MEETING OF THE BOARD OF MEDICAL EXAMINERS OF THE STAG OF NORTH CAROLINA Mid Pines Club, Southern Pines, North Carolina March 22+ 26th, 1972 The Board of Medical Examiners of the State of North Carolina met at the Mid Pines Club, Southern Pines, North Carolina, for the purpose of interviewing applicants for license by endorsement of credentials and other business. Friday, March 24th The Board convened for dinner. Drs. Cornelius T. Partrick, Pre8. dent, Joseph J. Combs, Secretary-Treasurer, Frank Edmondson, Bryant L. Galusha, Joseph W. Hooper, Jr. , H. Lee Large, Jr. and Vernon W. Taylor, Jr. were present. Mrs. Louise J. McNeill, Administrative Secretary, and Mrs. Betty Joe Cooke attended. Bca rd. Credentials for license by endorsement were reviewed by the members of the RE: Assistant to P sicians - The secretary presented applications as follows: RE: Dr. Leonard J. Goldwater has submitted application for David Ellis Lowe, which application is in order. VERDICT: Dr. Cornelius T. Partrick, Jr. moved that Dr. Leonard J. Goldwater be passed to register David Ellis Lowe as an assistant to physician. Dr. Joseph W. Hooper, Jr. duly seconded this motion and the same was passed by four in favor and one against. RE: Assistant to P sician - Dr. Frank Edmondson moved that the application for assistant to physician have a blank in front of application file showing whether or not requirements have been fulfilled relative to requirements set up by this Board. This motion was duly seconded by Dr. Joseph W. Hooper, Jr. and passed. RE: Dr. William Mitchell's application to register Charles Eugene DuBay as an assistant was presented to the Board. VERDICT: Dr. H. Lee Large, Jr. moved that the secretary be instructed to write an inquiry about the reply to questio n 5 regarding obstetrics, complicated fractures, tendon repair and badly traumatized wounds. This motion was duly seconded and passed. RE: Dr. Harr T. McPherson has submitted application for Glenn LeRoy Rowand, which application is in order. VERDICT: Dr. Cornelius T. Partrick moved that the application of Dr. Harry T. McPherson to register his assistant, Glenn LeRoy Rowand, be approved. This motion was duly seconded by Dr. Frank Edmondson and paseed. The Board convened for dinner. Drs. Cornelius T. Partrick, Pre8. dent,Joseph J. Combs, Secretary-Treasurer, Frank Edmondson, Bryant L. Galusha, JosephW. Hooper, Jr. , H. Lee Large, Jr. and Vernon W. Taylor, Jr. were present. Mrs.Louise J. McNeill, Administrative Secretary, and Mrs. Betty Joe Cooke attended.

RE: Dr. Leonard J. Goldwater has submitted application for David EllisLowe, which application is in order.

VERDICT: Dr. Cornelius T. Partrick, Jr. moved that Dr. Leonard J. Goldwater bepassed to register David Ellis Lowe as an assistant to physician. Dr. Joseph W.Hooper, Jr. duly seconded this motion and the same was passed by four in favor andone against.

RE: Assistant to P sician - Dr. Frank Edmondson moved that the applicationfor assistant to physician have a blank in front of application file showing whetheror not requirements have been fulfilled relative to requirements set up by this Board.This motion was duly seconded by Dr. Joseph W. VERDICT: Dr. H. Lee Large, Jr. moved that the secretary be instructed towrite an inquiry about the reply to questio n 5 regarding obstetrics, complicatedfractures, tendon repair and badly traumatized wounds. This motion was dulyseconded and passed.

RE: Dr. Harr T. McPherson has submitted application for Glenn LeRoy Rowand,which application is in order.

VERDICT: Dr. Cornelius T. Partrick moved that the application of Dr. HarryT. McPherson to register his assistant, Glenn LeRoy Rowand, be approved. Thismotion was duly seconded by Dr. Frank Edmondson and paseed.

VERDICT: Dr. Joseph W. Hooper, Jr. moved that the application of Dr. ErnestWhitmal Furguson to register his assistant, Craig George Bruno, be approved. Thismotion was duly seconded and passed.

RE: Dr. John Elliott Dixon —See previous Minutes with regard to Dr. Dixon'sapplication to register his assistant, Stephen Larry Joyner. Dr. Frank Edmond sonstated that Dr. Dixon had qualified the duties of the assistant and he is satisfied.that he is abiding by the rules.

VERDICT: Dr. Frank Edmondson moved that the application of Dr. John ElliottDixon to register his assistant, Stephen Lar~ Joyner, be approved. 'Ihe motion waspassed.

