Thank you for your letter of August 4, 1989 expressingconcerns regarding the state's handling of various matterspertaining to development of our geothermal resources.

Regarding the proposed administrative rules for geothermalpermitting, the Department of Land and Natural Resources reviewedall of the comments received at the pUblic hearings held June 21,1989, and 15 days afterwards in accordance with law. Changes weremade in the proposed rules to address a number of these concerns.However, the changes which were reviewed by the Attorney General'soffice were deemed of such a nature as to not require conductinga second round of pUblic hearings.

Regarding rules for air quality standards for geothermal wellsand facilities, the Department of Health indicates that they arescheduled for adoption later this year. In the meantime, theDepartment of Health has existing Administrative Rules, Title 11,Chapter 59, "Ambient Air Quality standards" and Chapter 60, "AirPollution Control" with which to properly regulate currentlyproposed geothermal activities.

Under the existing rules, the Director of Health has decidedthat a publ Lc hearing on the air quality permit for True/MidPacific geothermal wells would not provide any additionalinformation than that which is already in hand. The project islimited to the drilling and testing of exploratory wells which willonly require temporary release of air emissions. It should beemphasized that this proj ect has already gone through a 30-daypubl Lc comment period. On the other hand, the Department of Healthwill be holding a pUblic hearing on the Puna Geothermal Venture(Ormat) project proposal for the development of geothermal energywhich includes the construction and operation of geothermal wellsand a power plant.

First, regarding the administrative rules, theadministrative statute, chapter 91, Hawaii Revised Statutes,governed our Department of Land and Natural Resources' proceduresin developing the administrative rules for implementing chapter196D, Hawaii Revised Statutes. The administrative statuteprovides the framework for newspaper notices, public hearings,<:~nd '=5 C) fOI' .. t.h ,

The matters of which comments to include in the rules andwhich not to include, and whether or not changes are of such asubstantive nature that a subsequent public hearing is requiredare matters worked out by the department in consultation with theDepartment of the Attorney General within the framework ofC::haptel~ 9:i..

In the case of the administrative rules, the departmentconsidered and analysed all of the comments received. Somechanges were made in the propc~ed rules to address a number ofthese concerns. Staff contacted several of the principals orstaff of those offering substantive comments to let them know howtheir concerns had been addressed. The changes were primarily byway of clarifying an earlier version of the proposed rules, andwere not of such a nature as to require conducting a secondpubl:i.c hE?E\I'''ing.
