REPORT ON THE IMPLEMENTATION OF ARTICLE 66.2 OF THE TRIPS AGREEMENT

Addendum

The following communication, dated 29 January 2020, was received from the delegation of

the European Union.1 It reports on activities pursuant to paragraph 1 of the Decision on the Implementation of Article 66.2 of the TRIPS Agreement (IP/C/28) by the European Union, as well as certain of its Members. This document constitutes a new detailed report with information on the implementation of Article 66.2 of the TRIPS Agreement.

INTRODUCTION

1. This document is circulated in accordance with the Decision of the Council for TRIPS of 19 February 2003, according to which developed country Members shall submit annually reports on actions taken or planned in pursuance of their commitments under TRIPS Article 66.2 (incentives

provided to their enterprises or institutions for the purpose of promoting and encouraging technology transfer to least developed country Members).

2. As agreed in the Council for TRIPS, this document is a detailed report on technology transfer incentives put in place by the EU and its Members between July 2018 and August 2019.

Nature of incentive measure SaferAfrica has established of a Dialogue Platform between Africa and Europe focused on road

safety and traffic management issues. It represents a high-level body with the main objective of providing recommendations to update the African Road Safety Action Plan and the African

Road Safety Charter, as well as encouraging the Ref. Ares(2019)5148490 – 08 August 2019

two adoption of specific road safety initiatives. The activity of the Platform is also focussed on

the reinforcement of the endogenous African capabilities through the dissemination of the EU

knowhow. Twinning Programs will be set up, besides the conduction of different training

activities. Local context is taken into account. Studies on specific risk factors and transferability

analysis of measures already tested elsewhere will be carried out. The project fosters the

adoption of the "safe system" approach.

NExus in complex and trans-boundary water resources systems of fast-growing

developing countries

Objective or purpose Global trends in population growth and rising economic prosperity will increase the demand for

energy, food and water, with more severe impact in fast-growing economies, such as in several

African countries. The constraints on water, energy, and food could hamper economic

development, lead to social and geopolitical tensions, and cause lasting environmental

damage. DAFNE project advocates an integrated and adaptive water resources planning and management approach that explicitly addresses the water-energy-food nexus from a novel

participatory and multidisciplinary perspective.

Name of programme or project FLOWERED - de-FLuoridation technologies for improving quality of WatEr and agRo-

animal products along the East African Rift Valley in the context of aDaptation to

climate change

Objective or purpose The objective of the project is to contribute to the development of a sustainable water

management system in areas affected by fluoride contamination in water, soils and food in the

African Rift Valley countries (Ethiopia, Kenya, Tanzania), and thus to improve living standards

(environmental, health and food security) of its population.

Output or impact The major impact will be the generation of scientific knowledge on the extent of fluoride contamination of water and in the food chain and raising awareness in the African Rift Valley

Participation by local actors in the different joint actions will strengthen their innovation

capacity and the integration of new knowledge. The project will support the UN Sustainable

Development Goals.

Nature of incentive measure The project will determine suitable purification system sizes to suit typical locations, water

qualities, and water utilization patterns in Africa; design and construct demonstration system;

and build capacity in southern African countries through: - Strong involvement of local

communities and authorities (municipalities/water authorities) at the selected test sites, to

ensure community acceptance and participation, as well as assistance in the design of a

sustainable operating and business model at local level; and - Skills training to render a training

programme that provides qualified candidates to roll out the technological solution post

development, to ensure it is rapidly integrated into the targeted communities and rural

development areas.

Output or impact The technical developments in this project are expected to result in a broader positive socio-

economic impact in the rural and peri-urban areas of southern Africa. Access to safe water will

reduce health risks. The availability of safe water at the point-of-use will also increase the

freedom of those who are traditionally responsible for water supply, mainly women and

children. The project will contribute to the UN Sustainable Development Goals

Name of programme or project VicInAqua - Integrated aquaculture based on sustainable water recirculating system

for the Victoria Lake Basin

Nature of incentive measure VicInAqua will follow an integrated approach in order to develop a sustainable adapted

aquaculture fish pond system and simplified recirculation aquaculture systems combined with

a domestic sanitation system and agriculture activities for the Victoria Lake Basin. The project

will develop a novel and robust membrane bioreactor (MBR) system for a recirculating

aquaculture system (RAS), fish ponds and sanitation □ Development of a sustainable energy

supply system based on photovoltaics and biogas (generated from RAS sludge) which will be

integrated to the system for autonomous operation. A robust and low-cost real-time sensor

system based on wireless network monitoring will be developed and tested, which will contribute to the overall improvement of the aquaculture process. The R&D activities of

VicInAqua will be accompanied by Life Cycle Analysis studies in order to ensure affordability,

sustainability and environmental friendliness.

