BE IT ENACTED by the Queen's Most Excellent Majesty by and withthe advice and consent of the National Assembly of Saint Christopher and Nevis.and by the authority of the same as follows:

I (1) This Act may be cited as the International Trade in WildFauna and Flora Act. 2009.

(2) This Act shall come into operation on such date as theMinister may, by Order, appoint.

2. In this Act. unless the context otherwise requires,

"Appendices to CITES" means the Appendices to CITES asset out in the Schedule and a reference to any appendixshall be construed accordingly;

"artificially propagated" in relation to plants means plantsgrown from seeds, cuttings, callus tissues, spores orother propagules under controlled conditions includingparts or derivatives of such offspring;

"captivity bred" in relation to fauna or flora means offspringof fauna or flora including eggs born or otherwiseproduced in a clinical or controlled environment ofparentsthat mated or otherwise transmitted their gametes in acontrolled environment including parts and derivativesof such offspring:

"certificate ofartificial propagation" means the certificate ofartificial propagation issued pursuant to section 21 ;

"certificate of captive-breeding" means the certificate ofcaptive breeding issued pursuant to section 21;

"certificate ofintroduction from thesea" means a certificate ofintroduction from the sea issued pursuant to section 21;

"certificate of origin" means the certificate of origin issuedpursuant to section 23;

"certificate of sale" means the certificate of sale issuedpursuant to section 21;

"certificate of possession" means a certificate of possessionissued pursuant to section 21;

"CITES"" means the Convention on International Trade inEndangered Species ofWild Fauna and Flora. concludedin Washington D.C. on 3rd March, 1973, and anyamendments to. or substitutions of. thatConvention thatare, or wiU become, binding on Saint Christopher aodNevis;

"CITES Secretariat" means the CITES Secretariat referred toinArticle XII ofCITES;

"controlled environment" means

(a) in relation10an animal or animal reproductive material,an enviromnent which

(i) is manipnlated for the purpose of producing aselected species of animal or animalreproductivematerial;

(ii) has boundaries designed 10 prevent the entry,departure, introduction orremovalofanimalsoranimal reproductive materials;

(iii) includes facilities such as artificial housing,waste removal, health care. protection frompredators and artificial fond supply; or

(i,") is managed in a manner designed to maintainthe breeding stock indefinitely:

(bJ in relation to plants, an environment which

(I) is manipulated for the purposes of producing

selected hvbrid species (If plants or plantreproductnve material:

(ii) includes tillage, fertilization, weed control,irrigation or nursery operations, includingpotting, bedding or protection from weather; or

(iii) is managed in a manner designed to maintainthe breeding stock indefinitely;

"country oforigin" in relation to a specimen means the countrywhich is party to CITES and from which a specimen hasbeen taken from the wild, born or bred in captivity,artificially propagated or introduced from the sea:

"export" in relation to a specimen means to take a specimenout ofanyplace under the jurisdiction ofSaint Christopherand Nevis;

"export permit" means an export pcrnut issued pursuant tosection 21;

"import" in celation to specimen means to land or attempt to

land, bring into or cause 10 be brought into or theintroduction into any place of a specimen subject to thejurisdiction ofSaint Christopher and Nevis otherwise thanin transit or by transhipment;

"import permit" means an import permit issued pursuant tosection 21;

"international trade" means any export. re-export import orintroduction from the sea, whether of a commercial ornoncommercial nature, and "being traded internationally"shall be construed accordingly;

"in transit in relation to a specimen" means any occasion onwhich a specimen remains on board an aircraft, a ship orother form of transport and is in the process of shipmentto a named consignee outside the jurisdiction ofSaint Christopher and Nevis;

"introduction from the sea" of a specimen means thetransportation into the jurisdiction of Saint Christopherand Nevis of a specimen, which is taken from the marineenvironment not under the jurisdiction of any State.including the air space above the sea and the sea-bedand subsoil beneath the sea:

"label" means the written, printed or graphic matter on orattached to J specimen or to any of its containers includir»,

"Management Authority" means the national agencydesignated in accordance with section 7;

"mark" means any indelible imprint, lead, seal or other suitablemeans of identification;

"Minister" means the Minister responsible for matters relatingto the management and use of wild fauna and flora andthe implementation ofCITES;

"national enforcement officer" means officers appointedpursuant to section 51;

"non-commercial purpose" means a purpose whose conunercialaspects do not clearly predominate, including where tradeis being conducted for the

(a) purposes of non-profit scientific or medical research:

(b) purposes of conservation breeding or propagation:

(c) purposes of non-profit teaching and training:

(d) purposes of non-profit exhibition;

(e) use of a specimen as a household pet;

(f) purposes of non-profit zoological gardens: or

(g) use ofa specimen as a personal item, gift or donation;

"permission" means permission granted pursuant to

section 22:

"primarily commercial purpose" means a purpose which ispredominately geared towards «otaining economicbenefits, including

(a) profitable scientific or biomedical research:

(b) commercial captive breeding or artificial propagation:

(c) profitable exhibitions or zoological gardens: or

(d) professional tradings;

"quota" means the prescribed number or quantity ofspecimens that can be harvested. exported or otherwiseused oyer a specific period of time:

"readily recognizable part" in relation to a specimen includesany' specimen which appears from its label, mark.

description or any package or document accompanyingit. to be a pan or derivative of a specimen specified in

"re-export" in relation to a specimen means the export ofanyspecimen which has previously been imported into thejurisdiction of Saint Christopher and Nevis, whether ornot the specimen is in the same form as at the time ofimportation;

"re-export certificate" means a re-export certificate issuedpursuant to section 21;

"rescue centre" means a center established pursuant to section7 (2)(q) and as defined in paragraph 5 ofArticle vm ofCITES;

"Scientific Authority" means the Scientific Authoritydesignated pursuant to section 8;

"spccrcs'' includes any sub-species or geographically separatepopulation of any species;

"specimen" includes

(a) any animal or plant, whether alive or dead, ofa speciesincluded in Appendices I, II or !II ofCITES; and

(b) any readily recognizable part or derivative whichappears, from an accompanying document, thepackaging or a mark or label or from any othercircumstances, to be a part or derivative ofan animalor plant of species included in Appendices I, II andIII ofCITES;

"transhipment" in relation to a specimen means the procedurewhereby any animal or plant specimen remains in thecustody of Customs, is in the process of shipment to aconsignee and is being transferred from one (ann oftransport to another.

3. (I) The objects of this Act are:

(a) to facilitate Saint Christopher and Nevis's compliancewith its obligations under CITES;

(hi to conserve and manage the wild flora and fauna ofSaint Christopher and Nevis; and

(c) to regulate international trade, domestic trade,possession and transportation of the specimens ofspecies of animals and plants, in Saint Christopherand Nevis, which are listed in the Appendices tothis Act.

(2) Any recommendation included in the Resolutions anddecisions ofthe Conference ofthe Parties to CITES shali be implementedby the Government ofSaint Christopher and Nevis ifthe provisions are inconformity with the provisions of the Constitution and are in the nationalinterest.

Application of the

Act.4. (I) This Act applies to all specimen of animal and plant

species specified in Appendices I, II or III ofCITES.

(2) The provisons of this Act and any Regulations madeunder this Act shall be in addition to, and not in derogation or insubstitution of,

(a) the Fisheries Act, No.4 01'1984;

(b) the National Conservation and EnvironmentProtection Act NO.5 01'1987;

(c) the Customs (Control and Management) Act, No.401'1992; and

(d) any other relevant legislation

(3) Where any law in force in Saint Christopher and Nevisthat relates to the international trade of wild fauna and flora is in conflictwith this Act, this Act prevails.

Designation ofports. 5. 0) Subject to subsection (2). the Minister may. by Noticepublished in the Gazette and in at least one newspaper in general and atleast weekly circulation in Saint Christopher and Nevis, designate

(a) one or more ports of exit to which all exports andre-exports of specimen listed in the Appendices toCITES shall be restricted, and

(b) one or more ports of entry to which all imports,shipments in transit or transhipment andintroductions from the sea of specimens listed in theAppendices to CITES shall be restricted.

(2) The provisions ofsubsection (l) are without prejudice tothe provisions of any other enactment relating to the designation ofports.

