Transplant TourismAn International and National Law Model to Prohibit Travelling Abroad for Illegal Organ TransplantsTerry O. Adido

Transplant Tourism: An International and National Law Model to Prohibit Travelling Abroad for Illegal Organ Transplants explores the role that interna-tional and national laws must play in the prohibi-tion and eradication of transplant tourism and proposes a three-stage legal model for the prohibi-tion of the practices. Through the examination of international law norms, principles and instru-ments; laws and policies from several legal systems;

and legal frameworks and models which currently prohibit a number of national, transnational and international offences, this publication focuses on the creation of a comprehensive soft law instru-ment on transplant tourism, a treaty on transplant tourism and unified national transplant tourism laws with extraterritorial application in accordance with the principles and spirit of the international law instruments.

Annotated Legal Documents on Islam in Europe: IrelandEdited by Kathryn O’Sullivan

Strengthening the Validity of International Criminal Tribunals provides multi-disciplinary perspectives concerning ways in which international criminal tribunals can be made more valid and effective in a time of uncertainty for the field of inter-national criminal justice.

Parties negotiating the end ofauthoritarian regimes or armedconflicts are almost inevitableleft in a situation of legal uncer-tainty. Despite their overlappingscope of application, the differ-ences between the approaches ofInternational Criminal Law (ICL)and Transitional Justice (TJ) areso profound that it will not bepossible to harmonize the cur-rent legal regime.

This volume of Annotated Legal Documents on Islam in Europe covers Ireland and consists of an annotated collection of legal documents affecting the status of Islam and Muslims in Europe. The legal texts are published in the original English language and the annotations and supporting material are in English.

Language Policy and Conflict PreventionEdited by Iryna Ulasiuk, Laurenţiu Hadîrcă and William Romans

Language policy can promote stability. For many individuals and groups, language is a key compo-nent of identity, and threats to it can raise tensions. Respect for linguistic rights, whilst also consider-ing a state’s need to maintain cohesion, reduces conflict potential. The OSCE High Commissioner on National Minorities promotes functional solu-tions to such contentious issues, and the Oslo Recommendations regarding the Linguistic Rights

of National Minorities address these challenges. This book analyses the components of a balanced legal and policy framework on language use, with a view to preventing conflict. In addition to review-ing the work of the OSCE HCNM in this area, it also draws upon the expertise of other international organisations and leading academics working in this field.

READERSHIP: All interested in minority rights, language policy, and ethnic conflict prevention. The book will be of immediate relevance to policy makers, (academic) libraries, specialists, (post-graduate) stu-dents, practitioners.

Fair and Equitable TreatmentIts Interaction with the Minimum Standard and Its Customary StatusPatrick Dumberry

Non-discrimination is a funda-mental principle of internationalhuman rights law. This volumediscusses the international legalframework on this principle andcomparatively elaborates thedefinition of discrimination aswell as the grounds of discrimi-nation in the various generaland specialised internationalhuman rights treaties.

The theme of this BRP is the right to procreate in the Israeli context. Our discussion of this right includes the implementa-tion of the right to procreate, restrictions on the right (due to societal, legal, or religious concerns), and the effect of the changing conception of the right to procreate (both substantively and in practice) on core family concepts.

This book examines the inter-action between the concept of the ‘minimum standard of treatment’ under custom and the fair and equitable treatment (FET) standard found in the vast majority of BITs. It also analy-ses whether the FET standard should be considered as a rule of customary international law.

The Human Right to Water in Latin AmericaChallenges to Implementation and Contribution to the ConceptAnna Berti Suman

In this work, Filippo Fontanelli analyses the notions of jurisdic-tion and admissibility in invest-ment arbitration. The first part takes stock of the arbitration practice. The second part inter-rogates these notions within the wider theory of international law and reveals the effects of their inherent fuzziness on the work of investment tribunals.

Damages in Investor-State Arbitration: Current Issues and Challenges addresses specificities of the assessment of damages in investor-state disputes reflecting the tensions between sovereignty and self-determination of states and their legal obligations to-wards foreign investors.

In The Human Right to Water in Latin America, Anna Berti Suman investigates the develop-ment of the right to water and of water law in the Latin American context, illustrating the Latin American contribution in stimu-lating the social, political, and economic debate on the right to water, regionally and worldwide.

The special issue contributes new perspectives on the struc-ture of transnational criminal justice. Investigating the law, politics and practices that struc-ture the dynamics of this form of justice, the contributions criti-cally examine how it functions and has impact.

In Historical Title, Self-Determination and the Kashmir Question, Lone offers a fresh framework, while recognising signs of spreading terrorism in the region, to understand the rights of the Kashmiri people and how they could be addressed by the international community.

