BY-LAW REQUIREMENT:

1. A minimum interior side yard setback of 1.8 metres is required to a door. 2. A minimum interior side yard setback of 1.2 metres is required to an exterior

stairway. 3. A minimum rear yard setback of 0.6 metres is required to an accessory structure. 4. A minimum interior side yard setback of 1.2 metres is required to an A/C unit.

Order-to-Comply # 15-0230 has been issued for construction without obtaining a building permit.

Building Permits Issued:

A building permit has not been issued. The Ontario Building Code requires a building permit for structures that exceed 10m2.

Other Comments:

The applicant shall be advised that additional variances may be required upon review of detailed drawings for building permit/site plan approval. The proposed below grade entrance shall not be used to facilitate a basement apartment/secondary dwelling unit.

Proposal:

The Owner is requesting permission for the continued construction of a side door entrance with stairs, and to maintain an existing shed, and air conditioning (A/C) unit with the following variances:

Official Plan:

The subject lands are designated “Low-Rise Residential” by the City of Vaughan Official Plan 2010 (VOP 2010). The proposal conforms to the policies of the Official Plan.

Comments:

Development Planning staff conducted a site visit with photo documentation on November 4, 2015. The Development Planning Department has no objection to Variances #1, #2, #3, and #4. The existing accessory building (shed) abuts an OS2 Open Space Park Zone, and the existing A/C unit will not physically or visually impact any abutting properties. The Development Engineering and Infrastructure Planning Department has no objection to the reduced setbacks as a drain connection to a weeping tile system is being proposed, which will mitigate any drainage impacts on the lot. The Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land.

Condition(s):

None.

Recommendation: The Development Planning Department supports Minor Variance Application File A339/15.

Comments: The subject lot drains from the rear of the lot to the front as per as-constructed drawing LG-2 for Dreamwood Subdivision, dated February 2006. As such, the proposed stairway will block the intended side yard drainage for the subject lot. Further to knowledge of this information, the Development Engineering & Infrastructure Planning Department (DEIP) offers the following comments to the requested minor variances:

1. There is no objection from DEIP regarding this request; 2. As noted, the proposed stairway will block the side yard drainage for the lot. A four inch

drain is proposed in the depressed stairway to convey side yard drainage flow to the weeping tile system of the existing house. As such, DEIP does not object to this request;

3. As the lot drains in a back-to-front manner, minimal flow will impact the accessory structure; therefore, DEIP has no objection to this request;

4. The A/C unit shall remain elevated (as indicated in the photo attached in the application) to promote positive drainage.

Accordingly, the Development Engineering and Infrastructure Planning Department does not object to Variance Application A339/15.

COMMENTS:

PowerStream has received and reviewed the proposed Variance Application. This review, however, does not imply

any approval of the project or plan.

All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced. In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the safe limits of approach can be established. In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be responsible for 100% of PowerStream’s cost for any relocation work.
