IMPLEMENTING RULES AND REGULATIONS OF EXECUTIVE ORDER NO. 253,

PROVIDING FOR THE EXPANSION OF AIR SERVICES TO THE DIOSDADO MACAPAGAL

INTERNATIONAL AIRPORT (DMIA) AND SUBIC BAY INTERNATIONAL AIRPORT (SBIA)

ri"ht to carr# traffic from one $oint in the territor# of the Phii$$ines to another

furnishin" a Phii$$ine carriers en"a"ed in internationa air car"o trans$ortation !ith co$ies

thereof.

2.2 'he $etition sha s$ecif# the routes to be o$erated !ith D and>or S1 as "ate!a#

$oints, the ca$acit# to be offered on such routes on a !ee9# basis, the t#$es of aircraft to be

o$erated thereon and start@u$ dates of such o$erations= Provided, those !ith existin" S

sha incude a verified certification that the a$$icant air car"o carriers o$ts to o$erate to and

from D and>or S1 under EO 253 in ieu of the ri"hts "ranted under $ertinent S and

that it sha not mix its ri"hts to o$erate to other Phii$$ine $oints as ma# be "ranted under the

S !ith its ri"hts to be "ranted under EO 253= Provided further, that if the 1oard decides

to "rant the $etition, the decision sha ex$ress# state, amon" others, that the a$$icant air

car"o carrier sha not o$erate air services to and from D and S1 in accordance !ith

an# ri"hts "ranted to it under $ertinent S durin" the $eriod of vaidit# of the authorit#

"ranted $ursuant to EO 253 and that it sha not mix its ri"hts to o$erate to other Phii$$ine

$oints as ma# be "ranted under the S !ith its ri"hts to be "ranted under EO 253=

2.3 n determinin" the merits of a $etition, the 1oard sha consider that air access to D and

S1 is decared as a deveo$ment route. (ence, the authorit# to o$erate such route ma# be

"ranted !ithout an# restrictions on fre?uenc# or ca$acit#, aircraft confi"uration and non@

cabota"e traffic ri"hts, exce$t as ma# other!ise be demanded b# the o$erationa, commercia,

securit# and safet# re?uirements for the o$eration of air car"o services to and from the D

and S1=

2.4 'he 1oard sha revie! and assess the re?uest of the a$$icant a"ainst the current o$erationa,

commercia, securit# and safet# re?uirements of o$eratin" air car"o services to and from

D and S1 ta9in" into consideration comments that ma# have been fied b# the

interested $arties !ithin seven;A< da#s from recei$t of notice=

2.5 f the 1oard finds that the $etition is sufficient in form and substance and ao!abe on the

basis of technica, o$erationa and commercia re?uirements of o$eratin" to and from D

and> or S1, the same sha be favorab# "ranted. Other!ise, the 1oard sha conduct a

hearin" on the $etition to be com$eted and resoved !ithin thirt# ;30< da#s from the date of

the first hearin". Durin" the interim, the 1oard ma# issue $rovisiona orders for the $rotection

of the ri"hts of the $arties.

RULE III

TARIFF AND RATES

'he 1oard sha ensure that consumers are not subected to discriminator# $rices or $ractices or

$rices that are unreasonab# hi"h or restrictive due to abuse of dominant $osition. *i9e!ise, no air carrier

sha en"a"e in $redator# $ricin" resutin" in artificia# o! or uneconomic $rices.

t is the dut# of the 1oard to investi"ate and initiate actions a"ainst an# $ractice or vioation of

the above $ricin" mechanisms.

RULE IV

VALIDITY

effective for a $eriod of one ;&< #ear rene!abe u$on $etition of "rantee. 'he $etition for

rene!a must be fied !ithin thirt# ;30< da#s $rior to the date of the ex$iration of the $ermit.

'he !aiver sha be conterminous !ith the $ermit "ranted under 4.& and the )P issued b#

the 1oard under .. AAB.

RULE V

FEES

RULE VI

INSPECTION

Pursuant to its mandated $o!ers under .. AAB, the 1oard ma# ins$ect the $remises and

o$erations of internationa air car"o carriers o$eratin" !ithin the D and S1 to ensure the $ro$er

im$ementation of Executive Order No. 253.

RULE VII

VIOLATIONS AND PENALTIES

n# vioation of the $rovisions of Executive Order No. 253 and of this sha be $enai:ed in

accordance !ith the $ertinent $rovisions of .. AAB.

RULE VIII

RESERVATION CLAUSE

'he 1oard reserves the ri"ht to amend, re$ea or modif# this as !arranted b# circumstance

or events to !hich the obectives of Executive Order 253 and consistent !ith the $rovisions of .. AAB,

ma# be served.

RULE IX

SEPARABILITY CLAUSE

f an# section or an# $art of this sha be decared unconstitutiona b# a com$etent authorit#,

the remainin" section or $arts thereof sha not thereb# be affected.

REPEALING CLAUSE

other resoutions, economic re"uations and other issuance b# the 1oard !hich are