This book provides a refined definition of co-perpetration responsibility that could be uniformly applied in both the ad hoc- and the treaty-based (ICC Rome Statue) model of interna-tional criminal justice.

International Encyclopedia of Comparative LawInstalment 43Edited by K. Zweigert and Ulrich Drobnig

This massive work represents the labour of hun-dreds of lawyers and scholars throughout the world. It is undoubtedly the most extensive and thorough examination of comparative law on the international level ever published. It incorporates not only detailed descriptions of the legal sys-tems of more than 150 countries but, above all, thoroughly documented comparative analyses of the main issues in civil and commercial law and related issues world-wide. Consisting of 17 volumes in total, each volume is divided into 6-20 chapters written by relevant specialists. Rather than delay-ing publication until the volume is complete, every chapter is published on completion in paperback form. Once a year several of these chapters, not

necessarily of the same volume, are sent to sub-scribers in single instalment. As soon as all the chapters in a given volume are ready, they are indexed, updated where necessary and sent to sub-scribers in high-quality hardback form.

For an up-to-date list of published instalments, their contents, and prices, please contact [email protected]. No Sales rights in German-speaking countries, Eastern Europe, Portugal, Spain, Italy, Greece, South and Central America. The series published two volumes over the last 5 years.

Civil-Military ‘Legal’ Relations: Where to from Here? The Civilian Courts and the Military in the United Kingdom, United States and AustraliaPauline Therese Collins

Civil-military relations establishes the civilian con-trol over the military to protect democratic values. This book argues analysis of the CMR is distorted by the absence of consideration of the judicial arm, with the ‘civil’ seen as referring only to the execu-tive and/or legislature. The civil courts approach to military discipline and the impact that has for CMR within — the United Kingdom, United States

and Australia is investigated. The author concludes that by including the courts in the development of CMR theory militarisation of the civilian domain is discouraged. A paradigm shift acknowledging the fundamental role of all three organs of government in liberal democracies, for control of States’ power is essential for genuine civilian oversight.

READERSHIP: All interested in civil-military theory and the relationship between the three organs of gov-ernment as they operate to control their military arm.

The Inter-State Application under the European Convention on Human RightsBetween Collective Enforcement of Human Rights and International Dispute SettlementIsabella Risini

The Inter-State Application under the European Convention on Human Rights provides the first comprehensive monograph about the State-to-State human rights enforcement mechanism. The functions of the mechanism include also dispute settlement aspects, which are related to the com-pulsory jurisdiction of the Strasbourg Court. The study provides a full account of the development of the Inter-State Application under Article 33

ECHR and puts its case law in the relevant histori-cal and institutional context. The analysis con-cludes with detailed reform considerations which are situated within the discussion about the role of the European Court of Human Rights. The focus lies on the possibility to address and improve sys-temic human rights deficits beyond the single case. The Court’s growing inter-State docket evidences the need for legal certainty.

READERSHIP: All interested in international human rights law and the European Convention on Human Rights (students, scholars and practitioners), the institutional development of the Strasbourg machinery, human rights enforcement and the protection of human rights in times of crises.

Taming Ares: War, Interstate Law, and Humanitarian Discourse in Classical GreeceEmiliano J. Buis

This book intends to discuss the ethical questions of counter-ter-rorism for the military, with an emphasis on its counter-terrorist role in our home countries.

This Yearbook aims to contribute to a greater awareness of the functions and activities of the organs of the Inter-American sys-tem for the protection of human rights. Two volume set.

In Taming Ares Emiliano J. Buis studies the narrative founda-tions of the (il)legality of warfare in the classical Greek world in order to demonstrate its contri-bution to a better historical un-derstanding of the international legal rules applicable to the use of force and the conduct of hos-tilities.

Proving Discriminatory Violence at the European Court of Human RightsJasmina Mačkić

In Proving Discriminatory Violence at the European Court of Human Rights Jasmina Mačkić unveils the evidentiary issues faced by the European Court of Human Rights when dealing with cases of dis-criminatory violence. In that context, she evaluates the Court’s application of the standard of proof ‘beyond reasonable doubt’ and aims to answer the question whether that standard forms an obstacle

in establishing the occurrence of discriminatory violence. In addition, she offers an assessment into the circumstances in which the burden of proof may shift from the applicant to the respondent state. The author also looks at the types of eviden-tiary materials that may be used by the Court in order to establish discriminatory violence.

READERSHIP: All interested in human rights law and the European Court of Human Rights, and anyone concerned with issues related to hate crime and the law of evidence.