Special conditionsrelating to speciesborn or bred incaptivity orartificially

propagated.

6. Notwithstanding any other provision of this Act

(a) specimens ofanimal species listed in Appendix I ofCITES that have been born or bred in captivity forcommercial purposes shall be deemed to be specimensofa species listed in Appendix 1l ofCITES;

(bl specimens of plant species listed in Appendix I ofCITES that have been artificially propagated for

commercial purposes shall be deemed to be specimensof a species listed in Appendix II ofCITES;

(c) specimens of a species listed in Appendices II andIII of CITES that have been born and bred in captivityor artificially propagated for commercial purposesshall be treated in accordance with the provisionsapplicable to specimens of a species listed inAppendices II and III of CITES;

(d) specimens of animal species listed in Appendices I,II and 1lI of CITES that have been born or bred incaptivity shall not be traded internationally unlessthey originate from a breeding operation registeredby the Management Authority and have beenindividually and permanently marked in a manner soas to render alteration or modification byunauthorized persons as difficult as possible; and

(e) specimens of plant species listed in Appendices L IJ

and III ofCITES that have been artificially propagatedshall not be traded internationally unless theyoriginate from an operation registered by theManagement Authority and have been individuallyand permanently marked in a manner so as to renderalteration or modification by unauthorized personsas difficult as possible.

PARTIIDESIGNATIONANll FUNCTIONS OFMANAGEMENTALTHORITY

ANDSCIENTIF1CAT.HHORITY

7. (1) The Minister may, by Order, designate a national agencyas the Management Authority with primary responsibility for mattersrelating to the regulation of international trade in wild fauna and flora.

(2) The Management Authority shall

(a) in accordance with paragraph I(a) of Article IX ofCITES, be responsible for implementing CITES In

Saint Christopher and Nevis;

(b) coordinate CITES implementation and co-operatewith relevant national authorities, the ManagementAuthority ofother State parties, the CITES Secrerariatand other international bodies III the conservation ofspecies of flora or fauna listed in Ihe Appendices L II

or III ofCITES;

(c) grant permits, certificates and permissions inaccordance with the provisions ofCITES, in respectof the importation, exportation, re-exportation andintroduction from the sea of wild fauna and floraincluded in Appendices I, II, or III of CITES andattach to any such permits, certificates orpermissions; any condition that it may deemnecessary.

(d) advise the Minister on mailers ofimplementation andpolicy relating to international trade in wild faunaand flora;

(e) consult with the Scientific Authority ou the scientificaspects ofthe implementation ofCITES;

(I) consult with the Scientific Authority regardingproposals for amendment ofAppendices I, II or III ofCITES;

(g) formulate and implement or cause the formulationand implementation of mechanisms for theenforcement of this Act and CITES;

(h) maintain records of and monitor trade in specimensas required by CITES and compile and submit periodicreports on such trade and on the legislative,regulatory and administrative measures taken toenforce the provisions of this Act and CITES as mayin either case be required by CITES or by theMinister;

(i) determine, after consultation with the ScientificAuthority and such agency ofGovemment as it seesfit, the method of shipment, including by containerand other packaging requirement necessary for thetransport ofa specimen specified in Appendices I, IIor III ofCITES, in accordance with the law in force inSaint Christopher and Nevis relating to transportationby air or sea;

(j) stipulate specific prerequisites for registration ofanyperson or business involved in the captive breedingor artificial propagation of species specified inAppendices I, II or III of CITES and specifyconditions under which such persons or businessesmay operate;

(k) stipulate specific prerequisites for registration ofpersons or businesses involved in international trade

in species specified in Appendix I ofCITES and thoseinvolved in corrunercial trade of species specified inAppendices II or III ofCITES and specify conditionsunder which such persons or businesses mayoperate;

(I) take such steps as are necessary for the protection,conservation and management ofwild fauna and floraagainst over-exploitation through international trade;

(m) promote public awareness of species of wild floraand fauna which arc considered vulnerable,threatened, at risk, endangered, facing extirpation orfacing extinction and which are or may be affectedby international trade;

(0) to the extent possible, formulate and implement orcause the formulation and implementation of arecovery and management plan in Saint Christopherand Nevis for wild fauna and flora ofspecies specifiedIn Appendices I, II or III of CITES and implement orcause the implementation of approved managementprogrammes;

(0) subject to section 8(2), on the recommendation ofthe Scientific Authority cause proposals for thetransfer ofa specimen from one Appendix to anotheror for thede-listing or listing ofspecies inAppendicesI, II or III of CITES to be prepared and submitted tothe CITES Secretariat

(p) decide on the disposal of any confiscated or forfeitedspecimen, after taking into account any advice oftheScientific Authority on the matter;

(q) in consultation with the Scientific Authority set andmanage quotas and establish one or more rescuecentres for seized and confiscated livingspecimens.and

(r) perform such other functions pertaining tointernational trade in wild fauna and flora as may bespecified pursuant to this Act, or assigned from timeto time, by the Minister.

(3) Where the Management Authority reasonably suspectsthat a registered person, or permit orcertificate holder is in breach of this

Act the Regulations, registration, a permit or a certificate held by the

person, as the case may be, or where an allegation of breach is made tothe Authority against such a person. the Management Authority may

conduct any investigation it considers necessary in relation to theregistered person. or permit holder or certificate holder and may performany of the foUo\\';ng in the course of such investigation

(a) compel the production ofdocwnents and records inthe custody or control of the registered person,permit holder or certificate holder;

(b) compel the appearaoce ofan employee or officer ofthe registered person, permit holder or certificateholder, or any other person for the purpose ofascertaining compliance with this Act, theRegnIations, registration, the permit ortbe certificate;

(c) inspect, examine or make copies ofany document orrecord in the possession of the registered person,permit holder or certificate holder relevant to theregistration, or the permit or certificate held by theregistered person, permit holder or certificate holder;

(d) require verification of income and all other matterspertinent to registration. the permit or the certificate;

(e) enter or inspect any premises for the purpose ofascertaining compliance with this Act, theRegnIations, registration, the permit or the certificate;and

(f) seize, remove or impound any docwnent or recordsrelating to registration, the permit or the certificatefor the purpose ofexamination and inspection.

(4) In carrying out the provisions of subsection (2), theManagement Authority may consult any Department ofGovernment orstatutory body likely to be affected, and shall send to the Department ofGovernment or statutory body likely to be affected. a copy ofany reportprepared by the Management Authority in consequence of anyinvestigation made pursuant to subsection (2).

(5) Tbe Management Aulbonty shall not be liable for theacts ofa certificate holder or pennit holder.

S. (1) The Minister may by Order designate a separate andindependent body to be known as the Scientific Authority for purposesof this Act.

(21 The Scientific Aulbority shall advise the MaaagemenrAuthority on

(a) the status ill' wild fauna or Ilor.. 5pecJJjed mAppendices L II and III ofCITES,

(b) in the case of a proposed import of a live specimenlisted in Appendix I of CITES, whether or not it issatisfied that the proposed recipient of the specimenis suitably equipped to house and care for it;

(c) the disposal of seized or forfeited specimens;

(d) when and as appropriate, whether a proposed import,export, re-export or introduction from the sea of aspecimen specified in Appendices I, II and III ofCITES will be detrimental to the survival of thatspecies and on suitable measures to be taken toensure the non-detriment to the species;

(e) scientific issues related to international trade in wildfauna and flora;

(f) any national species which ar e vulnerable,threatened, at risk, endangered, facing extirpation orfacing extinction and which an: 01 may be affectedby international trade: and

(g) any other matters ill respect of which advise is soug1Jlby the Management Authority.

(3) The advice to the Management Authority shall be basedon the best available scientific evidence or ecological principles, butwhere little or no scientific evidence is available. the Scientific Authoritymay give advice based on the precautionary pnnciple or other relevantinformation.

(4) Whc re the Management Authority rejects anyrecommendation of the Scientific Authority, it shall give reasons for therejection.

