]-n. h-n. c-m-a-N-{-µ³s-N-bÀ-a-m³

ECHS was implemented on 01 April 2003. After implementation of the scheme, there were two con-ditions for the pensioners. (1) The Fixed Medical Allowance should be stopped (2) To pay the one time contribution along with the ECHS application formFixed Medical Allowance was implemented after 1995. Therefore, the pensioners were discharged prior to 01 January 1996 demanded that they should be exempted from payment of One Time Contribution. The Government of India did not agree. The Confed-eration of Ex-servicemen Association filed a case in the Supreme Court of India. The Hon’ble Supreme Court of India allowed the plea and issued orders on 22 August 2006 that pre-01-01-1996 retirees should be exempted from payment of the One Time Con-tribution. The Government of India postponed their decision to implement the Supreme Court Orders. The Central Organisation ECHS has issued orders on 08 June 2018 as amended vide order dated 03 August 2018 to refund the One Time Contribution to pre 01-01-1996 retirees.Copy of the Government of India orders and the pro-cedure for claiming the amount has been published in this bulletin. REFUND OF ONE TIME ECHS CONTRIBUTION FOR PRE 01 JAN 1996 RETIREES

1. All pre 01 Jan 1996 retirees are exempted from paying one time contribution for getting ECHS Member-ship vide GOI, MOD ID No 17(10)/06/US(WE)/D(Res) dated 13 April 2007 (copy attached).

2. It is observed that some of the pre 01 Jan 1996 retirees have deposited their one time contribution erro-neously through MRO though it was exempted for them. They can get the excess remittance refunded by the concerned PCDA/CDA on receipt of a pre-receipted Contingent Bill duly countersigned by the Stn Cdr as ECHS authority along with a Xerox copy of the MRO). In this connection, ref Para 27 of O/O CGDA New Delhi letter No AT/IV/4807/ECHS dated 29 October 2003 (copy attached)

3. Henceforth, all Regional Centres/Station Heaquarters to process all these cases of re-imbursement at their end. The above policy will also be given wide publicity.

4. This has the approval of the MD ECHS.