Financial implications Project Requested EC Contribution: EUR 2,997,710. Requested EC Contribution for LDC

country (Uganda): EUR 47,200.

Field of technology Wastewater treatment and reuse.


Output or impact The overall expected outcomes of the project include sound approaches to water management

for agriculture, taking into consideration broader socio-economic factors and also fomenting

job creation and greater gender balance in decision-making. The project will contribute to the UN Sustainable Development Goals.

Nature of incentive measure The project will develop a range of sustainable solar disinfection (SODIS) technologies.

Successful delivery of these technologies will require: - Complete assessment of physical and

chemical parameters for engineered systems to optimize disinfection; - An extended social

sciences programme that will build an integrated understanding of the social, political and economic context of water use and needs of specific communities; - Examination of the effect

of gender relations on uptake of solar water harvesting and SODIS reactor technologies; -

Exploration of relevant governance practices and decision-making capacity at local, national

and international level that impact the use of integrated solar technologies for point-of-use

drinking water treatment; - Determination of the feasibility and challenges faced at household,

community, regional and national level for the adoption of integrated solar technologies for

point-of-use drinking water treatment; and - Co-design community-led, gender sensitive,

educational and action programmes for the appropriate uptake of solar based technologies.

The overall aim is to transform access to safe drinking water through integrated social sciences, education and solar technologies.

Name of programme or project AfricanBioServices - Linking biodiversity, ecosystem functions and services in the

Great Serengeti-Mara Ecosystem (GSME) - drivers of change, causalities and

sustainable management strategies.

Objective or purpose The direct dependence of humans on ecosystem services is by far strongest in developing

regions where poverty restricts access to resources. This dependency also makes people in

developing countries more sensitive to climate change than their developed counterparts.

Increasing human populations deteriorates natural habitat, biodiversity and ecosystems services which spiral into poverty and low human welfare. This calls for innovative solutions

that encompass the entire socio-ecological-economic system, as recognized on a global scale

in the Millennium Ecosystem Assessment. Flow ever, innovative and practical solutions require

downscaling to regional levels for identifying concrete sets of drivers of change. For Africa

specifically, the interplay of human population growth, land use change, climate change and

human well-being is a major challenge. This project focuses on the Serengeti-Maasai Mara

Ecosystem and associated agricultural areas, a region in East Africa that encompasses parts

of Kenya and Tanzania. The ecosystem is world-famous for key aspects of its biodiversity, such

as the migration of 1.3 million wildebeest. This 'flagship ecosystem' role will enhance the

international interest in the project. In this project, internationally leading researchers from Norway, the Netherlands, Scotland, Denmark and Germany are teaming up with strong local

partners in Tanzania and Kenya.

Name of programme or project SWOS - Satellite-based Wetland Observation Service

Objective or purpose The objective of the project SWOS is to develop a monitoring and information service focussing

on wetland ecosystems. Globally wetlands are the ecosystems with the highest rate of loss.

This is alarming, considering their significance as biodiversity hotspots and ecosystems with a

central role in the water cycle, including improving water quality and reducing water scarcity,

in climate regulation and the economic benefit gained from using their services. A key limitation

to their more effective conservation, sustainable management and restoration is the missing

knowledge underpinning the application of European policy by Members. Under the Biodiversity

Strategy, Members have recently committed to the mapping and assessment of ecosystem

services (MAES); this provides a key instrument for an improved integration of wetlands in policy.

collection of data from the pilot sites in Mali, Senegal and Kenya, validation and ground

Nature of incentive measure SWOS will take full advantage of the Sentinel satellites and integrate results from the ESA

Globwetland projects. Status maps and indicators, as well as near real-time observations will

allow the assessment of biodiversity and the monitoring of dynamic changes in an unmatched

temporal and spatial resolution. The Service Portal will allow the integration and web-based

analysis of new maps and in-situ measurements and provide a unique entry point to locate,

access and connect existing information and databases. It follows a GEOSS compatible data-broker approach and adopts international standards.