(5) The Scientific Authority shall

(a) recommend, initiate, carry out and support researchwhich, in its opinion, is relevant to any of irs functionsunder this Act:

(b) monitor the grant of permits and certificates issuedin accordance with this Act and with the provisionsof CITES and monitor the actual international tradein specimens specified in Appendices I, II and III ofCITES: and

(c) perform such other functions pertaining tointernational trade in specimens of wild fauna and

flora included in Appendices I, II and III as may be

assigned to it. by the Management Authority.

(6) In this section "precautionary principle" means theprinciple that where there are threats of serious or irreversible damage tonatural resources or the environment, appropriate actions will be taken toconserve natural resources or their environment, even though fullscientific certainty may not have been established regarding all aspectsof the threats.

9. (I) The Minister may appoint a CITES committee WIthrepresentation from such governmental and non-governmental agencies,as the Minister may determine, to assist in the implementation of CITES.

(2) The Management Authority or the Scientific Authoritymay co-opt on a case by case basis any necessary expertise deemedappropriate to assist in carrying out its duties pursuant to this Act.

PARTillFINANCIAL PROVISIONS

10. (1) Any expense incurred by any Government Department inconnection with the administration and implementation of this Act shallbe defrayed out of moneys provided by Parliament.

(2) There shall be paid out of moneys provided hy Parliamentany increase attributable to this Act in the sums so payable under anyother Act

11. The Management Authority may charge a fee, at a rate set bythe Minister, for the processing of any application for a permit or acertificate, for the issue of a permit or a certificate. for registration pursuantto section 6 and for any other administrative purposes.

12. (1) The Minister may establish a special fund to be to beknown as the Conservation Fund which shall be used only for theconservation of wildlife and the implementation and enforcement ofCITES and of this Act, including the establishment and management ofthe rescue centres referred to in section 7(2) (q).

(2) Any fees charged pursuant to section 14 and anyvoluntary contribution by an individual or an organization made forconservation of wildlife, shall be paid into the Conservation fund.

PARTIVRESTRICnO:-iS

U. (1) Subject to subsection (2), a person shall not carryoninternanonal trade in a specimen listed in Appendix I ofC[TES unless thatperson

(al is registered by the Management Authonty 3ndcomplies with the conditions of registration or lS

exempt from the requirement of registration pursuantto this Act: and

(b) holds a valid permit or certificate issued for thatpurpose and complies with the permit or certificateor is exempt from the requirements of a permit orcertificate pursuant to this Act

(2) Notwithstanding subsection (1), a person shall not importor introduce from the sea a specimen listed in Appendix 1 ofCITES for aprimarily commercial purpose except where the specimen is a specimenreferred to in section 5(a) or (b).

(3) A person who contravenes subsection (1) or (2) commitsan offence and, subject to suhsection (4), is liahle

(a) in the case of a natural person

(i) on summary conviction to a fine not exceedingfifty thousand dollars or to imprisonment for aterm not exceeding two years or to both; or

(ii) on conviction on indictment to a fine notexceeding one hundred thousand dollars orimprisonment for a term not exceeding four yearsor to both;

(b) in the case of a person other than a natural person

(i) on summary conviction to a fine not exceedingone hundred thousand dollars: or

(ii) on conviction on indictment to a fine notexceeding two hundred thousand dollars.

(4) Notwithstanding subsection (3), where an offencecommitted pursuant to subsection (1) or (2) is a subsequent offencepursuant to this section, the person who commits the subsequent offenceis liable


(i) on summary conviction to a fine not exceedingone hundred thousand dollars or toimprisonment for a term not exceeding four yearsor to both; or

(ii) on conviction on indictment to a fine notexceeding two hundred and fifty thousanddollars or imprisonment for a term not exceedingten years or to both


(i) on summary conviction to a fine not exceeding

two hundred and fifty thousand dollars; or

(ii) on conviction on indictment to a fine notexceeding four hundred thousand dollars.

14. (I) A person shall not carryon international trade III

specimens listed in Appendices II and 111 of CITES unless that person

(a) is registered by the Management Authority andcomplies with the conditions of registration or isexempt from the requirements ofregistration pursuantto this Act; and

(b) holds a valid permit, certificate or permission issuedor granted for that purpose and complies with thepermit, certificate or permission or is exempt from therequirements of a permit, certificate or permissionpursuant to this Act.

(2) A person who contravenes subsection (1) commits anoffence and, subject to subsection (3), is liable


[i} on summary conviction to a fine not exceedingtwenty thousand dollars or to imprisonment fora term not exceeding one year or to both: or

(ii) on conviction on indictment to a fine notexceeding fifty thousand dollars or toimprisonment for a term not exceeding two yearsor to both; or


(i) on summary conviction to a fine not exceedingfifty thousand dollars; or

(ii) on conviction on indictment to a fine notexceeding one hundred thousand dollars.

(3) Notwithstanding subsection (2), where an offencecommitted pursuant to subsection (1) is a subsequent offence pursuantto this section, the person who commits the subsequent offence is liable



(ii) on conviction on indictment to a fine notexceeding seventy five thousand dollars or

imprisonment for a term not exceedmg threeyears or to both

15. (1) A person sha11 not produce captive bred animals orartificially propagated plants of any species listed in Appendices 1, 11, or1I1 of CITES unless that person

(a) is registered by the Management Authority andcomplies with the conditions of registration or isexempt from the requirements ofregistration pursuantto this Act; and

(b) in the case of production of

(i) captive bred animals, holds a certificate ofcaptive breeding; and

(ii) artificially propagated plants, holds a certificateof artificial propagation; and complies with thepermit or certificate or is exempt from therequirement ofa permit or certificate pursuant tothis Act.

(2) A person who contravenes subsection (1) commits anoffence and, subject to subsection (3), is liable


(i) on summary conviction to a fine not exceedingtwenty thousand dollars or to imprisonment fora term not exceeding one year or to both; or

(ii) on conviction on indictment to a fine notexceeding fifty thousand dollars or toimprisonment for a term not exceeding two yearsor to both: or


(i) on summary conviction to a fine not exceedingfifty thousand dollars; or

(Ji) on conviction on indictment to a fine notexceeding one hundred thousand dollars.

(3) Notwithstanding subsection (2), where an offencecommitted pursuant to subsection (1) is a subsequent offence pursuant

to this section the person who commits the subsequent offence is liable

16. (I) Subject to subsection (2) and to section 35, a personshall not have in his or her possession or under his or her control or offeror advertise for sale or sell any specimen listed in Appendices I, II or III ofCITES for the purposes of international trade or as a result of internationaltrade unless that person

(a) is registered by the Management Authority pursuantto this Act and complies with the conditions ofregistration or is exempt from the requirements ofregistration pursuant to this Act; and

(b) holds a valid penni! or certificate for that purposeand complies with the permit or certificate or is exemptfrom the requirements of a permit or certificatepursuant to this Act.

(2) Notwithstanding subsection (J), a person who has in hisor her possession or under his or her control any specimen of a specieslisted in Appendices I, II or III of CfTES in respect of which, prior to anamendment to CITES, there was no requirement for registration. a permit,a certificate or permission, the person shall be required to register withthe Management Authority and obtain a permit or a certificate or permissionin accordance with this Act within six months of the commencement ofthe enactment giving effect to the amendment to CITES.

(3) A person who contravenes subsection (1) or (2) commitsan offence and. subject to subsection (3), lS liable

(a) in the case of an natural person

(i) on summary conviction to a fine not exceeding

fifty thousand dollars or 10 imprisonment for aterm not exceeding two years or to both; 01

(ii) on conviction on indictment to a fine notexceeding one hundred thousand dollars orimprisonment for a term not exceeding four yearsor to both;


(i) on summary conviction to a fine not exceedingone hundred thousand dollars; or

(ii) on conviction on indictment to a fine notexceeding two hundred thousand dollars.

(4) Notwithstanding subsection (2), where an offenceconunitted pursuant to subsection (1) (a) is a subsequent offence pursuantto this section, the person who commits the subsequent offence is liable


(i) on summary conviction to a fine not exceedingone hundred thousand dollars or toimprisonment for a term not exceeding four yearsor to both; or

(ii] on conviction on indictment to a fine notexceeding one hundred and fifty thousanddollars or imprisonment for a term not exceedingfive years or to both


(i) on summary conviction to a fine not exceedingtwo hundred thousand dollars; or

(ii) on conviction on indictment to a fine notexceeding three hundred and fifty thousanddollars.

