4. FILE NO.: B81/01 ROYBRIDGE INVESTMENTS LTD.

LOCATION

Part of Lot 5 Concession 8, (Parts 1-4 of Reference Plan 65R-4536 and Blocks 2 and 3, Registered Plan 65M-3033, municipally known as 5875 Highway #7; 155 and 131 Regalcrest Court.) PROPOSAL The purpose of this application is to request the consent of the Committee of Adjustment to convey a parcel of land for the purpose of creating a new lot, for industrial/commercial purposes and retain lands for industrial purposes. There is an industrial/commercial building located on the subject land and two industrial buildings exist on the retained land. By-law 1-88 zones both the subject and retained lands “EM1” Prestige Employment Area Zone. Sam Speranza, the agent appeared on behalf of the applicant and gave a brief submission regarding the request. There was no one in attendance either in support of or in opposition to the request.

There were no objections from any Departments or Agencies and any conditions requested are listed below.

THAT Application No. B81/01– ROYBRIDGE INVESTMENTS LTD. be APPROVED subject to the following conditions : 1. Payment to the City of Vaughan of a Tree Fee if required, approved by Council as of

the date of granting the consent. Payment is to be made by certified cheque, to the satisfaction of the Finance Department and Parks Department;

2. That the owner shall pay all taxes as levied, if required, to the satisfaction of the

Finance Department; (contact Linda Nelson in the Finance Department to have this condition cleared).

3. The applicant shall provide the City of Vaughan with an appraisal report, if required

and valuation of the subject land (land only) to be prepared by an accredited appraiser, if required. Payment of a Parkland Levy to the City of Vaughan, if required, in lieu of the deeding of land for park purposes shall be made if a new lot is being created. Said levy is to be 2% of the appraised market value of the subject land as of the date of the Committee of Adjustment giving notice to the Applicant of the herein decision. Said levy shall be approved by the Manager of Real Estate. Payment shall be made by certified cheque only;

4. That Both parcels comply, if required, to the satisfaction of the Building Standards

Department; 5. Submission to the Secretary-Treasurer of three (3) white prints of a registered

deposited reference plan of survey, showing the subject land which conforms with the application submitted and which shows the dimensions and areas of each part shown on the plan;

6. Upon fulfilling and complying with all of the above-noted conditions, and only if

required, the Secretary-Treasurer of the Committee of Adjustment must be provided with three (3) copies of the Transfer/Deed of Land for the subject land to be stamped accordingly; or may provide a Certificate to the Applicant stating the Consent has been given in certain cases; When submitting Deeds please provide a “Schedule Page” which includes the legal description of the lands in question for stamping purposes. Failure to provide this Schedule page will result in the delay of stamping the Deeds until it is received

7. A fee of $200.00 made payable to the Treasurer City of Vaughan shall, be submitted

to the Secretary Treasurer for the issuance of the Certificate/stamping of the deeds. It will be necessary to allow up to three (3) working days after all conditions have been fulfilled and documentation filed. Proposal:

The Owner is requesting to permit a second (2) Personal Service Shop in an EM1 Prestige Employment Zone, whereas By-law 1-88 requires one Personal Service Shop having a maximum floor area of 185m2.

Official Plan:

The subject lands are designated “Prestige Area” with a by in-effect OPA #450 (Employment Area Plan). The subject lands are also designated “Employment Mixed Use” by the new City of Vaughan Official Plan 2010, which is subject to approval from the Ontario Municipal Board. The proposal conforms to the policies of the Official Plan.

Comments:

The Applicant is requesting to permit a second (2) Personal Service Shop on the subject lands. The subject lands are developed with a multi-unit building that contains office and commercial uses. The EM1 Prestige Employment Zone permits one Personal Service Shop use with a maximum gross floor area of 185m2. This application proposes a second Personal Service Shop use within Unit 14 with a gross floor area of 156.60m2. The new City of Vaughan Official Plan 2010 states that the “Employment Commercial Mixed-Use” designation “recognizes existing areas of predominately commercial uses within the Employment Area as of the adoption of this plan…these areas are planned to be developed with commercial buildings that allow for a variety of business uses to occur in close proximity to each other in order to assist the City in achieving its intensification objectives.” (Section 9.2.2.7, in part). Although the new City of Vaughan Official Plan 2010 is not yet in effect, once implemented, the Zoning By-law will be updated to reflect the policies and permitted uses of the “Employment Commercial Mixed-Use” designation. On this basis, the Development Planning Department is of the opinion that the addition of a second Personal Service Shop use within an EM1 Prestige Employment Zone is regarded as an incremental step towards implementing the new City of Vaughan Official Plan 2010 without adversely compromising the existing policies of the in-effect Official Plan and Zoning By-law. Accordingly, the Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent
