uccess in business is like auto racing, and I dare say it's a wild ride...every day – it's about speed, staying on course, out-maneuvering the competition and getting across the finish line.

In a fast paced environment, the Metro Chamber helps you work the controls and keep an eye on the dashboard by providing resources and programs, and engaging in government advocacy to advance important issues and protect the business environment.

This year, the Metro Chamber stepped up a gear or two to create new resources and opportunities for our members. We introduced several savings programs to help you – and your employees – save money on everyday business expenses, like shipping, office supplies, computers and software, email and social media marketing, mobile websites, credit card processing, legal and identity theft services, rental cars, and more. We realize that every dollar saved is invested back in your business, your employees and the community, and we want you to actualize these savings. But that’s not all. You asked us for more resources, expertise and new ways to help speed your way to growth. Our new Chamber University webinars give you free expert advice so that you can get ahead of new regulations, business trends and information you need to run your business – all while staying behind the wheel. We also introduced the Small Business Resource Center at LVChamber.com, giving you a one-stop place for business information, important links and helpful articles. And we accelerated efforts to help our members do more business with the government by introducing procurement lounges at Business Expo and Preview Las Vegas, holding a lunch and learn session with NASA and its prime subcontractors

and a full-day Focus Las Vegas session on how to do business with the military. Hundreds of members met with procurement representatives of local, state and federal agencies, as well as private entities, to help them get the contracts that can really make a difference to their business’ bottom line.

We were also engaged at every level of government, pushing for action when we see an opening while maintaining traction. The Metro Chamber’s government affairs engine was tuned up and tested constantly and tirelessly throughout the year at local, state and federal levels, working to protect and support businesses on a bipartisan basis. During the legislative session, the Metro Chamber was on course in Carson City every day, tracking 352 bills and testifying on 109. We worked with legislators, community leaders and other business organizations to protect small business and advance opportunities for job creation and economic growth.

But the Metro Chamber is not an organization to pause at the pit stop any longer than necessary to refuel. As we prepare for 2016, we are hard at work planning and executing even more ways for you to save money, get business done and take advantage of new business opportunities. We have new ideas for how you can get more engaged with us and the community through new programs and events, and forging partnerships to create a brighter future for our community.

NV Energy Launches Business Solutions Center to Meet Needs of Growing Customer Base NV Energy’s business customers now have a customer service center to call their own. The company recently launched its Business Solutions Center, staffed with a team of specialized contact center agents dedicated to meeting the unique needs of business customers. In addition to knowledgeable contact center agents, the Business Solutions Center will offer value-added online services, including a complete set of communication tools, content resources and administrative assistance. The Metro Chamber hosted a summit on K-12 education in conjunction with the U.S. Chamber of Commerce Foundation. The half-day symposium brought together education experts from throughout the United States, community stakeholders and business leaders for an in depth discussion on improving K-12 education in Nevada to better prepare our workforce for the needs of today and tomorrow’s employers, as well as the technical skills required for future jobs.

Cheryl Oldham, vice president of education policy at the U.S. Chamber of Commerce Foundation, kicked off the day with an in-depth discussion of where Nevada stands among other states with respect to national education trends. While consistently underperforming, Nevada is taking steps to improve results and outcomes for K-12 students.

Pat Skorkowsky, superintendent of the Clark County School District, delved into the Clark County

School District’s “Pledge of Achievement” action plan: increasing third-grade literacy, decreasing achievement gaps, increasing the graduation rate, increasing family engagement, increasing student safety and happiness, and increasing participation in both career and technical education, as well as the importance of Advanced Placement classes in college preparation and post-secondary achievement.

Dr. Magdalena Martinez, director of education programs at the Lincy Institute, discussed Nevada jobs and students' career and college aspirations with an eye to STEM careers. As a major component to skill sets required for jobs and an increasing concern with the skill gaps in the current workforce, STEM education is an area of significant opportunity for the state.

Dr. Steve Canavero, interim superintendent of public instruction for the Nevada Department of Education, detailed standards and

assessments as they relate to job creation and workforce needs.