PART VREGISlRATION, PERMITS, CERTIFlCATESAND PERJ'\1lSSION

17. (1) A person wishing to

(a) carryon international trade in specimens listed inAppendix I of CITES other than importation orintroduction from the sea for a primarily commercialpurpose;

(b) carryon international trade in specimens listed inAppendices II or III ofCITES;

(C) produce captive bred animals and artificiallypropagated plants ofany species listed in AppendicesLIL or III of CITES: or

(d) possess or have under his or her control, offer oradvertise for sale or sell any specimen listed inAppendices I, II or III of CITES for the purpose ofinternationaltradeor as a result ofinternational trade;

shall, subject to subsection (2), apply to the Management Authority forregistration for that purpose unless that person is exempt from therequirement of registration pursuant to this Act.

(2) An application pursuant to subsection (I) sball

(a) be in the prescribed form;

(b) be accompanied by the prescribed fee;

(c) state the purpose of the registration; and

(d) be submitted to the Management Authority togetherwith such other information as may be prescribed oras the Management Authority may require.

(3) The Management Authority, if satisfied that a personmaking an application pursuant to subsection (l) complies with theprescribed conditions of registration, shall, subject to subsection (4),register the applicant and issue a certificate of registration to the person.

(4) A certificate ofregistration shall


(b) be issued on payment of the prescribed fee to theManagement Authority; and

(c) entitle the holder to carry on one or more activitieslisted in subsection (I) on the condition that theholder also holds a valid permit or certificate for thatpurpose.

(5) Notwithstanding the foregoing provisions, the Ministermay, after consultation with the Management Authority, waive therequirement for registration or any fees payable pursuant to this section,subject to any conditions that the Minister may impose.

18. (1) A person registered pursuant to section 17 shall keep upto date records of their stocks and of any transactions in such form asmay be specified by the Management Authority.

(2) The Management Authority may inspect the premisesand records of any person registered pursuant to section 17 at any timeduring normal working hours and a person registered shall give access to

the Management Authoflly at such times,

(3) A person who contravenes subsection (1) or (2) commitsan offence and is liable on summary conviction to a fine of one hundredthousand dollars or to imprisonment for four years or to both.

(4) In convicting a person under subsection (3), the Courtmay in addition to the punishment under that subsection, order that theperson convicted be prohibited from engaging in an activity specified insubsections (1) for such period as the Court may determine.

19. Registration with the Management Authority shall be validfor a period of three years unless earlier revoked and is renewable oncondition that the person continues to comply with the requirements ofthis Act

20. The Management Authority may revoke the registration ofany person who fails to comply with the conditions for registration.

21. (1) Subject to subsection (2), a person who is registeredpursuant to section 17 and who wishes to

(3) carryon international trade in specimens listed inAppendix I of CITES other than importation orintroduction from the sea for a primarily commercialpurpose;

(b) carryon international trade in specimens listed inAppendices JI or III ofCITES;

(c) produce captive bred animals or artificiallypropagated plants of any species listed inAppendices I, JI, or III of CITES; or

(d) possess, have under his or her control, offer,advertise for sale or sell any specimen listed inAppendices I, 1I or III of CITES for the purpose ofinternational trade or as a result of international trade;

shall, subject to subsection (2), unless that person is exempt from therequirement of a permit or certificate or the requirement for a permit orcertificate is waived pursuant to the Act, apply to the ManagementAuthority for a permit or certificate for that purpose.

(2) An application pursuant to subsection (l) shall


(b) be accompanied by the prescribed fees;

(c) state the purpose of the permit: and

(d) be submitted to the Management Authority together

with such other information as may be prescribed oras the Management Authority may require.

(3) The Management Authority may refuse to issue a permitor certificate

(a) in accordance with section 29; or

(b) if it is not satisfied with the prescribed conditions fortrading internationally in specimens listed in theAppendices to CITES or for production of captivebred animals or artificial propagation of plants forany species listed in Appendices toCITES.

(4) Where the Management Authority refuses to grant apermit or certificate pursuant to this section, if it shall so inform theapplicant in writing statingthereasonsforrefusalanddrawtheapplicant'sattention to his or her right to appeal pursuant to this Act.

(5) If satisfied that a person making an application pursuantto subsection (1) complies with theprescribedconditions for internationaltradein specimens listed in the appendices to CITES or for production ofcaptive bred animals or artificial propagation of plants for any specieslisted in Appendices to CITES, the Management Authority shall, subjectto subsections (6) and (7) and to sections, 23, 24, 25, 26, 27, and 28 issuea permit or certificate to the person for that purpose.

(6) A permit or certificate pursuant to subsection (5) shall


(b) subject to subsection (8), be issued on payment ofthe prescribed fee to the Management Authority;

(c) state the activity which it authorizes the holder tocarry on;and

(d) entitle the holder to carryon the activity referred toin subsection (1) on the condition that the holder isalso registered for that purpose;

(7) A permit or certificate pursuant to this section shall beissued in relation to specimens listed in Appendix I, Appendix II andAppendix III of CITES as follows

(a) all export permit for the purpose of export of aspecimen listed in

(i) Appendix lor II orCITES;

(ii] Appendix III of CITES ifit is listed in AppendixIII orCITES on the request ofSaint Christopherand Nevis;

(b) a certificate of origin for the purposes of export of aspecimen listed ill Appendix III of CITES on therequest of a country other than Sainr Christopherand Nevis;

(e) an import permit for the purpose of importing aspecimen listed in the Appendix I of CITES;

(d) a re-export certificate for the purpose of re-export;

(e) a certificate of introduction from the sea for thepurpose of introduction from the sea;

(f) a certificate of artificial propagation for the purposeof artificial propagation;

(g) a certificate of captive breeding for the purpose ofcaptive breeding;

(h) certificate of possession for the purpose ofinternational trade or as a result of international trade;or

(i) a certificate of sale for the purpose of sale forinternational trade or as a result of international trade.

(8) Notwithstanding subsection (6), the Minister may, afterconsultation with the Management Authority, waive any fees payableunder this section subject to any conditions the Minister may impose.

22. (1) A person wishing to import a specimen listed in AppendixII or III afCITES shall obtain permission from the ManagementAuthority.

(2) The Management Authority may, in accordance withsection 24, grant permission for the importation of a specimen listed inAppendix II or III ofCITES,

(3) A permission granted pursuant to this section shall be

(a) in writing, or in any other form as the ManagementAuthority determines;

(b) accompanied by such other information as may beprescribed or that the Management Authority mayrequire:

(c) obtained prior to arrival of the specimen in SaintChristopher and Nevis unless determined otherwiseby the Management Authority,

23. (1) The Management Authority may issue an export permitpursuant to section 21 for the exportation of a specimen specified inAppendix I afCITES if

(a) it is satisfied that

(i) a valid import permit has been granted by the

competent Authority of the country of import:and

Pcrrnisviun.

(ii) the specimen was not obtained in contraventionof any national law relating to the protection,conservation and management of flora andfauna; and

(iii) any live specimen will be prepared and shippedin a manner whicb will minimize the risk ofinjury,damage to healtb or cruel treatment; and

(b) the Scientific Authority of Saint Christopher andNevis has advised the Management Authority thatsuch export will not be detrimentalto the survival ofthe species.

(2) The Management Authority may issue an export permitpursuant to section 2 t for the exportation of a specimen specified inAppendix II ofCITES if

(a) it is satisfied that

(i) the specimen was not obtained in contraventionof any national law relating to the protection,conservation and management of flora andfauna; and

(ii) any live specimen will be prepared and shippedin amanner which will minimize theriskof injury,damage to health or cruel treatment; and

(b) the Scientific Authority of Saint Christopher andNevis has advised the Management Authority thatsuch export will not be detrimentalto the survival ofthe species.

(3) The Management Authority may issue an export permitpursuant to section 21 for the exportation of a specimen specified inAppendix 1Il of CITES and is listed on the request of Saint Christopherand Nevis, if it is satisfied that

(a) the specimen was not obtained in contravention ofany law in force in Saint Christopher and Nevisrelating to the protection, conservation andmanagement of flora and fauna; and

(b) any live specimen will be prepared and shipped in amanner which will minimize the risk of injury, damageto health or cruel treatment.

