Be it enacted by the Senate and the House of Representatives of the Philippines in Congress assembled:

(S)C 112 Definition of Terms:"

(1!nndustrial Design is an$ co%position of lines or colors or an$ three*di%ensional for%, &hether or not associated &ith lines or colors' Provided! +hat such co%position or for% i-es a specialappearance to and can ser-e as pattern for an industrial product or handicraft.

(2 ntegrated Circuit %eans a product, in its final for%, or an inter%ediate for%, in &hich the ele%ents, at least one of &hich is an acti-e ele%ent and so%e or all of the interconnections areinterall$ for%ed in and/or on a piece of %aterial, and &hich is intended to perfor% an electronic function. and

(3 ayout#Design is s$non$%ous ith +oporaph$ and %eans the three*di%ensional disposition, ho&e-er epressed, of the ele%ents, at least one of &hich is an acti-e ele%ent, and of so%e orall of the i nterconnections of an interated circuit, or such a three*di%ensional disposition prepared for an interated circuit intended for %anufacture(

(S)C 113. Substantive Conditions$or Protection% * 1131 nl$ industrial desins that are ne& or orna%ental shall #enefit fro% protection under this !ct

(1132 Industrial desins dictated essentiall$ #$ technical or functional considerations to o#tain a technical result or those that are contrar$ to pu#lic order, health or %orals shall not #e protected

(1133 nl$ la$out *desins of interated circuits that are oriinal shall #enefit fro% protection under this !ct ! la$out*desin shall #e considered oriinal if it is the result of its creators o&nintellectual effort and is not co%%onplace a%on creators of la$out*desins and %anufacturers of interated circuits at the ti%e of i ts creation

(1134 ! la$out*desin consistin of a co%#ination of ele%ents and interconnections that are co%%onplace shall #e protected onl$ if the co%#ination, taen as a &hole, i s oriinal(

(S)C114 Contents of the &pplication% * 1141 )-er$ application for reistration of an industrial desin or la$out*desin shall contain'

(5a ! reuest for reistration of the industrial desin or la$out*desin.

(5# Infor%ation identif$in the applicant.

(5c !n indication of the ind of article of %anufacture or handicraft to &hich the industrial desin or la$out*desin shall #e applied.

(5d ! representation of the article of %anufacture or handicraft #$ &a$ of dra&ins, photoraphs or adeuate raphic representation of the industrial desin or of the la$out*desin as applied tothe article of %anufacture or handicraft &hich clearl$ and full$ discloses those features for &hich protection i s clai%ed. and

(5e +he na%e and address of the creator, or &here the applicant is not the creator, a state%ent indicatin the oriin of the riht to the industrial desin or la$out*desin reistration

(1142 +he application %a$ #e acco%panied #$ a speci%en of the article e%#od$in the industrial desin or la$out*desin and shall #e su#ect to the pa$%ent of the prescri#ed fee(

(S)C116 '(amination% * 1161 +he ffice shall accord as the filin date the date of r eceipt of the application containin indications allo&in the identit$ of the applicant to #e esta#lished and arepresentation of the article e%#od$in the industrial desin or the la$out *desin or a pictorial representation thereof

(1162 If the application does not %eet these reuire%ents, the filin date should #e that date &hen all the ele%ents specified in Sec 114 are filed or the %istaes corrected ther&ise, if thereuire%ents are not co%plied &ithin the prescri#ed period, the application shall #e considered &ithdra&n

(1163 !fter the application has #een accorded a filin date and the reuired fees paid on ti%e, the applicant shall co%pl$ &ith the reuire%ents of Sec 114 &ithin the prescri#ed period, other&isethe application shall #e considered &ithdra&n

(1164 +he ffice shall ea%ine &hether the industrial desin or la$out*desin co%plies &ith reuire%ents of Sec 112 5efinitions and Sec 113 5Su#stanti-e Conditions for :rotection(

(S)C 117" Registration% * 1171 here the ffice finds that the conditions referred to in Sec 113 are fulfilled, it shall order that reistration #e effected in the i ndustrial desin or la$out*desinreister and cause the issuance of an industrial desin or la$out*desin certificate of reistration. other&ise, it shall refuse t he application

( 1172 +he for% and contents of an i ndustrial desin or la$out*desin certificate shall #e esta#lished #$ the Reistrations' Provided! +hat the na%e and address of the creator shall #e %entionedin e-er$ case

( 1173 Reistration shall #e pu#lished in the for% and &ithin the period fied #$ the Reulations

( 1174 +he ffice shall record in the reister an$ chane in the identit$ of the proprietor of the i ndustrial desin or la$out desin or his representati-e, if proof thereof is furnished to i t ! fee shall#e paid, &ith the reuest to record the chane in the identit$ of the proprietor, if the fee is not paid, the reuest shall #e dee%ed not to ha-e #een filed In such case, the for%er proprietor and thefor%er representati-e shall re%ain su#ect to the ri hts and o#liations as pro-ided in this !ct

( 117; !n$one %a$ inspect the Reister and the files of reistered industrial desins or la$out*desins includin files of cancellation proceedins(