Dale Erquiaga, chief strategy officer for the Office of the Governor, finished the half-day program with an intensive recap of Nevada’s education reforms implemented during the 2015 legislative session and how Nevada's education system must align with needs of current employers, as well as prepare students to handle the jobs of the future.

COMMERCE TAX WORKSHOP: INFORMATION NEVADA BUSINESS OWNERS NEED TO KNOW

The Nevada Department of Taxation is conducting a workshop on Monday, December 7, at 10:30 a.m. to gather comments from Nevada businesses about possible regulations associated with the implementation, administration and collection of the Nevada Commerce Tax.

The workshop will be hosted at the Silver State Exchange offices in Carson City and Henderson, which are located at 2310 S. Carson Street. Ste. 2, Carson City and 150 N. Stephanie Street, Henderson. The workshop will not be broadcasted via the web. Members are encouraged to review the regulations and attend the workshop.

The proposed regulations are available for review at http://tax.state.nv.us.

The Nevada Commerce Tax, which was approved by the 2015 Legislature and signed into law by Governor Sandoval, took effect on July 1, and affects businesses with $4 million or more in annual gross revenues. As outlined by Senate Bill 483, the Nevada Department of Taxation will be responsible for the implementation and collection of the Nevada Commerce Tax. The regulations will require approval by the Nevada Tax Commission.

The Metro Chamber has also developed online resources regarding the new tax laws, which are available at LVChamber.com. PARTICIPATE IN THE DOWNTOWN MASTER PLAN PROCESS

The City of Las Vegas is embarking on a community-based master planning effort for Downtown Las Vegas. As part of the community engagement process, the City has engaged with hundreds of Downtown stakeholders, including businesses, residents, community members, employers and employees. This engagement has brought forth a vision for the future of Downtown Las Vegas, referred to as “The Legend Reinvented.”

Metro Chamber members are encouraged to participate in the Downtown Master Plan process by accessing an online open house, study area, vision, comment section and other online tools items provided by the City of Las Vegas. More information is available at visionlv.com.

The Metro Chamber, in partnership with the Las Vegas Convention and Visitors Authority, welcomed more than 200 customer service stars to the annual Customer Service Excellence Luncheon at The Orleans Hotel & Casino. During the program, employees who had been recognized multiple times throughout the year were given special thanks, and prizes were awarded. The Customer Service Excellence Person of the Year Award was presented to Michael Baker, of Carmine’s NYC inside the Forum Shops at Caesars.

INDIVIDUAL/FAMILY COVERAGE

Everyone who purchased an individual health plan in 2015 should have received notification by mail or email letting them know whether their current plan is available or changing in 2016. The new premium amount should be included in this letter, along with instructions about how to compare, change or keep the plan. In most instances, when nothing is done, the insured person is automatically re-enrolled in the same plan (or a similar plan when the current plan is no longer offered) to which they are currently subscribed. This automated process prevents any gap in coverage.

It is wise to review the new plans

and pricing for 2016. It is crucial to update income and household information for the coming year, based on information expected for 2016, to avoid potential tax penalties. Many Americans were required to pay back money received in subsidies during the previous year simply because they underestimated their annual income. Be sure to report household income and demographics conservatively and accurately.

Individuals without health insurance who do not qualify for an exemption face an increased penalty in 2016. The fee is calculated in two different ways – either as a percentage of household income or per person. These individuals will be charged the higher of either 2.5 percent of household income or $695 per adult and $347.50 per child under 18, with a maximum allowable penalty of $2,085.

GROUP COVERAGE

Employers with 50 or more full-time employees are required to offer health insurance benefits considered affordable under the law. Affordable coverage is defined as the employee’s share of the premium for the lowest priced plan available

to cover the employee only, not the employee’s family, to be 9.5 percent or less of household income. Employees offered coverage from their employer that is deemed affordable and provides minimum value are not eligible for a premium tax credit if they buy a plan through a health insurance marketplace.

