Environmental Clearance. Sir, The undersigned is directed to refer to your letters dated 11.02.2011 and 07.04.2011 on the subject mentioned above. The Ministry of Environment & Forests has examined the application. 2. It has been noted that the proposal is for setting up of lx43 MW Imported Coal Based Thermal Power Plant at village Lumshnong, in Khliehriat Taluk, in Jaintia Hills Distt., in Meghalaya. Land requirement will be 45 acres, of which 17.0 acres will be used for main plant and ash pond; 15.0 acres will be for green belt; 3.0 acres will for coal storage and truck tripling system yards; 2.0 acres will be for fabricationj construction yard and temporary site office; 5.0 acres will be for raw water reservoir and 3.0 acres will be for infrastructural facilities. The co-ordinates of the site are at Latitude 25°10'30.4" N to 25 0 10'49.9"N and Longitude 92°23'41.7" E to 92 0 23'57.9"E. Coal requirement will be 0.201 MTPAat 85% PLF. Imported coal from Indonesia will be used until domestic coal is available. Fly ash will be supplied to Mj s Cement Manufacturing Company Ltd and Mj s Megha Technical and Engineers Pvt. Ltd. Air cooled condensers will be installed. CFBC Boilers with lime dozing will also be installed. Water requirement will be 1.2 MLD and will be sourced from Umtyrngai, Ummutha nallahs and Umlunar River through an anicut pipeline at a distance of 3.65 km east from project site. There are no national parks, wildlife sanctuaries, heritage sites, tigerjbiosphere reserves, forest land etc. within 10 km of the site. Public hearing was held on 07.01.2011 Cost of the project will be Rs 183.73 Crores. 3. The undersigned is directed to refer to your letters dated 11.02.2011and 07.04.2011 on the subject mentioned above. The Ministry ofEnvironment & Forests has examined the application.

2. It has been noted that the proposal is for setting up of lx43 MWImported Coal Based Thermal Power Plant at village Lumshnong, inKhliehriat Taluk, in Jaintia Hills Distt., in Meghalaya. 4. Based on the information submitted by you, as at Para 2 above andothers and presentation made by you and your consultant viz. M/ s Min MecConsultancy Pvt. Ltd., New Delhi during the 22nd Meeting of the ExpertAppraisal Committee (Thermal Power) held during April 4-5, 2011, theMinistry of Environment and Forests hereby accords environmentalclearance under the provisions of EIA Notification dated September 14,2006, subject to the compliance of the following Specific and Generalconditions:

A. Specific Conditions:

(i) In case source of fuel supply is to be changed at a later stage (nowproposed on imported coal from Indonesia) the project proponent shallintimate the Ministry well in advance along with necessary requisitedocuments for its concurrence for allowing the change. In such a casethe necessity for re-conducting public hearing may be decided by theMinistry in consultation with the Expert Appraisal Committee.

(ii) High Efficiency Electrostatic Precipitators (ESPs) shall be installed toensure that particulate emissions do not exceed 50 mgy Nm-'.Adequate dust extraction system such as cyclones/ bag filters andwater spray system in dusty areas such as in coal handling and ashhandling points, transfer areas and other vulnerable dusty areas shallbe provided.

(iii) Sulphur and ash contents in the coal to be used in the project shallnot exceed 0.9% and 25 % respectively at any given time. In case ofvariation of coal quality at any point of time fresh reference shall bemade to MoEF for suitable amendments to environmental clearancecondition wherever necessary.

(iv) Stacks of 110 m shall be installed and provided with continuousonline monitoring equipments for SOx, NOxand PM2.sand PMlO. Exitvelocity of flue gases shall not be less than 22 ui] sec. Mercuryemissions from stack may also monitored on periodic basis.

(v) The company shall undertake measures for rain harvesting to harvestthe water from the built up and open area within the plant premisesto recharge the ground water and to minimize the fresh waterconsumption.

(vi) Hydro-geological status (quality and quantity) of ground water shall bereviewed annually from an institute/ organization of repute to assessimpact of surface water and ground regime (especially around ashdyke). In case and deterioration is observed specific mitigationmeasures shall be undertaken and reports/ data of water qualitymonitored regularly and maintained shall be submitted to theRegional Office of the Ministry.

(vii) Source of water for meeting the requirement during lean season shallbe specified and submitted to the Regional Office of the Ministrywithin three months.

(viii) No water bodies (including natural drainage system) in the area shallbe disturbed due to activities associated with the setting up /operation of the power plant.

(ix) The treated effluents conforming to the prescribed standards onlyshall be re-circulated and reused within the plant. Arrangementsshall be made that effluents and storm water do not do not get mixed.A sewage treatment plant shall be provided (as applicable) and thetreated sewage shall be used for raising greenbelt/ plantation.