RE' Dr. Kenneth E. Cos rove —The secretary submitted application for assis-tant to Dr. Cosgrove, Charles W. Kirchner, who had his training at the Universityof Alabama, which program has not been approved by this Beard. He has had 20 yearsof meritorius service in the army as a corpsman.

VERDICT: Dr. Joseph W. Hooper moved that the Board advised Dr. Kenneth E.Cosgrove that this Board can not certify Charles Willim Kirchner as assistant toa physician as he does not meet the standards. This motion was duly seconded byDr. Bryant L. Galusha and passed.

RE: Dr Thomas Francis F n appeared November 21st, 1929 applying for licenseby endorsement of credentials and was approved when and if he located in the state,within one year, for practice. Dr. Flynn has now advised that he has return. d toactive duty with the whited States Public Health Service ani is living in Norfolk,Virginia; that he has an all-year round vacation home at Kill Devil Hills; that hespends many week-ends and several weeks in the summer there, and requested licenseon the basis of his previous application.

VERDICT: Dr. Joseph W. Hooper, Jr. moved that Dr. Thomas Francis Flynn begranted license to practice medicine in this state on the basis of endorsement ofcredentials. This motion was duly seconded and passed.

RE: Dr Kanu A. Gu rati, graduate of a foreign medical school has made appli-cation to take Flex examination, looking towards locating in Clinton, North Carolina.He is licensed in the Virgin Islands and is certified by the American Board of Ophthal-mology.

VERDICT: Dr. Bryant L. Galusha moved that Dr. Kanu A. Gu]rati be seen inMay, 1972 with the idea that he be presented to the Bca rd and on the basis that hehas the Araican Board of Ophthalmology, may take this in lieu of Flex and considerhis credentials. This motion was duly seconded by Dr. H. Lee Large, Jr. and passed.

RE: Dr. Merton W. Olson has applied to take Flex. He is graduated by theUniversity of Guadala]ara, Mexico and was certified as completing the medical courseas a phyeician and surgeon.

VERDICT: Dr. Frank Edmondson moved that Dr. Merton W. Olson does not qualifyfor the examination since he does not have the titulo degree. This motion was dulyseconded by Dr. Joseph W. Hooper, Jr. and passed.

RE: Dr. Jose h Kre lick - The secretary presented application for narcotictax stamp for approval.

VERDICT: Dr. Joseph W. Hooper moved that the Board does approve Dr. JosephKreplick's application for narcotic tax stamp. This motion was secnnded and passed.

Dr. Hooper moved that if Dr. Joseph Kreplick requests audience before thisBoard that he have his court problems cleared up before the audience be granted.This motion was duly seconded by Dr. Frank Edmondson and passed.

RE: Dr. James S ullock Lambert, Swannanoa, North Carolina — (See previousMinutes) - The secretary presented report from the North Carolina Board of Pharmacyas follows: "Review of prescriptions reveal very few prescriptiors for narcotics.There are, however, a lot of his prescriptions around for amphetamines. No time waswasted doing a tabulation on such. If this is desired so notify. " This report wasreceived as information.

The meeting was adjourned.

Dr. Partrick: Would you please tell the Board what you intend to do with NorthCarolina License. A. I wrote Dr. Combs two or three times. I had a disabilityand had to quite practice. I was periodically laid up 2 — 3 months, then was withthe VA three years and took disability retirement . I want to do part-time work.Saluda Nursing Home needs a doctor, the Outpatient Department at the TryonHospital, I might fill in for vacations. I do not want to go in private practice,I do not want to lose my social security. I want to keep my fhger in medicine.

RZ ' Dr. Bobb Oliver Heafner, Stony Point, North Carolina - Dr. Heafnerappeared at the ~uest of the Board. His physician, Dr. James F. Toole, Bowman

Gray School of Medicine reported that Dr. Heafner had been a patient there andwas taking narcotic drugs, however, he did not consider him addicted. He was,therefore, requested to appear at this time. Dr. Heafner stated that he had aheavy work load; that he has seven children; that he has always had headache;that he has had bleeding ulcer on several occasions and tension. He admittedtaking narcotics to relieve his many problems; that he has had no drugs sinceFebruary, when he was hospitalizecL He stated that he has plans to take regulartime off from his office to help relieve his tension.

VERDICT: R. Joseph W. Hooper, Jr. moved that Dr. Bobby Oliver Heafner beadvised that the Board is concerned about his misuse of narcotics; that if we

have any inkling of this happening again we vill have him back up with the ideaof any action that might be necessary; that in the meantime we will keep closeinterest in his case through his attending physician and will request reportsfrom Dr. Toole every three months or as Dr. Toole feels necessary. This motionwas duly seconded and passed by a vote of five.