Output or impact SWOS will improve the availability of data, knowledge, methods and tools for monitoring and

assessment of the status and trends of wetland ecosystems and their services and therefore

impact national, European and international reporting activities and the responsible

stakeholders within science, industry and policy making. SWOS and its services will raise public

awareness of the threats faced by Europe's wetlands as well as their key role in ecosystem service delivery and in sustainable water management in Europe and beyond. At the European

level, SWOS will develop a monitoring and information service for wetlands that will

complement the mapping and assessment of ecosystem services process and support the

consideration of wetlands in the implementation of key policy areas such as the Water

Framework Directive, the Flood Directive, Habitats and Birds Directives and the EU's climate

and energy policy. SWOS will position Europe in a leading role for the new wetland activities

within the GEO ecosystem, biodiversity, water, land cover and across tasks. This will support

the Commission and Members in assessing the status of wetlands in Europe and will respond

to the requirements of national and local environmental reporting obligations. At the global scale, SWOS will contribute significantly to improve the knowledge on wetlands and will create

a new capacity for monitoring these ecosystems at multiple scales contributing to the

establishment of a Global Wetland Observing System, as requested by the Ramsar Convention

on Wetlands. Furthermore, the direct involvement and project partnership with users working

at different scales and in different regions ensures the usability of project results at different

levels.

Objective or purpose The E-SHAPE proposal is driven by the need to develop operational EO services with and for

the users and to create a conducive environment whereby the strengths of Europe are exploited

towards addressing societal challenges, fostering entrepreneurship and supporting sustainable

development. The proposal objectives are 1) to develop operational EO services with and for

users active in key societal sectors; 2) to demonstrate the benefits of the EO pilots through

the coordinated downstream exploitation of EO data and the utilization of existing EO

resources; 3) to promote the uptake of pilots at national and international scale, across vertical markets (private and public) and amongst key user communities; 4) to enable the long-term

sustainability of the numerous pilots, their penetration in public and private markets and

support their upscaling; 5) to increase uptake by raising awareness on the solutions developed

through tailored and well-targeted communication, dissemination and outreach activities. The

proposal aims at setting-up and promoting a sustainable organization dedicated to users'

uptake of European EO resources, building on Copernicus and GEOSS through the development

of co-design pilots (i.e. application-oriented products, services or solutions) built on a user-

centric approach and delivering economic, social and policy value to European citizens. It has

also the ambition through the development of 27 pilots organized in seven showcases to deliver

information that will also contribute to the three GEO engagements (SDGs, Paris Agreement and Sendai Framework).

Name of programme or project FarFish: Responsive Results-Based Management and capacity building for EU

Sustainable Fisheries Partnership Agreement- and international water

Objective or purpose The objective of FarFish is to improve knowledge on and management of EU fisheries outside

Europe, while contributing to sustainability and long-term profitability. 21% of EU catches

originate from non-EU waters. These fisheries are often poorly regulated, management

decisions are sometimes based on limited knowledge and enforcement capabilities, compliance

and trust between stakeholders tend to lack. FarFish will address these shortcomings in a

multidisciplinary and innovative way by focusing on six diverse case studies, four in Sustainable Fisheries Partnership Agreement (SFPA) waters and two in international waters. Firstly, FarFish

will analyse biological, ecological, technological, economic, political and social impacts of EU

fisheries in the case studies to advance knowledge and promote sustainable and profitable

exploitation. Secondly, introduce Results-Based Management approaches and new decision

support tools into these fisheries and test their applicability in collaboration with stakeholders.

Thirdly, build capacities in fisheries management and related disciplines amongst stakeholders.

