PRÉFACE AU CINQUIÈME VOLUME de

L'INTRODUCTION BIBLIOGRAPHIQUE A L'HISTOIRE DU DROIT

ET A L'ETHNOLOGIE JURIDIQUE

Les quelque cent vingt-cinq notices de l'Introduction bibliographique seront réparties en huit tomes (A, B, C, D ' , D", E ' , E " et F), sous couverture mobile. Le plan général de l'ouvrage est reproduit en tête de chaque tome.

Les notices sont publiées au fur et à mesure de leur achève­ment. Il en résulte que le cinquième volume remis aux sous­cripteurs comprend, comme les précédents, un certain nombre de notices destinées finalement à être réparties entre les huit tomes. H en sera de même des autres volumes. Il appartient aux souscripteurs de reclasser ces notices dans l'ordre systé­matique du plan général, lorsque la publication sera achevée.

Chaque notice est numérotée par une lettre et un nombre ; la lettre correspond au tome dans lequel la notice devra être classée; le nombre sert au classement dans chaque tome.

Quelques modifications ont dû être opérées dans ce domaine du fait de l'importance prise par certaines notices. C'est ainsi que les notices F 21, F 22 et F 26 sont devenues E 18, E 19 et E 19bis.

La table des noms d'auteur et la table alphabétique des matières paraîtront au moment où toutes les notices d'un tome auront été imprimées.

PREFACE TO PART V of the

BIBLIOGRAPHICAL INTRODUCTION TO LEGAL HISTORY AND ETHNOLOGY

The sections of this Bibliographical Introdtiction, which will be about hundred and twenty-five in number, will be divided over eight volumes (A, B, C, D ' , D", E ' , E " and F) under removable covers. The gênerai plan of the work is printed at the beginning of each volume.

The sections dealing with various countries or periods, are pubUshed as they are ready. Thus this f i f th part to be sent to the subscribers contains, just as the others, several sections which will ultimately be divided over the eight volumes. The same apphes to the other parts. I t will be left to the subscribers to re-arrange the sections in the order of the gênerai plan after publication of the complète work.

The sections are indicated by letters and numbers ; the let-ter indicates the volume, the number the place of the section within the volume.

Some changes have had to occur in this instance due to the far greater length taken by various sections. The sections F 21, F 22 and F 26 became E 18, E 19 and E 19bis.

The list of authors and the table of contents wiU be pub-lished as soon as ail sections of a given volume are printed.

INTRODUCTION

This Bibliographical Introduction to Légal History and Ethnology is intented to provide up - to - date bibliographical information for légal historians, historians, jurists, ethnologists and sociologists on the varions aspects of the évolution of law throughout the world. I t is not intented to replace the numerous specialised bibliographies to which specialists must continue to refer. But, at a moment when comparative stu-dies are undertaken in various branches of légal history and ethnology, it seems désirable to provide information on the sources and basic works for those who wish to extend their speciality.

The Bibliographical Introduction is therefore a sélective bibliography giving the most important, and above ail, the most récent works in each field; référence is made at the head of each section to existing exhaustive bibliographies.

The widest possible chronological and geographical frame-work has been adopted : the évolution of law and institutions in the five continents, from their origins to the présent day. I t has been inspired by the work of the Société Jean Bodin pour l'histoire comparative des institutions which for thirty years has encouraged the comparative study of institutional history at ail times throughout the world.

Within this framework, légal ethnology which concerns the law of peoples to whom writing was unknown, has been given an important place. Such studies may help towards an understanding of what is termed the "pre - history of law". In a few cases, a spécial section has been devoted to colonial law; but in most cases, specially for Africa, it has been dealt with at the same time as the légal ethnology of the présent day States.

The Bibliographical Introduction will include about a hun-dred and twenty five sections. We have sought, and often obtained, the collaboration of the best specialists for each period, country or région. We hope that they will accept our thanks for the time and care they have given to a work which

Elle ne tend pas à remplacer les nombreuses bibliographies spécialisées auxquelles les spécialistes doivent continuer à avoir recours. Mais, au moment où les études comparatives se développent dans les divers domaines de l'histoire et de l'ethnologie juridiques, il a paru utile de rendre les sources et les ouvrages de base plus aisément accessibles à ceux qui désirent étendre le champ de leurs recherches en dehors de leur spécialité.

'L'Introduction bibliographique est donc une bibliographie sélective, donnant pour chaque problème les ouvrages les plus importants et surtout les plus récents ; il est renvoyé au début de chaque notice aux bibliographies exhaustives qui existent.

Nous avons adopté le cadre chronologique et géographique le plus vaste possible, à savoir l'évolution du droit et des insti­tutions dans les cinq continents, depuis les origines jusqu'à nos jours. Nous nous sommes inspirés du cadre des travaux de la « Société Jean Bodin pour l'histoire comparative des institutions », qui depuis plus de trente ans tend à promouvoir l'étude comparée de l'évolution historique d'institutions données, à toutes les époques et dans toutes les parties du monde.

Une place importante a été réservée à l'ethnologie juridi­que, qui s'occupe du droit des peuples sans écriture; l 'étude de ce droit peut contribuer à faire mieux connaître ce qu'on peut appeller la « préhistoire du droit ». Dans quelques cas, le droit de la période coloniale a fait l 'objet d'une notice à par t ; le plus souvent, surtout pour l'Afrique, il a été traité en même temps que l'ethnologie juridique, dans le cadre des États actuels.

'L'Introduction bibliographique comprendra environ cent vingt-cinq notices. Nous avons recherché, et très souvent obtenu, la collaboration des meilleurs spécialistes pour chaque

— a list of the chief periodicals and sériai publications in which studies on the légal development of the relevant period or région may be found;

— the most important collections of légal sources : législation, — légal practice, law reports, customs, jurisprudence etc.; — the most récent and important historical works on varions

aspects of law derived from the accepted modem classical divisions : public law, criminal law, private law, procédure, etc.

The plan proposed to collaborators may be seen below (p. XVI). There is a summary at the beginning of each section. Obviously each author has adapted the plan according to his own needs.

Alphabetical lists of authors and matters will be published at the end of each volume, for ail the sections of that volume.

Chaque notice commence par une brève introduction desti­née à donner des indications très générales sur la période ou la région étudiée (cadre géographique et chronologique, éven­tuellement subdivisions chronologiques, renvois aux notices connexes, relevé des institutions de recherche). Elle comprend ensuite : — un relevé aussi complet que possible des répertoires

bibliographiques ; — la référence aux ouvrages généraux d'histoire du droit ou

d'ethnologie juridique et en outre à quelques ouvrages récents d'histoire générale de la période ou du pays étudié ;

— la liste des principales publications périodiques dans les­quelles paraissent des études relatives à l'évolution du droit de la période ou de la région ;

— les principaux recueils de sources du droit : législation, coutume, jurisprudence, doctrine, etc.;

— les travaux historiques les plus importants et les plus récents sur les divers aspects du droit, classés selon la subdivision classique du droit moderne : droit public, droit pénal, droit privé, procédure, etc.

Le plan-type des notices, tel qu'il a été proposé aux colla­borateurs, est reproduit ci-après (p. XVII). On trouvera un sommaire au début de chaque notice. Il va de soi que chaque auteur a dû adapter le plan-type aux particularités de la notice qu'il a rédigée.

Une table des noms d'auteurs et une table alphabétique des matières sera jointe à chaque tome ; elles seront communes à toutes les notices du tome.