(S)C 118 The Term of ndustrial Design or ayout#Design Registration * 1181 +he reistration of an industrial desin shall #e for a period of fi-e 5; $ears fro% the filin date of the application

( 1182 +he reistration of an industrial desin %a$ #e rene&ed for not %ore than t&o 52 consecuti-e periods of fi-e 5; $ears each, #$ pa$in the rene&al fee

(1183 +he rene&al fee shall #e paid &ithin t&el-e 512 %onths precedin the epiration of the period of reistration

(1194 Rights Conferred to the )*ner of a ayout#Design Registration * +he o&ner of a la$out*desin reistration shall eno$ the follo&in rihts'

(51 to reproduce, &hether #$ incorporation in an interated circuit or other&ise, the reistered la$out*desin in its entiret$ or an$ part thereof, ecept the act of reproducin an$ part that does notco%pl$ &ith the reuire%ent of oriinalit$. and

(52 to sell or other&ise distri#ute for co%%ercial purposes the reistered la$out desin, an article or an interated circuit in &hich the reistered la$out*desin is incorporated

(119; imitations of ayout Rights * +he o&ner of a la$out desin has no ri ht to pre-ent third parties fro% reproducin, sellin or other&ise distri#utin for co%%ercial purposes the reisteredla$out*desin in the follo&in circu%stances'

(51 Reproduction of the reistered la$out*desin for pri-ate purposes or for the sole purpose of e-aluation, anal$sis, research or t eachin.

(52 here the act is perfor%ed in respect of a la$out*desin created on the #asis of such anal$sis or e-aluation and &hich is itself oriinal in the %eanin as pro-ided herein.

(53 here the act is perfor%ed in respect of a reistered la$*out*desin, or in respect of an interated circuit in &hich such a la$out*desin is incorporated, that has #een put on the %aret #$ or&ith the consent of the riht holder.

(54 In respect of an interated circuit &here the person perfor%in or orderin such an act did not no& and had no reasona#le round to no& &hen acuirin the interated circuit or the articleincorporatin such an interated circuit, that it incorporated an unla&full$ reproduced la$out*desin' Provided! ho*ever!+hat after the ti %e that such person has recei-ed sufficient notice that thela$out*desin &as unla&full$ reproduced, that person %a$ perfor% an$ of the said acts onl$ &ith respect to t he stoc on hand or ordered #efore such ti%e and shall #e lia#le to pa$ to the rihtholder a su% eui-alent to at least ;A of net sales or such other reasona#le ro$alt$ as &ould #e pa$a#le under a freel$ neotiated license in respect of such la$out*desin. or

(5; here the act is perfor%ed in respect of an identical la$out*desin &hich is oriinal and has #een created independentl$ #$ a third part$(

(S)C 120 Cancellation of Design Registration% * 1201 !t an$ ti%e durin the ter% of the industrial desin reistration, an$ person upon pa$%ent of the reuired fee, %a$ petition the irector of@eal !ffairs to cancel the industrial desin on an$ of the follo&in rounds'

(5a If t he su#ect %atter of the industrial desin is not reistera#le &ithin the ter%s of Sections 112 and 113.

(5# If the su#ect %atter is not ne&. or (5 c If the su#ect %atter of the industrial desin etends #e$ond the content of the applic1tion as oriinall$ filed

(1202 here the rounds for cancellation relate to a part of the industrial desin, cancellation %a$ #e effected to such etent onl$ +he restriction %a$ #e effected in the for% of an alteration ofthe effected features of the desin

(here the rounds for cancellation are esta#lished &ith respect onl$ to a part of the la$out*desin, onl$ the correspondin part of the reistration shall #e cancelled

(!n$ cancelled la$out*desin reistration or part thereof, shall #e rearded as null and -oid fro% the #einnin and %a$ #e epuned fro% the records of the Intellectual :ropert$ fficeReference to all cancelled la$out*desin reistration shall #e pu#lished in the I : Baette(

+e3tion #.mplementing Rules and Regulations% * +he Intellectual :ropert$ ffice %a$ i ssue Reulations prescri#in details for the i%ple%entation of this la& +he Reulations %a$, in particular, pro-ide for thepa$%ent of fees in connection &ith applications for the reistration of la$out*desins of interated circuits and %atters related thereto, includin !d%inistrati-e Instructions relatin to the procedures and otherfunctions of the responsi#le until dul$ desinated #$ the irector Beneral

+e3tion .&pplicability% * +he pro-isions of this !ct shall appl$ to la$out*desins of interated circuits that &ere co%%erciall$ eploited an$&here in the &orld fro% and after Danuar$ 1998 pro-ided the$ %eet theconditions for protection under this !ct

+e3tion 6.Repealing Clause% * !ll acts and parts of acts inconsistent here&ith are here#$ repealed or a%ended accordinl$

+e3tion 5.Separability Clause% * If an$ pro-ision of this !ct or the application of such pro-ision to an$ circu%stance is held in-alid, the r e%ainder of this !ct shall not #e affected there#$