If an employer who is obligated to provide health insurance to his employees fails to do so and just one employee receives a premium tax credit or cost sharing subsidy through an exchange, the penalty is – at minimum – $2,000 annually, multiplied by the number of full-time employees, minus 30. The penalty is increased each year by the growth in insurance premiums.

If any employee has to pay more than 9.5 percent of family income for the employer coverage, they can choose to buy coverage in an exchange and receive a premium tax credit. If this is done, the penalty to the employer is $3,000 annually for each full-time employee receiving a tax credit, up to a maximum of $2,000 multiplied by the number of fulltime employees, minus 30. The penalty is increased each year by the growth in insurance premiums.

Year after year, tax professionals and business owners alike wait until December (or even later) for the decision to extend tax incentives that we have become familiar with, used to, and quite frankly, expect.

As a business owner, it is difficult to manage cash flow when you don’t know how much tax you will be expected to pay next spring. Take, for example, a planned acquisition of equipment with a purchase price of $400,000. As the statutes currently exist, we would be able to depreciate $57,160 if this was a seven-year asset. That is a little less than 15 percent of the total cost of the asset. If, however, the tax incentives are extended, it is possible that the whole cost of the equipment may be depreciated in year one under the Code Section 179 rules. Wouldn’t it be easier to plan for cash flow if you are going to be allowed a deduction of $57,160 or $400,000? At a tax rate of 35 percent, that is a difference of approximately $120,000 in tax.

In total, there are 51 provisions that lawmakers will decide to keep or end. But briefly, we have two very taxpayer-friendly expensing provisions that allow expensing of fixed asset purchases: Section 179 deduction and Bonus Depreciation.

SECTION 179 DEDUCTION

Currently, businesses can expense up to $25,000 of business assets put in service in 2015 subject to

a phase-out if total fixed asset additions exceed $200,000. If the tax incentives are extended, the expense limit rises to $500,000 and the phase-out starts at $2,000,000. That is a 2,000 percent increase in the expense limit.

BONUS DEPRECIATION

As of this article’s author date, Bonus Depreciation has expired and there is no benefit. The expected extension of the tax incentive would allow writing off 50 percent of the cost of new assets placed in service in 2015 with a useful life of 20 years or less. In addition to the first year write-off, you get the normal depreciation available for the remaining 50 percent. For a five-year asset, that is 20 percent for the first year for a total write off of 60 percent (20 percent of the remaining 50 percent which is 10 percent, plus the 50 percent bonus).

These two expensing provisions tend to apply to most businesses and provide the biggest savings to the bottom line.

OTHER PLANNING TIPS

Try to estimate what your 2015 taxable income looks like compared to what you expect for 2016. If you have more taxable income and therefore will be in a higher bracket in 2015, try to accelerate deductions and defer income. Of course, the opposite is true if you expect 2016 to have more income. This applies

to your personal taxes, as well. If you want to make a large charitable contribution, do it in the year that your tax rate is higher in order to get the largest deduction.

Take a look at your compensation before you close out 2015. Will your compensation level allow you to maximize your retirement contributions? You might want to pay yourself a bonus to reach the level of compensation you need for pension contributions but you may also want a bonus to play catch-up with under-withholding of income tax. Withheld tax is deemed paid ratably throughout the tax year and year-end bonus withholding could save you from estimated tax underpayment penalties.

If you don’t use a payroll service, you may want to start now. The Affordable Care Act reporting requirements are starting with steep penalties for failure to report. Check with your payroll provider to see if they can assist you in filing the new forms.

There are new filing deadlines for tax year 2016 (2017 filing season). Partnerships are due on March 15, instead of April 15. Regular C-corporations are due April 15, instead of March 15. There are other due date changes and it is best to check with your tax professional to see what other forms and extended due dates have changed.

In March 2014, President Obama directed the United States Department of Labor (DOL) to update the regulations defining which employees qualify for the “white collar” exemptions from the Fair Labor Standards Act’s minimum wage and overtime requirements. On July 6, 2015, the DOL issued proposed regulations, under which the minimum weekly salary for exempt employees will rise from the current $455 to a likely $970 in 2016. The comment period closed in early September 2015, and the DOL is expected to announce its final regulations sometime in 2016.

