Maryland Dear Mr. Denton: I refer to the letter from your office dated October 31, 1991, requesting the views of the - Executive Branch as to whether issuance of an expon license in accordance with the application hereinafter described meets the applicable criteria of the Atomic Energy Act of 1954, as amended by the Nuclear Non-Proliferation Act of1978: NRC No. XCOM1072 -- Application by Westinghouse Electric Corporation for nuthorization to export to Mexico relays and transfonners for switchgear equipment used to control reactor power level and primary coolant in Unit 2 of the Laguna Verde Nuclear Power Station. Westinghouse, anticipating additional orders to supply components and equipment to the Laguna Verde Nuclear Power Station with an estimated total value of 30 million dollars. has requested authorization to export to Mexico for the Laguna Verde facility all items conttolled by the NRC under 10 CFR Pan i10 Appendix A (5) through A (9). It is the judgment of the Executive Branch that the proposed and anticipated expons (including all nuclear components listed in 10 CFR Part i10 Appendix A(5) through A(9)] will not be inimical to the common defense and security of the United States, and are consistent with the provisions of the Atomic Energy Act of 1954, as amended by the Nuclear Non-Proliferation Act of 1978. As a pany to the NPT, Mexico has committed itself to maintain IAEA safeguards on all of its peaceful nuclear activities and has pledged not to produce or otherwise acquire any nuclear explosive device. It is therefore the judgment of the Executive Branch that enteria (1) and (2) for exports of nuclear components, substances and items under Section 109b of the Atomic Energy Act, as amended, are met, The remaining criterion, agreement not to retransfer the supplied items without prior U.S. consent, has been satisfied by an assurance letter from the Comision Federal de Electricidad, a copy of which is enclosed. On the basis of the foregoing, the Executive Branch recommends that the license be issued. I refer to the letter from your office dated October 31, 1991, requesting the views of the -
