SECTION 1. COVERAGE

This Supplemental Implementing Rules and Regulations (IRR& provides for additional guidelines for the issuarnce of driver's licenses and imposes addlitional restrictions for the enjoyment of the privilege to drive in relation to the extended validity of driver's licenses, which shall apply to all licensees eligible to the same.

SECTION 2. ENTITLEMENT TO TEN-YEAR VALIDITY DRIVErR'S LICENSE

Any driver whose license is valid for at least five (5) years an who has not committed any violation of Republic Act No. 4136 and other traffic laws, rul s, and regulations during the five (5)-year period shall be entitl~d to a renewal of such icense for ten (10) year, subject to the restrictions as may be imposed by the L TO includi g those provided herein. Nonetheless, any person entitled to a 10-year validity licensle may choose to renew his/her driver's license for one that is valid only for 5 years.

' SECTION 3. MANDATORY PERIODIC MEDICAL EXAMINATION DURING THE VALIDITY OF THE LICENSE

a. In addition to the medical examination performed during he application for new I

license and the renewal thereof, all driver's license r olders shall undergo mandatory periodic medical examination(s) (PME) during t~e validity period of their license in any L TO-accredited medical clinic or government health facility to ensure their fitness for the extended duration of the license.

b. For licensees who will be issued a 5-year validity driver's license, the PME shall be scheduled on the third (3rd) birthdate from the issuancy of the license. On the other hand, licensees who will be issued a 10-year valid tty driver's license shall undergo PMEs on the fourth (4th) and seventh (7th) birthdates from the issuance of the license. In both instances, licensees may undergo the PME within sixty (60) days before the specified birthdate. An illustrative example of the PME scheme is attached as Annex A.

c. All L TO-accredited medical clinics shall comply with Sec ion 4(a)(2) of Republic Act No. 7432, as amended by Republic Act Nos. 9257 a~d 9994, which provides that senior citizen shall be entitled to the grant of twenty_ /percent (20%) discount and exemption from the valueradded tax on medical services, diagnostic and laboratory fees in all private hospitals, n1edical facilities, and outpatient clinics.

d. Notwithstanding the frequency provided in the preceding subsections, the registered physician who performs the medical examination during the application for new license or renewal may prescribe a more f equent PME schedule considering the licensee's age, existing medical condition, medical history, previous injuries, and other physical or mental impairment/s that may worsen during the validity of the driver's license.

e. The registered physician is primarily tasked to determine whether the licensee has I

developed any physical or mental condition or illness that is likely to interfere with the latter's ability to control and operate a motor vehicle ·safely and report his/her findings to the L TO. The licensee shall be examined in accordance with the medical examination guidelines set by the L TO under Mf3morandum Circular No. 2018-2157 and such other issuances subsequent theret1.

f. When the physician determines that the licensee remains to be physically fit and medically qualified to drive a motor vehicle, the registerdd physician shall issue a completed medical certificate .in the prescribed form reflecting his/her findings therein. The biometric finger sea~ of both the examining physician and the licensee shall be required before the medical ce.rtificate is electrdnically transmitted to the Land Transportation Management System: Additionally) the licensee's biometric fingerprint must match the fingerprint impression recordJd in the L TO database.

g. Philippine driver's license holders working or living abroad whose PME schedule falls during their stay abroad shall be exempted from the lequirement under this section. However, should they return during or after the ab9ve-mentioned periods, they are required to subject themselves to a medical examination within thirty (30) days upon arrival to the Philippimes befdre exercising their privilege to drive.

h. The licensee shall be inform~~ of h{s/her · prescribed dates for the PME by indicating such dates in a written notice that comes with the Issuance of the license.

The L TO shall also provide a system to notify the licensee ~hirty (30) and sixty (60) days before the scheduled PME. After the schedule has lapsed, the licensee who fails to undergo the PME shall be given a notice requirinb his or her immediate compliance and stating the penalties for non-compliance. /

SECTION 4. MANDATORY MEDICAL EXAMINATION OF DRIVERS INVOLVED IN ROAD CRASHES

In addition to the periodic medical examination stated in the preceding section, a driver of a motor vehicle involved in road crash resulting in the loss of human life, physical injuries or substantial damage to properties shall be subjected t9 a medical examination to determine his/her physical and rpental fitness to drive. The driver shall submit himself/herself for medical examination at any L TO-accredited medical clinics or government health facility within sever,ity-two (72) hours from the time of the road crash or from his/her release from detention or medical treatment, if ap,plicable.

SECTION 5. EFFECTS OF CHANGES IN THE LICENSEE'S PHYSICAL CONDITION TO THE DRIVER'S LICENSE

If, upon on the findings of a physician, the physical condition of a licensee has changed in a manner where there is already a need to reclassify the license, restrict the driving privilege to a certain motor vehicle class and/or modify the conditions in his/her driver's license, the L TO shall cause the updating of his/her license det~ils and the reprinting of the driver's license to reflect such changes .