SALARY LEVEL WOULD AUTOMATICALLY ADJUST ON AN ANNUAL BASIS

Under its proposed regulations, the DOL set the salary threshold for the white collar exemptions at the 40th percentile of weekly earnings for full-time salaried workers nationwide. For 2013, using data from the Bureau of Labor Statistics, that figure was $921 per week, or $47,892 per year. The DOL anticipates that when its Final Rule goes into effect in 2016, the salary level will increase to $970 per week, or $50,440 per year.

To maintain the salary levels at a fixed percentile of earnings, the DOL proposed that the salary threshold automatically update annually. The automatic adjustment is intended

to prevent the salary level from diminishing through inflation and to potentially make additional rulemaking adjusting the salary basis unnecessary. The DOL believes that this will provide more certainty to employers with a meaningful, bright-line test while improving government efficiency.

HIGHLY COMPENSATED EMPLOYEE EXEMPTION: $122,148 SALARY

The current exemption for highly compensated employees requires, among other things, a total annual compensation of $100,000 or more. The DOL proposed to raise that compensation threshold also based on an annualized value of a percentile of weekly earnings for full-time salaried workers. This proposal set the total compensation level of highly-compensated employees at the 90th percentile, which was $122,148 per year for 2013. That number will likely increase by the time the Final Rule goes into effect. This total compensation requirement would also adjust automatically to the level equal to the 90th percentile of earnings for full-time salaried workers.

NO PROPOSED CHANGES TO DUTIES REQUIREMENTS

Believing that a rise in the salary level will provide an initial bright-line

test for the exemptions, the DOL refrained from proposing changes to the duties tests, but indicated it would consider requests for changes during the comment period. At this time, it is unclear whether the Final Rule will include amendments to the duties requirements.

NONDISCRETIONARY BONUSES MAY BE INCLUDED IN SALARY LEVEL REQUIREMENT

In the past, the DOL has not included nondiscretionary bonus payments when determining whether an employee’s salary meets the white collar exemption threshold; it looked only at actual salary or fee payments made to employees. In its proposed rules, the DOL sought input on whether it should permit nondiscretionary bonuses and incentive payments (e.g., those tied to productivity and profitability) to count toward a portion of the standard salary level requirement for the executive, administrative and professional exemptions. (Currently, those kinds of payments are only considered with respect to the total compensation received by highly compensated employees.) The DOL states, however, that for these bonuses or incentive payments to count toward the weekly salary requirement, the bonuses and incentive payments would need to be paid monthly or more frequently, not as a yearly “catch-up” payment.

Looking for a new customer with billions in buying power? Taking advantage of opportunities to do business with the federal government can truly boost your bottom line. In fiscal year 2014, the federal government awarded $91.7 billion in federal contracts to small businesses, or 24.99 percent – the highest percentage of contracting dollars awarded to small businesses since the 23 percent goal was established in 1997. Locally, contracts ranging from janitorial services to construction, consumer goods and consulting services are up for grabs in the coming year. Here’s how to get ready to competitively bid for contracting opportunities in 2016:

HOW DO YOU QUALIFY?

Visit sba.gov to ensure that your company can be classified as a small business. You will need to be sure your North American Industry Classification System (NAICS) codes are up-to-date and reflect your business. You’ll also need to obtain your Dun & Bradstreet (or D-U-N-S) Number, a unique nine-digit identification number for each physical location of your business, as well as register with the System of Award Management (SAM). Based on other factors, you may also qualify to receive other certifications – like female or minority ownership, HUBZone location, and veteran status – that may improve your business’ competitiveness with public and private contracts.

DO YOUR HOMEWORK

Contracting opportunities require a lot of research, but have the potential to yield big numbers to your bottom line. It is a good idea to do some digging into which agencies have initiatives or niche opportunities that fit your business’ products and services. To track invitations for bidding for public entities, websites like USAspending.gov and FedBizOpps.gov can assist in your efforts.