(4) Where a specimen referred to in subsection (3) is listed in

Appendix III of CITES on the request of a country other thanSaint Christopher and Nevis, a certificate of origin may, subject tosubsection 5, be issued by the Managcmcnt Authonry for the exportationof that specimen.

24. (I) The Management Authority may issue an import permitpursuant to section 21 for the importation of a specimen specified inAppendix I ofCITES if

(a) Saint Christopher and Nevis, as the country ofimport,is presented with a valid export permit or re-exportcertificate issued by a competent authority in acountry that is a party to CITES;

(b) the specimen is not intended to be used for primarilyfor commercial purposes; and

(c) the Scientific Authority has advised the ManagementAuthority that

(i) the intended purpose of import will not bedetrimental to the survival of the species, and

(ii) the proposed recipient is suitably equipped tohouse and care for any live specimen.

(2) The Management Authority may grant permissionpursuant to section 22 for the importation of a specimen specified inAppendix 11 ofCITES if

(a) Saint Christopher and Nevis. as the country ofimport,is presented with a valid export permit or re-exportcertificate issued by the competent authority in acountry which is a party to CITES;and

(b) the Scientific Authority has advised thai theproposed recipient is suitably equipped to houseand care for any live specimen.

(3) The Management Authority may grant permissionpursuant to section 22 for the importation of a specimen specified inAppendix !II ofCITES and listed on the request ofSaint Christopher andNevis in Appendix !II of CITES if

(a) Saint Christopher and Nevis as the country of importis presented with a valid export permit or re-exportcertificate; and

(b) the Scientific Authority has advised that theproposed recipient is suitably equipped to houseand care for any live specimen.

(4) The Management Authority may grant permissionpursuant to section 18 for the importation of a specimen specified inAppendix III ofCITES and listed in Appendix III of CITES on the request

of a country other than Saint Christopher and Nevis ifa valid certificateof origin has been issued from the country of origin.

25. (1) The Management Authority may issue a re-export permitpursuant to section 21 for the re-exportation of a specimen specified inAppendix I of CITES if satisfied that

(a) the specimen was imported into Saint Christopherand Nevis in accordance with CITES, the provisionsof this Act and the Regulations;

(b) the applicant possess valid originals of thedocuments issued to authorize the import of thespecimen into Saint Christopher and Nevis or theapplicant has been granted an import permit for a livespecimen; and

(c) any live specimens will be prepared and transportedin such a manner as to minimize the risk of injury,damage to health or cruel treatment.

(2) The Management Authority may issue are-exportcertificate pursuant to section 21 for the re-exportation of a specimenspecified in Appendix II of CITES if u is satisfied that

(a) the specimen was imported in accordance with CITES,the provisions of this Act and the Regulations;

(b) the applicant possess valid originals of thedocuments issued to authorize the import of thespecimen into Saint Christopher and Nevis,and

(c) that any live specimen will be prepared and shippedin such a manner as to minimize the risk of injury,damage to health or cruel treatment.

(3) The Management Authority may issue are-exportcertificate pursuant to section 21 for the re-exportation of a specimenspecified in Appendix III ofCITES if

(a) it is presented with a valid original export permit,certificate of origin or re-export certificate; and

(b) it is satisfied that the specimen was imported inaccordance with CITES, the provisions of this Actand the Regulations.

26. (1) The Management Authority may issue a certificate ofintroduction from the sea pursuant to section 21 for the introduction fromthe sea ofa specimen specified in Appendix I of CITES if

(a) the Management Authority is satisfied that thespecimen is not intended to be used for a primarily

commercial purpose;

(b) the Scientific Authority has advised the ManagementAuthority that

(i) the introduction thereof will not be detrimentalto the survival of the species; and

(ii) in the case of a live specimen, the proposedrecipient is suitably equipped to house and carefor it.

(2) The Management Authority may issue a certificate ofintroduction from the sea pursuant to section 21 for the introduction fromthe sea of a specimen specified in Appendix II of CITES if

(a) it is satisfied that any live specimen is handled so asto minimize the risk of injury, damage to health, orcruel treatment; and

(h) the Scientific Authority has advised the ManagementAuthority that the introduction will not bedetrimental to the survival of the species.

27. The Management Authority may issue a certificate ofpossession or certificate of sale pursuant to section 21 for possession orsale ofa specimen specified in Appendix I, II or II ofCITES for the purposeof international trade or as a result of international trade, if the personapplying for the certificate of possession or certificate of sale complieswith the requirements specified by the Management Authority.

28. (I) A permit or certificate issued pursuant to this Act shallnot be transferrable and shall be valid for such period as is specifiedtherein, being a period not exceeding

(a) twelve months in the case of an import permit inrespect ofa species specified inAppendix I ofCITES;

(b) six months, in the case of an export permit, are-exportcertificate and a certificate of introduction from thesea in respect of species specified in Appendices I,II or III ofCITES.

(2) A separate permit or certificate is required for eachconsignment of specimens.

(3) Only valid import permits, export permits, re-exportcertificates or certificates of origin shall be accepted to authorize thetrade in specimens ofa species listed in Appendices I, II and III of CITES.

(4) A permit or a certificate issued in violation of rhis Act orany other relevant laws of Saint Christopher and Nevis or in violation ofCITES shall be considered invalid.

29, The Management Authority may refuse to grant a permit or

certificate under this Act

(a) in any case where the Scientific Authorityrecommends such refusal on the ground that thepermit orcertificate wouldnothe in thepublicinterest,having regard to such factors as the ScientificAuthorityconsider relevant, including

(i) the need for the protection of certain species ofwild fauna orflora from over-exploitation throughinternational trade:

(ii) the preservation of the character of theenvironment, including the fauna or flora; and

(iii) the availability of the natural environment forthe enjoyment of the public;

(b) where all application contains or is based on false ormisleading representation or information which isfalse in a material particular;

(c) to an individual who

(i) is under the age of eighteen years;

(ii) is adjudged bankrupt; or

(iii) has been convicted of an offence under this Actduring the period of ten years immediatelypreceding the date of the application;

(d) to a body corporate

(i) in respect of which a resolution has been passedfor voluntary winding-up or an order has beenmadeby a courtofcompetent jurisdictionfor itswinding-up;

(ii) if a receiver has been appointed to manage anyof its assets;

(iii) if during the period of ten years inunediatelypreceding the date of application, any of itsdirectors has been convicted of an offencepursuant to this Act; or

(iv) which has been convicted of an offence underthis Act during the period of five yearsimmediatelypreceding the date of the application;or

(e) if, in the opinion of the Management Authority, theapplicant is not a fit and proper person to be granted

such permission.

30. (I) Where the Management Authority has issued a permit orcertificate to an applicant, the Management Authority may, subject tosubsection (2), suspend the permit or certificate if

(a) the holder is in breach of

(i) any provision of this Act or the Regulations forany other enactment providing for theprotection, conservation and management ofnatural resources or the environment; or

(ii) any term or condition subject to which the permitor certificate is granted;

(b) the holder notifies the Management Authority, inwriting, that he or she intends to cease the activitiesto which the permit or certificate relates for the periodstated in the notice.

(2) Before suspending a permit or certificate undersubsection (I )(a), the Management Authority shall notify the holder inwriting of the proposed suspension

(a) stating the reasons for the suspension;

(b) requiring the holder of the permit or certificate, in thecase of a breach, to remedy the breach within thetime specified in the notice; and

(c) stating that the permit or certificate is to be returnedwithin a specified time forthwith to the ManagementAuthority.

(3) A holder of a permit or certificate who is served with anotice under subsection (2) shall, after remedying the breach which gaverise to the suspension, notify the Management Authority in writing thatthe breach has been remedied.

(4) The Management Authority shall, upon receipt ofa noticereferred to in subsection (3), cause an inspection to be carried out and ifthe Management Authority is satisfied that the breach has been remedied,it shall withdraw the notice of suspension.