The results of FarFish will both have immediate and long-term application. FarFish includes a

diverse group of stakeholders, EU and third country fleets representatives, scientists, decision

makers, Regional Fisheries Management Organisations (RFMOs), relevant industries and

stakeholders from areas outside the case studies but of importance for the EU fleet, forming a platform for future cooperation between EU and third countries. FarFish addresses the work

programme by improving knowledge within the relevant fisheries, developing management

tools and models, improving professional skills and sharing new findings in correspondence to

the priorities of SFPAs, RFMOs and the CFP. FarFish will contribute to sustainable management,

resilience and efficiency in the seafood value chains, increase European food security, boost

long-term profitability and promote jobs.

Name of programme or project TRIATLAS - Tropical and South Atlantic climate-based marine ecosystem predictions

for sustainable management

Objective or purpose Sustainable management of human activities affecting Atlantic marine ecosystems is critical to

maintain its health and to support the blue economy of the bordering countries. TRIATLAS will

contribute to this by delivering knowledge of the current state and future changes of the

Atlantic marine ecosystems. We achieve this through a basin-wide approach integrating

research from the North and South, that closes critical knowledge gaps in the Tropical and

South Atlantic which impede an understanding of the entire basin. We bring together an interdisciplinary team of marine ecologists, physical oceanographers, climate researchers, and

social scientists from 34 different institutions in Europe, Africa, and South America, together

with multisectoral and regional stakeholders. We will enhance knowledge of the marine

ecosystems in key areas of the Atlantic using existing and pivotal new (physical, biological,

societal) observations. Earth system, ecological, and socio-economic models and observations

will be used to assess the cumulative impacts of (climatic, pollution, and fishing) pressures

driving fluctuations in the marine ecosystem, and the potential for tipping point behaviour and

regime shifts. We will develop the first predictions of the marine-ecosystem for the next 40

years for the whole Atlantic, by combining state-of-the-art climate prediction and ecosystem models, with Shared Socioeconomic Pathways, and by conducting socioeconomic vulnerability

assessments services, with stakeholder engagement. TRIATLAS will enhance capacity in

marine ecosystems, oceanography, and climate research in countries bordering the South and

Tropical Atlantic Ocean. There will be close cooperation and alignment with relevant European

Commission services and the South-South Framework for Scientific and Technical Cooperation,

as well as other relevant initiatives in the field. We will contribute to upscale cooperation around

the Atlantic.

Name of programme or project European Commission- DG EAC: Erasmus+

Nature of incentive measure Least developed countries feature as priority targets for certain actions such as the short-term

academic mobility for students, PhD candidates and staff (the top three academic disciplines

covered by partnerships with developing countries in Africa, Asia and Latin America are

business, engineering and economics). Furthermore, additional scholarships are reserved for

certain least developed countries for joint master programmes taught by consortia of European

universities, the additional scholarships awarded in this reporting period covered studies in

areas such as energy efficiency, gender studies, urban development, water and marine management. Regarding joint university projects, Erasmus+ Capacity Building Projects in

Higher Education focus on developing countries and benefit least developed countries. Such

projects are aimed at modernising and reforming higher education institutions, developing new

curricula, improving governance, and building relationships between higher education

institutions and enterprises. The most ambitious projects can also tackle policy topics and

issues, preparing the ground for higher education reform, in cooperation with national

authorities. The capacity-building projects are channelling university cooperation into

development goals, so each year the projects between them cover the topics of nearly all the

individual SDGs (smart buildings, boosting employability, increasing female participation in

STEM, etc.)

Financial implications Individual participants (i.e. students) are provided with scholarships and financial contributions

are provided to the organisations implementing the projects.

Objective or purpose The project aims to create the conditions for investment projects in the area of constructed

wetlands (CW) in Cambodia. These wetlands represent an economically, technologically as well

as aesthetically attractive alternative to standard mechanical and biological wastewater

treatment plants. Certain innovative improvements of the well-proven CW technology have been developed by the companies implementing the project making the wastewater treatment

more effective and manageable. The project seeks to improve sewage disposal in the rural

areas of Cambodia and improve the quality of both surface- and groundwater. The technology

is most suitable for the recreational facilities, smaller municipalities and industries and has a

wide potential in the country and beyond. The pilot project in Siem Reap province has been

completed in mid-2019 and handed over to the beneficiary.

