This invoice is issued electronically with the use of data processing. You will find all relevant forms, templates and sample invoices, along with explanatory notes for your invoice, on our website at www.stadtwerke-hall.de. 1. The legal basis for energy and water supply is the law on electricity and gas supply (EnWG), the regulations on basic supply of electricity and gas (StromGVV and GasGVV), the regulations on low voltage and low pressure connections (NAV and NDAV) and the General Terms of Supply of District Heating and Water (AVBFernwärmeV and AVBWasserV) with their respective annexes. You may request the EnWG, the regulations, the General Terms and Conditions and information about drinking water quality and degree of hardness from us or download these documents from our website. By purchasing energy and water, the customer is deemed to recognise this legal basis.

2. For our customers on a pricing plan, meter readings and billing of consumption are normally performed once a year. When changing residence, a final invoice will be issued. The advance payments made during the billing period are credited towards the billing. When any amendment is made to a pricing plan, prices or value added tax, no meter reading will be made. Billing is performed pro rata temporis using what is referred to as the weighting tables.

3. According to our payment terms, payments due in invoices shall be payable within 14 days. After this, billing reminder charges may be added. If a billing reminder is unsuccessful, we reserve the right to cut off the supply of energy/water.

4. If you have provided us with a SEPA direct debit authorisation, please do not make any transfers. The amounts due will be collected directly by ourselves and any credit balance will be refunded by transfer.

5. Eleven monthly advance payments in the amount of one-twelfth of the estimated annual charges must be paid. The relevant due date can be seen on the invoice overleaf. On the specified payment dates, the advance payments will be either deducted from your account (SEPA direct debits) or must be transferred by you without any specific request. The amount of the advance payments is based on last billed consumption and is rounded off to the nearest full euro.

6. When moving home or if other changes take place, please inform us in writing, orally or by phone no later than 3 working days in advance. In the absence of notification, you may continue to be required to pay all costs due (even when incurred by third parties).

7. Objections regarding the correctness of the billing must be lodged at Stadtwerke Schwäbisch Hall GmbH only, within 14 days of delivery of the invoice. Lodging of a complaint will not normally result in any deferment of an obligation to make payment.

8. With reference to the Federal Data Protection Act, we inform you that we will save and process all personal data that is acquired in connection with the existing contractual relationship.

9. A reduced tax rate applies to our supply of natural gas. We are obligated to include the following statement in our invoices and to request attention to “tax-privileged energy production”. This natural gas may not be used as fuel unless such use is permitted under the Energy Tax Act or the Energy Tax Implementing Regulation. Any other use as a fuel may result in prosecution under taxation or criminal law. In case of doubt, please contact the central customs office for your area.”

10. In billing for natural gas, the gas volumes under operating conditions (Vb) (actual cubic metres, m³) for each time segment between two meter readings is converted to energy (kilowatt hours, kWh) using Worksheet G 685 on Gas Billing, published by the German Gas and Water Association (DVGW). This conversion is performed by multiplying the actual cubic metres (m³) by the billing calorific value under standard conditions (Hs,eff) and the correcting factor (Z). In 2015, the average calorific value (Hs,eff) of our natural gas was 11.280 kWh/m³. Because natural gas is a product of nature, fluctuations occur in composition and therefore also in energy content (calorific value). The correcting factor (Z) is significantly influenced by the geodetic elevation of the receiving point and the uniform effective pressure of 22 mbar. Due to stark differences in mean elevations in the areas that Stadtwerke Schwäbisch Hall supplies with natural gas (from 277 m to 480 m above sea level), these elevations are divided into the following 4 elevation zones as prescribed by the DVGW Worksheet G 685. A correcting factor is determined for each of these zones:

Standardised definitions pursuant to Section 40 para.6 of the EnWG

Advance payments: The advance payments constitute a partial payment or down payment on the energy supply already provided and will be credited towards the regular final bill. The amount of the advance payments is guided by expected energy consumption.