31. (I) Where the Management Authority has granted permissionand issued a permit or certificate to an applicant, the ManagementAuthority may revoke the permit or certificate if it is satisfied that

(a) the application contained any false or misleadinginformation in any material particular;

(b) the holder has failed to remedy a breach which gave

rise to the suspension of the permit or certificateunder section 30, within the time specified in the noticeunder section 30 (2);

(c) therehasbeen a material changein thecircumstanceswhich existed at the time the permit or certificate wasgranted which would justify such revocation.

(2) Where a permit or certificate is issued in relation to aspecies that is transferred from one Appendix of CITES to anotherAppendix of CITES, that permit or certificate shall continue to have effectfor a period of six months commencing on the date of transfer Or theexpiry ofthe permit or certificate whichever is later.

32. (1) A person who is aggrieved by a decision of theManagement Authority

(a) to refuse to issue a permit or certificate; or

(b) having issued a permit or certificate, to suspend orrevoke the permit or certificate;

may appeal in writing to the Minister within twenty-eight days ofthe dateof notification of the decision.

(2) An appeal pursuant to this section shall set out thegrounds of appeal and shall be accompanied by a copy of anycorrespondence, documents or statements relevant to the appeal.

(3) Notice in writing ofthe appeal together with copies ofrhecorrespondence, documents or statements referred to in subsection (2)shall be served on the Management Authonty at the time when the appealis lodged,

(4) The Minister shall, within fourteen days of the receipt ofthe appeal under subsection (I), request the Management Authority tofurnish him or her within thirty days, with a statement in writing settingout the reasons for its decision.

(5) The Minister may order that any books, papers,documents or statements, relating to the appeal that are in the possessionof the appellant or the Management Authority be produced at the hearingof the appeal,

(6) The Minister shall take all reasonable steps to cause allparties to the appeal to be informed

(a) of the date of the hearing of the appeal;

(b) that they may appear themselves or by theirattorneys-at-law; and

(c) that they may sumrnon witnesses in their cause.

(7) The Minister shall, as soon as practicable after receipt of

the statement referred to in subsection (4), hear the appeal and may inwriting confirm. reverse or modify the decision of the Management

Authority and may give any decision that the Management Authoritycould have given in respect of the matter.

PARfVIEXEMPTIONS

33, (1) The requirement for registration, permission or a pcrnnror certificate shall not apply to specimens in transit or to the transhipmentof specimens through Saint Christopher and Nevis while the specimensremain under the control of Customs.

(2) The Management Authority may inspect a specimen intransit or transhipment in order to verify the existence ofan export pemutissued by the competent authority of the country of export or re-export.in accordance with the provisions of CITES.

34. (I) The requirement for registration, permission or a permitor certificate shall not apply to dead specimens, parts or derivatives ofspecies listed in Appendices L II or IfI of CITES that are personal orhousehold effects exempted under CITES and being imported, exportedor re-exported in compliance with Regulations under this Act.

(2) The requirement for a permit or certificate may be waivedby the Management Authority to allow for frequent cross-bordermovement of live animals regarded as personal or household effects ifthe owner holds a certificate of ownership issued by the ManagementAuthority or a competent authority in a country which is a party to CITES.

(3) A certificate of ownership pursuant to subsection (2)

(a) shall be issued on payment of the prescribed feeunless the fee is waived by the Minister;

(b) shall be valid for a period not exceeding three years;and

(c) is renewable on condition that the holder continuesto comply with this Act.

(4) Notwithstanding subsection (3), the Minister may, afterconsultation with the Management Authority, waive any fees payableunder this section subject to any conditions the Minister may impose.

(5) In this section "personal or household effects" meansspecimens that are

(a) personally owned or possessed for non-commercialpurposes;

(b) legally acquired; and

(c) at the time of import, export or re-export either

(i) worn or carried or included in personal baggage; or

(ii) part of a household move.

35. (1) Subject to subsections (4) and (5). the ManagementAuthority may, on the application of a scientific institution inSaint Christopher and Nevis, who is engaged in activities specified insubsection (3), by Order, declare that scientific institution to be anapproved scientific institution for the purpose of an exemption pursuantto this section in relation to categories of specimens specified in theOrder.

(2) Subject to this section, the requirement for permission ora pennit or certificate shall not apply to non-commercial loans, donationsand exchanges between approved scientific institutions of herbariumspecimens, other preserved, dried or embedded museum specimens orlive plant material which carry a label issued or approved by theManagement Authority.

(3) The activities referred to in subsection (1) are activitiesrelating to

(a) live specimens or species of plants;

(b) herbarium specimens; and

(c) preserved, dried or embedded museum specimens inSaint Christopher and Nevis.

(4) An Order pursuant to subsection (I), shall have effect

(a) for the purpose of permitting the non-commercialloan, donation or exchange of the categories ofspecimens specified therein; and

(b) for such period as may be determined by theManagement Authority after consultation with theScientific Authority and specified in the Order.

(5) The Management Authority shall nor declare a scientificinstitution to be an approved scientific institution unless it is satisfied asto the matters specified in subsection (6).

(6) The matters referred to in subsection (5) are as follows

(a) the scientific institution

(i) is owned or controlled by the Government ofSaint Christopher and Nevis;

(ii) in any case other than that referred to in

subparagraph (I)does not engage in commercIaltransactions in the categories of specimensspecified in the Order pursuant to section (1);

(b) one of the scientific institution's primary functionsis the carrying out of research or investigation intospecimens or species;

(c) where the scientific institution is situated inSaint Christopher and Nevis, it isengaged incommercial transactions only in relation to specimensthat are, or are derived from specimens that havebeen taken in accordance with a managementprogramme approved by the Management Authority;

(d) the scientific institution

(i) possesses resources and qualifications thatenable the undertaking of research orinvestigation;

(ii) publishes the results of its research orinvestigation and otherwise makes the raw dataand detailed results available to the ManagementAuthority and the public or the Government;and

(iii) imports or exports specimens taken in the wildonly if specimens that were bred in captivity orartificially propagated cannot be used for thepurposes of research, investigation or publiceducation;

(e) the scientific institution is suitably equipped to

(i) manage, confine, care for and, where appropriate,house live specimens;

(ii) maintain adequate records relating to themanagement, breeding, mortality and disposalof specimens; and

(iii) produce those records when required by theMauagement Authority.

(7) The Management Authority shall keep and maintain aRegister ofApproved Scientific Institutions in the prescribed manner.

36. (1) The Management Authority may waive the requirementsfor a permit or certificate pursuant to this Act and allow the movement ofspecimens which form part of a travelling zoo, circus, menagerie, plantexhibition or other travelling exhibition, in the following circumstances

(a) that the exporter or importer submits in writing full

details of such specimens with the ManagementAuthority;

(b) it can satisfactorily be shown that the specimenswere acquired before CITES applied to them;

(c) it can satisfactorily be shown that the specimenswere, or are a part of, or derived from any specimenofany animal species which was bred in captivity ora plant species which was artificially propagated;

(d) that the Management Authority is satisfied that anyliving specimen will be so transported and cared forso as to minimize damage, risk or injury, damage tohealth or cruel treatment; and

(e) the importer or exporter holds a valid travelingcertificate for each specimen issued by theManagement Authority in the prescribed form or bya competent authority in a country which is a partyto CITES.

(2) A travelling exhibition certificate shall


(b) be issued on payment of the prescribed fee unlessthe fee is waived by the Minister after consultationwith the Management Authority;

(c) be valid for a period not exceeding three years; and

(d) is renewable on condition that the holder continuesto comply with this Act.

37. (1) Where the Management Authority is satisfied that aspecimen was acquired before the provisions of this Act relating to thespecies listed in Appendices I, II and III of CITES, became applicable tothe specimen, the requirement for a permit or certificate shall not apply tothat specimen and the owner of that specimen shall, subject tosubsection (2), apply for and register with the Management Authorityand the Management Authority shall grant to that person, apre-Convention certificate to that effect.

(2) A pre-Convention certificate pursuant to subsection ( 1)shall


(b) be issued on payment of the prescribed fee unlessthe fee is waived by the Minister after consultationwith the Management Authority;

(c) be valid for a period not exceeding three years; and

(d) is renewable on condition that the holder continuesto comply with this Act.