Dr. Heafner was given the action of the Board by the president.

RE: Dr. L. B. Skeen, Moore ville, North Carolina, appeared at the requestof the Board. He has previously appeared with regard to prescribing for narcoticaddicts, at which time he was given ceutain instructions relating to his practiceof treating narcotic addicts. (See previous Minutes). Dr. Skeen appeared atthis time and stated that he had phased out the addicts he was treating withmethadone. He admitted having some medically addicted addicts under treatment;that he gives amphetamines for overweight.

VERDICT: Dr. Bryant L. Galusha moved. that Dr. L. B. Skeen be advis, .d asfollows:

1. That he be told again to register immediately his known narcotic addicts.2. As previously, that he accept no more known addicts for treatment of

addiction.3. That he thorough ly abstain from the use of amphetamines in his practice.

RE: D r. Fitzhu Lee Smith, Burlington, North Carolina — Purusant toreport from the Pharmacy Board as to Dr. Smith writing for an excessive amount ofamphetamines, he was requested to appear at this time. Dr. Smith came in and.stated that he had given amphetamines for obesity and mood elevators; that he wasnot aware that he was not exercising good judgment, but that he had discontinuedwriting for amphetamines since hearing from the Board and would not write forany more if the Boad so stated. He made the statement that he should have retired.

The Board discussed this situation and Dr. Smith was advised by the presidentthe danger of writing for excessive amounts of amphetamines and the possibility ofthe same getting into the black market; also that it had become increasingly evi-dent that the firm indications for amphetamines were confined to a few conditions.He told him that the Board was not interested in his retiring and that the Boardrespected his right to exercise his judgment and hoped he would continue an activeand productive practice.

RE: Dr. Robert Edward Gardner, O'Berry Hospital, Goldsboro, North Carolina-Dr. Gardner appeared for a routine interview. He was very disappointed that hehad failed to receive a trip to Vietnam to work in a out-patient cl inic for twomonths. It also appeared in his conversation that he was finding his routine worktedious. He was told by the president that the Board was pleased; that he appearedwell and it would like to see him in a happier situation, but that he should bevery cautious in what he planned to do and that the Hoard felt he should be in aprotected atmosphere.

RE: Dr. James Valentine Thomas, Eden, North Carolina, came in for a routineinterview. He stated that he had changed associates, which was done in an amicablemanner, and is now associated with Dr. Herbert Baker, but they have separate prac-tices. He denied having used alcohol or drugs and looked well. Dr. Thomas wascommended by the Board and told he would be invited in from time to time.

RE: Dr. James Richard Hu hes was requested to appear at this time but calledin and stated because of snow he could not make the trip.

The secretary advised that Dr. Hughes had applied for a BBND number and hehad received request of approval from the Narcotic Bureau, and that he had repliedto the Bureau of Narcotics and Dangerous Drugs, giving Dr. Hughes' situation andrequesting that BNDD number not be granted. 'Ihe secretary also reported that hehad received a phone call from the Bureau of Narcotics asking for more positive rea-son for his not receiv'L ng a BNDD number.

The secretary was directed to tell the Bureau of Narcotics that this doctorhad been in deep trouble and that in the judgment of the Board he should not havea narcotic tax stamp, to tell them clearly why the Board does not recommend thathe have narcotic tax stamp and that reply was delayed because of the expectedinterview.

The Board directed that Dr. James Richard Hughes be directed to appear beforethe Board in May, 1972.

RE: Written Examination — Part II — Dr. Bryant L. Galusha moved that June,1972 be unequivocably the last examin ation on Part II to be given. This motionwas duly seconded by Dr. V. W. Taylor and passed.

Dr. Joseph W. Hooper, Jr. moved that everyone on this list be written a formletter that this is the last time PR t II is going to be given; that if they wishto take an examination after June, 1972, it will be necessary to take Flex. thismotion was duly seconded and passed.

RE: Dr. Jerko Pokleoovic - To summraize he failed to take one-third ofthe questions in the basic science subjects, but made a passing Flex weightedaverage, and was granted license. The Board has bean advised by the NationalBoard of Medical Examiners that this procedure had not occurred before and Dr.Poklepovic might have difficulty in the future getting license by endorsement.

VERDICT: Dr. Frank Edmondson moved that Dr. Jerko Poklepovic be advisedas per the above information, the motion was duly seconded and passed.

RE: Dr. Manuel de la Serna Jr. — The secretary advised that Dr. de laSerna, Jr. had been advised that due to the fact that he was residing out ofthe state~ he was not eligible to have his license converted to full licenseupon becoming naturalized. Dr. de la Serna replied that he was in military ser-vice and would return to practice Urology either in Winston-Salem or Elkin thisSeptember.