(x) Additional soil for leveling of the proposed site shall be generatedwithin the sites (to the extent possible) so that natural drainagesystem of the area is protected and improved.

(xi) Utilisation of 100% Fly Ash generated shall be made preferably from4th year of commissioning of the plant. Status of implementation shallbe reported to the Regional Office of the Ministry from time to time.

(xii) Fly ash shall be collected in dry form and storage facility (silos) shallbe provided. Unutilized fly ash shall be disposed off in the ash pondin the form of slurry form. Mercury and other heavy metals (As,Hg,Cr,Pb etc.) will be monitored in the bottom ash as also in the effluentsemanating from the existing ash pond. No ash shall be disposed off inlow lying area.

(xiii) Ash pond (if any) shall be lined with HDPE/LDPE lining or any othersuitable impermeable media such that no leachate takes place at anypoint of time. Adequate safety measures shall also be implemented toprotect the ash dyke from getting breached.

(xiv) Green Belt consisting of 3 tiers of plantations of native species aroundplant and at least 30 m width shall be raised. Tree density shall notless than 2500 per ha with survival rate not less than 80 %.

(xv) The project proponent shall also adequately contribute in thedevelopment of the neighbouring villages. Special package withimplementation schedule for providing fluoride free potable drinkingwater supply in the nearby villages and schools shall be undertaken ina time bound manner.

(xvi) An amount of Rs 0.74 Crores shall be earmarked as one time capitalcost for CSR programme. Subsequently a recurring expenditure of Rs0.15 Crores per annum till the operation of the plant shall beearmarked as recurring expenditure for CSR activities. Details of theactivities to be undertaken shall be submitted within one monthalong with road map for implementation.

(xvii) While identifying CSR activities it shall be ensured that need basedassessment for the nearby villages within study area shall beconducted to study economic measures with action plan which canhelp in upliftment of poor section of society. As part of CSR vocationaltraining programme for possible self employment and jobs shall beimparted to identified villagers free of cost.

(xviii) It shall be ensured that in-built monitoring mechanism for theschemes identified is in place and annual social audit shall be gotdone from the nearest government institute of repute in the region.The project proponent shall also submit the status of implementationof the scheme from time to time.

B. General Conditions:

(i) Adequate safety measures shall be provided in the plant area tocheck/minimize spontaneous fires in coal yard, especially duringsummer season. Copy of these measures with full details along withlocation plant layout shall be submitted to the Ministry as well as tothe Regional Office of the Ministry.

(ii) Storage facilities for auxiliary liquid fuel such as LDO and/HFO/LSHS shall be made in the plant area in consultation withDepartment of Explosives, Nagpur. Sulphur content in the liquid fuelwill not exceed 0.5%. Disaster Management Plan shall be prepared tomeet any eventuality in case of an accident taking place due to storageof oil.

(iii) Regular monitoring of ground water level shall be carried out byestablishing a network of existing wells and constructing newpiezometers. Monitoring around the ash pond area shall be carriedout particularly for heavy metals (Hg,Cr,As,Pb) and recordsmaintained and submitted to the Regional Office of this Ministry. Thedata so obtained should be compared with the baseline data so as toensure that the ground water quality is not adversely affected due tothe project.

(iv) Monitoring surface water quantity and quality shall also be regularlyconducted and records maintained. The monitored data shall besubmitted to the Ministry regularly. Further, monitoring points shallbe located between the plant and drainage in the direction of flow ofground water and records maintained. Monitoring for heavy metals inground water shall be undertaken.

(v) First Aid and sanitation arrangements shall be made for the driversand other contract workers during construction phase.

(vi) Noise levels emanating from turbines shall be so controlled such thatthe noise in the work zone shall be limited to 75 dBA. For people

working in the high noise area, requisite personal protectiveequipment like earplugs/ear muffs etc. shall be provided. Workersengaged in noisy areas such as turbine area, air compressors etc shallbe periodically examined to maintain audiometric record and fortreatment for any hearing loss including shifting to non noisy/lessnOISYareas.

(vii) Regular monitoring of ambient air ground level concentration of S02,NOx, PM2.5& PMlOand Hg shall be carried out in the impact zone andrecords maintained. If at any stage these levels are found to exceedthe prescribed limits, necessary control measures shall be providedimmediately. The location of the monitoring stations and frequency ofmonitoring shall be decided in consultation with SPCB. Periodicreports shall be submitted to the Regional Office of this Ministry. Thedata shall also be put on the website of the company.