WATCH FOR EVENTS AND OPPORTUNITIES

The Metro Chamber has procurement lounges at Preview Las Vegas and Business Expo, and will hold procurement-focused events for small businesses throughout the year. Subscribing to emails from the Nevada Procurement Technical Assistance Center (PTAC) and the Small Business Administration, as well as keeping an eye out for private sector contracting events, can also help connect you to the right people in organizations and entities.

DON’T BE AFRAID TO ASK FOR HELP

The General Services Agency (GSA) Mentor-Protégé Program connects small firms with more experienced ones in the contracting field, with the objective of motivating larger companies to extend their expertise to smaller, less experienced

businesses. The SBA also offers a mentor-protégé program to socially and economically disadvantaged businesses that qualify for its 8(a) program. The Department of Defense and about a dozen civilian agencies offer these types of programs, as well.

There are several resources on getting started breaking into and growing your influence in contracting. The SBA offers a Government Contracting Classroom, contracting guides and blogs about the topic, and several national and local websites offer assistance, knowledge bases and resources. When Holidays Go Humbug

he holidays can be a festive, celebratory time around the workplace. They can also mean increased business and stress, seasonal workers who may not be familiar with a business’ safety policies, and holiday parties that carry a liability factor

for management. Here are some common HR scenarios seen around the holidays, and how to navigate them without getting a legal lump of coal in your stocking.

Promote Safety – With increased amount of cash and inventory on hand, the holidays are an easy target for thieves and scam artists. Be sure your employees are trained on how to enter and exit the building safely, understand proper cash handling, recognize suspicious behavior in your business and know basic crisis management. Even a simple “walk out with a buddy” policy can be effective in preventing a crime against your employees and your business.

TTemporary Workers – With increased business around the holidays, some businesses hire seasonal staff members to accommodate the influx of customers. Be sure that any seasonal team members know safety procedures for your business, including exiting the building after dark, cash handling procedures, the location of panic buttons and emergency exits, as well as what to do if a robbery or workplace accident occurs. Even something as simple as knowing the location of the first aid kit can make a big difference in the event of an emergency.

The Annual Company Holiday Party – The key is communication, as well as understanding your organization’s responsibilities. When possible, hold events at restaurants or locations not operated by the employer, and not during regular business hours. If you are planning on serving alcohol, designate a monitor to be sure that impaired employees do not drive themselves home. It may also be a good idea to limit the availability and consumption of alcohol by having drink tickets or an open bar during a set period of time. It is also important to remind employees that work rules regarding appropriate behavior, harassment and workplace conduct are still upheld during the holiday function, and violators will be subject to disciplinary measures.

Other ways to help control your business’ liability and offset any risks include making the party voluntary, inviting spouses, serving plenty of food and non-alcoholic beverages, and distributing your company’s

harassment policy before the party. Managers should also be trained and set the standard of behavior for other employees during the celebration.

Decorations – Hanging festive décor can be a great way of engaging employees in the holiday spirit. It is important to remember, however, that decorations cannot be attached to or limit the visibility or use of fire alarms, fire extinguishers or first response equipment, including emergency exit signage. Do not hang or place decorations in any hallway or stairwell door. You may also want to specify that any materials should be fire resistant, and not placed near any electrical outlets or devices, or near any heat sources.

By following these basic standards for enjoying the holiday season, as well as common sense principles of safety and management, your business – and your employees – can enjoy a fruitful, productive and profitable holiday.

he Southern Nevada Business Confidence Index, constructed by the Center for Business and Economic Reseaarch

at UNLV, fell from 126.7 in the third quarter to 122.6 in the fourth quarter of 2015. Despite the decline, survey respondents (which included Metro Chamber members) remain optimistic about Southern Nevada’s economy, indicated by a positive shift from a year ago, when the Index was 106.8. The number also represents the highest fourth quarter value since 2008.

Respondents were also more optimistic about Southern Nevada’s economic conditions than the U.S. economy as a whole. When asked about the U.S. economy, 40.1 percent of respondents expected an improvement. In regards to Nevada’s economy, 51.5 percent of respondents forecasted an improvement.