38. The requirement for an export permit or certificate of originshall not apply to the export of captive bred animals or artificiallypropagated plants where the Management Authority has issued acertificate of artificial propagation or certificate of captive breeding andthe Management Authority is satisfied that the specimens are captivebred animals or artificially propagated plants to which thecertificate applies.

39. The requirement for a certificate of introduction from the seapursuant to this Act shall not apply to a specimen listed in Appendix III ofCITES.

PARTVllENFORCEMENT

40. A police officer may arrest without a warrant, a person whocorrrrnits an offence specified in section 13, 14, 15 or 16.

41. (1) A national enforcement officer may seize and detain aspecimen being traded internationally contrary to sections 13, 14, 15 or 16.

(2) Where a national enforcement officer seizes and detainsa specimen pursuant to subsection (1), the national enforcement officermay in addition seize equipment or other property which he or shereasonably suspects is being used in the commission of the offencepursuant to section 13, 14, 15 or 16.

42. (1) Where a national enforcement officer has reasonablegrounds for suspecting that there is, or there l11...ay be within the nextfollowing seventy two hours, upon any land or in any premises, specimenscontrary to the provisions of section 13, 14, 15 or 16 the nationalenforcement officer may lay before a Magistrate an information on oathsetting out those grounds and apply for the issue of a warrant to searchthe land or premises for the specimens.

(2) Where an application is made under subsection (1) for asearch warrant, the Magistrate may, subject to section 43, issue a warrantauthorising a national enforcement officer, whether named in the warrantor not, with such assistance and by such force as is necessary andreasonable to enter upon the land or upon or into the premises and tosearch and to

(a) seize a specimen or anything found on the land or inthe premises in the course of the search that thenational enforcement officer believes on reasonablegrounds, to be specimens listed in Appendix L If orIII ofCITES;

(b) mark temporarily orpermanently, rake samples oforphotograph any specimen or thing found on the landor in the premises in the course of the search that the

national enforcement officer believes on reasonablegrounds, to be specimens listed in Appendix I, II orIII of CITES;

(c) copy or reproduce records found on the land orpremises;

(d) seize equipment or other property found on the landor premises in the course of the search that thenational enforcement officer believes, on reasonablegrounds, to be equipment or other property beingused in relation to an offence pursuant to the offencenamed in the warrant or any other offence pursuantto section 13, 14, 15 or 16, where the nationalenforcement officer believes, on reasonable groundsthat it is necessary to seize that equipment or otherproperty in order to prevent its concealment, loss ordestruction or its use in committing, continuing orrepeating the offence or any other offence.

43. A warrant issued pursuant to section 42 shall include

(a) a statement of the purpose for which the warrant isissued, and a reference to the nature of the offence;

(b) a description of the kind of property to be seized;

(c) a time, not being later than twenty eight days, uponwhich the warrant ceases to have effect; and

(d) a statement as to whether entry is authorised to bemade at any time of the day or night or duringspecified hours of the day or night.

44. (1) A national enforcement officer who seizes and detains aspecimen, equipment or other property pursuant to section 41 or nationalenforcement officer who in executing a warrant issuedpursuant to section 42seizes or detains a specimen, equipment or other property shall

(a) take reasonable care to ensure that the specimen,equipment or other property is preserved so that itmay be dealt with in accordance with the law;

(b) forthwith transfer the property to the ManagementAuthority for preservation and for it to be dealt within accordance with the law;

(c) as soon as practicable after the seizure and detention,but within a period of forty eight hours thereafter,

prepare a written report. identifymg the specimen.equipment or other property seized and the locationwhere the specimen, equipment or other property'

seized is being detained by the ManagementAuthority and forward a copy of the report to theMagistrate's Court in the District where the propertyis being detained.

(2) A Magistrate shall, on application, provide a copy of thereport

(a) to the person from whom the specimen, equipmentor other property was seized; and

(b) to any other person who appears to the Magistrateto have an interest in the specimen, equipment orother property.

(3) A request pursuant to section (2) shall be in writing andshall be supported by affidavit sworn to by the person making the request.

45. (1). Where a specimen, equipment or other property has beenseized pursuant to section 41 or in execution of a warrant issued pursuantto section 42, a person who claims an interest in the property may applyto the Court for an order that the specimen, equipment or other propertybe returned to him or her.

(2) Where a person makes an application under subsection (1)and the Court is satisfied that

(a) the person is entitled to possession of the specimen,equipment or other property;

(b) the person in respect of whose conviction, chargingor proposed charging the seizure of the property wasmade has no interest in the specimen, equipment orother property; the Court shall order the ManagementAuthority to returnthe specimen, equipment or otherproperty to the person, and the ManagementAuthority shall arrange for the property to bereturned.

(3) Where at the end of the period of forty eight hours afterthe time when the specimen, equipment or other property was seized, acharge has not been laid in respect of an offence pursuant to section 13,14, 15 or 16, the Management Authority shall, as soon as practicable afterthe end of that period and in any event within seventy two hours of theseizure and detention return the specimen, equipment or other propertyto the person from whose possession it was seized.

46. Specimens, equipment or other property seized or

detained pursuant to section 41 or 42 which has not been returnedpursuant to section 46 is liable to forfeiture on conviction of the personcharged in relation to the seizure or detention.

47. The burden of proof of the legal possession ofany specimenof a listed species shall lie with the possessor of that specimen.

48. Where a forfeiture order or any other order is made by thecourt in respect of a specimen, equipment or other property while thespecimen, equipment or other property is in the possession of theManagement Authority, the Management Authority shall deal with thespecimen, equipment or other property as directed by the order.

PARTVIIIOFFENCESAND PENALTIES

49. (1) A person shall not

(a) for the purposes ofobtaining anypennit or certificateunder this Act, whether for himself or herself or forany other person, make any declaration or statementwhich is false or misleading;

(b) knowingly furnish to a national enforcement officeror person performing any duty in relation to this Act,a document that to the knowledge of the firstmentioned person contains information which is falseor misleading in any particular;

(c) knowingly utter, produce, or make use of any suchdeclaration or statement or any document containingany false declaration or statement; or

(d) falsifyor unlawfully amend any information containedin a permit or certificate.

(2) A person who contravenes subsection (1) commits anoffence and is liable on summary conviction to a fine not exceeding tenthousand dollars or to imprisonment for a term not exceeding ten years orboth.

50. (1) The Minister may appoint qualified persons as nationalenforcement officers, which may include police officers and customsofficers, as may be prescribed.

(2) A person shall not

(a) threaten, assault, obstruct or otherwise hinder theManagement Authority or an officer of theManagement Authority or other person authorisedby the Management Authority in the performance ofhis or her duties;

(b) bribe orattempt to bribe the Management Authorityor an officer of or other person authorised by theManagement Authority

(3) A person who contravenes subsection (J) commits anoffence and is liable on summary conviction to a fine not exceeding twentythousand dollars or to imprisonment for a term not exceeding three yearsor both.

5!. (I) A person shall not unless authorised by a ManagementAuthority alter, deface or erase an authorised mark referred to in section 55.

(2) A person who contravenes subsection (I) commits anoffence and is liable on summary conviction to a fine not exceedingten thousand dollars or to imprisonment for a term not exceedingtwo years or to both.

52. (1) Where an offence under this Act which is committed by abody corporate is proved to be conunitted with the consent or connivanceof, or to be attributable to any neglect on the part of, a director, manager,secretary or other similar officer of the body corporate, or any personwho was purporting to be acting in any of such capacity, that person aswell as the body corporate commit an offence and shall be liable to beproceeded against and punished accordingly.

(2) In this section, "director", in relation to a body corporateestablished by or under any enactment for the purpose of carrying onunder public ownership any industry or part of an industry or undertaking,being a body corporate whose affairs are managed by its members, meansa member of that body corporate.

53. (1) Registration or a permit, certificate or permission grantedpursuant to this Act shall not have the effect of dispensing with therequirement of approval where such approval is required pursuant to anyother law in force in Saint Christopher and Nevis.

(2) For the purposes of this section "approval" includesregistration, permit, certificate, permission and authorisation.

54. The Management Authority, may, where it deems appropriate,cause any specimen that is being internationally traded to be marked withan authorised mark that is capable of identifying a specimen and isdesigned in such a manner as to prevent the imitation thereof byunauthorized persons.