The Board directed that Dr. Manyel L. de la Serna, Jr. be granted the privi1q, eof convering license to full license upon furnishing certification.

RE: Re ort to American Medical As+ ciation - The secretary presented requestfrom the American Medical Association that report be made on any type of license,special, et cetera. The Board does not at this time report resident~s traininglicense.

VERDICT: Dr. Prank Edmondson moved that the Board conform with the desiresof the American Medical Association and send information. This motion was dulyseconded and passed.

RE: James 0. Bailes Chirp ractice P sician — Report from the PharmacyBoard alleging that Dr. Bailes has been purchasing certain prescription legenddrugs was presented to the Board at its last meeting, at which time they directedthat the advice of the attorney for the Board be procured. 'Ihe attorney advisedthat in ivew of the absence of evidence that he has prescribed or dispenseddrugs, the institution of any action against him by the solicitor would not bewarranted.

Anderson, Attorney for the Board, that the courtaction had been settled, which included return of all North Carolina properties.The investigation also revealed that Dr. Strickland had rendered competent,satisfactory and attentive services to Mrs. Gudger in connection with her severalillnesses.

VERDICT: Dr. H. Lee Large, Jr. moved that this report be received as in-formation and might be considered closed until further information should beforthcoming. This motion was duly seconded and passed.

RE: Dr. L. R. Staton Hayesville, North Carolina — The State Bureau ofInvestigation gave a report that Dr. Staton had been indicted on four countsof unlawfully distributing cnntro13sR drugs; that Dr. Staton waived preliminaryhearing to be held March 22nd and was to be tried in superior court. ')he agentstated that the hearing set for April might be postponed until the Board couldinterview Dr. Staton.

VERDICT: The Board directed that Dr. L. R. Staton be seen at the June,1972 meeting.

RE: Anesthesiolo ists — Dr. J. F. Patterson came in and discussed withthe Board the effort his society is making to procure more anesthesiologists.

RE: Dr. Hen Oldham Williams, resident in Radiotherapy at Duke UniversitySchool of Medicine, appeared at the request of the Board. Dr. R. G. Lester,Chief of the Department of Radiology, appeared with him. This was precipitatedby a report from the State Buremaf Investigation that Dr. Williams had writtenprescriptions for narcotics, using his own name and others; that he had usedthe drugs himself. Dr. Williams admitted having taken percodan, first inOctober, 1971, and had continued until his interview with the State Bureau ofInvestigation agent with regard to the prescriptions he had written. He hasbeen receiving psychiatric care and feels that he is doing well. He stated thathe had previously had depression.

Dr. Lester talked with the Board and Rated that he was a conscientious andgood physician; that the department had every intention of keeping him. Dr.Lester said that at this moment no official action had been taken; that thesolicitor had reserved his privilege of taking the case to the Grand Jury. Healso said that as a resident Dr. Williams would not need his narcotic tax stampfor 82 narcotics.

VERDICT: Dr. Bryant L. Galusha moved that the Board of Medical Examinersrequest that Dr. Henry Oldham Williams relinquish his narcotic license; that hebe continuously on psychotherapy and that this Board get a progress report atthree month intervals; that the Board see him at three month intervals; thatthe secretary write a letter to the State Bureau of Investigatinn that it iscognizant of this problem and is taking remedial action. This motion was dulyseconded and passed.

On being questioned Dr. Williams stated that he had. no misgivings aboutsurrendering his BNDD number and agreed to do so.

The secretary presented to the Board a letter from Dr. Glenda H. W~'ber,Chief of Staff, of the Davidson County Hospital, Mocksville, North Carolina.This letter was accompanied by a document outlining a nurse practitioner clinicbeing set up by the Bowman Gray School of Medicine at Farmington, North Carolina.Dr. Weber then propounded the question of the legality of the operation and thepolicy that their hospital should have regarding that clinic. Mr. John H.Andrson, Attorney for the Board, had studied this proposal and was present forthe discussion. The Board took sometime in talking about the whole situation.It came to the conclusion that the legal angle should be left to the AttorneyGeneral's office, but that the Board should suggest some rules for the operatinnof the clinic, with the following action:

VERDICT: Dr. Bryant L. Galusha moved that the minimum standards and controlsshould include:

1. The name of a specific physician or a group of physicians designatedas assuming authority and responsibility for the medical care pro-vided for this clinic.

2, A mechanism should be developed to assure there is no gap in the continuityof the medical care available to the patients attending this clinic atanytime.
