenance to the area of this Plan.
The native vegetation is planted or grown from seed for purposes of a garden, lawn, landscaping, a street tree, timber production, provision of shelter, or the like but not revegetation intended to restore the land or a waterway consistent with the Ecological Vegetation Class that would have occurred naturally in that area.
The works are by a public authority and are necessary for emergency access or emergency works.
The works are necessary to maintain an existing building, utility, accessway, drainage works, flood retention facility or recreation facility.
The works are carried out in accordance with a Conservation Management Plan (if any), (including any necessary vegetation management measures, access ways, recreation facilities, and/or fire protection measures specified in that Conservation

Management Plan), that has been approved by the Responsible Authority and is to the satisfaction of the Department of Sustainability and Environment.
6. The works, payment or other actions necessary to offset the removal, destruction or lopping of native vegetation
Rezoning to residential 1 part of the original precinct area has greatly restricted the opportunity for shared payment of offsets on site. It is considered that offset on site is not available and although some areas will have restricted development condition of vegetation and management issues make offset on site not possible.
Offset offsite, must be consistent with the principles set out in Victoria’s Native Vegetation Framework—A Framework for Action (2002).
Offsets should be protected though measures such as conservation covenants, Section 173 or Section 69 agreements or gifts to the Crown or the responsible authority (where such gifts are accepted or transferred) to the satisfaction of the responsible authority.
The approximate offset requirements for native vegetation to be removed, destroyed or lopped are specified in Appendix 3 to this Plan.
Where works, or other actions relating to the proposed removal, destruction or lopping of native vegetation in the area of the Plan are needed:
All earthworks must be undertaken in a manner that will minimise soil erosion and adhere to Construction Techniques for Sediment Pollution Control (EPA 1991).
No grazing may occur on vegetation to be retained (unless it is permitted by a Conservation Management Plan approved by the responsible authority).
Soil must not be stockpiled on native vegetation that is to be retained.
Only indigenous plants of local provenance may be used in revegetation works.
Any native vegetation to be removed (in accordance with this NVPP) must be clearly marked on site.
A highly visible temporary fence must be placed around the protection area of any native vegetation to be retained to prevent inadvertent removal during any works within 20 metres of that vegetation.
All native vegetation that is to be retained must be physically protected from threatening processes such as root or canopy damage and changes to soil conditions, to the satisfaction of the responsible authority, using fencing or other methods as appropriate.
The protection area for scattered trees must be twice the radius of the tree canopy from the trunk of the tree.
The placement of fill must be designed so as to ensure that it does not compromise native vegetation to be retained.
Water run-off must be designed so as to ensure that native vegetation to be retained is not compromised.
Prior to felling any tree which contains hollows, it must be examined by a suitably qualified zoologist for the presence of fauna in hollows. If native fauna species are located, they must be salvaged and relocated to the closest suitable vegetation nearby, in consultation with the Department of Sustainability and Environment.

7. Procedures for the collection of any payments
All offset for vegetation removal will need to be sourced off site this includes the offset plantings to replace the scattered trees that will be removed.
The costs associated with the implementation of the offset requirements will be born by the individual developers.
8. Expiry
The specific controls contained within this incorporated document do not expire.
CONCLUSION
The gains from offset areas, included the protection of old trees, must be of a secure and ongoing nature. Vegetation to be used as offset must be protected and managed to produce a gain. The majority of the vegetation in the Jackass Flat Precinct area has been degraded by numerous activities including grazing, gravel extraction and wood removal. Taking the above into account and the rezoning of part of the original Precinct area to residential, it is considered that protection of remnant vegetation would not have a viable biodiversity value or produce an offset gain.
Offset areas must be to the satisfaction of the responsible authority and DSE.
Reasons for considering that offset is not available on site
Small sizes of many vegetation patches
Isolation of vegetation patches when surrounded by residential one development
Capability of patches to improve in quality.
Lack of native ground and shrub cover on the majority of sites
Long history of grazing on the majority of sites
Gravel extraction that has removed all top soil on some sites
Outcomes of the Victorian Bushfire Royal Commission.
Wildfire management controls i.e. removal of under storey and litter.
Reasons for protecting some vegetation on site.
Vegetation abutting the Bendigo Regional Park has been protected as a buffer to the park.
The vegetation along waterways is protecting the waterway and will form public open space.
Vegetation along roadsides is protected to form lings to the open spaces.
No vegetation has been protected for its biodiversity values.

This Plan recommends the retention of the following vegetation patches: Site 1
Retain vegetation on sub sites 4, 6, 9, and 77 and rezone with an appropriate vegetation overlay.
Retain part of vegetation on sub site 7 and rezone with an appropriate vegetation overlay.
Site 2
Retain vegetation on sub site 0 and rezone with an appropriate vegetation overlay
Site 3 Retain vegetation either side of drainage lines on sub site 20, 21, 22, 75 and 59. Retain vegetation on sub site 41 Harveys Lane. There may be a need for connecting
road through this patch. Retain part of vegetation on sub site 51. Retain part of vegetation on sub sites 46, 49, 50, 51, 52, 55. Place roads within development to retain vegetation on sub sites 16, 19, 27, Harveys
Lane. There may be a need for access roads through these patches. Retain vegetation on sub sites 29, 30, 31, 32 and 66, rezone with an appropriate
vegetation overlay. (Building envelopes will be required in some of these patches. Retain part of vegetation on sub sites 28 and 65 and rezone with an appropriate
vegetation overlay. Site 65 will require building envelopes. Offsets will be required for building envelopes and under storey removal.
There may be a need for connecting roads through the corridors but these should be kept to a minimum. Because of regulations for fire under storey and litter will be deemed as lost on all lots where vegetation is retained.
All other native vegetation within the study area, including the scattered trees can be removed and their losses offset offsite. Development of subdivision layouts will lead to the final proposals for vegetation retention/removal as shown in this Precinct Plan.

No scattered trees are identified as being retained at this point in time even though it is highly likely that the final form of the residential subdivision will result in the retention of some scattered trees. As these trees will be within the development area, it is assumed that all scattered trees will be removed or not sustainable.

APPENDIX 3—OFFSET REQUIREMENTS FOR VEGETATION REMOVAL
1. Offset Requirements for Vegetation Removal in the Jackass Flat Precinct
The gains from offset areas, including the protection of old trees, must be of a secure and ongoing nature. Existing vegetation needs to be managed to produce an offset gain. The majority of the vegetation in the Jackass Flat Precinct area has been degraded by numerous activities including grazing, gravel extraction and wood removal. Taking the above into account and the rezoning of part of the existing Precinct to residential one it is considered that protection of remnant vegetation would not have a viable biodiversity value.
Offset areas must be to the satisfaction of the responsible authority and DSE.
Reasons for considering that offset is not available on site
Small sizes of many vegetation patches
Isolation of vegetation patches when surrounded by residential development
Capability of patches to improve in quality.
Lack of native ground and shrub cover on the majority of sites
History of grazing on the majority of sites
Gravel extraction that has removed all top soil on some sites
Outcomes for Royal Commission into Black Saturday Fires.