Reactive power:Reactive power is the portion of electrical energy that is not transformed into useful energy, but is used in generating electromagnetic and electrical fields. Reactive power is specified in kVArh. This power represents a load carried on the supply networks of network operators and when the thresholds of energy suppliers are exceeded, this energy will be absorbed by energy suppliers and discharged to network operators.

Renewable energy levy:The renewable energy levy supports power generation in systems with renewable energy transmission that benefit from credits under the Renewable Energy Act (EEG). These costs are passed on to all consumers under the Renewable Energy Act.

Basic charge: The basic charge covers costs not linked to consumption and normally consists of a fixed performance price and a transfer price (meter price).

Concession fee: Compensation for the local authority for use of public roadways for laying utility lines. The relevant concession fee is therefore passed on by the network operator and billed by the supplier.

Co-generation levy:Co-generation systems produce electricity and heat simultaneously. This achieves a higher level of plant utilisation that saves fuel and enables reductions to be achieved in carbon dioxide emissions. Operators of co-generation systems receive a surcharge that is determined by law. These costs are passed on to all consumers under the Co-Generation Act (KWKG).

Performance price:Energy suppliers bill an agreed performance price for the purchased performance (kW). Depending on the price terms, this is calculated either as the highest measured value for the year (annual performance price) or the highest value for a month (monthly performance price.

Point of supply: The place where the supply of electricity or gas takes place. Metering point operations Metering point operations include the installation, removal and operation as well as maintenance of meters. These costs will be billed by the network operator or metering point operator.

Metering services: Metering includes the calculation of energy consumption and the recording, administration and provision of meter data. These costs will be billed by the network operator or or metering point operator.

Network operator number: The network operator number serves as a unique identification for the local distribution network operator for the network that is connected to the point of supply.

Network usage charges: Payment for energy network operators to cover the costs of transport and distribution of energy and associated services.

Electricity labelling (energy mix): The electricity labelling prescribed in the Energy Industry Act (EnWG) provides information about the origin of the purchased electricity and its environmental impacts.

Electricity tax: The electricity tax is a legally stipulated consumption tax that since 1999 has been levied on the basis of the Ecological Tax Reform Act. The tax is levied on consumption or offtake from networks inside the German tax jurisdiction. The electricity tax is collected by the energy supplier and paid into the treasury.

Gas tax: The as tax is a legally stipulated consumption tax that since 1999 has been levied on the basis of the Ecological Tax Reform Act. The tax is levied on consumption or offtake from networks inside the German tax jurisdiction. The natural gas energy tax is collected by the energy supplier and paid into the treasury.

Consumption or usage charge:Energy consumption is indicated in kilowatt hours (kWh) for the relevant billing period.

Energy charge:The usage charge or energy charge indicates the price for one kilowatt hour of energy that is used.

Contract account: The master data for the customer, the particulars of the point of supply and all payment procedures pertaining to this point of supply is recorded in the contract account.

Metering point/designation of metering point: A metering point specifically designates the point of supply. This number is unique within the European energy network. The relevant metering data is recorded at the metering point. For designation of the metering point, the network operator is able to identify the exact location of the metering point and assign it to the meter. In contrast, meter serial numbers are not tied to any particular location, given that meters may be replaced.

Thermal gas billing: Natural gas is measured volumetrically, i.e. in cubic metres (m³). Operating volume is dependent on pressure and temperature. The natural gas measured in m³ is converted into kilowatt hours (kWh) so that it can be billed without the influences of pressure and temperature. For this purpose, consumption in m³ is multiplied by the correcting factor (Z number) and calorific value according to the accepted rules of calibration. The correcting factor is an adjustment to compensate for the effect of temperature and pressure. The calorific value indicates how much energy is contained in the natural gas.

Gas consumption: The consumption value in m³ is the gas usage measured volumetrically by the gas meter for each billing period.

Correcting factor: Temperature and pressure at the point of usage affect the energy content of the natural gas and allowance is made for this in thermal consumption billing with the use of what is referred to as the correcting factor.

Calorific value: Calorific value is always measured for the natural gas delivered in the Stadtwerke Schwäbisch Hall GmbH utility network. The weighted mean value derived for the billing period is used in thermal consumption billing.