• If the physician determines that the licensee is no longer fit to driye because of a physical, neurologic, or cognitive impairment, the L TO shall immediately suspend the driver's license and subject the license card tq physical storage until a ~pecialist certifies that the licensee has clearly recovered to a state where he/she can safel~ operate a motor vehicle or that the loss or impairment has been adequately compensat~d. Such certification may include a recommendation to the L Tp to impose conditions, /limit the driving privilege and/or require the licensee to undergo a theoretical and/or practical examination in order to determine licensee's ability to operate motor vehicles.

SECTION 6. REPORTORIAL REQUIREMENT IN CASE OF TEMPORARY OR PERMANENT INCAPACITY

It shall be the duty of a licensee to infdrm the nearest L TO Regio~al I D!strict I ~xtension Office I Licensing Center in writing of his/her temporary or permanent incapacity and to surrender his/her driver's license for storage within six (6) months from the onset of the incapacity. A medical certificate issued by the licensee's examinir g physician stating the fact of such incapacity shall be required.

Based on the recommendation of the physician, the Assistant S, cretary or the Regional Director may:

The L TO shall have the authority to require any driver who appe1:1rs to

~:"v~-~ny phy:ivc~--I or mental condition or illness that may present a driving risk to undergo medical examination in order to assess his/her fitness to drive. As Sl!lch, whenever the L TO Assistant Secretary or Regional Director finds such driver and a review of the available records show that his/her condition ~as not been noted during the previous medical examinations by an L TO-registered p~ysician, the L TO Assistaf t Secretary or Regional Director may order the driver to undergo medical examination to assist him/her in making · the appropriate decision as to whetherfthe driver will continue to enjoy the driving privilege or have such privilege restricted, susp~nded or revoked. However, qualified drivers who are able to demonstrate that their condition is ~-~table and that they are able to compensate for their disability shall not be discriminated on the basis of such disability.

SECTION 8. EFFECT OF FAILURE TO UNDERGO MEDld AL EXAMINATION OR REPORT INCAPACITY

a. Any driver who, without valid cause, fails or refuses to undergo any of the mandatory medical examinations provided under Sections 3 and 4 hereof within the prescribed period shall hav.e his/her driver's license r utomatically suspended until he/she complies with such requirement. AccordinglYi, the penalty and demerit point/s applicable to the violation of driving with a suspe~ded driver's license shall be imposed upon such driver for every instance he/she if found operating a motor vehicle on any public highway during the period of non-compliance.

b. If a driver who was not sub]ect to the sanctions p/pvided in the preceding subsection was found during the renewal of his/her license to have omitted to undergo any of the medical exapiinations required under1this issuance, such driver shall be penalized with a fine of One Thousand Pesf s (P1 ,000.00) for every missed medical examination. Im addili~n, a:y driver wh1 failed to undergo a

required medical examination shall also be disqualified fro renewing the license and driving any motor vehicle for a period of one (1) year f om the payment of the fine.

c. Any driver who refuses to undergo medical examination a . provided in Section 7 hereof or who fails to report, without valid cause, his/her t mporary or permanent disability within the prescribed period shall be considered an improper person to operate a motor vehicle under S,ection 27 of RA 4136. Ass ch, the license of such driver shall be suspended or, . after hearing, revoked a the discretion of the Assistant Secreta~ or the conc~rned Regional Director.

:-i d. The decision of the Regional Director, i;'l all i;ases herein cf lling for the exercise of

discretion, may be appealed, within fifteen (15) days rom its receipt to the Assistant Secreta~ whose decision shall be final and una , pealable.

SECTION 9. NEURo-bsvCHIATRIC EXAMINATION REQUJIREMENT FOR THE REINS~ATEMENT OF DRIVER'S LICENSE

A person whose driveJs license has been revoked shall un 1 ergo neuro-psychiatric assessment or examina~ion to be conducted by any government- ccredited facility before his/her driver's licens1 may be reinstated. A psychologic I report with a clear recommendation for the r estoration of driving privilege shall bes bmitted as an additional documentary requirem1nt for the applicable license transacti n and as proof of the person's mental fitness to operate a m.otor vehicle.

This provision generally~applies to any~person with revoked licen e who have been found to be an improper per on to operate motor vehicles, or to hj e committed , or as an

\' accessory to, any crim or act which endangers the public w ile operating or using a motor vehicle, as provided under Section 27 of RA 4136. Likewi e, the same requirement applies to any person f ho has accumulated ·at least forty (40) demerit points and has been subject to an outright revocation of driver's l_icense under Section 16 of the IRR of RA 10930, and those w~ose driver's license has be'en revoked f r any other lawful reason except in cases where /perpetual disqualification from being gr nted a license has been imposed.

I SECTION 10. SEPA, BILITY CLAUSE

If any provision or pa1 hereof is declared invalid, the remain otherwise affected shall remain valid and s1,1bsisting.

SECTION 12. EFFECTIVITY

These guidelines shall take effect immediately upon its publicatioJ in the Official Gazette or a newspaper of general circulation, and upon registration with t1e Office of the National Administrative Register ~t the University of the Philippines La1 Center, U.P. Diliman, Quezon City.