Objective or purpose The aim of this project is to transfer an unique Environmental Multi-Stage Flash (EMSF)

technology to Mozambique in an area with extreme scarcity of freshwater supply for drinking

Objective or purpose Finnpartnership's mission is to increase commercial cooperation between Finland and developing countries. Finnpartnership provides advisory services for the business activities of

Finnish companies in developing countries, as well as financial support for the planning and

development phases of a project. Finnpartnership also offers a matchmaking service for

companies in developing countries for creating potential business partnerships with Finnish

companies. Finnfund is responsible for the management and implementation of the business

partnership programme on behalf of the Ministry for Foreign Affairs of Finland which finances

the programme.

Entity making the incentive available Finnfund is responsible for the management and implementation of the Finnpartnerhip business

partnership programme on behalf of the Ministry for Foreign Affairs of Finland which finances

Beneficiary enterprises or institutions The scheme is open to all companies in ODA eligible countries.

Nature of incentive measure Non-financial incentives: support to developing country companies identifying potential business partners in Finland via the Matchmaking service. Financial incentives to Finnish

companies & companies registered abroad with substantial links to Finland: Providing financial

support (Business Partnership Support) in the planning phase of the prospective business

partnership activities, as well as for the training of target country employees and other capacity

building activities in the implementation and business operation phases. In addition, financial

support is given for pilot projects with international organizations.

Financial implications The budget and funds for the Finnpartnership programme (including the financial support

granted through the programme) are decided by the Ministry for Foreign Affairs. The amount

of support granted also varies on the number of eligible applications received. From July 2018

to July 2019, a total of EUR 6.1 million of support was granted to a total of 94 projects. Majority

of the projects involve FDI or other activity involving transfer of technology or know-how.

Business Partnership Support Facility (the programme covers all sectors except the ones

and career development.

Financial implications In the 2018/19 financial year The MRC spent GBP 75.6 million on the described Global Health

Portfolio projects, of which approx. half relates to LDC. The Portfolio includes some awards

under the MRC-DfID concordat and through joint funding schemes where the research is

estimated to be worth between GBP 7 billion and GBP 17 billion a year. IWT threatens some of

the world's most iconic species, such as elephants and rhinos, with extinction; it damages

economic growth and sustainable development. It is fuelled by corruption and undermines

good governance and the rule of law. The UK government is committed to tackling the illegal

wildlife trade. The Illegal Wildlife Trade Challenge Fund provides financial support to practical projects around the world which help: • developing sustainable livelihoods and economic

development, to benefit people directly affected by IWT •strengthening law enforcement

•ensuring effective legal frameworks •reducing demand for IWT products.

International This project is contributing to reducing poaching and risks to security and livelihoods for local communities by equipping social media/e-commerce/ courier/ logistics

companies and law enforcement agencies with tools to break links between illegal wildlife

buyers and sellers, and through increasing enforcement and industry capacity in China, Viet

Nam, Cameroon and Tanzania. GBP 363,863.

supported and more professional park rangers. In some instances, small amounts of light

equipment (e.g. compasses, patrol bags and cookers) may be purchased for the benefit of the

rangers to ensure they have the minimum equipment necessary to complete the task. Training

is also given on effective radio operating.

Name of programme or project Africa Agri-Food Development Programme

Output or impact For African countries to move "beyond aid" they must increase their own trade and attract

investors. The development of business and agri-trade is a priority for many African countries

where the majority of the population live in rural areas and are dependent on farm incomes.

Many agricultural interventions have relied on increasing primary production of food and cash

crops without adequate investment in developing markets, infrastructure and the necessary

investment climate for business. There is broad consensus amongst development partners that

increased, local, regional and international trade will drive food production in developing countries. For investors, Africa still poses many difficulties. Many Irish investors perceive Africa

as a high-risk environment due to a combination of limited human resources, weak services

and fragile governance structures. In the Irish context, we recognize the benefits of

partnerships between private sector investors, development agencies and host governments.