Contemporary and Emerging Issues on the Law of Damages and Valuation in International Investment ArbitrationEdited by Christina L. Beharry

Complex Equality and the Court of Justice of the European UnionReconciling Diversity and HarmonizationRichard Lang

In General Principles of Law in Investment Arbitration, the au-thors address selected general principles of law, assessing their functions in investment arbitra-tion. The resulting picture is that of a lively source that escapes doctrinal straitjackets and main-tains its relevance.

Contemporary and Emerging Issues on the Law of Damages and Valuation in International Investment Arbitration, edited by Christina L. Beharry, examines a broad range of damages topics, building on basic principles and surveying current developments to identify trends in the jurispru-dence.

In Complex equality and the Court of Justice of the European Union: Reconciling Diversity and Harmonization, Richard Lang proposes that the EU’s judges adopt Walzerian Complex Equality as a complement to their existing, and unsatisfac-tory, test for equality based on Aristotle.

The Court of Justice of the European UnionSubsidiarity and ProportionalityKate Shaw

In the Court of Justice of the European Union, Subsidiarity and Proportionality Kate Shaw sets out how a subsidiarity and proportionality review applied to competences could be anchored by the Court of Justice when balancing the competing interests in cases concerning the residency rights of EU citizens. The book also considers the extent to which a court which is dedicated to enhancing

the European project is really able to be an inde-pendent arbiter between the EU and the Member States in this context. Both the legal reasoning of the Court and the controversial nature of residency rights of EU citizens are legally and politically very topical at the moment and of interest to legal aca-demics and law students.

READERSHIP: As the content for this book is primarily doctrinal, legal and critically analytical of EU law and the Court of Justice, the intended audience for the book is for academics, academic libraries, under-graduate and postgraduate EU law students as supplementary reading. The book may also be of relevance to policy makers involved in shared policy areas.

Revisiting Personal Laws in BangladeshProposals for ReformEdited by Faustina Pereira, Shahnaz Huda and Sara Hossain

The People’s Republic of Bangladesh is centrally located in South Asia and is one of the eight coun-tries that constitute the South Asian Association of Regional Cooperation (SAARC). In 2010, the South Asian Institute of Legal and Human Rights Studies in Dhaka (SAILS) initiated the ‘Combating Gender Injustice’ research study to investigate how the Christian, Hindu and Muslim communities in the country are affected by the laws and customs gov-erning their personal lives. The aim was to engage in a dialogue with the stakeholders the results of which would provide a basis to formulate recom-mendations for law, policy and procedural reform. These reports have been reproduced in this volume in updated and revised form. Moroever, in order to offer a more complete overview of the ethnic

and religious minorities concerned, a chapter has been added on the personal laws of the Buddhist community, the third largest religious community in Bangladesh. Finally, the volume offers much needed information on the laws and customs of the Indigenous Peoples of the Chittagong Hill Tracts, communities following traditional rules and customs in the remote and hilly region of the coun-try. The gender-sensitive personal laws prevalent in South Asian societies will continue to be debated for generations to come. This unique volume gives a voice to the different religious communities af-fected by the current laws and practices in force in Bangladesh. The reader will find an overview and gain understanding of the legal issues that need to be addressed in each case.

The Foundations of Modern International Law on Indigenous and Tribal PeoplesVolume 1: Basic Policy and Land RightsLee Swepston

The adoption in 2007 of the UN Declaration on the Rights Of Indigenous Peoples (UNDRIP), and the ongoing discussions in the international human rights community about the relative merits, impact and legal validity of the UN and ILO instruments, make it all the more important to understand how Convention 169 was adopted.

The author of this unique study was responsible for many years for the supervision of both Conventions in the ILO’s super-visory machinery, and was inti-mately involved in the adoption of the 1989 instrument, as well as in international discussions on the subject of indigenous and tribal peoples.

A critical and timely review of contemporary developments in minority-majority relations in Europe. It combines analysis, commentary and documenta-tion in relation to conflict man-agement, international legal developments and domestic legislation affecting minorities in Europe.

Volume 1: Basic Policy and Land RightsISBN 9789004289055Volume 2: Human Rights and the Technical ArticlesISBN 9789004289079

The International Labour Organization is respon-sible for the only two international Conventions ever adopted for the protection of the rights and cultures of indigenous and tribal peoples. The Indigenous and Tribal Populations Convention, 1957 (No. 107) and the Indigenous and Tribal Peoples Convention, 1989 (No. 169) that revised and replaced Convention No. 107, are the only international Conventions ever adopted on the subject, and Convention No. 169 is the only one that can now be ratified. This volume, and its com-

panion to be published at a later date, make clear that the basic concepts and the very vocabulary of international human rights on indigenous and tribal peoples derives from these two Conventions.
