RESULT NOTICE NO. s:-~TGT (SOCIAL SCIENCE), MALE POST CODE-i2f13 IN DIRECTORATE OF EDUCATION

1. Whereas Mr. Dinesh has filed an O.A No. 1222/2016, titled Dinesh Vs. GNCT ofDelhi & Ors , and the Hon'ble CAT has_disposed off the said O.A. vide order dated21.01.2019 wherein the operative part is as under:-

"the present O.A. is disposed of with a direction to the respondents todeclare the result of the applicant also qua the post code no. 12/13and take further decision in the matter as per the procedureprescribed for recruitment to the said post".

2. Whereas, Sh. Dinesh had applied for the post of TGT (Social Science) Male underPost Code-118/12 & Post Code-12/13 advertised by Advertisement No. 02/2012& Advertisement No. 01/2013 respectively. The applicant, Sh. Dinesh scored95.50 marks in the written examination for the post of TGT (Social Science) maleagainst post code-118/12. However, being lower in order of merit , hiscandidature for the post code-118/12 could not be considered for selection for thesaid post code.

3. Whereas, the candidature of Sh. Dinesh for the post of TGT (Social Science)Male ,Post Code-12/13 was also rejected at the time of initial scrutiny vide noticeno. F.1(39)/Scrutiny/DSSSB/2013/1794 dated 10.09.2013 on the ground that"applicant is not having the requisite qualification and no HindiKnowledge" .

4. Whereas, Sh. Dinesh, approached the Hon'ble CAT vide O.A. No. 1222/2016, i.e.after the conduct of examination on 28.12.2014 and the Hon'ble CAT vide orderdated 01.04.2016 had directed that appointments under Post Code-12/13, if anymade by the respondent will be subject to the outcome of the ~A. In complianceof the same ,the result of Post Code 12/13 was declared vide result noticenumber-47 dated 27.07.2016 and 01 post under the Post Code-12/13 was keptvacant.

5. Whereas, now Hon'ble CAT has disposed off OA no. 1222/2016 vide order dated21.01.2019 as reproduced in para 1 of this notice, directing to declare the resultof the applicant and take further decision as per recruitment procedure. Thecandidate has now approached the Hon'ble CAT seeking contemptproceedings against the Board vide CP No. 100/236/2019, for havingfailed to implement the orders dated 21.01.2019, as detailed in para 1 ofthe notice herein above.

6. Now therefore, in compliance of the Hon'ble CAT order dated 21.01.2019 in OANo. 1222/2016, titled Dinesh Vs. GNCTD & Others, the Rejection Notice No.F.l(39)/Scrutiny/DSSSB/2013/1794 dated 10.09.2013 in r/o Sh. Dinesh(Roll No. 54000280) stands cancelled and Sh. Dinesh (Roll No.54000280) is provisionally nominated under OBC Category for the post ofTGT (Social Science) Male, Post Code-12/13 in Directorate of Education.

7. The selection of the above candidate shall further be subject to genuineness ofthe documents on the basis of which they have claimed to have fulfilled all theeligibility conditions as prescribed in the RRs and terms and conditions ofadvertisement inviting applications and subject to thorough verification of theiridentity with reference to their photographs, signatures/handwriting etc. on theapplication form, admission certificate etc. The candidature of the abovecandidate is liable to be cancelled by the User Department also, in case thecandidates is found not to be fulfilling the terms & conditions of the advertisementinviting applications for the said post code. The decision of the User Departmentregarding the eligibility of the candidate shall be final and binding on thecandidate.

8. The User department shall also check the eligibility of the reservation benefit, ifany. Further, if applicable, User Department shall verify the genuineness of theCaste Certificate furnished by the candidate prior to issuing offer of appointmentto the candidates.

9. The Competent Authority of the User Department concerned shall issue theappointment letter to the candidates after being satisfied about their eligibility aslaid down in the recruitment rules and after verification of the correctness of theinformation/documents as furnished in the application for and e dossier vis-a-visthe original documents related to Educational Qualification, Age and otheressential certificates as per Instructions issued by Govt. of India in this regardvide MHA OM No.2/29/54-RRs dated 19-11-54.

10. The User department shall ensure that the appointment made is inconformity with DOPT guidelines and instructions of Govt issued fromtime to time.

11. Mere inclusion of name in the result notice does not confer anyright upon the candidate over the post unless the user department is

satisfied after such inquiry as may be considered necessary that thecandidate is suitable for the said post.

12. While every care has been taken in preparing the result, the DSSSBreserves the right to rectify errors and omissions, if any.