The desirable outcome is investment, growth and trade that is inclusive (meaning it delivers

for the poor and/or marginalised groups), profitable and sustainable beyond the normal cycle

of development assistance programmes. The Irish agri-food sector can play a central role in

the development of agri-business in Africa by bringing a much-needed business perspective to

the sector, supported where possible by investment and mutually beneficial trade. Irish

expertise, both public and private, in areas such as animal health, food production, veterinary practice, food safety, agri-food business is well established and respected internationally.

These kinds of expertise represent a significant learning resource for the agri-food sector in

Developing Countries.

Status of the programme or project Other (A new call for applications opened in June 2019. Grants linked to this new call are to be disbursed in October/November 2019. It is planned that going forward there will be two calls

for applications a year, tentatively planned to take place in Q1 and Q3 of each year. As part of

the follow up to recommendations from an external review of Private Sector Engagement in

Ireland's development programming, a review of the AADP's scope, operating model and

management process is to be undertaken over the period September 2019 – February 2020).

programme's scope and management process will be undertaken following the recent

Output or impact COSECSA has graduated 346 qualified specialist surgeons since 2008. Through a train the

trainer approach, the programme has supported the standardisation of surgical training across

the region through the training and development of over 350 surgical trainers. Specific

technological innovations developed by the programme include: Development and

administration of an Africa-centric surgical e-learning platform. Creation of a bespoke surgical

electronic logbook which enhances COSECSA assessment and is the biggest dataset of African

surgical training operative information. Interactive e-learning tool for non-surgeon cadres

performing basic surgery and anaesthesia in Low- and Middle-Income Countries. Development of examination standard operating procedures, collaboration on delivery of various seminars,

exchange of examiners, and assistance in the establishment of a Court of Examiners. There

are currently 534 COSECSA trainee surgeons from East, Central and Southern Africa and there

are 118 accredited training hospitals Other key outcomes include: 83% retention rate for

graduates from 2014-2017; 35% of surgeons working in COSECSA region are COSECSA

members/fellows; 14% of graduates are women and 17% of trainees are women.

Objective or purpose Swedfund’s objective is to contribute to the goals of Sweden’s Policy for Global Development

by co-financing investments in the private sector which encourage economically,

environmentally and socially sustainable business in developing countries. Swedfund’s owner

instructions were updated at the AGM held in April 2017. Among other things, it was stated

that Swedfund shall only invest in renewable energy. Swedfund offers development capital in

the form of equity and loans to strategic partners wishing to establish or expand their

operations in target regions.

Entity making the incentive available Through the Ministry of Foreign Affairs, Sweden's government has assigned Swedfund to be

Sweden's development finance institution for investments in developing countries. From

January 2015 Swedfund is managed by Sweden's Ministry of Enterprise and Innovation.

Financial implications The allocated budget for the first call-off regarding the recently started Renewable Energy

programme is MSEK 19,7 with a possibility to call off yet another programme within the

framework agreement focusing on other countries.

Field of technology The technology transfer covers knowledge of renewable energy and its benefits for sustainable

development and poverty reduction, as well as increased knowledge of methods and tools for

renewable energy and energy efficiency.


Output or impact The programme has so far resulted in a number of locally arranged conferences and workshops in all six countries where specialists from LIFE Academy have participated as experts. The

participants have also developed change projects in which LIFE Academy specialists serve as

advisors and mentors. Identified Change Projects are Ethiopia: Increased access to modern

energy in rural areas. Kenya: Power storage for grid and stand-alone systems. Tanzania:

Technology transfer refers to the ways and means through which companies, individuals and organizations acquire technology or know-how from third parties, whether such technology is IPR-protected or not, including know-how. More often than not, technology transfer is one component of a complex project. LDCs acquiring a viable technological base depends on both the provision of technology or equipment and on acquisition of relevant know-how, management and production skills, improved access to knowledge sources.

This year’s report shows that Sweden, through Swedfund and the Renewable Energy Programme, take its commitments and obligations under Article 66.2 TRIPS seriously and makes efforts to put in place projects that incentivizes technology transfer to LDCs.

Specialized technical consultancy supports harmonization processes (standards) and the

approximation of technical regulations. This consultancy will be rendered especially within the scope of the – internationally binding – Technical Committees. Intercomparisons, proficiency

tests and peer reviews will be promoted as benchmarking procedures.