55. (1) No action, suit, prosecution or other proceedings shallbe brought or instituted personally against any member of the ManagementAuthority or the Scientific Authority in respect of any act done in good

faith pursuant to or in execution of or intended execution of thatAuthority's functions under this Act

(2) Where any member of an Authority referred to insubsection (1) is exempt from liability by reason only of the provisions ofsubsection (I), the Authority shall be liable to the extent that it would ifthat member was a servant or an agent of the Authority.

56. Any member of the public may, in writing. recommend to theManagement Authority, that any specimen of a species be proposed forinclusion on or exclusion from the Appendices ofCITES, giving reasonsfor such recommendation and the Management Authority shall refer thatproposal to the Scientific Authority for advice.

57. (I) Subject to subsection (2), the Minister may by Order,amend the Schedule.

(2) The Minister may amend Appendices I, II or 1Il of CITESby Order, whenever Appendix I, II or 1Il of CITES is amended as a result ofa decision of the Conference of Parties to CITES and Saint Christopherand Nevis has entered no reservations in relation thereto.

58. (1) The Minister may make Regulations for the purposes ofgiving effect to provisions of this Act and in particular, but withoutprejudice to the generality of the foregoing, such Regulations may

(a) contain provisions in relation to

(i) the carrying into effect of CITES and anyamendment thereto and international standardsand recommended practices for the protectionand conservation of wild fauna and flora affectedor likely to be affected by international trade;

(iij the certification and registration of businesseswhich conduct artificial propagation of plantslisted inAppendiees I, II or 1Il of CiTES;

(iii) the certification and registration of businesseswhich conduct breeding in captivity of anyanimaf listed in Appendices I, II or 1Il of CITES;

(b) prescribe

(i) the procedures for applications for the issue ofpermits or certificates;

(ii) the fees payable in respect of anything donepursuant to this Act

(iii) the manner of keeping registers, records and thecontents and the form of such registers and-records:

(iv) conditions and procedures for the treatment ofspecimens referred to in sections 35, 36, and 37,live animals referred to in section 34(2), captivebred animals and artificially propagated plantsreferred to in section 15;

(v) the form, conditions and procedure for theapplication or requirement for a permit for salefor the purposes of international trade;

(vi) the form, conditions and procedures for theapplication or requirement for a permit for thepurposes or as a result of international trade;

(vii) biological criteria and trade criteria for proposalsfor the inclusion of species in Appendices I, IIor III of CITES; and

(viii) any other matter required by this Act to beprescribed;

(c) specify procedures relating to the branding,packaging, marking either permanently or temporarilyand labelling of species listed in Appendices 1, II orIII ofCITES for the purposes of identification;

(2) Regulations made under subsection (1), may provide for theimposition of penalties on summary conviction of a fine not exceedingfive thousand dollars or imprisonment for a term not exceeding one yearor to both.

consultation with the Standing Committee, to have sufficient nationallegislation and domestic trade controls to ensure that the imported ivorywill not be re-exported and will be managed in accordance with allrequirements ofResolution Conf. 10,10 (Rev, CoP 14) concerning domesticmanufacturing and trade:

iii) not before the Secretariat has verified the prospective importing countriesand the registered government-owned stocks:

iv) raw ivory pursuant to the conditional sale of registered governmentowned IVOry stocks agreed at CaPI2, which are 20,000 kg (Botswana),10,000 kg (Namibia) and 30,000 kg (South Africa);

v) in addition to the quantities agreed at CoPI2, government-owned ivoryfrom Botswana, Namibia, South Africa and Zimbabwe registered by 31January 2007 and verified by the Secretariat may be traded and despatched,with the ivory in paragraph g) iv) above, in a single sale per destinationunder strict supervision of the Secretariat;

vi) the proceeds of the trade are used exclusively for elephant conservationand community conservation and development programmes within oradjacent to the elephant range; and

vii) the additional quantities specified in paragraph g) v) above shall be tradedonly after the Standing Committee has agreed that the above conditionshave been met; and

h) no further proposals to allow trade in elephant ivory from populations alreadyin Appendix II shall be submitted to the Conference of the Parties for the

period from CoP 14 and ending nine years from the date of the single sale ofivory that is to take place III accordance with provisions in paragraphs g) i], g)

ii), g) iii), g) vi) and g) vii). In addition such further proposals shall be dealtwith in accordance with Decisions 14.77 and 14.78.

On a proposal from the Secretariat, the Standing Committee can decide to causethis trade to cease partially or completely in the event of non-compliance byexporting or importing countries, or in the case of proven detrimental impacts ofthe trade on other elephant populations.

All other specimens shall be deemed to be specimens of species included inAppendix I and the trade in them shall be regulated accordingly.

2. Artificially propagated specimens ofthe following hybrids and/or cultivars are notsubject to the provisions of the Convention:- Hatiora x graeseri- Schlumbergera x buckleyi- Schlumbergera russelliana x Schlumbergera truncata- Schlumbergera orssichiana x Schlumbergera truncate- Schlumbergera opuntioides x Schlumbergera truncata- Schlumbergera truncata (cultivars)- Cactaceae spp. colour mutants lacking chlorophyll, grafted on the followinggrafting stocks: Harrisia 'Jusbertii', Hylocereus trigon us or Hylocereus undatus- Opuntia microdasys (cultivars).

1 Artificially propagated hybrids of the following genera are not subject to theprovisions of the Convention, if conditions, as indicated under a) and b), are metCymbidium, Dendrobium, Phalaenopsis and Vanda:a) Specimens are readily recognizable as artificially propagated and do not show

any signs of having been collected in the wild such as mechanical damage orstrong dehydration resulting from collection, irregular growth andheterogeneous size and shape within a taxon and shipment, algae or otherepiphyllous organisms adhering to leaves. or damage by insects or otherpests; and

b) i) when shipped in non-flowering state, the specimens must be traded in shipmentsconsisting ofindividual containers (such as cartons, boxes, crates or individualshelves of CC-containers) each containing 20 or more plants of the samehybrid; the plants within each container must exhibit a high degree ofunifonnityand healthiness; and the shipment must be accompanied by documentation,such as an invoice, which clearly states the number of plants of each hybrid;orii) when shipped in flowering state, with at least one fully open flower per

specimen, no minimum number of specimens per shipment is required butspecimens must be professionally processed for commercial retail sale,e.g. labelled with printed labels or packaged with printed packagesindicating the name of the hybrid and the country of final processing.This should be clearly visible and allow easy verification.

Plants not clearly qualifying for the exemption must be accompanied by appropriateCITES documents.

s Artificially propagated specimens of cultivars of Cyclamen persicum are not subject to theprovisions of the Convention. However, the exemption does not apply to such specimenstraded as dormant tubers.

2 Artificially propagated hybrids and cultivars of Taxus cuspidata, live, in pots or othersmall containers, each consignment being accompanied by a label or document stating thename of the taxon or taxa and the text 'artificially propagated', are not subject to theprovisions of the Convention.

#3 Whole and sliced roots and parts of roots.

#4 All parts and derivatives, except:a) seeds, except those from Mexican cacti originating in Mexico, and pollen;b) seedling or tissue cultures obtained in vitro, in solid or liquid media, transported in

sterile containers;c) cut flowers of artificially propagated plants;d) fruits and parts and derivatives thereofofnaturalized or artificially propagated plants;

ande) separate stem joints (pads) and parts and derivatives thereofofnaturalized or artificially

propagated plants of the genus Opuntia subgenus Opuntia.

#5 Logs, sawn wood and veneer sheets.

#6 Logs, sawn wood, veneer sheets and plywood.

#7 Logs, wood-chips, powder and extracts.

#8 Underground parts (i.e. roots, rhizomes): whole, parts and powdered.

#9 All parts and derivatives except those bearing a label"Produced from Hoodia spp. material obtained through controlled harvesting and productionin collaboration with the CITES Management Authorities of Botswana/Namibia/SouthAfrica under agreement no. BWINAIZA xxxxxx".

#10 Logs, sawn wood, veneer sheets, including unfinished wood articles used for the fabricationof bows for stringed musical instruments.