(viii) Provision shall be made for the housing of construction labour (asapplicable) within the site with all necessary infrastructure andfacilities such as fuel for cooking, mobile toilets, mobile STP, safedrinking water, medical health care, creche etc. The housing may bein the form of temporary structures to be removed after thecompletion of the project.

(ix) The project proponent shall advertise in at least two local newspaperswidely circulated in the region around the project, one of which shallbe in the vernacular language of the locality concerned within sevendays from the date of this clearance letter, informing that the projecthas been accorded environmental clearance and copies of clearanceletter are available with the State Pollution Control Board/Committeeand may also be seen at Website of the Ministry of Environment andForests at http://envfor.nic.iil.

(x) A copy of the clearance letter shall be sent by the proponent toconcerned Panchayat, Zila Parisad / Municipal Corporation, urbanlocal Body and the Local NGO, if any, from whomsuggestions/representations, if any, received while processing theproposal. The clearance letter shall also be put on the website of theCompany by the proponent.

(xi) An Environmental Cell shall be created at the project site itself andshall be headed by an officer of appropriate seniority and qualification.It shall be ensured that the head of the Cell shall directly report to thehead of the organization.

(xii) The proponent shall upload the status of compliance of the stipulatedenvironmental clearance conditions, including results of monitoreddata on their website and shall update the same periodically. It shallsimultaneously be sent to the Regional Office of MOEF, the respectiveZonal Office of CPCB and the SPCB. The criteria pollutant levelsnamely; SPM, RSPM (PM2.5& PMlO),S02, NOx (ambient levels as well

as stack emissions) shall be displayed at a convenient location nearthe main gate of the company in the public domain.

(xiii) The environment statement for each financial year ending 31st Marchin Form-Vas is mandated to be submitted by the project proponent tothe concerned State Pollution Control Board as prescribed under theEnvironment (Protection) Rules, 1986, as amended subsequently,shall also be put on the website of the company along with the statusof compliance of environmental clearance conditions and shall also besent to the respective Regional Offices of the Ministry bye-mail.

(xiv) The project proponent shall submit six monthly reports on the statusof the implementation of the stipulated environmental safeguards tothe Ministry of Environment and Forests, its Regional Office, CentralPollution Control Board and State Pollution Control Board. The projectproponent shall upload the status of compliance of the environment ofthe environmental clearance conditions on their website and updatethe same periodically and simultaneously send the same bye-mail tothe Regional Office, Ministry of Environment and Forests.

(xv) Regional Office of the Ministry of Environment & Forests will monitorthe implementation of the stipulated conditions. A complete set ofdocuments including Environmental Impact Assessment Report andEnvironment Management Plan along with the additional informationsubmitted from time to time shall be forwarded to the Regional Officefor their use during monitoring. Project proponent will up-load thecompliance status in their website and up-date the same from time totime at least six monthly basis. Criteria pollutants levels includingNOx (from stack & ambient air) shall be displayed at the main gate ofthe power plant.

(xvi) Separate funds shall be allocated for implementation of environmentalprotection measures along with item-wise break-up. These cost shallbe included as part of the project cost. The funds earmarked for theenvironment protection measures shall not be diverted for otherpurposes and year-wise expenditure· should be reported to theMinistry.

(xvii) The project authorities shall inform the Regional Office as well as theMinistry regarding the date of financial closure and final approval ofthe project by the concerned authorities and the dates of start of landdevelopment work and commissioning of plant.

(xviii)Full cooperation shall be extended to the Scientists/ Officers from theMinistry / Regional Office of the Ministry at Bangalore / CPCB/ SPCBwho would be monitoring the compliance of environmental status.

5. The Ministry of Environment and Forests reserves the right to revokethe clearance if conditions stipulated are not implemented to the satisfaction

of the Ministry. The Ministry may also impose additional environmentalconditions or modify the existing ones, if necessary.

6. The environmental clearance accorded shall be valid for a period of 5years to start operations by the power plant.

7. Concealing factual- data or submission of false/fabricated data andfailure to comply with any of the conditions mentioned above may result inwithdrawal of this clearance and attract action under the provisions ofEnvironment (Protection) Act, 1986.

8. In case of any deviation or alteration in the project proposed includingcoal transportation system from those submitted to this Ministry forclearance, a fresh reference should be made to the Ministry to assess theadequacy of the condition(s) imposed and to add additional environmentalprotection measures required, if any.

9. The above stipulations would be enforced among others under theWater (Prevention and Control of Pollution) Act, 1974, the Air (Preventionand Control of Pollution) Act, 1981, the Environment (Protection) Act, 1986and rules there under, Hazardous Wastes (Management, Handling andTransboundary Movement) Rules, 2008 and its amendments, the PublicLiability Insurance Act, 1991 and its amendments.
