2. Land Acquisition – Colonial Drive Norton Summit – Confidential Item

SUMMARY

The purpose of this report is to seek Council consideration of a request to purchase a parcel of landon Colonial Drive at Norton Summit.

The request was initiated by the Norton Summit CFS and seeks to provide for improved parkingadjoining the CFS building which is located on the corner of Colonial Drive and St John Road, NortonSummit.

This matter was considered by the Property Advisory Group on 1 February 2016 where it was agreedthat Council should consider the request prior to commencing additional work associated withsurvey, design and planning.

RECOMMENDATION

Council resolves that:

1. The report be received and noted.

2. In principle support for the acquisition of the parcel of land identified in Appendix 1 beprovided / not provided.

3. Subject to support being provided for the acquisition of the parcel of land, staff work withthe Norton Summit CFS and the Anglican Church to prepare preliminary plans forconsideration by Council.

Land Acquisition – Colonial Drive Norton Summit – PERIOD OF CONFIDENTIALITY

4. That having considered at Agenda Item 19.2 in confidence under sections 90(2) and 90(3) (b)of the Local Government Act 1999, that an order be made under the provisions of sections91(7) and (9) of the Local Government Act 1999 that the report, related attachments and theminutes of Council and the discussion and considerations of the subject matter be retainedin confidence until, if determined by Council, until negotiations regarding land acquisitionhave been finalised, but not longer than 12 months.

5. Pursuant to section 91(9) (a) of the Local Government Act 1999, that Council delegates theduty to conduct an annual review of the confidentiality order to the Chief Executive Officer,or his sub-delegate.

6. Pursuant to section 91(9)(c) of the Local Government Act 1999, that Council delegates thepower to revoke the confidentiality order to the Chief Executive Officer, or his sub-delegate.

Acquisition of the parcel of land proposed by the Norton Summit CFS would, subject tofunding, provide the opportunity to develop additional car parking adjoining the currentstation. Allocation funds to this proposal may also assist in meeting communityexpectations relating to application of a proportion of funds from the sale of Morialta Barnswithin the vicinity of the Barns.

Financial and Resource Implications

A valuation of $120,000 for the proposed allotment has been received from Wayne SmithProperty Valuer, and included as Appendix 3 to this report.

It is estimated that costs of approximate $3,000 to $5,000 would be incurred to undertakethe required survey work and to obtain approvals for the land division. These costs wouldneed to be met by Council.

Cost estimates to undertake the road widening to provide for additional parking have notbeen undertaken at this time, but when undertaken would be in addition to the costsoutlined above.

The 2015/16 budget currently does not provide for any potential costs associated with thisproposal. If this proposal was endorsed to proceed it would be necessary to include survey,design and planning cost within Budget Review 3 as well as potential acquisition costs in theDraft Annual Business Plan for 2016/17.

2. BACKGROUND

Council was approached by Mr Lee Watson of the Norton Summit CFS in 2014 seekingsupport for the acquisition of a parcel of land adjoining the CFS facility to provide forimproved car parking.

The current CFS facility is located on Council land on the corner of Colonial Drive and StJohn Road, Norton Summit as shown in Appendix 1 of this report.

3. ANALYSIS

Council officers have meet onsite with the CFS as well as the Norton Summit AnglicanChurch, being the owners of the adjoining land, to consider options to address the parkingconcerns.

Whilst there is potential to improve parking requirements for the CFS through a roadwidening exercise and a smaller land acquisition, the proposal put forward seeks thepurchase of approximately 2000 square metres of land (Refer to Appendix 1) that wouldeffectively connect the land owned by Council to the East and West of the proposedallotment. A ‘Street View’ of the proposed site has been included as Appendix 2 forinformation.

During discussions with the CFS it was evident that whilst improved carparking is theprimary driver for the request, it was the sale of Morialta Barns in 2014 that provided theinitial catalyst for consideration given Council’s recommendation which stated in part:

“Council considers re-investing a portion of the proceeds from this sale back into alocal project as part of the 2013/14 budget deliberations”

The sale proceeds for Morialta Barns were $400,000 and at this time no additional projectshave been undertaken by Council within the area where funding has been specificallyassociated with the sale.

During discussions with the Norton Summit CFS and Anglican Church it was also recognisedthat should Council endorse the proposed land acquisition, that a septic treatment systemlocated immediately to the North of the CFS shed, could be more effectively managed as itis currently positioned across two titles.

4. OPTIONS

Council has two options in relation to this report:

Option 1 – Endorse progression of the proposed land acquisition as identified in this report.If this option was endorsed, Council staff would work with the Norton Summit CFS andAnglican Church to undertaken survey and design work prior to a formal request topurchase being provided to Council for consideration.

Option 2 – Not endorse the proposed land acquisition in which case the Norton Summit CFSand Anglican Church would be advised of Council’s decision. Council staff would then lookat potential road widening options for subsequent consideration by Council.
